Regulations on the management and maintenance of national railway infrastructure

Chapter I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular stipulates the management of railway infrastructure and the maintenance of national railway projects.
Article 2. This Circular applies to agencies and organizations related to the management of railway infrastructure and the maintenance of national railway projects invested by the State.
Article 2. Interpretation of Terms
In this Circular, the following terms are understood as follows:
1. Maintenance of railway projects refers to a set of activities aimed at ensuring and maintaining the normal operation and safety of railway projects according to design specifications or maintenance procedures.

3. Repair of railway projects involves restoring, reconstructing, or replacing damaged parts of projects, equipment, or structures within projects discovered during their operation and use to ensure their normal and safe operation and railway transportation safety. Railway project repairs include regular repairs and emergency repairs:
a) Regular repair of railway projects involves repairing damage or reconstructing, replacing parts of projects or equipment installed in projects that are damaged and carried out regularly according to maintenance procedures and approved project management and maintenance plans;
b) Emergency repair of railway projects involves repairs conducted when parts of projects or projects suffer damage due to sudden impacts such as wind, storms, floods, earthquakes, collisions, fires, and other sudden impacts, or when parts of projects or projects show signs of deterioration affecting their safe use, operation, and exploitation.
4. Inspection of railway projects involves visually observing or using specialized equipment to assess the current condition of projects to promptly identify signs of deterioration and damages to projects and equipment installed in projects, thereby taking timely measures. Railway project inspection includes regular inspections, periodic inspections, and emergency inspections.
5. Other tasks refer to contents determined in the project management and maintenance plan including tasks such as inspecting projects; drafting and reviewing maintenance procedures; establishing and reviewing economic and technical standards for project maintenance; overseeing the storage and management of materials recovered from project maintenance work; dismantling and handling railway infrastructure assets; preparing and updating infrastructure management records and project maintenance records; marking boundaries for railway land; and other tasks arising during the operation and exploitation of railway infrastructure.
6. Railway project maintenance database refers to a collection of information about projects and their maintenance history updated and utilized on the railway infrastructure management information system.
7. National railway asset management enterprise refers to an enterprise holding 100% state capital and entrusted with managing national railway infrastructure assets without considering state capital components in the enterprise.
Chapter II
MANAGEMENT OF RAILWAY INFRASTRUCTURE AND MAINTENANCE OF RAILWAY PROJECTS
Article 3. Contents of Infrastructure Management Work for Railways
1. Establishing and approving plans for managing and maintaining railway works, service fees for public services related to managing and maintaining railway infrastructure; managing financial resources for infrastructure management work and maintenance of railway works.
2. Implementing plans for managing and maintaining railway works and managing the quality of public services related to managing and maintaining railway infrastructure.
3. Preventing, combating, and mitigating consequences of accidents and natural disasters affecting railway infrastructure.
4. Protecting railway infrastructure in accordance with regulations.
5. Managing, monitoring, and organizing the handling of weak positions of works showing signs of danger and not ensuring safety during use.
6. Organizing the establishment of files and updating databases on maintenance of railway works.
7. Reporting periodically and urgently as prescribed.
Article 4. Contents of Railway Works Maintenance Work
1. The contents of railway works maintenance are established in the plan for managing and maintaining railway works, including tasks such as maintenance, monitoring, and other works; managing and supervising maintenance of railway works; repairing works; supplementing and replacing components and equipment of works to ensure safe exploitation and use of works.
2. Repair work is determined according to construction design or technical solutions and implemented in accordance with laws on quality management, construction, and maintenance of construction works.
3. Maintenance of railway works and management, supervision of maintenance of railway works; supplementing and replacing components and equipment of works are determined according to the technical operation plan of the enterprise managing national railway assets.
4. Monitoring tasks and other works are determined according to approved outlines and implemented in accordance with laws on quality management, construction, and maintenance of construction works.
Article 5. Requirements for Infrastructure Management Work and Railway Works Maintenance
1. Infrastructure management work for railways is carried out uniformly, clearly defining the authority and responsibilities of each agency and organization, and coordinating activities between agencies and units.
2. Railway works maintenance is carried out according to approved plans for managing and maintaining railway works and maintenance procedures.
3. Railway works maintenance must ensure safety for people, property, and works; ensure safe and smooth traffic; prevent fires and explosions, and protect the environment.
4. Tasks to be performed before adjusting and supplementing in the plan for managing and maintaining railway works include:
a) Works to repair the first stage consequences of damage caused by accidents and natural disasters as prescribed in regulations on preventing, combating, and mitigating the consequences of natural disasters; responding to accidents and rescue operations in the railway sector;
b) Tasks to handle railway works showing signs of danger and not ensuring safety for exploitation and use as stipulated in Article 8 of this Circular.
Article 6. Files for Infrastructure Management Work and Railway Works Maintenance
1. Infrastructure management files for railways are established for each type of railway works, ensuring consistency with the scope of management and being updated regularly to serve railway works maintenance. Infrastructure management files include technical condition files of works; files managing the protected area of works, railway traffic safety corridors; completion files of works (if any), and are defined as follows:
a) Technical condition files of works:
Technical condition files of works are established for each work, reflecting location, scope, scale; technical characteristics; construction and repair time; inspection time and current technical condition of the work;
Technical condition files of works include documents prescribed in the maintenance procedure, a summary table of technical conditions of works according to Model I attached to this Circular;
b) Files managing the protected area of works, railway traffic safety corridors are established for each railway line within administrative boundaries at provincial and municipal levels, ensuring synchronization with land boundary files reserved for railways according to the Government's regulations on managing and protecting railway infrastructure. The content of the file mainly includes: construction scope of railway works, protected area of works, and railway traffic safety corridor;
c) Completion files of works according to the Government's regulations on quality management, construction, and maintenance of construction works;
d) Technical condition files of works, files managing the protected area of works, railway traffic safety corridors are updated within a period not exceeding ninety days from the completion of work maintenance or actual changes.
2. Railway works maintenance files
a) Railway works maintenance files include documents serving maintenance work and completion files of maintenance established for each work and task according to approved plans for managing and maintaining railway works;
b) Documents serving railway works maintenance include: results of investigations on the basic status of railway works; plans for managing and maintaining railway works, approved public service fee schemes; results of inspections, monitoring, and quality testing of works (if any) to serve maintenance work;
c) Completion files of maintenance works include: approved technical operation plans; quality management documents of maintenance works according to the maintenance procedure and acceptance certificates of completed maintenance work;
d) Completion files of repaired works are established according to the Government's regulations on quality management of construction and maintenance of construction works;
đ) Completion files of works to mitigate the consequences of accidents and natural disasters for railway works are established according to the Minister of Construction's regulations on preventing, combating, and mitigating the consequences of natural disasters; responding to accidents and rescue operations in the railway sector;
e) Other files and documents related to the maintenance of railway infrastructure.
Article 7. Safety assessment of railway infrastructure during operation and use
1. Railway infrastructure that significantly affects safety and public interest as prescribed by the Government's regulations on project investment and construction management must be periodically or urgently assessed for load-bearing safety and operational safety during operation and use.
2. The procedures for conducting safety assessments of infrastructure, and the contents of such assessments shall be carried out in accordance with the provisions of laws on quality management, construction, and maintenance of construction projects.
3. State-owned railway asset management enterprises shall review and establish a list of railway infrastructure subject to safety assessment according to the legal regulations on quality management, construction, and maintenance of construction projects; the Vietnam Railways Administration shall review and publish the list of infrastructure as the basis for implementation in accordance with the regulations.
Article 8. Handling of railway infrastructure showing signs of danger, not ensuring safety for operation and use
1. During the implementation of railway infrastructure maintenance, state-owned railway asset management enterprises must promptly identify infrastructure, parts of infrastructure, and equipment installed on railway infrastructure that are damaged, deteriorated in quality, and do not ensure safety for operation and use, and handle them in accordance with the regulations.
2. Upon discovering or receiving information about infrastructure, parts of infrastructure, and equipment installed on railway infrastructure that are damaged, deteriorated in quality, and do not ensure safety for operation and use, state-owned railway asset management enterprises have the responsibility to:
a) Decide on emergency measures and organize handling to ensure train safety;
b) Prepare reports to submit to the Vietnam Railways Administration regarding the results of implementation or proposals for quality inspection of infrastructure (if necessary), monitoring of infrastructure, and urgent repairs of infrastructure. The report of the state-owned railway asset management enterprise shall be prepared according to the form attached as Appendix II to this Circular.
3. Upon receipt of the report from the state-owned railway asset management enterprise, the Vietnam Railways Administration decides to implement quality inspections of infrastructure, monitor infrastructure, and urgently repair infrastructure, and report the results of implementation to the Ministry of Construction.
4. After the Vietnam Railways Administration makes the decision under Clause 3 of this Article, the state-owned railway asset management enterprise shall implement as follows:
a) Quality inspections of infrastructure and monitoring of infrastructure shall be conducted in accordance with the provisions of laws on quality management, construction, and maintenance of construction projects;
b) Urgent repairs of infrastructure shall be carried out in accordance with Clause 3 of Article 12 of this Circular.
5. The results of quality inspections, monitoring, and urgent repairs of infrastructure shall be updated and supplemented into the infrastructure management and maintenance plan or adjustment plan.
Article 9. Monitoring and quality inspection of railway infrastructure and parts thereof during operation and use
1. Monitoring of infrastructure and quality inspection of infrastructure during operation and use shall be carried out in cases prescribed by the Government's regulations on quality management, construction, and maintenance of construction projects.
2. State-owned railway asset management enterprises shall review and establish a list of railway infrastructure requiring monitoring and quality inspection to be submitted to the Vietnam Railways Administration for decision-making as the basis for establishing annual infrastructure management and maintenance plans.
3. State-owned railway asset management enterprises shall implement monitoring and quality inspection of railway infrastructure in accordance with the provisions of laws on quality management, construction, and maintenance of construction projects.
Article 10. Application of economic and technical standards and norms in railway infrastructure maintenance work
1. Railway infrastructure maintenance work shall be carried out in accordance with economic and technical standards and norms, cost norms issued by competent authorities.
2. For tasks that have not been provided with economic and technical standards and norms, cost norms issued by competent authorities, they shall be determined based on construction unit prices published by provincial People's Committees or determined based on market prices or similar prices from completed projects.
Chapter III
ORGANIZATION AND IMPLEMENTATION OF INFRASTRUCTURE MANAGEMENT AND MAINTENANCE OF RAILWAY INFRASTRUCTURE
Article 11. Establishment, approval, and adjustment of plans for management and maintenance of railway infrastructure
1. Establishment of plans for management and maintenance of railway infrastructure
a) Based on the technical condition of railway infrastructure, transportation needs on each operational railway line, maintenance procedures, economic and technical norms, technical regulations, and related standards, the state-owned enterprise managing railway infrastructure assets shall establish annual or periodic plans for management and maintenance of railway infrastructure within its scope to ensure safety during operation.
b) The plan for management and maintenance of railway infrastructure shall include complete information such as: name of task, infrastructure project, project component; unit of measurement, quantity, estimated implementation costs; time frame for implementation; method of implementation and priority level for regular repair projects.
c) Contents of the plan for management and maintenance of railway infrastructure include:
Maintenance of railway infrastructure;
Repair of infrastructure;
Work to address consequences of accidents and natural disasters that have occurred;
Inspection, monitoring, and other works (if applicable);
Management and supervision of infrastructure maintenance;
Emergency tasks for handling infrastructure accidents; addressing consequences of accidents and natural disasters for the following year;
Management and protection of railway infrastructure;
d) Components of the file submitted for the plan for management and maintenance of railway infrastructure include:
Detailed description of the plan for management and maintenance of railway infrastructure, including the technical condition of railway infrastructure, transportation needs on each operational railway line, maintenance procedures, economic and technical norms, applied technical regulations, standards, and cost allocation plan;
The plan for management and maintenance of railway infrastructure is established according to the model attached as Appendix III to this Circular;
A summary table of maintenance quantities for railway infrastructure is established according to the model attached as Appendix IV to this Circular;
Technical status files of railway infrastructure as stipulated at point a, Clause 1, Article 6 of this Circular. In cases where the technical status of railway infrastructure is fully documented in the Railway Infrastructure Maintenance Database, the state-owned enterprise managing railway assets shall confirm this content in the request document as a basis for using it instead of paper files;
e) The state-owned enterprise managing railway assets shall organize the establishment of the annual plan for management and maintenance needs of railway infrastructure, submit it to the Ministry of Construction, and send it to the Vietnam Railway Administration before June 1st each year for review; the Vietnam Railway Administration shall complete the review report before June 20th each year. Based on the review report of the Vietnam Railway Administration, the state-owned enterprise managing railway infrastructure assets shall incorporate the review comments and perfect the plan for submission to the Ministry of Construction for approval of the maintenance work plan.
2. On the basis of the approved management and maintenance work plan, the Ministry of Construction shall aggregate the budget estimate for management and maintenance of railway infrastructure into the annual revenue and expenditure budget of the Ministry of Construction and send it to the Ministry of Finance before July 20th each year.
3. Approval of the plan for management and maintenance of railway infrastructure
a) Based on the notification from the Ministry of Construction regarding the state budget estimate for railway economic activities, within five working days, the state-owned enterprise managing railway assets shall review and update the annual plan for management and maintenance of railway infrastructure to align with the allocated funds and submit it to the Ministry of Construction, while sending it to the Vietnam Railway Administration for review. The components and contents of the plan for management and maintenance of railway infrastructure shall comply with the provisions at points b, c, and d of Clause 1 of this Article; the proposal for the plan for management and maintenance of railway infrastructure shall be established according to the model attached as Appendix V to this Circular;
b) The Vietnam Railway Administration shall conduct the review and send the results to the Ministry of Construction and the state-owned enterprise managing railway infrastructure assets before December 15th each year;
c) Based on the review report of the Vietnam Railway Administration, the state-owned enterprise managing railway infrastructure assets shall incorporate the review comments and perfect the plan for submission to the Ministry of Construction for approval of the plan for management and maintenance of railway infrastructure before December 25th each year.
4. Adjustment of the plan for management and maintenance of railway infrastructure:
a) The plan for management and maintenance of railway infrastructure may be adjusted during implementation to match the actual technical condition of railway infrastructure;
b) The state-owned enterprise managing railway assets shall prepare a file for adjusting the plan for management and maintenance of railway infrastructure, submit it to the Ministry of Construction, and send it to the Vietnam Railway Administration for review before October 1st each year; the Vietnam Railway Administration shall complete the review report before October 10th each year;
c) The components and contents of the adjusted plan for management and maintenance shall comply with the provisions at points b, c, and d of Clause 1 of this Article;
d) Based on the review report of the Vietnam Railway Administration, the state-owned enterprise managing railway infrastructure assets shall incorporate the review comments and perfect the plan for submission to the Ministry of Construction for approval of the plan for management and maintenance of railway infrastructure before October 31st each year.
Article 12. Implementation of the management and maintenance plan for railway infrastructure projects
1. Based on the management and maintenance plan for railway infrastructure projects and the state budget expenditure estimate assigned by the Ministry of Construction, the enterprise managing national railway assets shall organize the implementation of railway infrastructure maintenance.
2. Implementation of maintenance work for railway infrastructure projects
a) The enterprise managing national railway assets may implement procurement orders for products and public service goods according to the Government's regulations on the management, use, and exploitation of railway infrastructure assets;
b) When implementing maintenance work for railway infrastructure projects through procurement orders, the process of establishing, reviewing, and issuing pricing documents for public services shall be carried out as follows:
The enterprise managing national railway assets shall organize the establishment of pricing plans for public service projects to be submitted to the Ministry of Construction, while sending them to the Vietnam Railway Administration before January 15 each year;
The Vietnam Railway Administration shall conduct a review of the pricing plans for public services and compile reports to submit to the Ministry of Construction before February 5 each year. On the basis of the review results from the Vietnam Railway Administration, the Ministry of Construction shall approve the review results of the pricing plans for public services and consolidate them to send to the Ministry of Finance for maximum pricing determination;
The Vietnam Railway Administration shall issue specific pricing documents for public services related to the management and maintenance of national railway infrastructure according to the laws on pricing.
3. Implementation of repair work
a) For repair projects with costs of VND 500 million or more, the enterprise managing national railway assets shall organize the preparation of economic and technical reports or investment construction projects to be reviewed and approved by the Vietnam Railway Administration. The implementation of such projects shall comply with the laws on investment and construction and relevant laws;
b) For repair projects with costs below VND 500 million, the enterprise managing national railway assets shall organize the preparation and approval of technical and budget plans and proceed with their implementation.
4. Implementation of repairs and remediation of consequences of accidents and natural disasters affecting railway infrastructure projects
a) First-stage remediation project for accident and natural disaster consequences
The procedures for implementation shall follow the regulations of the Minister of Construction regarding prevention, response, and remediation of natural disaster consequences; emergency response and rescue operations in the railway sector;
After completing the first-stage remediation of accident and natural disaster consequences, the enterprise managing national railway assets shall compile a list of projects to report to the Vietnam Railway Administration for cost adjustment to update and supplement the management and maintenance plan or the adjusted plan.
b) The second-stage remediation project for accident and natural disaster consequences shall be implemented according to the provisions of Clause 3 of this Article.
5. The use of non-budgetary funds for the management and maintenance of railway infrastructure projects shall be conducted in accordance with the laws on the management and use of public assets and relevant laws.
Article 13. Quality Management of Maintenance Work for Railway Infrastructure Projects
1. The enterprise managing national railway assets shall implement quality management of maintenance work for railway infrastructure projects in accordance with the regulations.
2. Management of materials, products, components, and equipment used for maintenance work on railway infrastructure projects
a) For railway infrastructure maintenance: main materials and equipment must undergo testing and inspection or require suppliers to provide complete certificates of quality and origin before being allowed for use;
b) For repair projects: the management of materials, products, components, and equipment used in the projects shall be carried out in accordance with the regulations on quality management, construction, and maintenance of construction projects.
3. Acceptance of maintenance work for railway infrastructure projects
a) For railway infrastructure maintenance, the enterprise managing national railway assets shall carry out acceptance according to the supervision, acceptance criteria, and maintenance procedures;
b) For repair work on railway infrastructure projects and remediation of accident and natural disaster consequences, the enterprise managing national railway assets shall organize the acceptance of construction works, stage-by-stage construction completion acceptance, or parts of the project, final acceptance of project components, and the commissioning of construction projects for use according to the Government's regulations on construction quality management and maintenance of construction projects;
c) For other work under the approved management and maintenance plan for railway infrastructure projects, the enterprise managing national railway assets shall organize acceptance in accordance with relevant laws.
4. The enterprise managing national railway assets shall be responsible for organizing the establishment of a quality management system for railway infrastructure maintenance as a basis for implementation. The quality management system for railway infrastructure maintenance must comply with the approved maintenance procedures.
Article 14. Periodic Reports during the Management of Railway Infrastructure and Maintenance of Railway Works
1. Report Name: Periodic Report on the Results of Railway Infrastructure Management and Maintenance Work.
2. The report content must fully reflect the following items: tasks performed; volume and budget approved or adjusted by the Ministry of Construction in the management and maintenance plan for railway works; quality of implementation, acceptance results, payment; proposals and recommendations (if any).
3. Reporting entity: national railway asset management enterprises.
4. Receiving agency: Vietnam Railway Administration, Ministry of Construction.
5. Method of submitting and receiving reports: paper documents and through the electronic document management system between the Ministry of Construction, Vietnam Railway Administration, and national railway asset management enterprises.
6. Deadline for submitting reports: before July 15th each year for the mid-year periodic report; before January 15th of the following month for the annual report.
7. Frequency of reporting: twice a year.
8. Data closing period for reporting: from January 1 to June 30 for the mid-year periodic report; from January 1 to December 31 for the annual report.
9. Reporting form according to Model VI attached to this Circular.
Article 15. Responsibilities for Managing Railway Infrastructure and Maintaining Railway Works
1. Vietnam Railway Administration
a) Organize inspections of the responsibilities and obligations of national railway asset management enterprises in managing railway infrastructure and maintaining railway works as stipulated in this Circular;
b) Fulfill the responsibilities and obligations of the construction sector's specialized agencies under the Ministry of Construction for railway repair projects included in the management and maintenance plan for railway works.
2. Based on their functions and duties, the Departments and Bureaus under the Ministry of Construction shall advise the Minister of Construction on state management of railway infrastructure and maintenance of railway works.
3. National railway asset management enterprises
a) Organize the implementation of railway infrastructure management and maintenance work as prescribed;
b) Supervise railway maintenance work, bear full responsibility for the volume and quality of railway maintenance work, ensuring smooth, orderly, safe, and accurate railway transportation operations in accordance with the law;
c) Conduct regular inspections and monitoring of railway works' quality during operation and use; carry out minor repairs to maintain the stable technical condition of railway works, ensuring the safety of the works and railway transportation;
d) Bear responsibility for incidents or deterioration of works due to non-compliance or incomplete compliance with the prescribed railway infrastructure management and maintenance work.
Chapter IV

Article 16. Sources and Content of Costs for Managing Railway Infrastructure and Maintaining Railway Works
1. Funds allocated for railway infrastructure management and maintenance work funded by the state are formed from the following sources:
a) State budget;
b) Other lawful sources as prescribed by law.
2. The management and use of funds allocated for railway infrastructure management and maintenance work shall be carried out in accordance with current laws.
3. The contents of cost items related to the implementation of railway infrastructure management and maintenance work include:
a) Costs for preparing and reviewing maintenance procedures and economic-technical norms serving maintenance work;
b) Costs for inspecting, monitoring, testing quality, assessing safety, repairing railway works, maintaining railway works, and managing and supervising maintenance work;
c) Costs for preparing and updating railway infrastructure management files; costs for updating maintenance data on railway works;
d) Other necessary costs for implementing railway works maintenance work in accordance with laws on quality management, construction, and maintenance of construction works.
4. Determination of costs for implementing management and maintenance of railway works is carried out as follows:
a) For repairing railway works, the implementation costs are determined for each project according to the laws on investment construction cost management;
b) For maintaining railway works and stage 1 damage recovery from accidents and natural disasters, national railway asset management enterprises organize the preparation of public service price plans and cost estimates in accordance with the laws on the state budget;
c) For other tasks, the implementation costs are determined based on cost estimates according to the content and volume of work performed as prescribed by current laws.
Chapter V
IMPLEMENTING PROVISIONS
Article 17. Effective Date
1. This Circular takes effect from June 30, 2025, and replaces Circular No. 03/2021/TT-BGTVT dated February 8, 2021, issued by the Minister of Transport regarding the management and maintenance of national railway infrastructure.
2. During implementation, if the legal regulations cited in this Circular are amended, supplemented, or replaced, they shall be applied according to those legal regulations.
Article 18. Transitional Provisions
1. Construction works and tasks that have been approved and are being implemented until the date this Circular takes effect and have not yet been completed shall continue to be implemented in accordance with Circular No. 03/2021/TT-BGTVT dated February 8, 2021 issued by the Minister of Transport.
2. Construction works and tasks that were approved before the date this Circular takes effect but have not yet commenced shall be implemented in accordance with the provisions of this Circular.
3. The State-owned enterprise managing railway assets shall be responsible for updating and supplementing the management files of railway infrastructure in accordance with Clause 1, Article 6 of this Circular to serve the management and maintenance of railway construction works as prescribed.
