CIRCULAR
GUIDELINES ON THE PROCEDURES FOR REGISTERING NATIONAL ANTIQUITIES, ARTIFACTS, AND TREASURES
Pursuant to Article 42 of the Law on Cultural Heritage and Article 23 of Decree No. 92/2002/NĐ-CP dated November 11, 2002 of the Government detailing certain provisions of the Law on Cultural Heritage regarding the registration of national antiquities, artifacts, and treasures.
The Ministry of Culture and Information hereby provides guidance as follows:
I. GENERAL PROVISIONS
1. Organizations and individuals who are owners or legally managing national antiquities, artifacts, and treasures (hereinafter referred to as owners of national antiquities, artifacts, and treasures) that are not part of national museums, specialized museums, provincial museums, or historical and cultural sites and scenic spots already classified shall register with the Department of Culture and Information at their place of residence.
2. National antiquities, artifacts, and treasures currently in dispute over ownership rights may only be registered after the ownership or legal management rights have been clearly determined.
3. For national antiquities, artifacts, and treasures belonging to national museums, specialized museums, provincial museums, or historical and cultural sites and scenic spots already classified, they shall be inventoried and preserved according to the provisions of the Law on Cultural Heritage.
II. SPECIFIC PROVISIONS
1. Registration procedures and formalities.
- The owner of national antiquities, artifacts, and treasures shall submit a request for registration of national antiquities, artifacts, and treasures (Model Appendix 1 attached hereto) to the Department of Culture and Information at their place of residence.
- Within fifteen days from the date of receipt of the application from the owner of national antiquities, artifacts, and treasures, the Department of Culture and Information shall be responsible for reviewing and responding regarding the time limit for organizing the registration. Within fifteen days from the completion of the registration formalities, the Department of Culture and Information shall be responsible for issuing a Certificate of Registration of National Antiquities, Artifacts, and Treasures (Model Appendix 4 attached hereto) to the owner of national antiquities, artifacts, and treasures.
2. Content of registration of national antiquities, artifacts, and treasures.
- The registration of national antiquities, artifacts, and treasures shall be carried out using the Registration Form and the Register of National Antiquities, Artifacts, and Treasures (Model Appendices 2 and 3 attached hereto).
3. Content of the Registration Form for National Antiquities, Artifacts, and Treasures:
a) Registration number: To be specified by the Department of Culture and Information.
b) Date of registration: Record the date/month/year when the item was registered.
c) Name of the item: Record the name of the item according to its type, material, decoration, etc. (Example: White porcelain bowl with blue painting).
d) Classification:
- Determine the age and value of the registered item as an antiquity, artifact, or national treasure based on the criteria set forth in Article 4 of the Law on Cultural Heritage and Article 2 of the Decree detailing certain provisions of the Law on Cultural Heritage, then mark (X) in the corresponding box:

- For national treasures, a Decision recognizing them must be attached from the Prime Minister.
đ) Quantity:
- Quantity of items: If the item consists of only one unit, record 01 (For example: A single inkstone is recorded as 01); if the item consists of multiple parts, record the number of parts constituting a single inventory unit of the item (For example: A male traditional Vietnamese costume set consisting of three parts is recorded as 03 (trousers, shirt, scarf); a ceramic lamp stand consisting of two parts is recorded as 02 (lamp body, lamp base). A tea set consisting of 01 pot, 04 cups (glasses), 04 plates is recorded as 09 (one pot, four cups, four plates).
e) Dimensions:
- Dimensions are measured in centimeters. Clearly record the basic dimensions of the item: diameter of mouth (DM:), diameter of bottom (DB:), height (H:); for rectangular items, record length (L:), width (W:), height (H:).
- For dimensions that are difficult to determine, additional reference points for measurement should be noted.
g) Weight:
- Weight is measured in grams. Precious metal items should be recorded according to the weight indicated on a precision scale.
h) Description:
Briefly describe the characteristics of the item in the following sequence:
- Name of the item
- Material.
- Shape (from top to bottom, inside to outside).
- Color.
- Decorative theme.
- Decorative technique.
- Special marks (e.g., burn marks, ink stains, cracks, breaks, fractures...).
i) Origin and source:
Clearly record the origin of the item:
- Collected
- Donated, given
- Exchanged, transferred
- Purchased
- Inherited.
- Other forms.
k) Age:
Based on the results of the appraisal, record the age of the item according to absolute or relative dating and origin.
- Absolute dating records the exact year the item was made or formed.
- Relative dating records the period the item was made or formed according to geological eras or historical periods: Paleolithic, Mesolithic, Neolithic, Ly Dynasty, Tran Dynasty, Early Le Dynasty, Nguyen Dynasty, etc.
l) Preservation status:
- Clearly record the preservation condition: intact, cracked, broken, torn, decayed, repaired...
m) Appraisal Committee:
- Clearly record the location of the Appraisal Committee and the names of the appraisers.
n) Change of ownership:
- Clearly record the names, addresses, and times of change of previous owners.
o) Owner's name and address:
- The owner signs, records their full name and contact address.
p) Film number: Record the film number of the item's photograph.
q) Form number: Record the sequential number of the registration form as specified by the Department of Culture and Information.
Item photograph: Take two types of photographs showing the basic features of the item. One overall photo and one detailed photo highlighting the most important feature for research or identification purposes can be taken.
The Registration Form shall be prepared in duplicate. The registration team retains one copy, and the owner of the national antiquities, artifacts, and treasures retains one copy.
4. Register of National Antiquities, Artifacts, and Treasures.
- The content recorded in the Register of National Antiquities, Artifacts, and Treasures is the content of the Registration Form for National Antiquities, Artifacts, and Treasures. However, the description section may be summarized. The Notes section of the Register of National Antiquities, Artifacts, and Treasures records issues that the registration team deems necessary to note for monitoring and managing the item.
III. IMPLEMENTATION
1. Responsibilities of the Department of Culture and Information.
- Establish a Registration Team for National Antiquities, Artifacts, and Treasures and appoint a member of the Department's Management Board as the Team Leader.
- Assign to the provincial museum or the provincial relic management board to serve as the permanent body of the Registration Group for cultural relics, antiques, and national treasures, and appoint staff with expertise in appraising cultural relics, antiques, and national treasures from the museum or relic management board to participate in the Registration Group. In cases where necessary, the Department of Culture, Sports and Tourism may invite experts on cultural relics, antiques, and national treasures from research institutions to participate as scientific collaborators.
- Develop plans and budget estimates for the registration of cultural relics, antiques, and national treasures.
2. Responsibilities of the Registration Group.
- Receive applications, review them, and respond to the owners of cultural relics, antiques, and national treasures regarding the plan for organizing the registration according to the authority specified in this Circular.
- Organize the appraisal and registration of cultural relics, antiques, and national treasures.
- Report the registration results to the Director of the Department of Culture, Sports and Tourism and request the Director of the Department of Culture, Sports and Tourism to issue a Certificate of Registration for cultural relics, antiques, and national treasures.
- Manage the Registration Forms for cultural relics, antiques, and national treasures, the Register Books for cultural relics, antiques, and national treasures, films, and other related documents.
- The Registration Group may cooperate with the local government's cultural and information management agency at the district level to organize mobile registration activities in different areas within their jurisdiction.
3. Responsibilities of the owners of cultural relics, antiques, and national treasures.
- Owners are responsible for paying fees and charges as prescribed by law and complying with professional requirements set forth by the Department of Culture, Sports and Tourism and the Registration Group for cultural relics, antiques, and national treasures.
IV. IMPLEMENTATION PROVISIONS
1. This Circular takes effect fifteen days after its publication in the Official Gazette.
2. The Heritage Department is responsible for monitoring, guiding, and inspecting the implementation of this Circular.
