Provisions on metrology for group 2 measuring instruments

 

Circular No. 23/2013/TT-BKHCN dated September 26, 2013, issued by the Minister of Science and Technology, concerning metrology for group 2 measuring instruments, took effect from November 15, 2013, and was amended and supplemented by:

Pursuant to the Law on Metrology dated November 11, 2011;

Pursuant to Decree No.Decision No. 20/2013/NĐ-CPdated February 26, 2013, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the request of the Director General of the Standardization, Measurement, and Quality Control Department,

The Minister of Science and Technology issues this Circular on metrology for group 2 measuring instruments. [1]

Chapter I. GENERAL PROVISIONS

 

Article 1. Scope of Regulation

Article 1. This Circular stipulates metrology for group 2 measuring instruments (hereinafter referred to as measuring instruments), including: List of measuring instruments, measures for metrological control and calibration cycles of measuring instruments; approval of samples; calibration of measuring instruments.

Article 2. This Circular does not apply to radiation measuring instruments, nuclear measuring instruments, measuring instruments that are goods enjoying preferential treatment, exemption from customs formalities, temporarily imported-reexported goods, transiting goods, transferred goods, goods stored in bonded warehouses, goods serving urgent needs, and goods directly serving special metrological activities in the fields of national defense and security.

Article 2. Applicability

Point 1. Organizations and individuals (hereinafter referred to as entities) producing, importing, trading, and using measuring instruments.

Point 2. Organizations designated to calibrate and test measuring instruments.

Point 3. State agencies on metrology, other organizations and individuals related thereto.

Article 3. Explanation of Terms [2]

In this Circular, the following terms are understood as follows:

1. Metrological technical requirements are a set of metrological technical characteristics of measuring instruments specified in Vietnamese metrological technical documents (denoted as DVLN);

2. Measuring Device are technical equipment, including: measuring devices and tools; equipment and tools with measurement functions; measurement systems to perform measurements;

3. Group 2 measuring instruments are measuring instruments used to quantify goods and services in transactions, payments, ensuring safety, protecting public health, protecting the environment, in inspections, examinations, judicial appraisals, and other official activities subject to metrological technical requirements specified in Vietnamese metrological technical documents;

4. Approval of samples is a measure of metrological control implemented by the General Department of Standardization, Metrology, and Quality Assurance to evaluate and confirm that a sample of a measuring instrument or a type of measuring instrument (hereinafter collectively referred to as sample) meets metrological technical requirements;

5. Calibration is a measure of metrological control carried out by organizations designated to calibrate measuring instruments to evaluate and confirm that the metrological technical characteristics of measuring instruments meet metrological technical requirements;

6. Measuring instrument manufacturing entity is an organization or individual implementing one or more activities of technology transfer, manufacture, assembly, improvement, or modification of measuring instruments that have been produced or imported;

7. Measuring instrument import entity is an organization or individual importing or acting as an agent for the importation of complete measuring instruments;

8. Measuring instrument trading entity is an organization or individual wholesaling, retailing, or acting as an agent for the sale of measuring instruments in Vietnam;

Article 9. Other terms shall be understood in accordance with Article 3 of the Law on Metrology dated November 11, 2011.

Chapter II. LIST OF MEASURING INSTRUMENTS, METROLOGICAL CONTROL MEASURES AND CALIBRATION CYCLES FOR MEASURING INSTRUMENTS

- Symbol "-": the measure does not need to be carried out for the measuring instrument;

- Throughout the entire period specified in the calibration cycle, the metrological technical characteristics of the measuring instrument must be maintained during its use.

2. Measuring instruments not specified in Clause 1 of this Article but required to be calibrated or verified according to national technical regulations, other regulatory legal documents, or when used for inspection, supervision, judicial appraisal, or other state administrative activities, must be calibrated or verified upon request of the competent state management authority without the need for model approval.

Article 5. Amending and Supplementing the List of Measuring Instruments, Measurement Control Measures, and Calibration Cycle of Measuring Instruments

Annually, based on the proposals of ministries, ministerial-level agencies, and management requirements for measurement, the National Standardization, Measurement, and Quality Control Committee [5] (hereinafter referred to as the Committee [6] ) will compile and submit to the Ministry of Science and Technology for consideration and decision on amending and supplementing the List of Measuring Instruments, measurement control measures for measuring instruments, and calibration cycle of measuring instruments as stipulated in Article 4 of this Circular.

Chapter III. APPROVAL OF SAMPLES

 

Section 1. PROCEDURES AND FORMALITIES FOR APPROVING SAMPLES

Article 6. Requirements for Sample Approval

1. Sample approval includes: sample registration for approval; testing and evaluating the sample; deciding on sample approval.

2. Sample testing must be conducted by testing organizations listed in the Directory of Testing Organizations designated by the Committee [7] .

The Directory of Designated Testing Organizations is published on the Committee's website. [8] .

3. The sample must have a structure and technical features that prevent impacts from altering its primary measurement technical characteristics during use; it must be tested, evaluated, and concluded as meeting the specified measurement technical requirements.

4. Manufacturers and importers of measuring instruments approved by samples must ensure that the measuring instruments produced or imported comply with the approved samples.

Article 7. Documents for Sample Registration Approval [9]

The entity submits the application dossier for approval of measurement instrument model online through the National Public Service Portal, directly or via postal service to the Committee (one set). The dossier includes:

1. Application form for approval of measurement instrument model according to Form 1. DM at Appendix issued together with this Circular.

2. Technical documentation of the sample. Documentation must clearly state: operating principle, schematic structural diagram, usage instructions; important structures affecting the primary measurement technical characteristics of the sample; positions of mechanisms for setting and adjusting primary measurement technical parameters of the sample; locations for affixing seals, inspection stamps, and sealing, and other features if present on the sample; mechanisms or technical features implementing prevention of impacts altering primary measurement technical characteristics of the sample during use (in Vietnamese or English or both languages).

3. Color photographs of the sample and a CD containing electronic data of these photographs. The set of photographs includes: one (01) overall photograph of the sample; front (displaying measurement results), back, top, bottom (if applicable), right side, left side photographs of the sample; separate photographs showing information about model codes, types, and primary measurement technical characteristics of the sample; electronic circuit boards (if applicable), operation keys; positions of product labels, seal affixing locations; sealing locations on the sample; other parts directly influencing the primary measurement technical characteristics of the sample.

Photographs must be the same size, minimum 100 mm x 150 mm but not larger than 210 mm x 297 mm, attached or printed on A4 paper bound into a booklet. Photographs must clearly and accurately depict the primary measurement technical characteristics of the sample and meet the requirements for comparison, verification, and checking the conformity of manufactured or imported measuring instruments with the approved sample.

4. Test and evaluation report dossier of the model in accordance with Article 12 of this Circular.

In cases where the entity requests exemption or reduction in sample testing during sample registration for measuring instrument approval, the dossier shall include relevant documents concerning the exemption or reduction in testing as stipulated in Article 10 of this Circular.

Article 8. Processing registration files for model approval

1. Within seven (07) working days from the date of receipt of the file, if the file is incomplete or invalid, the Committee shall notify in writing to the entity the contents that need to be amended or supplemented. [10] notify the entity in writing about the contents that need to be amended and supplemented.

2. In cases where the file requests exemption or reduction of sample testing but lacks sufficient grounds for such exemption or reduction, the Committee shall notify in writing to the entity about the necessity to test the sample and/or supplement and complete the registration file for model approval. [11] notify the entity in writing about the requirement to test samples and/or supplement and complete the registration approval dossier.

3. Within twenty (20) working days from the date of receiving the Committee's notification, if the entity does not have a complete file to supplement, the entity must submit a written document to the Committee detailing the reasons and completion deadline. The processing of the file can only continue once the file is complete and valid. [12] If the entity does not have sufficient documents for supplementation, it must submit a written notice to the Committee detailing the reasons and completion deadline. The processing of the dossier can only continue once it is complete and valid.

4. Within ten (10) working days from the date of receiving a valid file, the Committee shall issue a decision on approving the model in accordance with Article 13 of this Circular. [13] issue a decision to approve the sample in accordance with Article 13 of this Circular.

Article 9. Sample Testing

1. Sample testing shall be conducted by the entity registering for model approval, carried out according to an agreement with the designated testing organization.

2. The number of samples for testing and the procedures, formalities for testing the samples shall be carried out according to the corresponding testing process established by the Committee. [14] 2. 3. In cases where there is no testing process for the sample, of the National Assembly; [15] designated 3. In cases where there is no testing process for the sample, [16] the testing organization shall build and submit to the Committee for approval of a temporary testing process and proceed with sample testing.

The basis for building a temporary testing process is the recommendations of the International Legal Metrology Organization (OIML), International Electrotechnical Commission (IEC) standards, International Organization for Standardization (ISO) standards, national standards (TCVN), enterprise standards (TCCS), foreign standards, and relevant technical regulations related to the sample.

Article 10. Exemption from and Reduction in Sample Testing

Article 10. Exemption and Reduction of Sample Testing

1. Exemption from sample testing applies to one of the following cases: [17] a) Imported measuring instruments with international metrological organization certification or with model approval certificates from authorized foreign metrological agencies recognized by the Committee regarding the results of the sample testing of those measuring instruments;

b) Measuring instruments produced or imported according to the approved sample for another entity and permitted in writing by that entity;

b) Measuring instruments produced or imported according to a model already approved for another entity and permitted in writing by that entity;

2. Reduction in sample testing shall be considered and applied in one of the following cases:

c) Imported measuring instruments within equipment or integrated equipment chains approved by competent state management agencies.

b) Measuring instruments of the same type as the sample already approved for the entity applying for sample approval.

a) Measuring instruments modified or improved from a model already approved for the registering entity but which changes one or more key metrological characteristics compared to the approved model;

1. The evaluation of tested samples shall be conducted by the testing organization.

b) Measuring instruments of the same type as the model already approved for the registering entity. [19] The Committee shall consider and decide on the reduction and degree of reduction of sample testing.

2. Contents of the sample evaluation:

Article 11. Model Evaluation

1. The evaluation of tested models shall be carried out by the testing organization.

In cases where the model is exempted from testing, the Committee shall designate an organization to conduct the model evaluation.

d) The suitability of management and technical measures established and implemented by the entity with the requirements stipulated in Clause 4, Article 6 of this Circular.

2. Contents of model evaluation:

a) Compliance of the sample testing results with corresponding metrological technical requirements;

b) Exchange information related to technical experts;

b) Compliance of the structure and technical features of the model with requirements to prevent impacts that change the key metrological characteristics of measuring instruments produced or imported according to the approved model during use;

Article 12. File of testing and evaluation results

Upon completion of the testing and evaluation process, the organization conducting the testing and evaluation shall prepare one (01) file to submit to the Committee. [20] The file includes:

1. A consolidated report on the testing and evaluation results of measuring instruments according to Model 3. BCPDM attached as an appendix to this Circular.

2. Test certificates and test result minutes according to the prescribed model in the corresponding testing procedures (for samples that must be tested as required).

Article 13. Decision to approve samples

1. Based on the valid registration approval file and the testing and evaluation results file, the Committee [21] will consider and decide to approve the sample for the entity.

In case the entity's file does not meet the requirements, the Committee [22] will issue a document rejecting the sample approval and clearly state the reasons.

2. The approval decision contains the following main contents:

a) Name and main office address of the entity;

b) Manufacturer name and country of production (for imported samples);

c) Sample code and type;

d) Main metrological characteristics of the sample;

đ) Approval sample code;

e) Validity period.

3. Validity period

a) The validity period of the approval decision and extension decision is ten (10) years from the date of signing;

b) The validity period of the adjustment decision follows the most recent approved approval decision issued prior to it.

4. The approval sample code is specified in Model 4. KHPDM attached as an appendix to this Circular.

5. The approval decision is sent to the entity and the local Standardization, Metrology and Quality Control Agency where the entity has registered its main office.

6. The decision and images of the approved sample are published on the Committee’s electronic information portal. [23] .

Article 14. Retention of files of approved samples

1. The file of an approved sample consists of: the approval decision, the registration approval file stipulated in Article 7, and the testing and evaluation results file stipulated in Article 12 of this Circular.

2. One (01) set of files is retained at the Committee. [24] The entity is responsible for preparing one (01) set of the approved sample file and retaining it at the entity.

3. The retention period is five (05) years after the approval decisions, adjustment decisions, and extension decisions expire.

Section 2. EXTENSION OF EFFECTIVENESS, AMENDMENT OF CONTENTS, SUSPENSION, AND REVOCATION OF APPROVAL DECISIONS

Article 15. Extension of effectiveness of the approval decision

1. The extension of effectiveness can only be implemented once for each approval decision.

2. [25] One (01) month before the approval decision expires, if there is a need, the entity submits an online registration approval file for measuring instruments on the National Public Service Portal, directly or through postal service to the Committee (one set). The file includes:

An application for extending the effectiveness of the approval decision for measuring instruments according to Model 5. ĐNGHPDM attached as an appendix to this Circular.

3. Based on the application file, the Committee [26] will consider and decide to extend the effectiveness of the approval decision (hereinafter referred to as the extension decision) according to Article 13 of this Circular.

4. The extension decision and the application file for extending the effectiveness are retained according to Article 14 of this Circular.

Article 16. Amendment of contents of the approval decision

1. In case of a request to change the name or main office address of the entity with an approved sample

a) The entity prepares one (01) amendment application file and sends it directly to the Committee's office or via postal service. [27] The file includes:

- A letter requesting the amendment;

- Relevant documents related to the requested amendment.

b) [28] Within five (05) working days from the date of receiving a complete and valid file, the Committee will consider and issue an amendment decision according to Article 13 of this Circular for the amended content.

2. In case of a request to amend contents related to points b, c, and d Clause 2 Article 13 of this Circular

a) The entity prepares one (01) amendment application file and sends it directly to the Committee's office or via postal service. [29] The file includes:

- A letter clearly stating the requested amendment;

- Relevant documents related to the requested amendment.

b) [30] Within five (05) working days from the date of receiving a valid file, the Committee will consider and issue guidance for the entity to apply for a new approval or issue an amendment decision according to Article 13 of this Circular for the amended content.

3. The amendment decision and the amendment application file are retained according to Article 14 of this Circular.

Article 17. Suspension of Effectiveness of Approval Decision

1. The partial or full suspension of the effectiveness of the approval decision shall apply to the following cases:

a) The entity fails to fulfill its responsibilities as stipulated in Article 23 of this Circular, causing serious consequences;

b) The entity submits a request for the suspension of the effectiveness of the approval decision.

2. Depending on specific circumstances, the Committee shall examine and issue a decision to suspend the partial or full effectiveness of the approval decision (referred to as the suspension decision). The suspension period shall not exceed six (06) months from the date the suspension decision becomes effective. [31] 3. The suspension decision shall be sent to the entity, the local Standardization, Measurement, and Quality Control Agency where the entity has registered its principal office, and published on the Committee's electronic information portal.

4. During the suspension period specified in Clause 2 of this Article, after completing the rectification of consequences due to non-compliance with the responsibilities stipulated in this Circular, the suspended entity may prepare one (01) set of documents requesting the revocation of the suspension decision and send it via postal service or directly to the Committee's office. [32] .

a) A letter requesting the revocation of the suspension decision; [33] The file includes:

b) Documents and records proving the completion of rectifying the consequences.

5. Depending on specific circumstances, the Committee shall decide to review the documents or conduct an inspection at the entity regarding the rectified matters.

6. Within seven (07) working days from the date of receiving the documents, if the documents do not comply with the regulations, the Committee shall notify the entity of the contents that need to be supplemented or amended. [34] 7. Within seven (07) working days from the date of receiving valid documents, the Committee shall issue a decision to revoke the suspension decision (referred to as the revocation decision).

8. The retention of the suspension decision and the documents for requesting the revocation of the suspension shall be carried out in accordance with the provisions of Article 14 of this Circular. [35] Article 18. Revocation of Effectiveness of Approval Decision

1. The revocation of the effectiveness of the approval decision shall apply to the following cases: [36] a) The entity with the approved model goes bankrupt, is dissolved, or seriously violates the law;

b) The entity whose suspension decision has exceeded the suspension period but has not completed the rectification of consequences;

c) The entity submits a document requesting to cease production or importation of measuring instruments according to the approved model.

2. The Committee shall issue a decision to revoke the effectiveness of the approval decision (referred to as the revocation decision).

3. The revocation decision shall be sent to the entity, the local Standardization, Measurement, and Quality Control Agency where the entity has registered its principal office, and published on the Committee's electronic information portal.

Section 1. GENERAL REQUIREMENTS FOR TESTING

Article 19. Testing Regimes

1. Initial testing is the first testing conducted on measuring instruments before they are put into use. [37] 2. Periodic testing is the testing carried out according to the cycle prescribed in Article 4 of this Circular for measuring instruments during their use.

Comparative testing is a form of periodic testing conducted as required under Section 2, Chapter IV of this Circular. [38] .

Chapter IV. Serial

 

3. Post-repair testing is the testing conducted on measuring instruments in any of the following situations:

a) Measuring instruments are repaired due to failing to meet the technical measurement requirements;

b) The test certificate (test mark, test label, test certification) of the measuring instrument is lost, damaged, or otherwise impaired, but the structure and technical measurement characteristics of the measuring instrument have not changed compared to the approved model;

c) Based on the conclusion of inspections or audits by competent authorities;

d) Users of measuring instruments discover signs indicating that the measuring instruments may not meet the technical measurement requirements and request retesting.

3. Post-repair verification is the verification of measuring instruments in one of the following cases:

a) Measuring instruments repaired due to non-compliance with prescribed metrological technical requirements;

b) Verification certificates (verification marks, verification labels, verification certificates) of measuring instruments are lost, damaged, or otherwise impaired but the structure and metrological technical characteristics of the measuring instruments remain unchanged compared to the approved sample;

c) Based on the inspection and audit conclusions of competent authorities;

d) Users of measuring instruments discover signs indicating that the measuring instruments may not comply with prescribed metrological technical requirements and request re-verification.

Article 20. Requirements for Calibration

1. The calibration shall be carried out by the entity with measuring instruments that need to be calibrated, selecting and implementing it according to an agreement with a designated calibration organization within the List of Designated Calibration Organizations that have the appropriate scope of calibration.

The List of Designated Calibration Organizations is published on the website of the Committee. [39] .

2. The calibration shall be conducted by metrology inspectors of the designated calibration organization. Metrology inspectors must be certified and issued a card in accordance with regulations.

3. The calibration shall be performed in accordance with the procedures and formalities stipulated in the corresponding calibration process for measuring instruments as prescribed by the Committee. [40] 2. The number of samples tested and the procedures, formalities for sample testing shall be implemented according to the corresponding testing process issued by the Committee.

4. In cases where there is no calibration process for measuring instruments, the Committee [41] designates an organization to develop, submit to the Committee [42] for approval a temporary calibration process and conduct calibration.

The basis for developing a temporary calibration process includes recommendations from the International Legal Metrology Organization (OIML), standards from the International Electrotechnical Commission (IEC), standards from the International Organization for Standardization (ISO), national standards (TCVN), basic standards (TCCS), foreign standards, technical specifications related to samples.

5. Calibration certificates shall be made according to a unified model nationwide.

6. Calibration certificates must be printed, manufactured, distributed, managed, and used in accordance with regulations. Calibration certificates issued to measuring instruments that meet requirements are valid throughout the country.

7. The validity period of calibration certificates will end when any of the following situations occur:

a) The calibration cycle has expired;

b) There has been a change or improvement that alters the metrological characteristics of the measuring instrument;

c) The measuring instrument is damaged or does not meet the specified metrological requirements;

d) Calibration certificates are lost, damaged, or otherwise impaired.

Section 2. REQUIREMENTS FOR COMPARATIVE CALIBRATION

Article 21. Measuring Instruments Must Undergo Comparative Calibration

1. Measuring instruments must undergo comparative calibration including:

a) Electric meters;

b) Cold water meters.

2. Depending on state management requirements at each stage, the Committee [43] proposes the Ministry of Science and Technology to amend and supplement the measuring instruments that must undergo comparative calibration as stipulated in Clause 1 of this Article.

Article 22. Requirements for Comparative Calibration

1. The organization entrusted to carry out comparative calibration (referred to as the comparative calibration organization) must meet the following requirements:

a) The comparative calibration organization must be included in the List of Designated Calibration Organizations as prescribed in Clause 1 of Article 20 of this Circular; [44] b) Regarding quantity: not less than two (02) organizations for one (01) type of measuring instrument that must undergo comparative calibration in one (01) province or centrally governed city.

The number of measuring instruments calibrated at each comparative calibration organization is determined based on the total number of measuring instruments that must undergo comparative calibration in one (01) year in one (01) province or centrally governed city and local state management requirements for measurement.

2. 3. The determination and notification of specific numbers and names of comparative calibration organizations, and the number of measuring instruments that must undergo comparative calibration at each comparative calibration organization in the locality shall be implemented by the Committee

after consulting the opinions of the Local Standards Measurement Quality Control Bureau. [45] 4. Comparative calibration shall be carried out in accordance with the provisions of Clauses 2, 3, 4, 5, 6, and 7 of Article 20 of this Circular.

RESPONSIBILITIES OF STATE AUTHORITIES ON MEASUREMENT, ORGANIZATIONS, AND INDIVIDUALS

Chapter V. RESPONSIBILITIES OF STATE ADMINISTRATIVE AUTHORITIES ON MEASUREMENTS, ORGANIZATIONS, AND INDIVIDUALS

Article 23. Responsibilities of production and import entities for measuring instruments

1. Implement the provisions on approving measuring instrument models as stipulated in Chapters II and III of this Circular when producing or importing measuring instruments.

2. Produce or import measuring instruments according to approved models.

3. Implement measures to prevent and combat interventions that alter the primary technical measurement characteristics of measuring instruments during their use.

4. Conduct initial verification of measuring instruments in accordance with the provisions set forth in Chapter IV of this Circular.

5. Comply with inspection and supervision activities related to measurement conducted by competent state agencies as prescribed by law.

6. Implement the provisions of this Circular and other relevant legal regulations.

7. Annually before March 31 or at any time upon management requirements, prepare reports on the situation of production and import of measuring instruments and submit them to the Committee. [46] .

Article 24. Responsibilities of business entities dealing in measuring instruments

1. Deal in measuring instruments whose models have been approved as prescribed.

2. Provide customers with information about the technical measurement characteristics of measuring instruments.

3. Comply with inspection and supervision activities related to measurement conducted by competent state agencies as prescribed by law.

Article 25. Responsibilities of entities using measuring instruments [47]

1. Ensure storage and usage conditions for measuring instruments in accordance with the manufacturer's regulations and technical measurement requirements of competent state agencies; maintain the technical measurement characteristics of measuring instruments throughout their use period between two verifications.

2. Conduct periodic verification and post-repair verification of measuring instruments during their use as stipulated in Chapter IV of this Circular.

3. Adhere to the qualifications, expertise, and professional experience requirements for personnel using measuring instruments when conducting measurements as prescribed by competent state agencies.

4. Ensure conditions as prescribed for relevant parties to monitor and inspect the implementation of measurements, measurement methods, measuring instruments, and quantities of goods.

5. Comply with inspection and supervision activities related to measurement conducted by competent state agencies as prescribed by law.

Article 26. Responsibilities of designated organizations for verifying and testing measuring instruments

1. Conduct verification and testing of measuring instruments as stipulated in this Circular.

2. Fulfill customer requests for verification and testing of measuring instruments except in cases of force majeure.

3. Implement the manufacture and management of verification certificates and test reports as prescribed.

4. Manage the verification and testing activities of metrology inspectors and testing staff.

5. Comply with inspection and supervision activities related to measurement conducted by competent state agencies as prescribed by law.

6. Annually before March 31 or at any time upon management requirements, prepare reports on verification and testing activities and submit them to the Committee [48] and the local Standardization, Measurement, and Quality Control Agency where the verification and testing organization has registered its main office.

Article 27. Responsibilities of the National Standardization, Measurement, and Quality Control Committee [49]

1. Issue Vietnamese technical measurement documents regarding technical measurement requirements, verification procedures, and testing procedures for measuring instruments.

2. Approve measuring instrument models.

3. Designate organizations for verifying and testing measuring instruments as prescribed.

4. Annually before June 30 or at any time upon management requirements, notify in writing the local Standardization, Measurement, and Quality Control Agencies and related organizations and individuals about the number of measuring instruments required to undergo comparative verification and the organizations designated to conduct comparative verification in the locality.

5. Conduct inspections and supervision in accordance with the law on the implementation of this Circular.

Article 28. Responsibilities of the agency advising and assisting the People's Committee of provinces and centrally governed cities in managing science and technology on their respective territories [50]

1. Direct the Standard Metrology Quality Control Agency to conduct state inspections and supervision on measurement in accordance with the provisions of the law.

2. Direct the Inspectorate of the agency advising and assisting the People's Committee of provinces and centrally governed cities in managing science and technology on their respective territories to conduct inspections on compliance with laws on measurement within their territory, handle complaints and denunciations, and deal with violations related to measurement in accordance with the provisions of the law.

Article 29. Responsibilities of the Standard Metrology Quality Control Agencies of provinces and centrally governed cities [51]

1. Provide information, promote awareness, and guide organizations and individuals related to the implementation of the provisions of this Circular.

2. Conduct inspections and handle administrative violations related to measurement for group 2 measuring instruments within their territory in accordance with the provisions of the law.

3. Conduct state supervision on measurement for measuring instruments within their territory within the scope of responsibility stipulated in Clause 3, Article 13 of Decree No. 86/2012/ND-CP dated October 19, 2012 of the Government detailing and guiding the implementation of certain articles of the Measurement Law.

4. Annually before May 30 or at any time upon request for management supervision, prepare reports on the implementation of verification, propose the number of measuring instruments that must undergo verification, organize the designated verification on the local level, and send them to the National Standard Metrology Quality Control Agency and the agency advising and assisting the People's Committee of provinces and centrally governed cities in managing science and technology on their respective territories.

Chapter VI. IMPLEMENTING PROVISIONS [52]

 

Article 30. Effectiveness of Implementation

1. This Circular takes effect from November 15, 2013.

2. Abolish the effectiveness of the following documents:

a) Decision No. 1073/QĐ-BKHCNMT dated May 17, 2002 of the Minister of Science, Technology, and Environment (now the Ministry of Science and Technology) regarding the issuance of the Verification Procedure for Measuring Instruments;

b) Decision No. 65/2002/QĐ-BKHCNMT dated August 19, 2002 of the Minister of Science, Technology, and Environment (now the Ministry of Science and Technology) concerning the issuance of the "List of Measuring Instruments Required for Verification and Registration for Verification";

c) Decision No. 22/2006/QĐ-BKHCN dated November 10, 2006 of the Minister of Science and Technology regarding the approval of measuring instrument samples;

d) Decision No. 13/2007/QĐ-BKHCN dated July 6, 2007 of the Minister of Science and Technology issuing the "List of Measuring Instruments Required for Verification";

đ) Decision No. 25/2007/QĐ-BKHCN dated October 5, 2007 of the Minister of Science and Technology regarding the application of the Verification Procedure and cycle for measuring instruments listed in the List of Measuring Instruments Required for Verification;

e) Decision No. 11/2008/QĐ-BKHCN dated August 29, 2008 of the Minister of Science and Technology amending and supplementing the "List of Measuring Instruments Required for Verification" issued together with Decision No. 13/2007/QĐ-BKHCN dated July 6, 2007;

g) Circular No. 14/2011/TT-BKHCN dated June 30, 2011 of the Minister of Science and Technology amending and supplementing some articles of Decision No. 22/2006/QĐ-BKHCN dated November 10, 2006 of the Minister of Science and Technology regarding the approval of measuring instrument samples.

Article 31. Transitional Provisions

1. Measuring instruments that have been in use prior to the effective date of this Circular but have not yet been approved according to regulations shall establish a registration dossier for sample approval in accordance with Clauses 1, 2, 3, and 4 of Article 7 of this Circular and submit it to the Committee. [53] .

Based on the quantity and type of measuring instruments proposed for approval, the Committee [54] will examine and decide whether to review the dossier or conduct an actual inspection at the place of use to approve the sample for the entity. The cost of the actual evaluation shall be borne by the entity.

2. Entities producing or importing measuring instruments with valid sample approval certificates under Decision No. 22/2006/QĐ-BKHCN dated November 10, 2006 of the Minister of Science and Technology may continue to produce or import measuring instruments consistent with the approved sample and in accordance with the provisions of this Circular until the expiration of the validity period of the sample approval certificate issued to the entity.

Article 32. Implementation Organization

1. National Committee for Standards, Metrology, and Quality [55] shall guide and implement this Circular.

2. State agencies, organizations, and individuals related to this matter shall be responsible for implementing this Circular.

3. During the implementation process, if difficulties arise, they should report to the Ministry of Science and Technology for consideration and resolution./.

APPROVAL SYMBOL FOR THE SAMPLE

1. The approval symbol for the sample must be placed in a position that is easily visible, readable, and not damaged during use, transportation, or storage of the measuring instrument.

2. The approval symbol for the sample consists of three groups of letters and numbers:

a) The first group consists of the three letters PDM;

b) The second group is the serial number of the sample approved in the year;

c) The third group consists of four digits indicating the year of approval.

Between the first group and the second group is a space. Between the second group and the third group is a hyphen.

3. The approval symbol for the sample must be clear, with the height of letters and numbers not less than two (2) millimeters./.

Circular No. 07/2024/TT-BKHCN dated October 8, 2024, issued by the Minister of Science and Technology, amending and supplementing certain provisions of legal normative documents within the authority of the Minister of Science and Technology related to the National Standard Measurement Quality Committee, based on the following grounds:

Pursuant to Decree No. Decision No. 28/2023/NĐ-CP dated June 2, 2023, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the request of the Acting Chairman of the National Standard Measurement Quality Committee, the Director of the Legal Department;

The Minister of Science and Technology issues this Circular amending and supplementing certain provisions of legal normative documents within the authority of the Minister of Science and Technology related to the National Standard Measurement Quality Committee."

Circular No. 58/2025/TT-BKHCN amending and supplementing certain Circulars to reduce and simplify administrative procedures related to production and business activities under the management of the Ministry of Science and Technology, based on the following grounds:

Pursuant to the Law on Legislative Acts of Legal Normative Documents No. 64/2025/QH15, amended and supplemented by Law No. 87/2025/QH15;

Based on Decree No. 78/2025/NĐ-CP dated April 1, 2025, of the Government detailing certain provisions and measures for organizing and guiding the implementation of the Law on Issuing Legal Normative Documents, amended and supplemented by Decree No. 187/2025/NĐ-CP;

Pursuant to Decree No. 55/2025/NĐ-CP dated March 2, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the proposal of the Director of the Legal Department;

The Minister of Science and Technology issues this Circular amending and supplementing certain Circulars to reduce and simplify administrative procedures related to production and business activities under the management of the Ministry of Science and Technology."

[2] This is amended and supplemented pursuant to Clause 1, Article 1 of Circular No. 07/2019/TT-BKHCN amending and supplementing certain provisions of Circular No. 23/2013/TT-BKHCN dated September 26, 2013 of the Minister of Science and Technology on measurement for group 2 measuring instruments, which takes effect from January 1, 2020.

[3] This is amended and supplemented pursuant to Clause 2, Article 1 of Circular No. 07/2019/TT-BKHCN amending and supplementing certain provisions of Circular No. 23/2013/TT-BKHCN dated September 26, 2013 of the Minister of Science and Technology on measurement for group 2 measuring instruments, which takes effect from January 1, 2020.

[4] This clause is amended and supplemented pursuant to Article 1 of Circular No. 03/2024/TT-BKHCN amending and supplementing certain provisions of Circular No. 23/2013/TT-BKHCN dated September 26, 2013 of the Minister of Science and Technology on measurement for group 2 measuring instruments, which has been amended and supplemented by Circular No. 07/2019/TT-BKHCN dated July 26, 2019 of the Minister of Science and Technology, and takes effect from October 15, 2024.

[5] The phrase "General Department of Standardization, Measurement and Quality" is replaced by the phrase "National Committee for Standardization, Measurement and Quality" pursuant to Clause 1, Article 17 of Circular No. 07/2024/TT-BKHCN amending and supplementing certain provisions in legal normative documents within the authority of the Minister of Science and Technology related to the National Committee for Standardization, Measurement and Quality, which takes effect from November 22, 2024.

[47] This provision has been amended and supplemented pursuant to Clause 3, Article 1 of Circular No. 07/2019/TT-BKHCN dated July 26, 2019, issued by the Minister of Science and Technology to amend and supplement certain provisions of Circular No. 23/2013/TT-BKHCN dated September 26, 2013, issued by the Minister of Science and Technology regarding measurement for measuring instruments in Group 2, which took effect from January 1, 2020.

[48] The phrase "General Department" is replaced by the phrase "Committee" pursuant to Clause 1, Article 17 of Circular No. 07/2024/TT-BKHCN amending and supplementing certain provisions in legal normative documents within the authority of the Minister of Science and Technology related to the National Committee for Standardization, Measurement and Quality, which takes effect from November 22, 2024.

[49] The phrase "General Department of Standardization, Measurement and Quality" is replaced by the phrase "National Committee for Standardization, Measurement and Quality" pursuant to Clause 1, Article 17 of Circular No. 07/2024/TT-BKHCN amending and supplementing certain provisions in legal normative documents within the authority of the Minister of Science and Technology related to the National Committee for Standardization, Measurement and Quality, which takes effect from November 22, 2024.

[50] This provision has been amended and supplemented pursuant to Clause 4, Article 1 of Circular No. 07/2019/TT-BKHCN amending and supplementing certain provisions of Circular No. 23/2013/TT-BKHCN dated September 26, 2013, issued by the Minister of Science and Technology regarding measurement for measuring instruments in Group 2, which took effect from January 1, 2020, and Decision No. 3138/QĐ-BKHCN dated October 28, 2019, issued by the Minister of Science and Technology to correct Circular No. 07/2019/TT-BKHCN dated July 26, 2019, issued by the Minister of Science and Technology on amending and supplementing certain provisions of Circular No. 23/2013/TT-BKHCN dated September 26, 2013, issued by the Minister of Science and Technology regarding measurement for measuring instruments in Group 2.

[51] This provision has been amended and supplemented pursuant to Clause 5, Article 1 of Circular No. 07/2019/TT-BKHCN amending and supplementing certain provisions of Circular No. 23/2013/TT-BKHCN dated September 26, 2013, issued by the Minister of Science and Technology regarding measurement for measuring instruments in Group 2, which took effect from January 1, 2020.

[52] Articles 2 and 3 of Circular No. 07/2019/TT-BKHCN amending and supplementing certain provisions of Circular No. 23/2013/TT-BKHCN dated September 26, 2013, regarding measurement for measuring instruments in Group 2, which took effect from January 1, 2020, are hereby prescribed as follows:

Article 2. Implementation clause

Domestic stainless steel produced and imported before June 1, 2020 shall continue to circulate in the market until June 1, 2021.

Article 3. Implementation Organization

1. During implementation, if any issues arise or difficulties occur, organizations and individuals shall promptly report them in writing to the Ministry of Science and Technology for guidance or research on amendments and supplements.

2. The Director of the National Standard Measurement Quality Administration shall be responsible for guiding and organizing the implementation of this Circular.

3. The Minister, the Heads of Ministries equivalent to Ministries, the Chairpersons of People's Committees of provinces and centrally governed cities, and related organizations and individuals shall be responsible for organizing the implementation of this Circular.

Articles 2 and 3 of Circular No. 03/2024/TT-BKHCN amending and supplementing certain provisions of Circular No. 23/2013/TT-BKHCN dated September 26, 2013, issued by the Minister of Science and Technology regarding measurement for measuring instruments in Group 2, which have been amended and supplemented by Circular No. 07/2019/TT-BKHCN dated July 26, 2019, issued by the Minister of Science and Technology, and took effect from October 15, 2024, are hereby prescribed as follows:

Article 2. Implementation clause

This Circular takes effect from October 15, 2024.

This Circular takes effect from December 25, 2025/.

1. During implementation, if any issues arise or difficulties occur, organizations and individuals shall promptly report them in writing to the Ministry of Science and Technology for guidance or research on amendments and supplements.

2. The Director of the National Standard Measurement Quality Administration shall be responsible for guiding and organizing the implementation of this Circular.

3. The Minister, the Heads of Ministries equivalent to Ministries, the Chairpersons of People's Committees of provinces and centrally governed cities, and related organizations and individuals shall be responsible for organizing the implementation of this Circular.

Articles 78, 79, and 80 of Circular No. 07/2024/TT-BKHCN amending and supplementing certain provisions in legal normative documents within the purview of the Minister of Science and Technology relating to the National Committee for Standardization, Measurement, and Quality Control, which take effect from November 22, 2024, are hereby prescribed as follows:

Article 78. Effective Date

This Circular takes effect from November 22, 2024.

Article 79. Transitional Provisions

The contents of tasks assigned to the General Department of Standards Metrology and Quality Management and the Director of the General Department of Standards Metrology and Quality Management to implement in the legal normative documents of the Minister of Science and Technology from Article 1 to Article 77 of this Circular shall be transferred to the National Standardization, Metrology and Quality Control Committee and the Chairman of the National Standardization, Metrology and Quality Control Committee for continued implementation.

Article 80. Implementation Provisions

1. The Minister, the Heads of Ministries equivalent to Ministries, the Heads of Government agencies, the Chairmen of Provincial People's Committees under the Central Government, and related organizations and individuals are responsible for implementing this Circular.

2. In the course of implementation, if there are difficulties or obstacles, organizations and individuals are requested to report in writing to the Ministry of Science and Technology for guidance or research on amendments and supplements to make it appropriate./”

Article 20, Article 21, Article 22 of Circular No. 58/2025/TT-BKHCN amending and supplementing certain Circulars to reduce and simplify administrative procedures related to production and business activities under the management of the Ministry of Science and Technology shall take effect from December 31, 2025 and are stipulated as follows:

"Article 20. Effective Date

This Circular takes effect from the date of issuance.

Article 21. Transitional Provisions

Applications received by competent authorities before the effective date of this Circular but not yet processed shall continue to be handled in accordance with the laws applicable at the time of receipt of the application.

Article 22. The Head of the Office, the Director of the Legal Affairs Department, the Heads of agencies and units under the Ministry and relevant agencies, organizations, and individuals are responsible for implementing this Circular./”

[55] The phrase "General Department of Standardization, Measurement and Quality" is replaced by the phrase "National Committee for Standardization, Measurement and Quality" pursuant to Clause 1, Article 17 of Circular No. 07/2024/TT-BKHCN amending and supplementing certain provisions in legal normative documents within the authority of the Minister of Science and Technology related to the National Committee for Standardization, Measurement and Quality, which takes effect from November 22, 2024.

[56] This model is abolished according to the provisions of Article 4 of Circular No. 58/2025/TT-BKHCN amending and supplementing certain Circulars to reduce and simplify administrative procedures related to production and business activities under the management of the Ministry of Science and Technology, which takes effect from December 31, 2025.

[57] The phrase "General Department of Standards Metrology and Quality Management" is replaced by the phrase "National Standardization, Metrology and Quality Control Committee" as provided for in point a, Clause 2, Article 17 of Circular No. 07/2024/TT-BKHCN amending and supplementing certain articles in legal normative documents within the authority of the Minister of Science and Technology related to the National Standardization, Metrology and Quality Control Committee, which takes effect from November 22, 2024.
