DECREE

On National Universities

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Education Law dated December 2, 1998;

Pursuant to Decree No. 43/2000/NĐ-CP dated August 30, 2000 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

Considering the proposal of the Minister of Government Organization and Cadres Affairs and the Minister of Education and Training,

 

DECREE:

Article 1. A National University is a high-quality multi-disciplinary center for university education, postgraduate studies, scientific research, and technology application.

A National University has high autonomy in its activities related to education, scientific and technological research, finance, international relations, and organizational structure.

Article 2.A National University has legal personality, its own seal and bank account; it is responsible for annual plan targets assigned to it.

Article 3. A National University is under the state management of the Ministry of Education and Training; other ministries, sectors, and local people's committees where the National University is located, within the scope of their functions as prescribed by the Government and in accordance with the law.

Article 4. The organizational structure of a National University includes:

1. Member units:

a) Universities;

b) Research institutes for science and technology.

2. Subordinate Units:

a) Faculties;

b) Research centers for science and technology;

c) Units serving educational work, scientific research, and technology application.

3. Office and some functional boards assisting the Director of the National University.

The Prime Minister decides on the establishment, merger, division, and dissolution of units as stipulated in Clause 1 of this Article.

Article 5. A National University has a National University Council, the composition of which is determined by the Prime Minister.

The National University Council collectively resolves on: the strategy, planning, and development plans of the National University, the organization and operational regulations of member units, faculties, and science and technology research centers subordinate to the National University in accordance with the Regulations on the Organization and Operation of the National University.

Article 6. A National University has a Director and Deputy Directors. The Director and Deputy Directors of the National University are appointed and relieved of duty by the Prime Minister.

The Director of the National University is the legal representative, responsible for all aspects of the National University's operations; implements the resolutions of the National University Council; decides on the establishment, merger, division, and dissolution of units as stipulated in Clauses 2 and 3 of Article 4 of this Decree in accordance with the Regulations on the Organization and Operation of the National University.

Article 7. Based on the provisions of this Decree, the Prime Minister decides on the establishment, merger, division, and dissolution of National Universities; promulgates the Regulations on the Organization and Operation of the National University.

Article 8. This Decree takes effect fifteen days from the date of signature. It abolishes Decree No. 97/CP dated December 10, 1993 of the Government on the establishment of the Hanoi National University, and Decree No. 16/CP dated January 27, 1995 of the Government on the establishment of the Ho Chi Minh City National University. It also abolishes previous regulations that conflict with this Decree.

Article 9. The Minister of Education and Training, the Minister of Science, Technology, and Environment, the Minister and Head of the Government Organization and Cadres Affairs, the Ministers of other ministries, heads of agencies equivalent to ministries, government agencies, Chairmen of provincial and centrally-administered city People's Committees, and Directors of National Universities are responsible for implementing this Decree./.
