Announcing the port waters area within the jurisdiction of Thai Binh Province and under the management of Thai Binh Maritime Port Office
On the basis of Government Decree No. 34/2003/NĐ-CP dated April 4, 2003, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
On the basis of Government Decree No. 71/2006/NĐ-CP dated July 25, 2006, on the management of seaports and maritime channels;
On the basis of the opinion of the People's Committee of Thai Binh Province at Official Letter No. 1710/UBND-CN dated October 17, 2006;
Considering the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration.
1. Now announcing the port waters area within the jurisdiction of Thai Binh Province including:
DECISION:
Article 1
a) The waters in front of the wharf of Diem Dien Seaport;
b) The waters of the port channel, branch channel, pilot station, quarantine area, anchorage, transshipment area, and storm shelter of Diem Dien Seaport.
2. Other waters in front of the wharf, anchorage, transshipment area, and storm shelters are announced according to the provisions of the law.
The extent of the Diem Dien Seaport waters within the jurisdiction of Thai Binh Province is measured from the highest tide level and is specified as follows:
Article 2. 1. The seaward boundary: limited by straight lines connecting points A1, A2, A3, A4, and A5, with the following coordinates:
A1: 22
33'48"N, 106032'00"E, 106044'15"E;
A2: 20038'36"E;030'00"N, 106
A3: 20037'00"E;030'00"N, 106
A4: 20037'00"E;033'12"N, 106
A5: 20034'12"E;02. The landward boundary: limited from point A1 to point A5 along the Diem Dien River to the Diem Dien Bridge, including the Diem Dien sluice and Quang Lang canal.
The pilot station, quarantine area, anchorage, transshipment area, and storm shelter for vessels entering the Diem Dien Seaport within the jurisdiction of Thai Binh Province are defined as follows:
Article 3. 1. Pilot station, quarantine area: the water area limited by a circle with a radius of 0.5 nautical miles, with the center located at the coordinates:
20030'42"N, 106037'53"E;
2. Anchorage, transshipment area, and storm shelter: the water area limited from the mouth of the Diem Dien River to 100 meters downstream of the Diem Dien Gate. For fishing vessels, they can only anchor in the Quang Lang canal from the mouth of the Diem Dien River up to 300 meters deep into the canal.
Thai Binh Maritime Port Office shall be responsible for:
Article 4. 1. Performing its duties and powers as prescribed by the Vietnam Maritime Code and related laws concerning maritime activities in the Diem Dien Seaport waters within the jurisdiction of Thai Binh Province.
2. Based on actual conditions regarding weather, waves, draft, and vessel tonnage, designating specific positions for vessels to pick up pilots, undergo quarantine, anchor, transship, and seek shelter from storms in the areas specified in Article 3 of this Decision, ensuring maritime safety, maritime security, and environmental protection.
Outside the areas specified in Articles 2 and 3 of this Decision, Thai Binh Maritime Port Office shall also be responsible for state management of maritime safety and security in the sea areas within the jurisdiction of Thai Binh Province.
Article 5. This Decision takes effect fifteen days after its publication in the Official Gazette and revokes Decision No. 1027/1999/QĐ-BGTVT dated April 29, 1999 of the Ministry of Transport on the waters of the Diem Dien Seaport in Thai Binh Province.
Article 6. The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of the Departments under the Ministry, the Directors of the Vietnam Maritime Administration, the Vietnam Inland Waterways Administration, the Director of the Thai Binh Department of Transport, the Director of Thai Binh Maritime Port Office, and the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Decision./.
