for use regarding positions, management roles, and specialized vocational titles, and the structure of civil servants according to vocational titles in unitsunder the judicial sector

Pursuant to the Government Decree number 98/2022/NĐ-CP dated September 29 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade; Pursuant to Decree No. 31 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Decree No. 106/2020/NĐ-CPdated September 10 2020 of the Government on positions and the number of staff in public service units;

Pursuant to Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government stipulating the establishment, restructuring, and dissolution of public service organizations;

At the proposal of the Director of the Cadre and Civil Servant Organization Department;

The Minister of Justice issues this Circular guiding positions, management roles, and specialized vocational titles, and the structure of civil servants according to vocational titles in public service units under the judicial sector.

This Circular guides the list of positions, job descriptions, and competency frameworks for leadership and management positions and specialized vocational title positions; the structure of civil servants according to specialized vocational titles in public service units under the judicial sector that operate public services in areas including: legal aid; state compensation; criminal record verification; notarization; asset auction; registration of security measures; legal support and legal consultation.

Article 2. Applicability

1. Public service units established by competent authorities in accordance with the law and operating public services in the judicial sector as specified in Article 1 of this Circular.

2. Agencies, organizations, and individuals related to the management and use of positions and civil servants in public service units under the judicial sector.

Article 3. Principles and basis for determining positions in public service units

1. Leadership and management positions and specialized vocational titles of civil servants in public service units under the judicial sector shall be determined based on the principles set forth in Article 3 of Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on positions and the number of staff in public service units (hereinafter referred to as Decree No. 106/2020/NĐ-CP).

2. The basis for determining leadership and management positions and specialized vocational titles of civil servants in public service units under the judicial sector shall be implemented in accordance with Clause 1 of Article 4 of Decree No. 106/2020/NĐ-CP.

Article 4. List of positions, job descriptions, and competency frameworks for leadership and management positions and specialized vocational titles in the judicial sector

1. The list of leadership and management positions in public service units under the judicial sector includes 16 positions as specified in Appendix I attached to this Circular.

3. Job descriptions and competency frameworks for leadership and management positions and specialized vocational titles in public service units under the judicial sector are specified in Appendices III, IV, V, VI, VII, and VIII attached to this Circular.

4. The level framework for determining competencies for leadership and management positions and specialized vocational titles in public service units under the judicial sector is specified in Appendix IX attached to this Circular.

Article 5. Staff Structure According to Professional Titles

The determination of the staff structure according to professional titles is carried out in accordance with the provisions of Clause 5, Article 3, and Clause 3, Article 4 of Decree No. 106/2020/NĐ-CP.

Article 6. Transitional provisions

1. Civil servants in leadership and management positions currently holding grades of specialized vocational titles shall continue to implement until a decision by the competent authority in accordance with the law.

2. Civil servants currently holding higher grades of specialized vocational titles than those required by the positions specified in this Circular before the effective date of this Circular shall continue to hold their current grades until a decision by the competent authority in accordance with the law.

Article 7. Effective Date

1. This Circular takes effect from November 20, 2023.

2. In cases where the legal normative documents referred to in this Circular are amended, supplemented, or replaced, they shall be implemented in accordance with the provisions of the amended, supplemented, or replacing documents.

Article 8. Responsibility for Implementation

1. Chairpersons of provincial People's Committees, Heads of units under the Ministry of Justice, Directors of Justice Departments of provinces and centrally-administered cities, heads of public service units under the judicial sector, and related agencies and organizations are responsible for implementing this Circular.

2. During implementation, if there are any difficulties, public service units under the judicial sector and related agencies and organizations are requested to promptly report to the Ministry of Justice for guidance and resolution.
