Circular No. 45/2016/TT-BYT promulgates the Circular detailing the List of medicines for human use and cosmetics imported into Vietnam that have been assigned commodity codes according to the Export and Import Goods Tariff and the Preferential Import Tariff.

Issuing the List of Drugs for Human Use and Cosmetics Imported into Vietnam that have been Assigned Commodity Codes under the Export and Import Goods Tariff and the Preferential Import Tariff

Pursuant to Decree No. 63/2012/NĐ-CP dated August 31, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to Decree No. 08/2015/NĐ-CP dated January 21, 2015 of the Government detailing and providing implementation measures for the Law on Customs regarding customs procedures, inspection, supervision, and control;

At the proposal of the Director of the Drug Administration Department;

The Minister of Health issues this Circular to provide for the List of Drugs for Human Use and Cosmetics Imported into Vietnam that have been Assigned Commodity Codes under the Export and Import Goods Tariff and the Preferential Import Tariff.

Article 1. Issuance of the list

Attached herewith is the List of Drugs for Human Use and Cosmetics Imported into Vietnam that have been Assigned Commodity Codes under the Export and Import Goods Tariff and the Preferential Import Tariff, including:

1. List 1: commodity codes of raw materials for drugs, which are active pharmaceutical ingredients for human use imported into Vietnam;

2. List 2: commodity codes of semi-finished drug products imported into Vietnam;

3. List 3: commodity codes of finished drug products containing only one active pharmaceutical ingredient imported into Vietnam;

4. List 4: commodity codes of finished drug products in combination form imported into Vietnam;

5. List 5: commodity codes of medicinal herbs imported into Vietnam;

6. List 6: commodity codes of plastics, gums, plastic substances from medicinal herbs, and extracts from medicinal herbs imported into Vietnam;

7. List 7: commodity codes of essential oils for drugs imported into Vietnam;

8. List 8: commodity codes of cosmetics imported into Vietnam.

Article 2. Provisions on the use of the list.

1. The List of Drugs for Human Use and Cosmetics Imported into Vietnam that have been Assigned Commodity Codes under the Export and Import Goods Tariff and the Preferential Import Tariff serves as the basis for customs declaration when importing into Vietnam.

2. Individuals and organizations when importing drugs for human use and cosmetics into Vietnam shall base their customs declaration on the list attached to this Circular.

In case disputes arise regarding commodity codes in the list attached to this Circular, the Department of Medicine Management (Ministry of Health) or the Department of Traditional Medicine Management (Ministry of Health) will take the lead in coordinating with the General Customs Department (Ministry of Finance) to review and unify the determination of the commodity codes.

3. When importing drugs for human use and cosmetics not included in this list, customs declaration shall be carried out in accordance with other current laws and regulations.

Article 3. Implementation Provisions

1. This Circular takes effect from February 6, 2017.

Decision No. 41/2007/QĐ-BYT dated November 20, 2007 of the Minister of Health on the issuance of the List of Drugs for Human Use and Cosmetics Imported into Vietnam that have been Assigned Commodity Codes under the Export and Import Goods Tariff and the Preferential Import Tariff shall cease to be effective from the date this Circular takes effect.

2. The Department of Medicine Management (Ministry of Health), the Department of Traditional Medicine Management (Ministry of Health), units under and affiliated to the Ministry, provincial and municipal health departments directly under the central government, sectoral healthcare units, and domestic organizations and individuals, as well as foreign individuals and organizations engaged in the importation of drugs and cosmetics into Vietnam, are responsible for implementing this Circular.

During implementation, if there are difficulties or obstacles, they are requested to report to the Department of Medicine Management (Ministry of Health) and the Department of Traditional Medicine Management (Ministry of Health) for consideration and resolution./.
