Repealing certain regulatory legal documents issued by the Minister of Public Security

Based on the Law on Enactment of Legislative Acts dated June 22, 2015;

Based on the Law Amending and Supplementing Certain Provisions of the Law on Enactment of Legislative Acts dated June 18, 2020;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;

On the basis of Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing some articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some provisions and measures for implementing the Law on Enacting Regulatory Legal Documents;

Pursuant to Decree No. 59/2024/NĐ-CP dated May 25, 2024 of the Government amending and supplementing some articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some provisions and measures for implementing the Law on Enacting Regulatory Legal Documents which has been amended and supplemented some articles according to Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to Decree No. 05/2024/NĐ-CP dated November 11, 2024 of the Government amending and supplementing some articles of Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Department of Legal Affairs and Administrative Reform and Justice;

The Minister of Public Security issues this Circular to repeal certain regulatory legal documents issued by the Minister of Public Security.

Article 1. Repeal all regulatory legal documents issued by the Minister of Public Security

Repeal all the following regulatory legal documents issued by the Minister of Public Security:

1. Circular No. 09/TT-BNV(X11) dated December 12, 1995 of the Minister of Interior regarding the payment system for overtime teaching.

2. Circular No. 09/2004/TT-BCA(V19) dated June 16, 2004 of the Minister of Public Security guiding the application of certain measures to protect informants, witnesses, and victims in drug-related cases.

3. Circular No. 41/2009/TT-BCA-V19 dated July 2, 2009 of the Minister of Public Security supplementing Circular No. 12/2004/TT-BCA(V19) dated September 23, 2004 of the Minister of Public Security guiding the implementation of certain provisions of the Criminal Investigation Organization Ordinance 2004 within the People's Public Security.

4. Circular No. 51/2012/TT-BCA dated August 10, 2012 of the Minister of Public Security stipulating the political theory study system in the People's Public Security.

5. Circular No. 41/2014/TT-BCA dated September 24, 2014 of the Minister of Public Security stipulating the management of officers, non-commissioned officers, workers, and staff in the People's Public Security.

6. Circular No. 55/2017/TT-BCA dated November 16, 2017 of the Minister of Public Security stipulating measures for implementing the financial autonomy mechanism of public service units within the People's Public Security.

7. Circular No. 04/2020/TT-BCA dated January 10, 2020 of the Minister of Public Security stipulating equivalent positions in the People's Public Security.

Decision No. 1103/2000/QĐ-BCA (E17) dated December 7, 2000 of the Minister of Public Security promulgating regulations on the production, storage, preservation, transportation, distribution, use, and destruction of CS substance and pepper spray containing CS as auxiliary tools for the People's Public Security force.

9. Decision No. 767/2002/QĐ-BCA dated August 21, 2002 of the Minister of Public Security concerning the issuance of forms to be used when registering product quality and producing technical equipment and auxiliary tools.

Article 2. Repeal part of the regulatory legal document issued by the Minister of Public Security

Repeal the phrase ", with confirmation from the police station of the commune, ward, town where the stateless person temporarily resides" at Point b Clause 2 Article 5 and Point c Clause 1 Article 7 of Circular No. 31/2015/TT-BCA dated July 6, 2015, guiding certain contents regarding the issuance of visas, temporary residence cards, entry-exit permits, and permanent residency for foreigners in Vietnam issued by the Minister of Public Security.

Article 3. Implementation Organization

1. This Circular takes effect from January 16, 2025.

2. The Director of the Legal System and Administrative Reform, Judicial Affairs Bureau, Heads of units under the Ministry, Directors of Public Security Departments of provinces and centrally-administered cities, and related agencies, organizations, and individuals are responsible for implementing this Circular./.
