Pursuant to Government Decree No. 43/2000/NĐ-CP dated August 30, 2000 detailing and guiding the implementation of certain provisions of the Education Law;

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of Ministries and ministerial-level agencies;

At the proposal of the Director of the General Secondary Education Department,

DECISION:

Article 1. Now, we amend and supplement certain articles in the Examination Regulations for Secondary School Graduation, Specialized Secondary School, and Junior High School issued pursuant to Decision No. 15/1998/QĐ-BGD&ĐT dated April 1, 1998, Decision No. 07/1999/QĐ-BGD&ĐT dated February 27, 1999, and Decision No. 03/2000/QĐ-BGD&ĐT dated February 28, 2000 of the Minister of Education and Training as follows:

1. Amend Clause 1 of Article 6 as follows:

Students following which program (General Secondary School, Specialized Secondary School, Junior High School) will take the examination according to that program. The examination content covers the entire curriculum of the final grade (Grade 9 for Junior High School, Grade 12 for General Secondary School, Specialized Secondary School).

2. Amend and supplement Article 8 as follows:

Students mentioned in Clause 1 of Article 7 shall be recognized as meeting the conditions to take the examination if:

1) They have completed the full curriculum of their level of education, received an average annual evaluation in the final grade with conduct rated at least satisfactory, and not rated as poor in academic performance according to current regulations; they have not been temporarily detained or deprived of civil rights during the examination period.

2) The total number of days absent from the final grade does not exceed 45 days (whether in one absence or multiple absences combined).

For students who are currently studying but do not meet the conditions to take the examination, the Principal shall notify the student and their family ten days before the examination date.

Directing, inspecting, and guiding the police at the commune level on registration and management of residence; guiding registration to ensure community reintegration for individuals who have completed serving prison sentences and reside in the locality; managing, operating, and utilizing the Database on Residence."

Not exceeding twenty years old for the Junior High School graduation examination, not exceeding twenty-four years old for the General Secondary School or Specialized Secondary School graduation examination.

4. Amend the first sentence of Article 14 as follows:

Students who do not violate the Examination Regulations, do not have any subject scored zero, and achieve the required average score for each category as follows:

5. Amend Clause 2 of Article 16 as follows:

Students exempted from taking the examination shall also be classified as having graduated if they meet the following conditions and their average graduation score is calculated as follows:

a) Excellent: If academic performance is rated excellent and conduct is rated good; the average graduation score is 9.0

b) Good: If both academic performance and conduct are rated at least good; the average graduation score is 7.0.

c) Average: If academic performance is not rated as poor and conduct is rated at least satisfactory; the average graduation score is 5.0

6. Supplement the duties of the Printing Committee at Clause 2 of Article 30 as follows:

The Printing Committee is responsible for printing sample questions, reviewing the questions, identifying and reporting any deficiencies in the questions to the Question Setting Committee of the Ministry of Education and Training for guidance on corrections and supplements before proceeding with printing for students.

7. Amend Clause 1 of Article 34 as follows:

The Examination Marking Committee for each level of education is established by the decision of the Director of the Provincial Department of Education and Training.

Each province or centrally governed city may establish one or more Examination Marking Committees for each level of education based on the number of candidates and specific local conditions.

The establishment of the Sealing Committee for each level of education independently from the Examination Marking Committees for graduation examinations is carried out according to the requirements and conditions of each locality. The composition, number, tasks, and powers of the Sealing Committee are defined by the Director of the Provincial Department of Education and Training and reported to the Ministry of Education and Training.

8. Amend and supplement Point 4 Subsection 2.1 Clause 2 of Article 34 as follows:

Examiners must be teachers currently or previously teaching the subjects in the final grade, and they must not have children or siblings participating in the examination. The number and specific tasks of the Examiners are determined by the Director of the Provincial Department of Education and Training.

9. Amend and supplement Article 40 as follows:

The Director of the Provincial Department of Education and Training is responsible for managing and directing the issuance of Junior High School graduation certificates, Secondary School graduation certificates, various types of graduation certificates, certificates related to bonus point awards, and certificates for priority status in the graduation examination according to the regulations and guidelines of the Ministry of Education and Training.

10. Amend Article 44 as follows:

Disciplinary actions against civil servants who are officials or teachers involved in the graduation examination shall be implemented according to the provisions of Decree No. 97/1998/NĐ-CP dated November 17, 1998, and the Government's regulations on disciplinary measures and financial responsibility for civil servants, and Circular No. 05/1999/TT/TCCP dated March 27, 1999, guiding the implementation of this Decree by the Civil Service Management Board.

For those who are not civil servants participating in final examinations, penalties shall be implemented in accordance with the provisions of labor contracts and current laws.

Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.

Article 3. Chairmen of People's Committees of provinces and centrally governed cities, Heads of Ministries' Offices, Directors of the General Secondary Education Department, heads of units under the Ministry of Education and Training, and Directors of Provincial Departments of Education and Training are responsible for implementing this Decision./.
