Repealing certain regulatory legal documents
issued by the Minister of Public Securityjointly issued
Pursuant to the Law on Enacting Regulatory Legal Documents dated June 22, 2015;
Based on the Law Amending and Supplementing Certain Provisions of the Law on Enactment of Legislative Acts dated June 18, 2020;
Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;
On the basis of Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing some articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures for implementing the Law on Enacting Regulatory Legal Documents;
Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
At the proposal of the Director of the Department of Legal Affairs and Administrative Reform and Justice;
The Minister of Public Security issues this Circular to repeal certain regulatory legal documents issued by the Minister of Public Security, jointly issued.
Article 1. Repeal all regulatory legal documents jointly issued by the Minister of Public Security
Repeal all regulatory legal documents jointly issued by the Minister of Public Security as follows:
1. Joint Circular No. 04/TTLB dated June 2, 1988 of the Ministry of Interior and the Ministry of Foreign Affairs regarding the handling of Vietnamese citizens wishing to exit the country to reunite with their families for humanitarian reasons.
2. Joint Circular No. 01/2005/TTLT-BCA-BLDTBXH dated January 18, 2005 of the Ministry of Public Security and the Ministry of Labor, Invalids and Social Affairs guiding preventive and anti-violation activities in the field of labor export.
3. Joint Circular No. 06/2006/TTLT-BCA-BNV-BTC dated October 10, 2006 of the Ministry of Public Security, the Ministry of Interior, and the Ministry of Finance guiding the implementation of Decision No. 289/2005/QĐ-TTg dated November 8, 2005 of the Prime Minister regarding salaries and allowances for officers and non-commissioned officers under the People's Public Security force who have transferred to other sectors.
4. Joint Circular No. 07/2012/TTLT-BCA-BQP dated June 29, 2012 of the Ministry of Public Security and the Ministry of National Defense guiding the implementation of some provisions of Decree No. 77/2010/NĐ-CP dated July 12, 2010 of the Government on cooperation between the Ministry of Public Security and the Ministry of National Defense in performing national security protection tasks, maintaining public order and safety, and defense tasks.

2. Circular No. 12/2004/TT-BCA(V19) dated September 23, 2004 of the Minister of Public Security guiding the implementation of some provisions of the Criminal Investigation Organization Ordinance 2004 within the People's Public Security force.
3. Circular No. 18/2004/TT-BCA(V19) dated November 9, 2004 of the Minister of Public Security guiding compensation for damages caused by wrongful convictions resulting from actions by authorized persons involved in criminal proceedings within the People's Public Security force.
4. Circular No. 01/2006/TT-BCA(C11) dated January 12, 2006 of the Minister of Public Security guiding the implementation of some contents of Article 35 of the Criminal Procedure Code 2003.
5. Circular No. 04/2007/TT-BCA-V19 dated May 21, 2007 of the Minister of Public Security amending and supplementing Circular No. 12/2004/TT-BCA(V19) dated September 23, 2004 of the Minister of Public Security guiding the implementation of some provisions of the Criminal Investigation Organization Ordinance 2004 within the People's Public Security force.

Article 3. Implementation Organization

The Director of the Department of Legal System and Administrative Reform and Judicial Affairs, Heads of units under the Ministry, Directors of Public Security Departments of provinces and centrally-administered cities, and related agencies, organizations, and individuals shall be responsible for implementing this Circular./.
