CIRCULAR

Regulations on standards and conditions regarding promotion to higher rank titles

profession of civil servants in various natural resources and environmental specialties

 

Pursuant to Decree No. 68/2022/NĐ-CP dated September 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

WHEREAS pursuant to Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants;

On the basis of Decree No. 85/2023/ND-CP dated December 7, 2023 of the Government amending and supplementing certain articles of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants;

The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.

The Minister of Natural Resources and Environment issues this Circular stipulating standards and conditions for promotion to Level II in the profession of civil servants in various natural resources and environmental specialties.

Article 1. Scope of Regulation

This Circular stipulates standards and conditions for promotion to Level II for civil servants holding professions in various natural resources and environmental specialties.

Article 2. Applicability

This Circular applies to civil servants holding professions in the following specialties: land administration, natural resource and environment survey, meteorology and hydrology forecasting, meteorology and hydrology control, natural resource and environment monitoring, and cartography working in public service units that are subject to promotion to Level II.

Article 3. Standards and conditions for promotion to Level II for civil servants holding professions in various natural resources and environmental specialties

Civil servants holding professions in various natural resources and environmental specialties are eligible to register for promotion to Level II when they meet all the following standards and conditions:

1. The standards and conditions prescribed in Clause 1, Article 32 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants (amended at Clause 16, Article 1 of Decree No. 85/2023/ND-CP dated December 7, 2023 of the Government).

2. The job position plan of the public service unit must be established and approved in accordance with the provisions of the law, having a job position corresponding to the civil servant's profession being considered for promotion.

3. Authorized to participate in the promotion review process by the competent authority.

4. They have held the profession at Level III in the specialty registered for promotion or equivalent for at least nine years (excluding probationary and trial periods). In cases where they have equivalent time to the profession at Level III, they must hold the profession at Level III in the specialty registered for promotion for a minimum of one year (12 months) up to the deadline for submitting the application for promotion review (if the time held at Level III in the specialty registered for promotion is not continuous, it can be accumulated).

5. During the period of holding the profession at Level III and equivalent, they must be officially recognized in writing (attached to the file) by the competent authority for one of the following achievements:

a) Leading or participating in scientific and technological tasks at the grassroots level or higher, which have been accepted and evaluated as meeting the requirements by the competent authority;

b) Leading or participating in implementing projects, programs, plans, strategies within their sector, field, agency, or unit of work, which have been issued, approved, accepted, or put into use by the competent authority at a satisfactory level or higher, confirmed by the head of the agency or unit responsible for implementation;

c) Leading or participating in drafting normative legal documents which have been issued by the competent authority, confirmed by the head of the agency or unit responsible for implementation;

d) Leading or participating in drafting regulations, procedures, technical guidelines, or professional guidance documents within their sector, field, agency, or unit of work, which have been issued by the competent authority, confirmed by the head of the agency or unit responsible for implementation;

đ) Achieving commendations from ministries, sectors, provincial-level authorities or higher, or receiving titles such as Model Worker at the grassroots level or higher in performing professional tasks.

Article 4. Implementation provisions

1. This Circular takes effect from August 15, 2024.

2. In case the referenced normative legal documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the provisions of the amended, supplemented, or replacing normative legal documents.

Article 5. Responsibilities for Implementation

1. Ministries, agencies equivalent to ministries, government agencies; People's Committees of provinces and centrally-administered cities, and heads of agencies, organizations, units, and individuals related to this matter are responsible for implementing this Circular.

2. During the process of implementation, if there are any difficulties, agencies, organizations, units, and individuals are requested to promptly reflect them to the Ministry of Natural Resources and Environment for consolidation, consideration, amendment, and supplementation to ensure appropriateness./.
