Guidelines on positions of civil servants in specialized business affairs in industry and trade agencies and organizations

Pursuant to Decree No. 96/2022/NĐ-CP dated November 29, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade. under the Ministry of Industry and Trade.
Pursuant to Decree No. 62/2020/NĐ-CP dated June 1, 2020, of the Government, on positions and staffing of civil servants;
At the proposal of the Department of PersonnelArticle 1. Public service units in the field of education and training established by competent authorities according to Article 2 of Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government on establishment, restructuring, and dissolution of public service units (except educational institutions with School Councils established under specialized laws, performing the functions, duties, and powers of School Councils as prescribed by specialized laws and performing the functions of Management Boards as prescribed in Decree No. 120/2020/NĐ-CP).
After consultation with the Ministry of Home Affairs, the Minister of Industry and Trade issues this Circular guiding positions of civil servants in specialized business affairs in industry and trade within agencies and organizations under the industry and trade sector.This Circular guides the list of positions, job descriptions, and competency frameworks for civil servants in specialized business affairs in industry and trade from central to local levels within agencies and organizations under the industry and trade sector.
Article 1. Scope of Regulation
1. Civil servants in agencies and organizations as specified in Clause 2 of this Article.
Article 2. Applicability
2. Agencies and organizations under the industry and trade sector from central to local levels, including:
a) Agencies and organizations under Ministries and ministerial-level agencies assisting the Ministers and Heads of ministerial-level agencies in state management of the industry and trade sector (hereinafter referred to as state management of industry and trade).
b) Specialized agencies under provincial People's Committees advising and assisting provincial People's Committees in performing their state management functions over the industry and trade sector.
c) Specialized agencies under district People's Committees advising and assisting district People's Committees in performing their state management functions over the industry and trade sector.
d) Organizations performing state management functions over the industry and trade sector established by the Government,
1. Principles for determining positions of civil servants in specialized business affairs in industry and trade
Article 3. Principles and Bases for Determining Job Positions
a) Ensuring the principles stipulated in Article 3 of Decree No. 62/2020/NĐ-CP dated June 1, 2020 of the Government on positions and staffing of civil servants.
b) Each position must have a specific name and be linked to a civil servant grade.
2. Bases for determining positions of civil servants in specialized business affairs in industry and trade The bases for determining positions of civil servants in specialized business affairs in industry and trade are stipulated in Clause 1 of Article 4 of Decree No. 62/2020/NĐ-CP dated June 1, 2020 of the Government on positions and staffing of civil servants.
1. List of positions of civil servants in specialized business affairs in industry and trade in agencies and organizations under Ministries and ministerial-level agencies assisting the Ministers and Heads of ministerial-level agencies in state management of industry and trade is specified in Appendix IA of this Circular.
Article 4. List of job positions
2. List of positions of civil servants in specialized business affairs in industry and trade in specialized agencies performing advisory and assistance functions for provincial People's Committees in state management of industry and trade is specified in Appendix IB of this Circular.
3. List of positions of civil servants in specialized business affairs in industry and trade in specialized agencies performing advisory and assistance functions for district People's Committees in state management of industry and trade is specified in Appendix IC of this Circular.
Article 5. Job Descriptions and Competency Frameworks
1. Job descriptions for positions of civil servants in specialized business affairs in industry and trade include the following contents:
a) Position title;
b) Position objectives;
c) Tasks and evaluation criteria;
d) Work relationships;
đ) Scope of authority;
2. Competency frameworks for positions of civil servants in specialized business affairs in industry and trade include the following contents:
a) Requirements for qualifications, including: Educational training, retraining, certificates; work experience; personal qualities; other requirements according to the position.
b) Competencies, including: General competencies; professional competencies; management competencies.
c) Competency frameworks for positions of civil servants in specialized business affairs in industry and trade must comply with current regulations on civil servant grade standards. Levels of each group of competencies are implemented according to Appendices IIA, IIB, and IIC of this Circular.
3. Job descriptions and competency frameworks for positions of civil servants in specialized business affairs in industry and trade are carried out according to Appendix III of this Circular. Administrative agencies and organizations under the industry and trade sector develop specific job descriptions and competency frameworks based on the functions and tasks of the agency or organization and the job descriptions and competency frameworks in Appendix III, submitting them for approval by competent authorities.
1. This Circular takes effect from May 10, 2023.
Article 6. Effectiveness
2. Agencies and organizations as specified in Article 2 shall base themselves on the guidelines in this Circular to develop position plans for their agencies and organizations, submitting them for review and approval by competent authorities in accordance with the law.
For civil servants currently holding a higher civil servant grade than the grade required for the positions specified in this Circular, they will be retained until new salary regulations are issued.
3. In cases where the regulatory legal documents cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the newly issued documents.
Article 7. Transitional Provisions
1. Ministers, Heads of ministerial-level agencies, Heads of government agencies, and heads of organizations established by the Government,
