CIRCULAR

Guidelines on the functions, tasks, and authorities of the Department of Home Affairs
under the People's Committee of provinces and centrally governed cities
and the internal affairs sector of specialized departments under the People's Committee of communes, wards, and special administrative-economic zones within provinces and centrally governed cities

Pursuant to the Government Decree No. 25/2025/NĐ-CP dated February 21, 2025 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decree No. 150/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the organization of specialized agencies under the People's Committees of provinces and centrally governed cities and the People's Committees of communes, wards, and special administrative-economic zones within provinces and centrally governed cities;

The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.

The Minister of Home Affairs issues this Circular guiding the functions, tasks, and authorities of the Department of Home Affairs under the People's Committees of provinces and centrally governed cities and the internal affairs sector of specialized departments under the People's Committees of communes, wards, and special administrative-economic zones within provinces and centrally governed cities.

PART I

Form 3. Application for issuance of the Archival Profession Practice Certificate

Article 1. Position and Functions

1. The Department of Home Affairs is a specialized agency under the People's Committee of provinces and centrally governed cities (hereinafter referred to collectively as provincial level), performing the function of advising and assisting the People's Committee at the provincial level in state management over: Administrative organization, public service organizations; local administration, administrative boundaries; civil servants, public officials, and civil service; administrative reform; associations, social funds, charitable funds, non-governmental organizations; commendation and reward; state archives; youth; labor, wages; employment; social insurance; occupational safety and health; persons with meritorious services; gender equality; and other tasks, powers, and responsibilities assigned, delegated, or authorized by the People's Committee at the provincial level and the Chairman of the People's Committee at the provincial level in accordance with the law.

2. The Department of Home Affairs has legal personality, its own seal and separate account in accordance with the law; it complies with the directives and management of the People's Committee at the provincial level; at the same time, it complies with the directives, guidance, and supervision regarding professional matters from the Ministry of Home Affairs.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Submit to the provincial People's Committee:

a) Draft resolutions of the Provincial People's Council, draft decisions of the People's Committee at the provincial level related to the industry and field under the management of the Department of Home Affairs and other documents as assigned by the People's Committee at the provincial level in accordance with the law;

b) Draft plans for industry and field development; programs and measures to organize the implementation of tasks in the industry and field within the province under the management of the Department of Home Affairs;

c) Draft decisions on the delegation of tasks and powers in state management of the industry and field to the Department of Home Affairs, specialized agencies, and other administrative organizations under the People's Committee at the provincial level, commune-level People's Committees, and ward-level People's Committees (hereinafter referred to collectively as commune level); and the delegation of tasks and powers to public service units under continuous and regular management by the People's Committee at the provincial level in accordance with the law;

d) Draft decisions specifying the functions, tasks, powers, and organizational structure of the Department of Home Affairs; draft decisions specifying the functions, tasks, powers, and organizational structure of district-level agencies and equivalent organizations under the Department of Home Affairs (if any);

đ) Draft decisions specifying the functions, tasks, powers, and organizational structure of public service units directly under the Department of Home Affairs (except where otherwise provided by specific laws);

e) Draft decisions implementing the socialization of activities providing public services in the industry and field within the authority of the People's Committee at the provincial level and according to the delegation of competent authorities.

2. Submitting draft documents within the authority to issue by the Chairman of the People's Committee of the provincial level as assigned.

3. Implementing regulatory legal documents, planning, programs, projects, and schemes approved by competent authorities; disseminating information, promoting, guiding, popularizing, educating, monitoring, and enforcing laws in fields under the state management authority of the Department of Home Affairs.

4. On organizational structure:

a) Advising and assisting the People's Committee at the provincial level:

Submitting to the Provincial People's Council for decision on the establishment, reorganization, renaming, and dissolution of specialized agencies and other administrative organizations under the People's Committee at the provincial level in accordance with the law;

Providing detailed guidance on procedures and formalities for the establishment, reorganization, and dissolution of public service units under the People's Committee at the provincial level;

Leading and guiding the commune-level People's Committees to specify the functions, tasks, and powers of the Internal Affairs sector of the Culture-Society Departments under the commune-level People's Committees;

Directing agencies, organizations, and units to manage non-public service units on the territory in accordance with the law.

b) Reviewing draft documents:

Specifying the functions, tasks, powers, and organizational structures of administrative agencies and public service units under the decision-making authority of the People's Committee at the provincial level and the Chairman of the People's Committee at the provincial level; ensuring the performance of internal affairs management tasks within the functions, tasks, powers, and organizational structures of administrative agencies at the provincial and commune levels;

Establishing, reorganizing, and dissolving administrative organizations, public service units, and management boards in public service units under the decision-making authority of the People's Committee at the provincial level (except where otherwise provided by specific laws);

Establishing, improving, merging, and dissolving inter-agency coordination bodies under the decision-making authority of the People's Committee at the provincial level and the Chairman of the People's Committee at the provincial level in accordance with the law.

c) Reviewing, guiding, monitoring, and inspecting the implementation of classification and ranking of public service units in accordance with the law and regulations of the People's Committee at the provincial level and the Chairman of the People's Committee at the provincial level.

5. On job positions and civil servant quotas:

a) Advising and assisting the People's Committee at the provincial level in deciding and managing job positions and civil servant quotas in accordance with the division of labor and delegation of authority and the provisions of the Party and the law;

b) Advising and assisting the People's Committee at the provincial level:

Reviewing, compiling, and preparing annual or phased civil servant quota plans; adjusting civil servant quotas of agencies and organizations of the Provincial People's Council, Provincial People's Committee, and commune-level People's Committees and submitting them to the Ministry of Home Affairs in accordance with the law;

Submit to the Provincial People's Council for decision on the quota of civil servants of the organs and organizations of the People's Council, People's Committee at provincial and communal levels within the total quota of civil servants assigned by the competent authority; assist the Provincial People's Committee in implementing after being decided by the Provincial People's Council; submit to the Provincial People's Council the number of labor contracts for professional work at public service units in the locality according to regulations;

c) Compile job positions and civil servant ranks corresponding to the organs and organizations of the People's Council, People's Committee at provincial and communal levels; submit to the Provincial People's Committee for sending to the Ministry of Home Affairs as prescribed by law.

6. On job positions, the structure of public service personnel by occupational titles, and the number of staff working in public service units:

a) Review the proposal on job positions, the adjusted proposal on job positions and the structure of public service personnel by occupational titles of self-financing public service units partially funded from the state budget and public service units fully funded from the state budget under the management of the Provincial People's Committee; submit to the Provincial People's Committee for approval of job positions and the structure of public service personnel by occupational titles of public service units not yet self-financing under its management;

b) Advising and assisting the People's Committee at the provincial level:

Review the number of staff working with state budget salaries and the number of staff working with income from public services (if any) of public service units not yet self-financing under the management of the Provincial People's Committee; compile and submit to the Provincial People's Committee the plan on the number of staff working in public service units not yet self-financing in the locality to be sent to the Ministry of Home Affairs for review;

Submit to the Provincial People's Council for approval the number of staff working with state budget salaries in self-financing public service units partially funded from the state budget and public service units fully funded from the state budget under its management within the total number of staff working with state budget salaries already reviewed by the Ministry of Home Affairs;

Decide on allocating and adjusting the number of staff working with state budget salaries for each public service unit not yet self-financing under its management within the total number of staff approved by the Provincial People's Council as prescribed;

Decide on the number of staff working with income from public services for each self-financing public service unit partially funded from the state budget under its management as prescribed by law;

Guide and inspect the implementation of regulations on job positions, the structure of public service personnel by occupational titles, and the number of staff working in self-financing public service units, self-financing public service units and those financing both regular expenses and investments under its management; the number of staff signing labor contracts for professional work at public service units in the locality;

Direct agencies, organizations, and units to implement the mechanism of autonomy in performing tasks, organizational structures, job positions, and the number of staff working for public service units under its management;

c) Compile job positions, the structure of public service personnel by occupational titles, and the number of staff working in public service units based on the degree of financial autonomy (fully funded from the state budget; partially funded from the state budget; self-financing; self-financing and investment funding) under its management, submit to the Provincial People's Committee for reporting to the Ministry of Home Affairs as prescribed by law;

7. On salary systems, allowances, and bonuses for cadres, civil servants, public service personnel, and contractual workers in administrative organs, organizations, and public service units:

a) Decide according to the level of authority or submit to the Chairman of the Provincial People's Committee for decision on increasing regular pay grades, early increases in pay grades, and other systems and policies regarding salaries, allowances, bonuses, and other policies as prescribed by law and by the Provincial People's Committee;

b) Guide, inspect, resolve within the scope of authority or propose the competent authority to resolve difficulties in implementing salary systems, allowances, and bonuses for cadres, civil servants, public service personnel, and contractual workers in administrative organs, organizations, and public service units of the locality as prescribed by law and by the Provincial People's Committee;

8. On administrative reform:

a) Advise and submit to the Provincial People's Committee for decision on assigning specialized agencies under the Provincial People's Committee to take the lead or cooperate in implementing the contents and tasks of administrative reform work;

b) Advise and submit to the Provincial People's Committee, the Chairman of the Provincial People's Committee:

Direct and implement programs, plans, and other documents from higher-level agencies on administrative reform;

Decide on measures to promote administrative reform according to programs, proposals, and plans already approved by the competent authority;

c) Advise and assist the Provincial People's Committee:

Implement the identification and scoring of administrative reform indices; measure the satisfaction of citizens with the services provided by state administrative agencies annually in the province according to regulations and guidelines issued by the Ministry of Home Affairs based on requirements of administrative reform at different stages;

Monitor, inspect, evaluate, and compile results of the implementation of administrative reform tasks by agencies, organizations, and units under the management of the Provincial People's Committee;

d) Chair and coordinate with specialized agencies under the provincial People's Committee in organizing and implementing the content of organizational restructuring; civil service system; labor, salary; social insurance; employment; occupational safety and health; persons with meritorious service; youth; gender equality; state archival management; commendation and reward; and information dissemination and propaganda on administrative reform.

9. On local administration:

a) Advise and assist the Standing Committee of the Provincial People's Council and the Provincial People's Committee in implementing election work for National Assembly deputies and People's Council deputies at all levels within the province in accordance with the law and guidance from higher-level agencies;

b) Advise and assist the Chairman of the Provincial People's Council and the Chairman of the Provincial People's Committee in presenting to the Provincial People's Council for approval the election, removal, and dismissal of the Chairman, Vice Chairmen, and members of the Provincial People's Committee in accordance with the law;

c) Complete the dossier to be reported to the Standing Committee of the Provincial People's Council by the Provincial People's Committee for submission to the Ministry of Home Affairs for review and then to the Prime Minister for decision on approving the results of the election of the Chairman and Vice Chairmen of the Provincial People's Committee; and transfer the authority of the Chairman of the Provincial People's Committee in accordance with the law;

d) Review and present to the Chairman of the Provincial People's Committee for approval of the results of the election, removal, and dismissal of the Chairman and Vice Chairmen of the Commune People's Committee; transfer and remove the positions of the Chairman and Vice Chairmen of the Commune People's Committee; and transfer the authority of the Chairman of the Commune People's Committee in accordance with the law;

đ) Advise and assist the Chairman of the Provincial People's Committee in deciding on the appointment, removal, transfer, and removal of heads and deputy heads of specialized agencies, other administrative organizations, and public service units under the Provincial People's Committee; and temporarily suspend the duties of the Vice Chairmen of the Provincial People's Committee, heads of specialized agencies, other administrative organizations, and public service units under the Provincial People's Committee, and the Chairman of the Commune People's Committee in accordance with the law and the division of management of cadres;

e) Advise and assist the Provincial People's Committee and the Chairman of the Provincial People's Committee in guiding and inspecting the organization and activities of the Commune People's Committee; advise and assist the Provincial People's Committee in deciding the number of Vice Chairmen of the Commune People's Committee within the framework set by the Government;

g) Advise and assist the Provincial People's Committee and the Chairman of the Provincial People's Committee in managing villages and residential wards according to the law;

10. On administrative unit boundaries and classification of administrative units:

Advise and assist the Provincial People's Committee and the Chairman of the Provincial People's Committee:

a) Implement boundary management work, files, markers, and maps of administrative unit boundaries at various levels within the province in accordance with the law and guidance from competent state agencies;

b) Prepare project files and submit them to the Provincial People's Committee for presentation to the same-level People's Council for consideration, complete the files, and send them to the Ministry of Home Affairs for organization of review and submission to the competent authority for examination and decision on projects for establishment, dissolution, merger, division, adjustment of boundaries, renaming of administrative units, and resolution of inconsistencies in provincial and commune administrative unit boundaries; classification of provincial administrative units; recognition of safe zones;

c) Review and present to the Chairman of the Provincial People's Committee for decision on recognizing island communes and safe zone communes; classification of commune administrative units;

d) Implement and carry out related projects and documents concerning administrative unit boundaries, files, markers, and maps of administrative unit boundaries after receiving decisions from competent authorities;

11. On cadres, civil servants, public officials, and non-professional staff:

a) Advise and assist the Provincial People's Committee in implementing recruitment, utilization, and management of cadres, civil servants, public officials, except where otherwise provided by specific laws; management of individuals holding positions and representatives of state capital in enterprises under the management authority of the Provincial People's Committee; and non-professional staff in accordance with the Party's regulations, the law, and the regulations of the Provincial People's Council and the Provincial People's Committee;

b) Advise and present to the Provincial People's Committee regulations on standards for leadership and management positions within its management scope in accordance with the law and the delegation of the Party agency with authority;

Other contents related to cadres, civil servants, public officials, and non-professional staff shall be implemented in accordance with the law and the competent authority;

12. On training and capacity building for cadres, civil servants, and public officials:

a) Advise and present to the Provincial People's Committee:

Issuance of plans for training and capacity building for cadres, civil servants, and public officials within its management scope and organize implementation after approval by the Provincial People's Committee;

Implement training and capacity building for cadres, civil servants, and other specified groups in accordance with the Party's regulations, the law, and the regulations of the Provincial People's Committee;

b) Implement capacity building and training according to job requirements in the assigned sectors and fields for civil servants, public officials, and those working in these sectors and fields;

c) Coordinate with relevant agencies and units to present to the Provincial People's Committee for decision on budget allocation for local training and capacity building activities for cadres, civil servants, and public officials in accordance with the law;

d) Summarize the results of training and capacity building for cadres, civil servants, and public officials and submit them to the Ministry of Home Affairs and other competent agencies as prescribed;

13. On associations, social funds, charitable funds, and non-governmental organizations:

a) Advise and assist the Provincial People's Committee and the Chairman of the Provincial People's Committee in state management of associations, social funds, charitable funds, and non-governmental organizations in accordance with the law on associations, social funds, charitable funds, and non-governmental organizations and related laws;

b) Advise on Red Cross activities in the locality in accordance with the law;

14. On state archival management:

a) Advise and submit to the Provincial People's Committee for issuance of the list of state agencies and organizations not falling under the cases stipulated in Clause 2, Article 18 of the Law on Archives to submit files and documents to the national historical archives at the provincial level within their authority;

b) Advise and submit to the Chairman of the Provincial People's Committee for decision to destroy archival materials at the national historical archives at the provincial level; decide on taking archival materials at the national historical archives at the provincial level out of the country; approve the list of archival materials with conditional access at the national historical archives at the provincial level; recognize and revoke recognition of archival materials of special value for private archival materials and archival materials of agencies and organizations under the management area, except for cases within the authority of the Minister of Home Affairs;

c) Advise and assist the Provincial People's Committee in managing archival materials at the national historical archives at the provincial level; archival material database within their management authority; build and update the local archival material database; update the archival material database of the National Archive of Vietnam according to the management authority;

d) Advise and assist the Provincial People's Committee in issuing Certificates of Eligibility for Business in Storage Services;

đ) Advise the Provincial People's Committee on organizing the national historical archives at the provincial level; direct the national historical archives at the provincial level to implement tasks assigned according to the law;

15. On youth and gender equality:

a) Organize the implementation of policies, laws, strategies, programs, plans, projects, and proposals for youth development at the local level; gender equality and women cadres work; Month of Action for Gender Equality and Prevention and Response to Gender-Based Violence;

b) Implement or guide the integration of youth development indicators and targets; gender equality issues and prevention and response to gender-based violence when building annual and phased socio-economic development programs of the locality;

c) Take the lead or coordinate with relevant agencies and organizations in resolving inter-sectoral issues related to youth and youth work; gender equality and prevention and response to gender-based violence;

d) Carry out statistical work, manage, exploit, and publish statistical data on youth; guide and organize the collection, compilation, and periodic reporting of statistical data on gender equality and prevention and response to gender-based violence, national gender statistics, and women cadre work from the locality;

đ) Supervise, inspect, and evaluate the implementation of regulations, policies, and laws concerning youth and youth work; gender equality and prevention and response to gender-based violence in the jurisdiction;

e) Guide specialized agencies of the Provincial People's Committee, Commune People's Committees, and relevant agencies in the jurisdiction to perform state management tasks on youth and gender equality according to specific fields;

16. On competition and rewards:

a) Advise and submit to the Chairman of the Provincial People's Committee for issuance of plans and organization of implementation of the propaganda of President Ho Chi Minh's thoughts on patriotic emulation, Party guidelines, State policies, and laws on competition and rewards; propaganda, promotion of exemplary models, good people and deeds, selection of collectives and individuals with outstanding achievements in emulation movements for timely commendation and reward;

b) Advise and assist the Provincial People's Committee, the Chairman of the Provincial People's Committee, and the Provincial Competition and Reward Council in organizing emulation movements; guide and inspect agencies, organizations, and units under the management of the locality to implement emulation movements and Party guidelines, State policies, and laws on competition and rewards;

c) Review reward proposal files of agencies, organizations, and units under the management of the locality, submit to the Chairman of the Provincial People's Committee for reward decisions within their authority or propose rewards to competent authorities according to the law;

d) Advise and assist the Provincial People's Committee in implementing the awarding and receiving of competition titles and reward forms; manage, issue, recover, replace, and reissue reward items according to the law;

đ) Build and manage the database on competition and rewards; build, manage, and use the Competition and Reward Fund according to the law and the regulations of the Provincial People's Committee;

e) Perform the standing duties of the Provincial Competition and Reward Council;

17. On employment sector:

a) Organize the implementation of long-term and annual strategies, programs, plans, projects, and proposals on employment, job creation support, labor market development, employment services, unemployment insurance, recruitment, and labor management in Vietnam according to the guidance of competent authorities; collect, store, compile, analyze, forecast, disseminate, and manage information on the local labor market;

b) Guide and implement job creation support policies and unemployment insurance policies according to the law;

c) Guide and organize the implementation of laws on employment services at the local level;

d) Implement approval of foreign labor demand; confirm non-permit labor category; issue, reissue, extend, and recover work permits for foreign workers working in Vietnam according to labor laws;

đ) Implement state management over foreign workers working in Vietnam within the management scope of the locality;

18. On Vietnamese workers going to work abroad under contracts:

a) Receive and issue approval documents for preparing labor sources for service enterprises within the management authority;

b) Receive reports and respond in writing to enterprises that have won bids or taken on projects abroad within the management authority;

c) Receive reports after enterprises complete overseas bidding contracts; request enterprises undertaking construction projects and programs abroad to submit ad hoc reports as prescribed;

d) Receive reports and respond in writing to organizations and individuals investing abroad according to the provisions of the law;

đ) Receive and respond in writing to enterprises implementing registration for sending Vietnamese workers abroad for training, skill enhancement, and vocational improvement for a period of ninety days or more within their jurisdictional management authority;

e) Issue documents approving registration for services sending Vietnamese workers abroad for domestic work;

g) Receive lists and confirm lists of Vietnamese workers going abroad for domestic work;

h) Issue documents requesting banks holding performance bonds to refund the bond money to enterprises (for vocational training contracts with a duration of ninety days or more) within their jurisdictional management authority;

i) Provide information on policies and laws regarding Vietnamese workers working abroad under contracts directly concluded with employers to Vietnamese workers working abroad under labor contracts;

k) Provide information on the labor market and recruitment needs of employers for workers returning to Vietnam after completing their contracts abroad to choose suitable employment opportunities based on their accumulated knowledge, skills, experience, and occupational qualifications obtained during their time working abroad;

l) Support workers returning to Vietnam to access voluntary social psychological counseling services to facilitate their reintegration into society;

Advise and present to the Provincial People's Committee:

19. In the field of labor and wages:

a) Guide and organize the implementation of legal regulations concerning labor contracts, labor discipline, material responsibility, workplace dialogue, collective bargaining, collective labor agreements, resolution of labor disputes and strikes, and systems for workers in enterprise restructuring, organization, sale, lease, conversion, transfer of ownership rights, and use rights of assets of enterprises and cooperatives; liquidation and bankruptcy of enterprises; in the reorganization, renovation, and improvement of state-owned enterprise operations;

b) Guide the implementation of legal regulations concerning wage systems in production and business sectors;

c) Guide the implementation of legal regulations concerning female workers and gender equality, senior workers, disabled workers, juvenile workers, domestic workers, and other specific categories of workers;

d) Guide and organize the implementation of legal regulations concerning labor leasing at the local level;

đ) Guide and organize the implementation of legal regulations concerning the registration and state management of trade unions and their activities in enterprises according to the law and as assigned or delegated by the Provincial People's Committee;

20. In the field of social insurance:

a) Guide and organize the implementation of legal regulations concerning social insurance within the local area according to the law and as assigned or delegated by the Provincial People's Committee;

b) Advise the Provincial People's Committee to propose solutions (if any) to relevant ministries and sectors to resolve issues related to social insurance within their jurisdiction;

c) Accept applications and determine the number of workers temporarily suspended from mandatory social insurance contributions due to temporary layoffs for agencies, units, organizations, and enterprises managed by the Provincial People's Committee;

d) Coordinate with social insurance agencies and relevant agencies to implement and organize the promotion of social insurance in the locality;

21. In the field of occupational safety and health:

a) Assist the Provincial People's Committee in managing occupational safety and health;

b) Guide and organize the implementation of legal regulations concerning occupational safety and health, working hours, rest periods, and the month-long campaign for occupational safety and health within the local area;

c) Guide and implement state management over the quality of special products and goods;

d) Accept applications and process administrative procedures concerning occupational safety and health and special products and goods within the delegated authority;

đ) Guide technical safety inspections;

e) Chair and coordinate the investigation of fatal workplace accidents involving two or more workers injured severely; re-investigate workplace accidents and cooperate with the health sector to investigate occupational diseases upon request from the social insurance agency as prescribed by law;

g) Guide the implementation of preventive measures and risk-sharing regarding workplace accidents and occupational diseases in the locality; organize the collection, storage, publication, and evaluation of information on workplace accident situations and serious technical incidents causing occupational safety and health hazards;

h) Accept notifications from enterprises, agencies, organizations, and individuals using labor within the management area about organizing overtime work exceeding 200 hours up to 300 hours in a year;

22. In the field of persons with meritorious service:

a) Guide and organize the implementation of legal regulations concerning persons with meritorious service and their dependents;

b) Implement planning for social care facilities for persons with meritorious service, memorials for martyrs, and graves of martyrs; manage memorials and graves of martyrs within the delegated authority in the locality;

c) Chair and coordinate the reception and burial of martyrs' remains, provide information and notify about martyrs' graves, visit and relocate martyrs' remains according to assigned or delegated authority;

d) Manage beneficiaries, beneficiary files, and funding for policies and preferential systems for persons with meritorious service and their dependents;

đ) Guide and organize campaigns to "repay debts of gratitude"; manage and utilize the "Debt Repayment Fund" at the provincial level.

23. Regarding democratic work and mass mobilization:

a) Advising and organizing the implementation of laws on promoting democracy at the grassroots level within the jurisdiction;

b) Advising on the development and implementation of resolutions of the Provincial People's Council to determine measures ensuring the promotion of democracy at the grassroots level within the jurisdiction;

c) Summarizing and reporting to competent state agencies on the situation of promoting democracy at the grassroots level within the jurisdiction when requested;

d) Advising and implementing mass mobilization work of administrative state agencies and local authorities at all levels in accordance with the regulations of the Party, laws, and guidance from higher-level agencies.

24. Managing enterprises, collective economic organizations, private economic organizations, associations, social funds, charitable funds, and non-governmental organizations within the scope of the industry and field in accordance with the provisions of the law.

25. Coordinating and guiding the implementation of self-management mechanisms for public service units under the management scope in accordance with the provisions of the law; managing the activities of public and non-public service units within the scope of the industry and field.

26. Implementing international cooperation in the industry and field managed and according to the division of labor or delegation of authority by the Provincial People's Committee.

27. Providing professional guidance within the industry and field managed to specialized departments under the People's Committee of the commune.

28. Organizing research, application of scientific and technological progress, innovation, and digital transformation; building information systems and archives serving state administration and professional tasks; operating and exploiting local civil affairs databases in a unified, synchronized, connected, and shared manner.

29. Implementing regular and urgent information and reporting on the implementation of assigned tasks within the scope of state administration to the Provincial People's Committee and the Ministry of Home Affairs.

30. Inspecting organizations and individuals in the execution of legal provisions within the industry and field under their responsibility; receiving citizens, handling complaints, accusations, preventing corruption, waste, and negativity in accordance with the law within the scope of management.

31. Implementing public services in the civil affairs sector within the scope of state administration of the Department of Home Affairs.

32. Specifying the functions, tasks, and powers of the office and specialized professional departments in accordance with the functions, tasks, and powers of the Department of Home Affairs; the working relationship and responsibilities of heads of units subordinate to the Department of Home Affairs in accordance with the law.

33. Managing organizational structures, civil servant quotas, job positions, the ratio of civil servants needed for each job position, the structure of civil servants by occupational titles, and the number of people working in public service units subordinate to the Department of Home Affairs; implementing salary systems and policies, incentives, training, commendation, and disciplinary actions for civil servants, civil employees, and workers within the scope of management in accordance with the law.

34. Managing and being responsible for financial resources and assets allocated in accordance with the law and the regulations of the Provincial People's Committee.

35. Performing duties and powers within the defined scope of authority, decentralization, and delegation in accordance with the law and other regulations of the competent authority. In cases where the Department of Ethnic Minorities and Religion is not established, the Department of Home Affairs shall perform state management functions regarding ethnic minorities and beliefs and religions in accordance with the regulations of the Ministry of Ethnic Minorities and Religion and related laws.

Chapter II
PROVISIONS ON THE FUNCTIONS, TASKS, AND POWERS OF THE SOCIAL CULTURE DEPARTMENT UNDER THE COMMUNE PEOPLE'S COMMITTEE IN THE FIELD OF HOME AFFAIRS

Article 3. Functions

The Social Culture Department advises and assists the Commune People's Committee in performing state management functions in various fields, including home affairs, which include: Administrative organization, public service; local government, administrative unit boundaries; cadres, civil servants, civil employees, and public service; administrative reform; associations, social funds, charitable funds, non-governmental organizations; commendation and reward; national archives; youth; labor, wages; employment; social insurance; labor safety and hygiene; war veterans; gender equality.

Article 4. Tasks and Powers

1. Submit to the People's Committee at the commune level

a) Drafting resolutions of the Commune People's Council and decisions of the Commune People's Committee related to the industry and field under the management of the Department and other documents as assigned by the Commune People's Committee;

b) Drafting plans for industry and field development; programs and measures to organize the implementation of tasks in the industry and field within the commune jurisdiction;

c) Drafting decisions specifying the functions, tasks, powers, and organizational structure of the Department and public service units under the Commune People's Committee in accordance with the law and regulations of the Provincial People's Committee.

2. Submitting to the Chairman of the Commune People's Committee for decision on personnel appointments within the Chairman's authority according to the regulations of the Party and the law.

3. Implementing legal documents, planning, and plans after approval; disseminating, popularizing, and educating the law on areas within the assigned management scope; monitoring the enforcement of the law.

4. On organizational structure:

a) Advising and assisting the Commune People's Committee to submit to the Commune People's Council for decision on establishing, reorganizing, changing names, dissolving specialized agencies, and other administrative organizations under the Commune People's Committee;

b) Reviewing draft documents:

Specifying the functions, tasks, powers, and organization of administrative agencies and public service units under the Commune People's Committee; ensuring the implementation of state management tasks in the field of home affairs relevant to the functions, tasks, powers, and organization of specialized departments under the Commune People's Committee;

Establishing, reorganizing, and dissolving administrative organizations and public service units within the authority to decide of the Commune People's Committee (except where specific laws provide otherwise);

Establishing, improving, merging, and dissolving inter-departmental coordination organizations within the authority to decide of the Chairman of the Commune People's Committee in accordance with the law.

5. On job positions and civil servant quotas:

a) Review the job position plan, the job position adjustment plan of agencies and organizations under the management scope of the People's Committee at the commune level; compile and submit to the People's Committee at the commune level for decision within its authority, or submit to the People's Committee at the province level for decision in accordance with the law and the regulations of the People's Committee at the province level;

b) Advise and assist the People's Committee at the commune level:

Review and submit to the People's Committee at the province level the annual civil servant quota plan or the adjustment of the civil servant quota belonging to the local administrative level at the commune level;

Implement the allocation of civil servant quotas for agencies and organizations under the People's Council at the commune level and the People's Committee at the commune level within the total number of civil servant quotas assigned by the competent authority and according to the分级管理的级别划分由省人民委员会规定;

6. On job positions, the structure of public service personnel by occupational titles, and the number of staff working in public service units:

a) Review the job position plan, the job position adjustment plan, and the structure of staff by occupational title of public service units that have not self-assured regular expenses within the management scope of the People's Committee at the commune level; submit to the People's Committee at the commune level for approval within its authority, or submit to the People's Committee at the province level for approval and adjustment of job positions and the structure of staff by occupational title of public service units that have not self-assured regular expenses within the management scope;

b) Advise and assist the People's Committee at the commune level:

Review and submit to the People's Committee at the province level the plan on the number of employees of public service units that have not self-assured regular expenses within the management scope;

Decide on the allocation and adjustment of the number of employees receiving state budget salaries for public service units that have not self-assured regular expenses, and the number of employees receiving salaries from business income for each public service unit that partially self-assures regular expenses within the management scope after being assigned by the competent authority and according to the分级管理的规定;

c) Compile job positions, the structure of staff by occupational title, and the number of employees in public service units based on the degree of financial autonomy (fully guaranteed by the state budget for regular expenses; partially guaranteed for regular expenses; self-assured for regular expenses; self-assured for regular expenses and investment costs) within the management scope of the locality, and submit to the People's Committee at the commune level for submission to the Department of Home Affairs in accordance with the law;

7. On salary systems, allowances, and bonuses for cadres, civil servants, public service personnel, and contractual workers in administrative organs, organizations, and public service units:

a) Advise and submit to the Chairman of the People's Committee at the commune level for decision within his authority, or propose the competent authority to decide on the regular salary increment, early salary increment, and implementation of wage policies and allowances for cadres, civil servants, staff, and contractual workers in accordance with the law and the regulations of the People's Committee at the province level;

b) Guide, inspect, resolve within his authority, or propose the competent authority to resolve difficulties in implementing wage policies and allowances for cadres, civil servants, staff, and contractual workers in administrative agencies and public service units within the jurisdiction in accordance with the law and local regulations;

8. On administrative reform:

a) Advise and submit to the People's Committee at the commune level:

Decide on the assignment of specialized agencies under the People's Committee at the commune level to take the lead or cooperate in implementing the contents and tasks of administrative reform;

Decide on measures to promote administrative reform within the jurisdiction;

b) Advise and assist the People's Committee at the commune level in supervising and inspecting specialized agencies at the same level in implementing administrative reform within the jurisdiction;

9. On local administration:

a) Advise and assist the Standing Body of the People's Council at the commune level and the People's Committee at the commune level in implementing election work for National Assembly deputies and deputies of all levels of People's Councils within the jurisdiction in accordance with the law and guidance from higher-level authorities;

b) Advise and assist the Standing Body of the People's Council, the Chairman of the People's Council, and the Chairman of the People's Committee at the commune level to submit to the People's Council at the commune level for the election, removal, and dismissal of the Chairperson, Vice-Chairpersons, and Heads of Committees of the People's Council at the commune level, and the Chairperson, Vice-Chairpersons, and members of the People's Committee at the commune level; approve the list and the resignation of Deputy Heads and members of Committees of the People's Council at the commune level in accordance with the law;

c) Advise and assist the Standing Body of the People's Council at the commune level to submit to the Standing Body of the People's Council at the province level for approval of the results of the election, removal, and dismissal of the Chairperson and Vice-Chairpersons of the People's Council at the commune level;

d) Advise and assist the Standing Body of the People's Council at the commune level to submit to the Chairman of the People's Committee at the province level for approval of the results of the election, removal, and dismissal of the Chairperson and Vice-Chairpersons of the People's Committee at the commune level; assign the right to act as the Chairperson of the People's Committee at the commune level in accordance with the law;

đ) Advise and assist the People's Committee at the commune level to submit to the People's Council at the commune level for decision on the establishment, reorganization, dissolution, renaming, and changing the name of villages and residential wards in accordance with the law; specifically decide on the number of non-professional personnel working in the jurisdiction who receive allowances from the state budget in accordance with the regulations of the provincial local government;

e) Advise and assist the People's Committee at the commune level and the Chairman of the People's Committee at the commune level to guide and inspect the organization and activities of villages and residential wards in accordance with the law and the分级管理的规定;

10. On administrative unit boundaries:

Advise and assist the People's Committee, the Chairman of the People's Committee at the commune level:

a) Submit to the competent authority for consideration and decision on the plan for establishing, dissolving, merging, dividing administrative units, adjusting boundaries, renaming administrative units at the commune level, and resolving cases of inconsistency in administrative unit boundaries at the commune level; recognition of classification of administrative units at the commune level; recognition of island communes and safe area communes;

b) Manage the boundary files and maps of administrative units at the commune level; national, provincial, and commune-level boundary markers in the locality in accordance with the law and guidance from higher-level state agencies;

c) Implement related plans and documents concerning administrative unit boundaries, boundary files, and maps of administrative units in accordance with the law after being decided by the competent authority.

11. On cadres, civil servants, public officials, and non-professional staff:

Advise and assist the Chairman of the People's Committee at the commune level to decide on the recruitment of civil servants according to the分级和授权;决定规划、任命、重新任命、调动、轮换、借调;免除职务;辞职、免职、对机关专业人员、行政组织和其他单位的负责人进行纪律处分;决定暂时停职副乡级人民委员会主席、机关专业人员、行政组织和其他单位的负责人;决定使用、分配、安排、检查、评估、暂时停职;培训、提升、表彰奖励;实施工资制度、终止工作、退休以及属于乡级人民委员会管理权限的其他制度和政策。

12. Implement training and capacity building for cadres, civil servants, public officials, and other subjects in accordance with laws and regulations of the provincial People's Committee.

13. On associations, social funds, charitable funds, and non-governmental organizations:

Advise and assist the People's Committee at the commune level, the Chairman of the People's Committee at the commune level to manage state affairs regarding associations, social funds, charitable funds, non-governmental organizations, and Red Cross activities according to the regulations on associations, social funds, charitable funds, non-governmental organizations, and relevant laws.

Advise and assist the People's Committee at the commune level:

15. On youth and gender equality:

a) Organize the implementation of policies, laws, strategies, programs, plans, projects, and proposals for youth development at the local level; gender equality and women cadres work; Month of Action for Gender Equality and Prevention and Response to Gender-Based Violence;

b) Implement the integration of youth development indicators and targets; gender equality issues and prevention and response to gender-based violence when drafting annual and phased socio-economic development programs of the locality;

c) Take the lead or coordinate with relevant agencies and organizations in resolving inter-sectoral issues related to youth and youth work; gender equality and prevention and response to gender-based violence;

d) Implement statistical work, management, exploitation, and publication of statistical data on youth, youth development indices in the locality; organize the implementation of regular collection, compilation, and reporting of statistical data on the locality regarding gender equality and prevention and response to gender-based violence, national gender statistics, and female cadre work;

đ) Inspect and evaluate the implementation of regulations, policies, and laws concerning youth and youth work; gender equality and prevention and response to gender-based violence in the locality.

16. On competition and rewards:

a) Advise and assist the People's Committee at the commune level, the Chairman of the People's Committee at the commune level to organize mass movements and implement the Party's policies and State laws on commendation and reward in the locality; identify and promote exemplary models in mass movements in a timely manner;

b) Review files for commendation proposals from collectives and individuals in the locality, submit to the Chairman of the People's Committee at the commune level for decision on commendation or propose to competent authorities for decision on commendation in accordance with the law; advise and assist the People's Committee at the commune level to organize the implementation of awarding and receiving commendation titles and forms of reward;

c) Guide and inspect the implementation of plans and contents of commendation and reward in the locality; build, manage, and use the Commendation and Reward Fund in accordance with the law;

d) Serve as the standing body of the Commendation and Reward Council at the commune level.

17. On employment sector:

a) Organize the implementation of long-term and annual strategies, programs, plans, projects, and proposals on employment, job creation support, labor market development, employment services, unemployment insurance, recruitment, and labor management in Vietnam according to the guidance of competent authorities; collect, store, compile, analyze, forecast, disseminate, and manage information on the local labor market;

b) Guide and implement job creation support policies and unemployment insurance policies according to the law;

c) Guide and organize the implementation of legal provisions on employment services in the locality.

18. On Vietnamese workers going to work abroad under contracts:

a) Provide information on policies and laws regarding Vietnamese workers going abroad under contracts directly concluded with foreign employers;

b) Provide information on the labor market and recruitment needs of employers to enable Vietnamese workers returning from abroad to choose suitable jobs based on their knowledge, skills, experience, and occupational qualifications accumulated during their time working abroad;

c) Support Vietnamese workers returning home to access voluntary social psychological counseling services to facilitate their reintegration into society;

d) Advise and submit to the People's Committee at the commune level where the worker resides to sign a document confirming the registration of the labor contract in accordance with Clause 3, Article 50 of the Law on Vietnamese Workers Going Abroad Under Contracts 2020.

20. In the field of social insurance:

a) Guide and organize the implementation of legal provisions on social insurance within the locality in accordance with the law;

b) Receive applications and determine the number of employees temporarily not working who are required to participate in mandatory social insurance for agencies, units, organizations, and enterprises under the People's Committee at the commune level that request a temporary suspension of contributions to the pension and death benefit fund.

21. In the field of occupational safety and health:

a) Guide and organize the implementation of legal provisions on occupational safety and health; working hours and rest periods within the locality; Month of Action on Occupational Safety and Health;

b) Take the lead and coordinate to investigate serious workplace accidents involving one injured worker, minor workplace accidents involving workers participating in voluntary workplace accident insurance in the locality; record the incident in a report for serious workplace accidents involving workers not employed under a labor contract;

c) Receive and handle serious technical incidents causing occupational safety and health hazards in the locality;

d) Advise and assist the People's Committee at the commune level in managing state affairs in the field of occupational safety and health.

22. In the field of persons with meritorious service:

a) Manage memorials and graves of martyrs in the locality according to the分级;

b) Coordinate with departments and mass organizations to build a movement of the whole people caring for and assisting those who have made contributions to the revolution and social policy beneficiaries;

c) Guide and organize the implementation of legal provisions concerning those who have made contributions to the revolution and their dependents in the locality according to the分级;

d) Manage beneficiaries, beneficiary files, and funding for implementing preferential policies and benefits for those who have made contributions to the revolution and their dependents in the locality according to the分级;

23. Regarding democratic work and mass mobilization:

a) Advise and implement the enforcement of laws on grassroots democracy; maintain close ties with the people and community in the commune-level area;

b) Advise on the development and implementation of resolutions by the People's Council to decide on measures to ensure democracy at the grassroots level within the commune area;

d) Aggregate and report to competent state agencies on the situation of grassroots democracy within the commune area when requested; promptly report to higher-level state agencies on issues not within their jurisdiction;

đ) Advise and implement mass mobilization work according to the regulations of the Party, laws, and guidance from higher-level agencies;

24. Assist the Commune People's Committee in managing state administrative affairs in accordance with the law for collective economic organizations, private economic organizations, associations, social funds, charitable funds, and non-governmental organizations operating within the internal affairs domain;

26. Implement information and regular and urgent reporting tasks; summarize and conclude on the situation of assigned tasks according to the regulations of the Commune People's Committee and the Provincial Department of Internal Affairs;

28. Organize the provision of public services in the internal affairs domain within the scope of state management as prescribed by law;

29. Manage organizational structures, civil servant quotas, job positions, the number of civil servants required for each position, the structure of civil servants by occupational titles, and the number of employees in public service units; implement salary systems and incentive policies, training, rewards, and disciplinary actions for civil servants, civil employees, and workers under the scope of management as prescribed by law and as assigned by the Commune People's Committee;

30. Perform duties and exercise powers within the scope of authority, delegation, decentralization, and authorization as prescribed by law and other regulations of competent authorities;

31. Perform other tasks assigned by the Commune People's Committee in accordance with the law;

c) Aggregate job positions and corresponding civil servant ranks of agencies and organizations under the Commune People's Council and Commune People's Committee, and submit to the Commune People's Committee for submission to the Provincial Department of Internal Affairs for consolidation as prescribed by law;

c) Take the lead and coordinate with specialized agencies under the Commune People's Committee in organizing and implementing organizational restructuring content; civil service systems; labor and wages; social insurance; employment; labor safety and hygiene; persons with meritorious service; youth; gender equality; state archival records; commendation and reward activities, and information and propaganda work on administrative reform;

14. On state archival management:

a) Inspect and guide record-keeping and archival work within the scope of management;

b) Carry out record-keeping and archival activities as prescribed;

c) Serve as the point of contact for submitting archival files and documents of commune-level agencies and organizations to the national historical archives at the provincial level as prescribed;

19. In the field of labor and wages:

a) Receive registration of labor rules and regulations when authorized by the specialized agency under the Provincial People's Committee in accordance with the law;

b) Guide the implementation of legal regulations concerning wage systems in production and business sectors;

c) Promote and disseminate legal provisions regarding domestic workers; manage, inspect, and supervise the implementation of regulations concerning domestic workers within the area;

d) Guide, support, and organize the implementation of labor laws regarding the organization and operation of worker organizations in enterprises;

c) Examine, resolve, and promptly respond to citizens' complaints, reports, and suggestions; people's supervisory boards at the commune level; investment supervision boards of trade unions, the Vietnam Fatherland Front Central Committee, and political-social organizations at the commune level;

25. Organize the application of scientific and technological progress; build information systems, innovation, digital transformation, and storage to serve state management and professional activities of specialized agencies at the commune level; operate and exploit local internal affairs databases;

27. Inspect organizations and individuals in the implementation of legal provisions in their respective fields; handle complaints and reports; prevent and combat corruption and waste in accordance with the law and assignments by the Commune People's Committee;

Chapter III
IMPLEMENTATION

Article 5. Transitional Provisions

For the content on transferring functions and tasks among related agencies concerning administrative procedures, it shall be implemented according to the following principles:

1. In cases where organizations or individuals have submitted applications before this Circular takes effect, they shall continue to follow the legal provisions applicable at the time of submission.

2. In cases that have been appraised, approved, and issued certificates, licenses, or certificates before this Circular takes effect, they shall continue to be used according to the documents issued by competent state agencies, and if there is a term, it shall be implemented until the end of the term. In cases of amendment, supplementation, adjustment, renewal, revocation, or recovery, they shall be carried out in accordance with the guidance provided in this Circular and related regulations;

Article 6. Effectiveness

This Circular replaces Circular No. 05/2021/TT-BNV dated August 12, 2021, issued by the Minister of Internal Affairs guiding the functions, tasks, and powers of the Provincial Department of Internal Affairs under the Provincial People's Committee and the District Department of Internal Affairs under the District People's Committee, and Circular No. 11/2021/TT-BLDTBXH dated September 30, 2021, issued by the Minister of Labor, Invalids, and Social Affairs guiding the functions, tasks, and powers of the Provincial Department of Labor, Invalids, and Social Affairs under the Provincial People's Committee and the District Department of Labor, Invalids, and Social Affairs under the District People's Committee;

Article 7. Responsibility for Implementation

1. The Provincial People's Committee and the Chairman of the Provincial People's Committee are responsible for directing and organizing the implementation of this Circular;

2. During the implementation of this Circular, if there are difficulties or need for supplementation or modification, please reflect and report to the Ministry of Internal Affairs for consideration and resolution within their authority./.
