CIRCULAR
Amending and Supplementing Certain Articles of Circular No. 10/2025/TT-BNV dated June 19, 2025 by the Minister of Home Affairs on the functions, tasks, powers of the Department of Home Affairs under the People's Committee of provinces, centrally-run cities, and specialized departments under the People's Committees of communes, towns, and special districts within provinces, centrally-run cities

BASED ON Decree No. 25/2025/NĐ-CP of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

AND BASED ON Decree No. 150/2025/NĐ-CP of the Government on the organization of specialized agencies under the People's Committees of provinces, centrally-run cities, and communes, towns, special districts within provinces, centrally-run cities; amended by Decree No. 370/2025/NĐ-CP:

ACCORDING TO the request of the Director of the Personnel Organization Department:

THE MINISTER OF HOME AFFAIRS ISSUES THIS CIRCULAR AMENDING AND SUPPLEMENTING CERTAIN ARTICLES OF CIRCULAR NO. 10/2025/TT-BNV DATED JUNE 19, 2025 BY THE MINISTER OF HOME AFFAIRS ON THE FUNCTIONS, TASKS, POWERS OF THE DEPARTMENT OF HOME AFFAIRS UNDER THE PEOPLE'S COMMITTEE OF PROVINCES, CENTRALLY-RUN CITIES, AND SPECIALIZED DEPARTMENTS UNDER THE PEOPLE'S COMMITTEES OF COMMUNES, TOWNS, SPECIAL DISTRICTS WITHIN PROVINCES, CENTRALLY-RUN CITIES.

Article 1. Amend and supplement certain points and clauses of Article 2

1. Amend and supplement point c clause 5 as follows:
"c) To compile and adjust job positions and the ratio of civil servants assigned to job positions according to the adjusted job positions of the Office of the Delegation of the National Assembly and People's Council at the provincial level, specialized agencies, organs, administrative bodies under the People's Committee at the provincial level; specialized agencies, administrative bodies under the People's Committee at the commune, town, special district levels (in cases where the People's Committee at the provincial level does not delegate or authorize)."

2. Amend and supplement points b and d clause 8 as follows:

a) Amend and supplement point b as follows:
"b) To advise, submit to the People's Committee of the province and its chairman:
Direct, issue, implement programs, plans, and other documents from higher organs regarding administrative reform;
Decide measures to promote administrative reform according to approved programs, schemes, and plans."

b) Amend and supplement point d as follows:
"d) To coordinate and cooperate with relevant agencies and units in organizing the implementation of local administrative reform work across six fields: Reform of institutional framework; reform of administrative procedures; reform of organizational structure; reform of civil service system; reform of public finance; development and promotion of electronic government, digital government."

3. Amend point b clause 10 as follows:
"b) To prepare a proposal for an action plan, submit it to the People's Committee of the province for submission to the same level People's Council for examination, complete the proposal and document to be sent to the Ministry of Home Affairs for review, approval regarding the establishment, dissolution, merger, division of administrative units, adjustment of boundaries, renaming of administrative units at provincial and commune levels; special districts with special status; categorization of administrative units at provincial level;"

4. Amend and supplement clause 14 as follows:
"a) To advise the People's Committee of the province in managing archival records stored in the historical archives of the state at the provincial level and the database of archival records according to delegated authority;
b) To advise the People's Committee of the province in establishing an electronic archive repository for managing the database of archival records and digital archival records under its management authority;
c) To advise the chairman of the People's Committee of the province on directing the development, updating of the local archival record database and updating the Vietnam National Archive Database according to delegated authority;
d) To advise and submit to the chairman of the People's Committee of the province for decision on agencies and organizations under the state to submit records and documents into the historical archives at the provincial level in accordance with legal provisions;
(d) To advise and submit to the chairman of the People's Committee of the province for decision on taking archival records out of the historical archives at the provincial level abroad;
e) To advise and submit to the chairman of the People's Committee of the province for approval of a list of restricted access archival records and cancellation of archival records in the historical archives at the provincial level;
g) To advise and submit to the chairman of the People's Committee of the province on recognizing, canceling recognition of archival records with special value for personal documents and archival records of organizations under its jurisdiction;
h) To guide and inspect activities related to archival services according to management authority;
i) To direct the historical archives at the provincial level in performing their archival business operations in accordance with legal provisions;
k) To carry out statistical, management, utilization, and publication of statistical data on documentation; guide and organize the collection, compilation, reporting of regular statistical data on documentation from localities."

5. Amend and supplement point b clause 16 as follows:
"b) To advise and assist the People's Committee of the province, its chairman, and the provincial Committee for Competition and Merit in issuing directives and guidelines related to competition and merit work at the local level; organizing competitive campaigns; guiding and inspecting agencies, organizations, units under the management scope of the locality in implementing competitive campaigns and Party policies, State laws on competition and merit;"

6. Amend and supplement clause 17 as follows:
"a) To advise and assist the People's Committee of the province in developing a system of labor market information to serve local objectives; compile and provide information about the labor market; organize, publicize, guide workers on registering and adjusting their registration information;
b) To guide and implement policies supporting job creation, unemployment insurance according to legal provisions;
c) To guide and organize implementation of laws related to employment services at localities."
d) Guide and organize the implementation of legal provisions concerning foreign workers working in Vietnam;
đ) Advise and assist the People's Committee at the provincial level in implementing state management over foreign workers working in Vietnam, Vietnamese workers working for foreign organizations or individuals within the province’s jurisdiction as per legal provisions;
e) Advise and assist the People's Committee at the provincial level in carrying out local tasks related to vocational skills development according to legal provisions.

7. Amend and supplement paragraph 18 as follows:
"a) Receive and advise, submit proposals for the People's Committee at the provincial level to issue documents approving the preparation of labor force for service enterprises within their jurisdiction;
b) Receive notifications regarding Vietnamese workers sent abroad by winning bid companies for construction projects or programs overseas; receive reports after such companies complete their foreign contracts; request immediate reports from winning bid companies for construction projects or programs overseas according to regulations;
c) Receive notifications regarding Vietnamese workers sent abroad by overseas investing organizations and individuals according to legal provisions; receive annual regular reports from such organizations and individuals on the dispatch of Vietnamese workers abroad; request immediate reports from them according to regulations;
d) Receive and advise, submit proposals for the People's Committee at the provincial level to issue documents approving registration of training internships contracts for enterprises sending Vietnamese workers abroad for training, skill enhancement overseas within their jurisdiction; receive annual regular reports from domestic enterprises sending Vietnamese workers abroad for training, skill enhancement; request immediate reports from such enterprises according to regulations;
đ) Receive notifications from service companies dispatching Vietnamese workers abroad under contract regarding the fulfillment of conditions for sending Vietnamese workers abroad for household work in foreign countries;
e) Receive and advise, submit proposals for the People's Committee at the provincial level to issue documents requesting banks to accept security deposits for enterprises sending Vietnamese workers abroad for training, skill enhancement within their jurisdiction;
g) Provide information on policies and laws related to Vietnamese workers working abroad under contract to Vietnamese workers working abroad according to direct labor contracts;
h) Provide information on the labor market, recruitment needs of employers so that returning Vietnamese workers can choose suitable employment after completing their overseas contracts based on knowledge, skills, experience, and occupational proficiency gained during their time abroad;
i) Support returned workers in accessing voluntary social counseling services to facilitate reintegration into society.

8. Amend and supplement point a of paragraph 20 as follows:
"a) Guide and organize the implementation of legal provisions on social insurance, expanding coverage for mandatory and voluntary social insurance, late payment of mandatory social insurance contributions, and evasion of mandatory social insurance contributions within the province’s jurisdiction according to legal provisions and instructions;
9. Amend and supplement points a and e of paragraph 21 as follows:
"a) Advise and assist the People's Committee at the provincial level in managing state affairs related to occupational safety, health; working hours, rest periods;" "e) Take charge, coordinate investigations into fatal workplace accidents involving two or more workers; re-investigate workplace accident cases; cooperate with the health sector in investigating occupational diseases as requested by social insurance agencies according to legal provisions;"
10. Amend and supplement paragraph 22 as follows:
a) Guide and organize the implementation of legal provisions concerning veterans and their dependents;
b) Advise and implement planning, management of facilities for veteran care, memorial sites for martyrs within the province’s jurisdiction;
c) Advise and implement reception, burial, identification of remains of martyrs according to assigned tasks and levels of authority;
d) Manage subjects, files, data on subjects, funding for implementing preferential policies and benefits for veterans and their dependents in accordance with regulations and instructions from competent authorities;
đ) Guide and organize "Repaying Debts of Gratitude" campaigns; manage and utilize the provincial Fund of Repaying Debts of Gratitude;
e) Advise and assist the People's Committee at the provincial level in guiding, inspecting, reporting on the implementation of preferential policies for veterans at the local level to the Ministry of Home Affairs.

11. Amend and supplement paragraph 26 as follows:
"26. Carry out international cooperation and integration in the field of management according to instructions or delegation from the People's Committee at the provincial level."

12. Amend and supplement paragraph 30 as follows:
"30. Conduct industry-specific inspections for organizations and individuals regarding compliance with legal provisions; perform tasks related to handling complaints and reports according to regulations and instructions from competent authorities; receive visitors, prevent corruption, waste, and malpractice within the scope of management."

Article 2. Amendment and Supplement to Certain Points and Clauses of Article 4

1. Amend and supplement point c of clause 5 as follows:
"c) To compile, adjust the position of employment and the ratio of civil servants assigned according to the positions of people's committee at the commune level, specialized agencies, administrative organizations under the people's committee at the commune level in accordance with legal provisions and decentralization and delegation by the people's committee at the provincial level."

2. Amend and supplement point c of clause 8 as follows:
"c) To take the lead and coordinate with relevant agencies and units in implementing administrative reform work in the locality across six fields: Reform of institutional mechanisms; reform of administrative procedures; reform of organizational structure; reform of civil service system; reform of public finance; development and promotion of e-government, digital government."

3. Amend and supplement clause 14 as follows:
"14. To advise the people's committee at the commune level in implementing regulatory documents, business guidelines, plans, projects, technical standards, economic and technical standards for document management within its jurisdiction."

4. Supplement points d, e, g of clause 19 as follows:
"d) To advise the people's committee at the commune level, chairman of the people's committee at the commune level on the use of persons under 13 years old for work in accordance with provisions of Article 145, Paragraph 3, Labor Code, where such use is authorized by a specialized agency concerning internal affairs of the provincial people's committee according to legal provisions;
e) To organize implementation of labor dispute resolution regulations as provided by law;
g) To advise the people's committee at the commune level, chairman of the people's committee at the commune level on implementing regulations related to strikes in accordance with legal provisions."

5. Amend and supplement point c of clause 23 as follows:
"c) To examine and promptly handle and respond to complaints, accusations, and suggestions from citizens, suggestions from the People's Supervisory Committee at the commune level, community investment supervisory board, Vietnam Fatherland Front and local political-legal organizations according to legal provisions."

6. Amend and supplement clause 25 as follows:
"25. To apply scientific and technological advancements; build an information system, innovate and transform, and promote digital transformation for document management in support of government administration and professional business operations at the specialized agency level; to operate and utilize local data systems in the field of internal affairs. To provide information, publicity, guidance, dissemination, education, and monitoring of legal implementation in areas under state administrative authority."

7. Amend and supplement clause 27 as follows:
"27. To inspect by sector or field assigned to ensure compliance with legal provisions by organizations and individuals; to cooperate in resolving complaints and accusations; to prevent and combat corruption and waste according to legal provisions and assignments from the people's committee at the commune level, chairman of the people's committee at the commune level."

8. Supplement clause 32 as follows:
"32. In cases where administrative units at the commune level do not establish specialized departments, civil servants assigned to such departments shall advise and assist the people's committee at the commune level in managing state affairs related to internal affairs according to the guidance provided by this Circular."

Article 3. Provisions for Implementation

1. In case provisions of law concerning responsibilities, powers, functions, duties, and authorities of people's committees and chairmen of people's committees at all levels in the field of internal affairs change after the issuance of this Circular, the functions, duties, and authorities of specialized agencies assisting the people's committees at all levels shall be carried out according to provisions by competent authorities.

2. This Circular takes effect from June 15, 2026.

3. People's Committees at provincial level and chairmen thereof are responsible for directing and organizing the implementation of this Circular. During its implementation, if any difficulties arise or further supplements or amendments are needed, please report to the Ministry of Home Affairs for consideration and resolution according to authority.
