Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of the Prime Minister on the system, policies and support work for organizations and individuals performing missions of searching and collecting remains of revolutionary martyrs, which took effect from February 1, 2014, was amended and supplemented by:
Decision No. 35/2017/QĐ-TTg dated July 25, 2017 of the Prime Minister amending and supplementing some articles of Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of the Prime Minister on the system, policies and support work for organizations and individuals performing missions of searching and collecting remains of revolutionary martyrs, which took effect from September 10, 2017.
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 31/2013/NĐ-CP dated April 9, 2013 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Persons Contributing to the Revolution; includes for the revolution;
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 on salary regulations for officers, civil servants, public officials, and armed forces personnel;
"Based on the proposal of the Minister of National Defense;"
The Prime Minister issues this Decision on the system, policies and support work for organizations and individuals performing missions of searching and collecting remains of revolutionary martyrs.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decision stipulates certain allowances, subsidies, supplements, material standards, and logistical support for those engaged in the mission of searching and collecting remains of revolutionary martyrs both domestically and abroad, as well as policies and benefits for related persons; ensuring equipment, means, materials, and financial support for the mission of searching and collecting remains of revolutionary martyrs both domestically and abroad.
Article 2. Applicability
1. Officers, professional military personnel, non-commissioned officers, soldiers, and defense workers under the establishment of specialized teams directly performing the mission of searching and collecting remains of revolutionary martyrs (hereinafter referred to as search and collection teams) both domestically and abroad.
2. Organizations directly directing and implementing the search and collection of remains of revolutionary martyrs include:
a) Search and collection teams performing the mission both domestically and abroad;
b) Steering Committees, Special Work Teams, and Specialized Commissions; Offices and permanent agencies at all levels for searching and collecting remains of revolutionary martyrs;
c) Military units assigned the task of collecting and completing files on revolutionary martyrs, gravesite files of revolutionary martyrs; welcoming relatives of revolutionary martyrs.
3. Individuals directly mobilized by competent authorities to search and collect remains of revolutionary martyrs (guides, guards, participants in direct search and collection activities); individuals providing information about revolutionary martyrs; relatives or persons worshipping revolutionary martyrs seeking their gravesites.
4. Members of Steering Committees, Special Work Teams, and Specialized Commissions at all levels for searching and collecting remains of revolutionary martyrs.
Chapter II
SYSTEM, POLICIES AND SUPPORT
Article 3. System, policies for subjects under the establishment of search and collection teams both domestically and abroad
Subjects specified in Clause 1, Article 2 of this Decision during the time directly performing the mission of searching and collecting remains of revolutionary martyrs, in addition to salary, allowances, and other systems as prescribed, shall also enjoy the following systems and policies:
1. When performing the mission abroad
a) Allowance equal to 100% of the current rank pay or grade level pay plus leadership position allowance and seniority bonus (if applicable) for those receiving salary or rank allowance for non-commissioned officers and soldiers;
b) Regional allowance: Level 1.0 compared to the basic wage;
c) Responsibility allowance: Level 0.5 compared to the basic wage;
d) Direct mission allowance for surveying, exhumation, and collection of remains of revolutionary martyrs: VND 220,000 per person per day actually performing the mission. During the mission period, if receiving mission allowance, the travel expense allowance will be discontinued;
đ) Health allowance: VND 500,000 per person (not exceeding twice a year);
e) Additional food allowance equivalent to the basic food allowance of non-commissioned officers and soldiers of infantry;
g) Support for learning Lao and Cambodian languages: VND 500,000 per person per year (duration not exceeding three years);
h) Issuance of specialized uniforms in kind (Annex I attached);
i) If injured or ill and treated at medical facilities in the host country, hospitalization fees and transportation costs will be reimbursed.
2. When performing the mission domestically
a) Responsibility allowance: Level 0.5 compared to the basic wage;
b) Direct mission allowance for surveying, exhumation, and collection of remains of revolutionary martyrs: VND 220,000 per person per day actually performing the mission. During the mission period, if receiving mission allowance, the travel expense allowance will be discontinued;
c) Health allowance: VND 500,000 per person (not exceeding twice a year);
d) Additional food allowance equivalent to the basic food allowance of non-commissioned officers and soldiers of infantry;
đ) Issuance of specialized uniforms in kind according to Annex I issued together with this Decision.
Article 4. Regime and policies for members of the Steering Committee, Special Task Force Board, and specialized committees at all levels
The objects specified in Clause 4, Article 2 of this Decision during the time directly performing tasks to direct the search and collection of烈士遗骸,除了工资、补贴和其他规定制度外,还享受以下制度和政策:
1.6 Living expenses allowance: A rate of 220,000 VND per person per day when actually going out to inspect and direct the work of searching for and collecting烈士遗骸in both domestic and foreign areas. If living expenses allowance is enjoyed, then the lodging subsidy stipulated for civil servants on domestic business trips shall not be enjoyed.
2. Other regimes
a) When performing tasks to direct the work of searching for and collecting烈士遗骸in foreign countries, they shall enjoy the travel expense regime for state officials on overseas business trips;
b) In cases where they are injured or fall ill and need treatment at medical facilities in the host country, hospitalization fees and transportation costs will be reimbursed.
Article 5. Regime and policies for persons directly mobilized to search for and collect烈士遗骸;persons providing information about martyrs; supporting relatives or those who worship martyrs in searching for their graves
1. Persons directly mobilized to search for and collect烈士遗骸(guides, guards; participating directly in activities to search for and collect烈士遗骸)enjoy the following regimes and policies:
a)7 A rate of 220,000 VND per person per day for being mobilized to perform the task of searching for and collecting烈士遗骸both domestically and abroad;
b) Guaranteed food expenses at twice the basic food allowance for infantry non-commissioned officers and soldiers;
c) Provided with funds to purchase special uniforms if they have been directly involved in searching for and collecting烈士遗骸for three (03) months or more;
d) Arranged means of transportation or travel expenses reimbursed according to regulations for civil servants on business trips;
đ) In cases where they are injured or fall ill and need treatment at medical facilities, hospitalization fees and transportation costs will be reimbursed.
2. Persons providing information about martyrs enjoy the following regimes:
a)8 A subsidy of 3,000,000 VND for accurate information leading to the discovery and collection of one烈士遗骸; a subsidy of 5,000,000 VND for accurate information leading to the discovery and collection of a collective grave containing two to five烈士遗骸; a subsidy of 10,000,000 VND for accurate information leading to the discovery and collection of a collective grave containing six or more烈士遗骸;
b) Those with outstanding achievements will be rewarded according to regulations.
3. Relatives or those who worship martyrs searching for their graves enjoy the following regimes:
a) Relatives of martyrs or those who worship martyrs searching for their graves, who do not fall under the provisions of Clause 1, Article 64 of Decree No. 31/2013/ND-CP dated April 9, 2013 of the Government detailing and guiding the implementation of certain articles of the Ordinance on Preferential Treatment for Persons Contributing to the Revolution (hereinafter referred to as Decree No. 31/2013/ND-CP), will be supported with travel expenses and food expenses when visiting units and localities (where the martyr participated in work or combat), with a maximum of three (03) people per year;
b) The level of support is implemented according to the object specified in Clause 1, Article 64 of Decree No. 31/2013/ND-CP.
Article 6. Guarantee for search and collection teams operating domestically and internationally
1.9 Search and collection teams tasked with searching and collecting remains of烈士遗骸 in Vietnam and abroad shall be guaranteed:
a) Equipment, specialized means, logistics, and living conditions as stipulated in Appendix II attached hereto;
b) Fuel guarantee expenses;
c) A budget of 150,000,000 VND per temporary house per team;
d) Expenses for exhuming martyrs' graves containing remains at a rate of 1,000,000 VND per grave;
đ) Expenses for repairing and replacing automobile parts at a rate of 40,000,000 VND per vehicle per year;
e) Support expenses for the Special Task Force Committee and the provincial specialized committee of the Partner to conduct farewell ceremonies for martyrs' remains at a rate of 30,000,000 VND per occasion, not exceeding two occasions per year;
g) Support expenses for mobilizing the people of the Partner province at a rate of 30,000,000 VND per team per year for one partner province;
h) Expenses for purchasing common medicines for prevention and treatment at a rate of 20,000,000 VND per team per year (excluding medicines provided by the Ministry of Defense according to regulations);
i) Expenses for purchasing diplomatic gifts when traveling to the Partner country to coordinate in implementing tasks at a rate of 30,000,000 VND per occasion, not exceeding two occasions per team per year for one partner province;
k) Expenses for hospitalization fees, patient transportation; purchasing water purification equipment; passport fees, other fees; renting means of transport, compensating damages to facilities, crops, and field produce (if any) during the course of duty;
l) Expenses for purchasing excavation tools (shovels, spades, crowbars, knives, machetes, and other items) at a rate of 10,000,000 VND per team per year.
2. The fuel guarantee expense standard specified in Point b and the contents of expenses specified in Point k Clause 1 of this Article shall be handled annually by the Ministry of National Defense, in coordination with the Ministry of Finance, to prepare budgets, settle accounts, and finalize accounts according to regulations.
Article 7. Guarantee for expenditures related to the activities of the Steering Committee, Special Task Force Committee, Professional Commission; Office, permanent agencies at various levels concerning the search and collection of martyrs' remains and military units assigned the task of collecting and completing files on martyrs, grave files, and welcoming relatives of martyrs
1. The national steering committee; special task force committees, professional commissions at all levels shall be guaranteed:
a) Expenses for sending delegations out and receiving delegations for negotiation and signing;
b) Support expenses for the Government's special task force committee, the special task force committee of provinces in Laos, the Government's professional commission, the professional commission of military regions and provinces in Cambodia, and other foreign organizations approved by the Prime Minister to organize coordinated activities for searching and collecting martyrs' remains;
c) Expenses for preliminary and final summary meetings; awards;
d) Expenses for propaganda activities.
2. Offices, permanent agencies, and professional agencies at all levels shall be guaranteed:
a) Equipment and means of operation as stipulated in Appendix III attached hereto;
b) Expenses for organizing information collection, processing, building, and perfecting documentation and data on martyrs and their graves; decoding unit symbols and emblems; mapping search and collection operations;
c) Expenses for publishing publications; maintaining public service activities related to the search and collection of martyrs' remains on the Electronic Information Portal;
d) Fuel, materials, and uniform guarantee expenses;
đ) Expenses for organizing memorial services, handovers, and burials of martyrs' remains.
3. Support expenses for units and localities in organizing information collection, perfecting documentation and files on martyrs and their graves; handing over grave records; supporting relatives or those who worship martyrs in searching for martyrs' graves.
4. The expenditure standards for the contents prescribed in Clauses 1, 2, and 3 of this Article shall be handled annually by the Ministry of National Defense, in coordination with the Ministry of Finance, to prepare budgets according to current regulations.
Chapter III
IMPLEMENTING PROVISIONS
11Article 8. Principles of Application
1. The regimes prescribed in Points a, b, and c Clause 1 and Point a Clause 2 Article 3 of this Decision shall be paid together with monthly salary and shall not be used to calculate contributions or benefits under social insurance and health insurance schemes.
2. The subjects prescribed in Clauses 1 and 4 Article 2 of this Decision shall cease to enjoy the regimes prescribed in Articles 3 and 4 of this Decision when they are not performing the mission of searching for and collecting烈士遗骸。
Article 9. Sources of Funding for Implementation
1. The funds to implement the policies and ensure the work stipulated in this Decision shall be guaranteed from the state budget in accordance with the laws on the state budget.
2. Annually, the Ministry of National Defense shall base on its tasks and prepare the budget estimate for implementation within the state budget estimate to submit to the Ministry of Finance for consolidation and presentation to the Prime Minister for decision.
3. Along with the allocated funds, localities and units are encouraged to allocate additional funds in accordance with the law to carry out the work of searching for and collecting烈士遗骸。
Article 10. Effective Date
1. This Decision shall take effect from February 1, 2014.
2. From the date this Decision takes effect, all systems and policies for organizations and individuals performing the mission of searching for and collecting烈士遗骸,as previously prescribed in other documents, shall be abolished.
Article 11. Responsibility for Implementation
1. The Ministry of National Defense and the Ministry of Finance shall provide guidance on the implementation of this Decision.
2. Ministers, heads of ministerial-level agencies, heads of government agencies, and Chairpersons of provincial-level People's Committees are responsible for enforcing this Decision./.

Pursuant to Resolution No. 61/NQ-CP dated July 11, 2017 of the Government on the regular meeting in June 2017;
"On the basis of the Law on Organization of the Government dated June 19, 2015;
Pursuant to Decree No. 31/2013/NĐ-CP dated April 9, 2013 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Those Who Have Contributed to the Revolution.
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;
The Prime Minister promulgates this Decision to amend and supplement some articles of Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of the Prime Minister on the system, policies, and support work for organizations and individuals performing the mission of searching for and collecting烈士遗骸。

This Point was amended pursuant to Clause 2, Article 1 of Decision No. 35/2017/QD-TTg amending and supplementing certain articles of Decision No. 75/2013/QD-TTg dated December 6, 2013 of the Government Chairman regarding the regime, policies, and work assurance for organizations and individuals performing tasks related to searching for and collecting烈士遗骸, effective from September 10, 2017.
This provision has been amended pursuant to Clause 3, Article 1 of Decision No. 35/2017/QĐ-TTg amending and supplementing certain provisions of Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of the Prime Minister regarding regulations on systems, policies, and support work for organizations and individuals performing tasks of searching for and collecting remains of revolutionary martyrs, which took effect from September 10, 2017.

This point has been amended pursuant to Clause 7, Article 1 of Decision No. 35/2017/QĐ-TTg amending and supplementing certain provisions of Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of the Prime Minister regarding regulations on systems, policies, and support work for organizations and individuals performing tasks of searching for and collecting remains of revolutionary martyrs, which took effect from September 10, 2017.
Articles 2 and 3 of Decision No. 35/2017/QĐ-TTg amending and supplementing certain provisions of Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of the Prime Minister regarding regulations on systems, policies, and support work for organizations and individuals performing tasks of searching for and collecting remains of revolutionary martyrs, which took effect from September 10, 2017, are stipulated as follows:
“Article 2. Effective Date
1. This Decision takes effect from September 10, 2017.
2. The specialized uniforms, equipment, and means of transport specifically provided for military personnel, workers, and civil servants assigned to search and collection teams; specialized equipment, logistical, and living support means for search and collection teams; and support means for the Steering Committee, Special Task Force, Special Commission, Office, and specialized agencies at all levels specified in Appendices I, II, and III attached to Decision No. 75/2013/QĐ-TTg that are still within their service life shall continue to be applied according to the provisions of Appendices I, II, and III attached to this Decision.
The Minister of National Defense shall strictly manage and use vehicles such as UOAT and Xitec fuel carriers issued under Appendix II attached to Decision No. 75/2013/QĐ-TTg, which are no longer equipped for search and collection teams as specified in Appendix II attached to this Decision.
3. The Circular Jointly Issued No. 66/2014/TTLT-BQP-BTC dated June 13, 2014 of the Ministry of National Defense and the Ministry of Finance guiding the implementation of Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of the Prime Minister regarding regulations on systems, policies, and support work for organizations and individuals performing tasks of searching for and collecting remains of revolutionary martyrs is hereby abolished.
Article 3. Responsibility for Implementation
1. The Minister of National Defense is responsible for guiding the implementation of Decision No. 75/2013/QĐ-TTg.
2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision.
12 Appendix I List of specialized uniforms provided in kind for military personnel, workers, and civil servants assigned to search and collection teams, issued together with Decision No. 75/2013/QĐ-TTg, effective from February 1, 2014, is replaced by Appendix I List of specialized uniforms provided in kind for military personnel, workers, and civil servants assigned to search and collection teams, as stipulated in Clause 2, Article 2 of Decision No. 35/2017/QĐ-TTg amending and supplementing certain provisions of Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of the Prime Minister regarding regulations on systems, policies, and support work for organizations and individuals performing tasks of searching for and collecting remains of revolutionary martyrs, which took effect from September 10, 2017.
13 Appendix II List of specialized equipment, means of transport, logistics, and living support for search and collection teams, issued together with Decision No. 75/2013/QĐ-TTg, effective from February 1, 2014, is replaced by Appendix II List of specialized equipment, means of transport, logistics, and living support for search and collection teams, as stipulated in Clause 2, Article 2 of Decision No. 35/2017/QĐ-TTg amending and supplementing certain provisions of Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of the Prime Minister regarding regulations on systems, policies, and support work for organizations and individuals performing tasks of searching for and collecting remains of revolutionary martyrs, which took effect from September 10, 2017.
Appendix III - List of equipment and means of assurance for the Steering Committee, Special Task Force Board, Professional Committees; Office of the permanent agency, specialized agencies at all levels issued together with Decision No. 75/2013/QĐ-TTg, effective from February 1, 2014, is replaced by Appendix III - List of equipment and means of assurance for the Steering Committee, Special Task Force Board, Professional Committees; Office of the permanent agency, specialized agencies at all levels as stipulated in Clause 2, Article 2 of Decision No. 35/2017/QĐ-TTg amending and supplementing certain articles of Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of the Prime Minister regarding the system of regulations, policies, and assurance work for organizations and individuals performing the mission of searching for and collecting remains of revolutionary martyrs, effective from September 10, 2017.
