THE MINISTER OF TRADE
Based on the Agreement between the Ministry of Trade of the Socialist Republic of Vietnam and the Ministry of Trade of the Lao People's Democratic Republic on goods benefiting from preferential import tariff rates, signed on July 28, 2005;
Based on Decree No. 29/2004/NĐ-CP dated January 16, 2004 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Trade;
To implement the guidance of the Prime Minister in Document No. 4672/VPCP-QHQT dated August 19, 2005 approving the Agreement with the Lao Ministry of Trade on goods benefiting from preferential import tariff rates between Vietnam and Laos;
After reaching consensus with the Ministry of Trade of the Lao People's Democratic Republic,
DECISION:
Article 1. Apply the tariff quota for the year 2006 for three imported goods from Laos: rice, tobacco leaves and stalks, and motorcycle accessories. The commodity codes and total quantity of the tariff quota for the year 2006 for these goods are set forth in Appendix I attached to this Decision.
Article 2. Extend the import period under the tariff quota for the year 2005 for rice as specified in Decision No. 2581/2005/QĐ-BTM dated October 26, 2005 of the Ministry of Trade regarding the importation under the tariff quota for the year 2005 for two goods originating from Laos with a zero percent import duty until March 31, 2006.
Article 3. Enterprises with business registration certificates for relevant product categories importing rice, tobacco leaves and stalks, and motorcycle accessories originating from Laos shall enjoy a zero percent import duty within the tariff quota provided that they import from designated lead enterprises in Laos listed in Appendix II attached to this Decision. For tobacco stalks, only enterprises that have notified their 2006 tobacco raw material import plans to the Ministry of Industry may import.
Article 4. Goods imported as specified in Article 1 and Article 2 of this Decision shall be cleared through border gates as specified in Appendix III attached to this Decision and within the total quantity of the tariff quota for the year 2006 and the extended quantity of the rice tariff quota for the year 2005. Import procedures for goods with a zero percent preferential import duty shall be processed at the customs office where the import procedures are carried out according to the principle of automatic retroactive deduction (the total quantity of the tariff quota minus the quantity of each commodity imported with a Certificate of Origin in Form S - C/O issued by the competent authority of the Lao People's Democratic Republic in accordance with regulations).
Imports exceeding the total quantity of the tariff quota specified in Article 1 and Article 2 of this Decision shall be implemented in accordance with Decision No. 60/2005/QĐ-BTC dated August 31, 2005 of the Ministry of Finance on the import tariff rate for goods imported from Laos.
Article 5. This Decision takes effect fifteen days after its publication in the Official Gazette and remains effective until December 31, 2006./.
