Guidelines on the system for increasing pay grades for professional military personnel and civil servants, defense officials receiving salaries from state budget funds
To implement Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for civil servants, public officials, and military personnel.
Pursuant to Circular No. 03/2005/TT-BNV dated January 5, 2005 issued by the Ministry of Home Affairs guiding the implementation of the regular increase in pay grade system and early increase in pay grade system for cadres, civil servants, and officials.
After reaching agreement with the Ministry of Finance, the Ministry of National Defense guides the system for increasing pay grades for professional military personnel and civil servants, defense officials as follows:
I. OBJECTS AND SCOPE
1. Object and scope of application.
Professional military personnel; civil servants, defense officials, and contractual employees who have decisions from the General Staff Office currently receiving salaries according to the professional military personnel salary table and other specialized, vocational, administrative, and service salary tables issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, officials, and armed forces.
2. Non-applicable objects.
- Professional military personnel who have been decided to be retired or have reached the final pay grade in their group;
Civil servants, defense officials who have been decided to stop working or have reached the final pay grade in their position.
- Those working under contracts not classified under the wage scales prescribed by the State.
II. CONDITIONS AND STANDARDS FOR INCREASING PAY GRADES
Professional military personnel, civil servants, and defense officials falling within the object defined in Point 1, Section I of this Circular shall be eligible for consideration for an increase in pay grade if they meet the following conditions and standards:
1. Time condition
The time period for holding a pay grade within the professional military personnel group or civil servant, defense official position to consider a regular increase in pay grade is stipulated as follows:
- Civil servants, defense officials who have not yet reached the final pay grade in the civil servant, defense official positions of Class B and Class C of Table 2, Table 3 and the administrative, service positions classified under Table 4 as prescribed in Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government, shall be considered for an increase in pay grade after two years (24 months) of holding the current pay grade in the position.
- Professional military personnel who have not yet reached the final pay grade in the professional military personnel salary table (Table 7); civil servants, defense officials who have not yet reached the final pay grade in the civil servant, defense official positions from Class A0 to Class A3 of Table 2, Table 3 as prescribed in Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government, shall be considered for an increase in pay grade after three years (36 months) of holding the current pay grade in the group or position.
2. Standards for increasing pay grades.
Professional military personnel, civil servants, and defense officials meeting the time condition for holding a pay grade within the group or position as stipulated in Point 1, Section II of this Circular and passing the following standards throughout the time holding the previous pay grade shall be eligible for an increase in one pay grade:
2.1. Completing assigned duties and responsibilities at the required quantity, volume, quality, and time.
2.2. Adhering well to regulations, without violating national laws or military discipline to the extent of being disciplined with a reprimand or higher.
3. Regarding early increase in pay grade.
3.1. Professional military personnel, civil servants, and defense officials who, during the time holding the previous pay grade, achieve outstanding results in performing tasks (awarded the title of Model Soldier at the grassroots level or higher) but have not yet reached the final pay grade in the group or position and still lack from one month to twelve months to qualify for a regular increase in pay grade shall be considered for an early increase in pay grade up to a maximum of twelve months ahead of the time stipulated in Point 1, Section II of this Circular, and such early increase in pay grade shall not be implemented twice during the time holding one pay grade.
The ratio of professional military personnel, civil servants, and defense officials eligible for an early increase in pay grade due to outstanding achievements in performing tasks in one year shall not exceed five percent of the total number of professional military personnel, civil servants, and defense officials within the payroll establishment of the agency or unit (excluding those specified in Item 8.2, Point 8, Section II of this Circular).
3.2. Professional military personnel, civil servants, and defense officials who have a decision to take retirement preparation leave and complete assigned tasks during the time holding the previous pay grade but have not yet reached the final pay grade in the position or group shall be considered for an early increase in pay grade of one year (twelve months) ahead of the time stipulated in Point 1, Section II of this Circular.
III. IMPLEMENTATION
1. Professional military personnel, civil servants, and defense officials who are authorized to be sent to work as experts, study, intern, or work domestically and abroad and remain on the list paid by the military shall have such time counted towards the time for considering an increase in pay grade if they meet the prescribed standards.
In cases where the time spent working as an expert, studying, interning, or working domestically and abroad exceeds the period prescribed by the competent authority; the time of suspension of duty, detention, or arrest shall not be counted towards the time for considering an increase in pay grade.
2. Professional military personnel, civil servants, and defense officials working in projects, joint ventures, etc., where salaries are not paid by the military, the time worked for these organizations shall not be counted towards the time for considering an increase in pay grade.
3. Professional military personnel, civil servants, and defense officials who fail to complete assigned tasks or are disciplined with a reprimand or higher shall have the time for considering an increase in pay grade extended by one year (twelve months) compared to the time stipulated in Point 1, Section II above.
4. Units directly subordinate to the Ministry shall base on these guidelines to plan and implement the increase in pay grade for professional military personnel and civil servants, defense officials under their management according to the Ministry's classification.
5. The Military Personnel Department - General Staff Office, the Cadre Department - Political Commissariat, the Finance Department - Ministry of National Defense shall coordinate with relevant agencies to inspect the annual implementation of pay grade increases for professional military personnel and civil servants, defense officials and have the right to immediately revoke incorrect pay grade increase decisions for professional military personnel and civil servants, defense officials.
The head of the unit shall be responsible for compensating the amount of salary that was incorrectly decided if they improperly handle the matter of increasing the pay grade. This Circular takes effect fifteen days after its publication in the Official Gazette; the regulations on increasing the pay grade for professional military personnel and defense civil servants shall be implemented from October 1, 2004. All previous provisions contrary to this Circular are hereby abolished.
In the course of implementation, if there are any difficulties, agencies and units shall report them to the Ministry (through the General Staff Department, the Cadre Department, and the Finance Department) for consideration and resolution./.
