CIRCULAR

Directives to amend Point 2, Clause 8, Article 79 of Circular No. 01/2004/TT-BYTdated January 6, 2004 issued by

the Minister of Health guiding private medical and pharmaceutical practice

To facilitate conditions and gradually manage private optical service activities more strictly, the Ministry of Health issues directives to amend and supplement Point 2, Clause 8, Article 79 of Circular No. 01/2004/TT-BYT dated January 6, 2004 guiding private medical and pharmaceutical practice (hereinafter referred to as Circular No. 01/2004/TT-BYT) as follows:

 

1. Optical service facilities existing before the effective date of Circular No. 01/2004/TT-BYT, if meeting the conditions regarding personnel engaged in specialized work and physical infrastructure, equipment as stipulated in Point d, Clause 1, Article 36 of Circular No. 01/2004/TT-BYT, and at the same time, the head does not have a high school diploma in health but holds a certificate on medical equipment training issued by a training institution designated by the Ministry of Health, the Department of Health shall organize on-site inspections to allow these optical service facilities to continue operations until December 31, 2007. If by December 31, 2007, an optical service facility fails to meet the condition regarding the head, it must cease operations.

2. This Circular takes effect fifteen days from the date of publication in the Official Gazette. Point 2, Clause 8, Article 79 of Circular No. 01/2004/TT-BYT and Point 1, Clause 2 of Circular No. 09/2004/TT-BYT dated September 14, 2004 issued by the Ministry of Health guiding amendments and supplements to some points of Circular No. 01/2004/TT-BYT dated January 6, 2004 issued by the Minister of Health guiding private medical and pharmaceutical practice are hereby repealed./.
