CIRCULAR
Regulations on recruitment, utilization, and training
for vocational education teachers
Pursuant to the Law on Vocational Education dated November 27, 2014;
Pursuant to the Law on Public Officials dated January 15, 2010;
Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
Pursuant to Decree No. 48/2015/NĐ-CP dated May 15, 2015, of the Government detailing certain provisions of the Vocational Education Law;
Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, utilization, and management of civil servants;
At the proposal of the Director General of the General Department of Vocational Education;
The Minister of Labor, Invalids and Social Affairs issues this Circular regulating recruitment, utilization, and training for vocational education teachers.
PART I
GENERAL PROVISIONS
1. This Circular regulates recruitment, utilization, standardization training, and advanced training for vocational education teachers teaching at colleges, secondary vocational schools, and vocational education centers (hereinafter referred to collectively as vocational education institutions). Private vocational education institutions and those with foreign investment are not subject to the recruitment and utilization provisions of this Circular.
2. This Circular applies to vocational education teachers teaching at vocational education institutions; relevant agencies, organizations, and individuals.
3. This Circular does not apply to teacher training colleges and teachers teaching teacher training programs under the management of the Ministry of Education and Training.
Article 2. Duties and powers of teachers sent for training
1. Vocational education teachers undergoing standardization training and advanced training (hereinafter referred to collectively as training) must complete the full curriculum and study plan during the training period; comply with state laws, internal regulations, and rules of the training institution; maintain and protect the property of the training institution.
3. Vocational education teachers working at private vocational education institutions and those with foreign investment participating in training classes shall enjoy rights and benefits as prescribed by law.
4. Teachers participating in training courses must commit to working time at their managing unit after completing the training course as prescribed by law.
5. Teachers sent for training or internships at enterprises or specialized agencies must have the responsibility to store and report the outline and results of the training and internship.
1. For public service units fully self-financing both capital and recurrent expenditures, and those self-financing only recurrent expenditures: funding for training activities shall be sourced from the unit's revenue from public service fees and other sources (if any).
2. For public service units partially financing recurrent expenditures: funding for training activities shall be sourced from the state budget according to the pricing schedule for public services, the unit's revenue from training, and other sources (if any).
3. For units fully financed by the State: funding for training activities shall be covered by the state budget and other sources (if any).
4. For private vocational education institutions and those with foreign investment: funding for training activities shall be sourced from the institution's revenue and included in the training costs.
Chapter II
TEACHER RECRUITMENT AND USE
Recruitment of vocational education teachers in public vocational education institutions shall be carried out in accordance with Chapter II of Decree No. 29/2012/ND-CP dated April 12, 2012, of the Government on recruitment, utilization, and management of public officials; Circular No. 15/2012/TT-BNV dated December 25, 2012, of the Ministry of Home Affairs guiding recruitment, signing employment contracts, and compensating training and development expenses for public officials; and Circular No. 16/2012/TT-BNV dated December 28, 2012, of the Ministry of Home Affairs promulgating the Examination and Selection Regulations for public officials; and the Promotion Regulations for occupational titles of public officials. Recruitment and utilization of public officials must ensure the number, structure, and standards of public official positions based on job requirements.
1. Persons recruited to the position of vocational education teacher for college, secondary, and basic levels must undergo the probationary period as stipulated in Article 20 of Decree No. 29/2012/NĐ-CP dated April 12, 2012, of the Government on recruitment, utilization, and management of public officials. The probationary period for college and secondary level teachers is twelve months; for basic level teachers, it is six months.
Vocational education institutions must employ teachers meeting the standards as prescribed, suitable for the training profession or consistent with the agreement in the employment contract or labor contract.
Chapter III
TRAINING FOR VOCATIONAL EDUCATION TEACHERS
Article 6. Types of Training
1. Standardization training is a type of training for teachers to meet the standards of professional knowledge and skills; occupational title qualifications, and other contents as prescribed by law.
2. Advanced training is a type of training for teachers to enhance their professional knowledge, vocational skills, pedagogical expertise, foreign languages, information technology, scientific progress, and technological advancements, as well as other contents necessary to meet the demands of their profession.
3. Internship at enterprises or specialized agencies for teachers is a form of training to update knowledge, technology, production organization and management methods, and practical skills in production, business, and service.
Article 7. Requirements for Training Program Content
The content of the training program must ensure the following requirements:
1. To demonstrate the training objectives; specify the knowledge and skills that learners will acquire upon completion of the course; define the scope and structure of the content, training methods, and formats; and establish evaluation criteria for assessing learning outcomes after completing the course.
2. Ensuring scientificity, modernity, systematicness, practicality, and flexibility to adapt to changes in the labor market; ensuring the interconnection between different training programs;
3. Regularly reviewed and updated to be consistent with production, business, and service technologies.
Article 8. Organization for Building, Reviewing, and Issuing Training Programs
1. Establish a Steering Committee to develop a comprehensive outline, design a general program, and compile a detailed program. The duties, powers, structure, composition, and qualifications of Steering Committee members are specified in detail for each training program.
2. Establish an Evaluation Board to approve the training programs. The duties, powers, structure, composition, and qualifications of Evaluation Board members are specified in detail for each training program.
3. The approval results of the Review Board serve as the basis for issuing the training program.
Article 9. Forms and Methods of Organizing Training
1. Forms of organization: Concentrated, semi-concentrated, work-study, and distance learning.
2. Methods of organization: Seminars; workshops; specialized training; research and field surveys; study tours; advanced internships; and self-study to improve proficiency.
Article 10. Utilization of Training Results
Training results shall be used to evaluate teachers' performance in annual tasks or as conditions for promotion examinations, certification of qualification attainment, and related policies.
Chapter IV
IMPLEMENTATION
Article 11. Responsibilities of the Ministry of Labor, Invalids and Social Affairs
1. Issuing vocational teacher training programs; certificate templates, and regulations on managing and issuing vocational education certificates for teaching at various levels of vocational training.
2. Issue standardized training programs for occupational titles; model certificates, and regulations on managing and issuing certificates for teachers in vocational education according to the provisions.
Article 12. Responsibilities of the General Department of Vocational Education and Training
1. Guiding vocational education institutions, ministries, sectors, and localities to develop training plans for vocational education teachers in each phase and annually, and coordinating to implement them.
2. Establishing Steering Committees and Evaluation Boards to organize the development, evaluation, and acceptance of training programs and materials for teachers.
5. Directing, inspecting, and supervising the implementation of the provisions stipulated in this Circular.
Article 13. Responsibilities of Ministries, agencies equivalent to ministries; People's Committees of provinces and centrally-run cities
2. Developing plans and budget estimates for teacher training in each phase and annually and submitting them to the competent authority for approval.
Article 14. Responsibilities of the Department of Labor, Invalids and Social Affairs
2. Develop plans and budget estimates for teacher training in vocational education institutions under their authority for each phase and annually, and submit them for approval by the People's Committee of the province or centrally governed city.
2. Guide teachers assigned for training to develop plans, outlines, and reports on the results of implementation. Ensure that teachers undergo periodic training at least once every five years; intern at enterprises or specialized agencies: four weeks per year for teachers teaching higher and intermediate levels, and two weeks per year for teachers teaching basic level.
3. Organize or cooperate with other educational institutions, enterprises, or specialized agencies meeting the required conditions to provide training for teachers.
4. Assign and create favorable conditions for teachers to participate in training courses organized by authorized agencies and units; have mechanisms to encourage self-training activities for teachers.
5. Report on the results of teacher recruitment, utilization, and training work according to each phase and annually as prescribed.
Article 16. Responsibilities of training organizations
1. Training organizations providing training for teachers must ensure the conditions required for each type and content of training and be permitted by the competent authority to organize and implement.
2. Institutions organizing teacher training must develop training plans; manage the learning process, evaluate, and recognize learning outcomes; report training results and issue certificates to trainees according to the regulations of the Ministry of Labor, Invalids and Social Affairs (General Department of Vocational Education).
Chapter V
IMPLEMENTING PROVISIONS
Article 17. Effective Date
1. This Circular takes effect from May 1, 2017.
2. Decision No. 57/2008/QD-BLDTBXH dated May 26, 2008, issued by the Minister of Labor, Invalids and Social Affairs regarding the use and training of vocational teachers; Circular No. 41/2015/TT-BLDTBXH dated October 20, 2015, issued by the Minister of Labor, Invalids and Social Affairs concerning the use and standardization training, and advanced training for basic level teachers, shall cease to be effective from the date this Circular takes effect.
3. Any difficulties encountered during implementation should be reported to the Ministry of Labor, Invalids and Social Affairs for guidance./.
