DECREE
REGULATIONS ON QUALITY CONTROL FOR CIVIL SERVANTS' ENTRY REQUIREMENTS
Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Pursuant to the Civil Servants and Public Officials Law dated November 13, 2008; the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Law on Public Service Personnel dated November 25, 2019;

The Government promulgates this Decree on quality control for civil servants' entry requirements.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Decree stipulates principles, conditions, authority, content, form, and implementation of quality control for entry requirements for individuals participating in recruitment to become civil servants in agencies of the Communist Party of Vietnam, the Vietnam Fatherland Front, political-social organizations, central-level state agencies, provincial-level state agencies, and district-level state agencies.
2. Quality control for civil servants' entry requirements as prescribed in this Decree shall apply to individuals registering for recruitment to become civil servants through competitive examinations.
Article 2. Principles for Implementing Quality Control for Civil Servants' Entry Requirements
1. Quality control for civil servants' entry requirements is an activity to assess and recognize foundational knowledge necessary for candidates before participating in civil servant recruitment at authorized agencies.
2. Principles for implementing quality control for civil servants' entry requirements are as follows:
a) Ensuring transparency, fairness, objectivity, and compliance with the law.
b) Ensuring practicality, effectiveness, and economy.
c) Results of quality control shall be uniformly applied nationwide.
d) There shall be no limit on the number of times each candidate may register for quality control.
e) Enhancing the application of information technology and digital transformation in organizing quality control for civil servants' entry requirements.
Chapter II
IMPLEMENTATION OF QUALITY CONTROL FOR CIVIL SERVANTS' ENTRY REQUIREMENTS
Article 3. Conditions for Registering for Quality Control for Civil Servants' Entry Requirements
1. Conditions for registering for quality control for civil servants' entry requirements shall be implemented in accordance with Clause 1, Article 36 of the Civil Servant Law.
2. Cases specified in Clause 2, Article 36 of the Civil Servant Law shall not be allowed to register for quality control for civil servants' entry requirements.
Article 4. Organization of Quality Control for Civil Servants' Entry Requirements
1. The Ministry of Home Affairs is the competent authority for quality control for civil servants' entry requirements.
2. Quality control for civil servants' entry requirements shall be organized regularly twice a year in July and November.
3. Before January 31 each year, the Ministry of Home Affairs shall announce plans for organizing quality control for civil servants' entry requirements on its official website and the quality control for civil servants' entry requirements information page.
4. In cases where recruitment agencies require quality control for civil servants' entry requirements, they shall develop plans, notify according to Article 7 of this Decree, and accept registration forms for quality control at their own agency, organization, or unit's official website; compile a list of candidates and submit it to the Ministry of Home Affairs for organization of quality control. The Ministry of Home Affairs shall organize quality control no later than thirty days from the date of receipt of the list.
Article 5. Form, Content, and Duration of Quality Control
1. Form of quality control: Computer-based multiple-choice test.
2. Content of quality control: Assessment of cognitive ability, application of knowledge to practice; general and basic understanding of the candidate regarding the political system, organizational structure of the Party, Vietnam Fatherland Front, political-social organizations, state agencies; administrative management; rights, duties of civil servants, public service ethics; knowledge about society, culture, history.
3. Duration and number of questions for quality control:
a) Quality control for entry requirements for individuals participating in competitive examinations for positions requiring a bachelor's degree or higher: 120 minutes, 100 questions.
b) Quality control for entry requirements for individuals participating in competitive examinations for positions requiring a college or vocational school degree: 100 minutes, 80 questions.
Article 6. Determining Successful Completion of the Certification Period
The certification result shall be determined based on the number of correct answers in the examination. A candidate who correctly answers 50% or more of the questions shall be deemed to have met the requirements for the quality entry certification for civil servants.
Article 7. Announcing the Organization of Certification and Acceptance of Registration Forms for Certification Participation
1. Based on the annual certification plan, the Ministry of Home Affairs publicly announces information about the certification periods on its official website and the quality entry certification for civil servants' information page at least 30 days before the organization of the certification.
2. The announcement includes:
a) Conditions for registering to participate in certification.
b) Time limit, address, and location for accepting registration forms for certification participation, the phone number of the department responsible for receiving registration forms for certification participation, costs for participating in certification, and the bank account for paying the certification participation fee.
c) Form, content, time, and location for organizing the certification.
3. In case of changes to the time and location for organizing the certification, the Ministry of Home Affairs will publicly announce such changes on its official website and the quality entry certification for civil servants' information page at least 30 days before the organization of the certification.
4. Individuals registering to participate in certification fill out the registration form for certification participation according to the model issued together with this Decree and submit it through the quality entry certification for civil servants' information page.
5. The deadline for accepting registration forms for certification participation is 30 days from the date of public announcement of the certification plan.
Article 8. Certification Board
1. The Minister of Home Affairs decides to establish the Certification Board to organize the quality entry certification for civil servants (hereinafter referred to as the Certification Board). The Certification Board consists of 7 or 9 members, including:
a) The Chairman of the Board is a leader of the Ministry of Home Affairs.
b) The Vice-Chairman of the Board is a representative of the advisory department regarding certification work of the Ministry of Home Affairs.
c) A member兼任秘书处代表的委员,由部内关于认证工作的顾问部门代表。
d) Other members are decided by the Minister of Home Affairs.
2. The Certification Board operates under the principle of collective decision-making, deciding by majority vote; in case of equal votes, the decision is made according to the opinion of the Chairman of the Board. The Certification Board for quality entry certification for civil servants has the following duties and powers:
a) Establishing working units: Examination Registration Review Committee, Examination Supervision Committee, Secretariat.
b) Organizing the collection and expenditure of certification organization fees in accordance with regulations.
c) Reviewing examination registration forms, organizing certification in accordance with internal rules and regulations.
d) Reporting to the head of the authority with the power to decide on the recognition of certification results.
e) Resolving complaints and reports during the certification organization process.
f) The Certification Board dissolves itself after completing its tasks.
3. Individuals who have relationships as grandparents, grandmothers, parents, siblings, or children by blood or adoption of those applying for certification, spouses or children by blood or adoption of those applying for certification, individuals currently undergoing disciplinary action or executing disciplinary decisions shall not be arranged as members of the Certification Board or members of the working units assisting the Certification Board.
Article 9. Procedures for organizing certification
1. The Certification Board shall announce the list and convene candidates who meet the conditions and criteria to participate in the civil servant entry quality certification on the Ministry of Home Affairs' electronic portal and the website on civil servant entry quality certification. At the latest 15 days from the date of announcing the convocation of candidates, the Certification Board shall organize the certification.
2. The organization of certification shall be conducted on computers. The results of the certification shall be immediately communicated to the candidates upon completion of the examination time and no re-examination shall be carried out for the certification results.
3. Within five working days from the end of the certification period, the Certification Board shall report to the head of the competent authority to approve the certification results; the certification results shall be publicly announced on the Ministry of Home Affairs' electronic portal and the website on civil servant entry quality certification.
Article 10. Utilization of certification results
1. The civil servant entry quality certification results shall have validity for use within twenty-four months from the date of the decision approving the certification results issued by the Ministry of Home Affairs. During the validity period of the certification results, those who achieve the certification results may register to take the civil servant recruitment examination at the agencies and organizations specified in Clause 1 of Article 1 of this Decree throughout the country.
2. The heads of agencies and organizations with the authority to recruit civil servants shall base the certification results of civil servants to stipulate the conditions for registering to apply for civil servant positions and organize the second round of examinations for those who achieve the certification results in accordance with Clause 2 of Article 8 and Point a, Point c of Clause 3 of Article 14 of Government Decree No. 138/2020/NĐ-CP dated November 27, 2020 on recruitment, utilization, and management of civil servants (hereinafter referred to as Decree No. 138/2020/NĐ-CP).
3. The certification results of the entry quality for individuals participating in the recruitment examination for positions requiring a bachelor's degree or higher can be used to replace the certification results of the entry quality for individuals participating in the recruitment examination for positions requiring a lower level when registering to apply for civil servant positions in accordance with the recruitment requirements.
4. Annulment of certification results.
a) Providing false information in the Application Form for Registration for Certification.
b) In cases where the agency, organization, or unit with the authority to recruit civil servants discovers that the recruited individual uses diplomas, certificates, or certifications not in accordance with regulations, they shall propose a written request to the Ministry of Home Affairs to annul the certification results.
c) The list of cases where certification results are annulled shall be publicly announced on the Ministry of Home Affairs' electronic portal and the website on civil servant entry quality certification. Individuals whose certification results are annulled shall not be allowed to register for certification in the next certification period.
Chapter III
IMPLEMENTING PROVISIONS
Article 11. Implementation Organization
1. The Ministry of Home Affairs shall be responsible before the Government for performing state management functions regarding civil servant entry quality certification and shall have the following tasks and powers:
a) Issuing internal regulations and rules for organizing civil servant entry quality certification.
b) Taking the lead and coordinating with Party agencies, the Vietnam Fatherland Front, political and social organizations, central-level state agencies, provincial People's Committees to build and review the question bank and answer key for civil servant entry quality certification; developing software for organizing certification, software for building and managing the question bank, and the website on civil servant entry quality certification.
c) Organizing the implementation of civil servant entry quality certification according to the assigned authority.
d) Inspecting and supervising the use of civil servant entry quality certification results.
đ) Implementing reports and statistics on civil servant entry quality certification.
e) Resolving complaints and denunciations related to civil servant entry quality certification work in accordance with the laws on complaints and denunciations.
2. Agencies with the authority to recruit civil servants shall comply with the provisions regarding the utilization of civil servant entry quality certification results for applicants.
Article 12. Transitional Provisions
1. The organization of the first round of examinations in civil servant recruitment shall continue to be implemented in accordance with the provisions of Government Decree No. 138/2020/NĐ-CP until July 31, 2024. During this period, individuals who achieve the certification results under this Decree when participating in civil servant recruitment examinations do not need to undergo the first round of examinations as stipulated in Clause 1 of Article 8 and Point a, Point b of Clause 3 of Article 14 of Government Decree No. 138/2020/NĐ-CP.
2. As of August 1, 2024, recruitment agencies shall only recruit civil servants for individuals who achieve the certification results.
Article 13. Effective Date
1. This Decree shall take effect from April 10, 2023.
2. Abolish the provisions of Clause 1 of Article 8 and Point a, Point b of Clause 3 of Article 14 of Government Decree No. 138/2020/NĐ-CP from August 1, 2024.
1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.
Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees, and relevant agencies, organizations, and individuals shall be responsible for implementing this Decree.
