Issuing the List of medicines, raw materials for medicines for human use, and cosmetics for export and import that have been assigned commodity codes according to the List of goods for export and import in Vietnam

 

 
 

 

 

 

Pursuant to Decree No. 08/2015/NĐ-CP dated January 21, 2015 of the Government detailing and providing implementation measures for the Law on Customs regarding customs procedures, inspection, supervision, and control;

Pursuant to Decree No. 75/2017/NĐ-CP dated June 20, 2017 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Drug Administration Department;

The Minister of Health issues this Circular to issue the List of medicines, raw materials for medicines for human use, and cosmetics for export and import that have been assigned commodity codes according to the List of goods for export and import in Vietnam.

Article 1. Scope of Regulation

1. This Circular issues the List of medicines including: chemical drugs, herbal drugs, vaccines, biological products; raw materials for medicines such as drug substances and cosmetics for export and import that have been assigned commodity codes according to the List of goods for export and import in Vietnam issued together with Circular No. 65/2017/TT-BTC dated July 26, 2017 of the Minister of Finance on issuing the List of goods for export and import in Vietnam.

2. This Circular does not apply to traditional medicines, raw materials for medicines such as herbal drugs, excipients, and gelatin capsules.

Article 2. Issuing the List

This Circular issues the List of medicines, raw materials for medicines for human use, and cosmetics for export and import that have been assigned commodity codes according to the List of goods for export and import in Vietnam (hereinafter referred to as the List), including:

1. List 1: List of toxic drugs and raw materials for drugs for export and import with commodity codes already determined;

2. List 2: List of raw materials for drugs for export and import that are narcotic drug substances with commodity codes already determined;

3. List 3: List of raw materials for drugs for export and import that are psychotropic drug substances with commodity codes already determined;

4. List 4: List of raw materials for medicines for export and import that are precursors used in medicines and have been assigned commodity codes;

5. List 5: List of drugs and drug substances for export and import belonging to the Prohibited Substances List for Certain Industries and Fields with commodity codes already determined;

6. List 6: List of radioactive materials for medical use for export and import with commodity codes already determined;

7. List 7: List of raw materials for drugs for export and import that are drug substances and intermediates with commodity codes already determined;

8. List 8: List of single-component drug substances for export and import with commodity codes already determined;

9. List 9: List of combination drugs for export and import with commodity codes already determined;

10. List 10: List of cosmetics for export and import that have been assigned commodity codes.

Article 3. Using the List

1. Principles for applying the list:

a) In cases where only four-digit codes are listed, all eight-digit codes within the four-digit group shall be applicable.

b) In cases where only six-digit codes are listed, all eight-digit codes within the six-digit sub-group shall be applicable.

c) In cases where eight-digit codes are listed in detail, only those eight-digit codes shall be applicable.

2. The List of medicines, raw materials for medicines for human use, and cosmetics for export and import that have been assigned commodity codes according to the List of goods for export and import serves as the basis for customs declaration when exporting and importing in Vietnam.

3. Individuals and organizations when exporting and importing medicines, raw materials for medicines for human use, and cosmetics in Vietnam shall base their customs declarations on the List issued together with this Circular.

In case disputes arise related to commodity codes in the List issued together with this Circular, the Drug Administration of Vietnam, the Traditional Medicine Administration, and the Department of Medical Equipment and Health Facilities (Ministry of Health) shall coordinate with the General Department of Customs (Ministry of Finance) to examine and unify the commodity codes according to the principles stipulated in Clause 4, Article 19 of Decree No. 08/2015/NĐ-CP dated January 21, 2015 of the Government detailing and providing implementation measures for the Law on Customs regarding customs procedures, inspection, supervision, and control to facilitate the clearance of goods, while proposing amendments and supplements to the List.

4. When exporting and importing medicines, raw materials for medicines for human use, and cosmetics not included in this List, customs declarations shall be made in accordance with other current laws.

Article 4. Effectiveness

1. This Circular takes effect from the date of     month    year

2. Lists 1, 2, 3, 4, and 8 issued together with Circular No. 45/2016/TT-BYT dated December 20, 2016 of the Minister of Health on issuing the List of medicines for human use and cosmetics for export and import in Vietnam that have been assigned commodity codes according to the List of goods for export and import and the Preferential Import Tariff Schedule shall cease to be effective from the date this Circular takes effect.

Article 5. Reference Provisions

In case the referenced documents in this Circular are amended, supplemented, or revoked, they shall be applied according to those documents.

Article 6. Responsibility for Implementation

The Drug Administration, the Traditional Medicine Administration, the Department of Medical Equipment and Health Facilities, units under and affiliated with the Ministry of Health, Provincial Departments of Health under centrally governed cities, relevant agencies, organizations, and individuals are responsible for implementing this Circular.

During the implementation process, if there are difficulties or obstacles, the units are requested to report to the Ministry of Health (Drug Administration) for examination and resolution./.
