DIRECTIVE

On strengthening the work of popularizing and educating about traffic laws for the period of 2008-2012

Implementation of Resolution No. 61/2007/NQ-CP dated December 7, 2007 of the Government on continuing to implement Directive No. 32-CT/TW dated December 9, 2003 of the Central Committee of the Communist Party of Vietnam on enhancing the leadership of the Party in the work of popularizing and educating about laws, raising awareness of law compliance among cadres and people; the Popularization and Education Program on Laws from 2008 to 2012 issued with Decision No. 37/2008/QD-TTg dated March 12, 2008 of the Prime Minister, the Minister of Transport has issued the Plan on Popularizing and Educating about Laws in 2008 of the Ministry of Transport pursuant to Decisions No. 530/QD-BGTVT dated March 4, 2008 and No. 1044/QD-BGTVT dated April 16, 2008. In recent times, the transport sector has implemented the work of popularizing and educating about laws (PBGDPL) through various measures and forms to gradually improve the quality and effectiveness of this work, contributing to strengthening state management in the field of transport, ensuring traffic safety... As a result, the awareness of law compliance regarding transport of cadres, civil servants, employees, and citizens has gradually increased, making a significant contribution to curbing and reducing traffic accidents.

 

 

However, the work of PBGDPL in the transport sector still has many limitations, manifested in the inadequate understanding of some agencies, units, and individuals about the position, role, and importance of this work; the programs and contents of PBGDPL are still lacking in attractiveness, scattered, formalistic, and not deep enough; the forms and methods of PBGDPL have not been updated promptly; the staff working on PBGDPL are insufficient in number, weak in capability, and unable to meet new requirements; financial resources, materials, and equipment serving PBGDPL are still lacking; the mechanism for coordination between forces conducting PBGDPL in the transport sector and political-social organizations, local authorities at all levels is still problematic, failing to fully mobilize the strength of the entire political system and society's participation.

To enhance the quality and effectiveness of PBGDPL on transport in the new situation, aiming to achieve the goals of the Popularization and Education Program on Laws from 2008 to 2012 of the Prime Minister, the Minister of Transport issues the following directive:

1. Continue to thoroughly implement Directive No. 32-CT/TW dated December 9, 2003 of the Central Committee of the Communist Party of Vietnam, and guiding documents of the Party and State on the work of PBGDPL; organize the implementation of the Popularization and Education Program on Laws from 2008 to 2012 issued with Decision No. 37/2008/QD-TTg dated March 12, 2008 of the Prime Minister and the Annual Plan on Popularizing and Educating about Laws of the Ministry of Transport. Enhance the understanding of the position, role, and importance of PBGDPL throughout the industry, recognizing PBGDPL as part of political and ideological education but also as a solution that is both urgent and fundamental and long-term, aimed at building a cultural lifestyle in transport, forming habits of law compliance among cadres, civil servants, employees in the entire industry, and citizens when participating in transport.

2. By the end of 2012, the work of PBGDPL on transport must strive to achieve the following specific goals:

a) From 80 to 90% of the population nationwide will be informed about specialized transport laws relevant to each group of residents according to different areas and targets;

b) Over 95% of cadres, civil servants, and employees in the transport sector will be equipped with legal knowledge related to their professional activities through various forms;

c) 95% of organizations and individuals operating in the transport sector will be informed and popularized about legal regulations related to business activities through various forms.

3. The content of PBGDPL needs to be selected reasonably, systematically, ensuring effectiveness and practicality for each target group and each locality, specifically:

a) For cadres, civil servants, and employees in the transport sector: in addition to regularly equipping them with basic knowledge of general laws, focus should be placed on essential contents such as their tasks and powers in the operation of agencies and units; it is necessary to recognize that cadres, civil servants, and employees in the transport sector must be pioneers and models in complying with traffic laws. The annual assessment, classification, and commendation of cadres, civil servants, and employees in agencies and units must take into account the completion of assigned PBGDPL tasks;

b) For organizations and individuals engaged in business in the transport sector: focus should be placed on legal normative documents directly related to their production and business activities in the transport sector;

c) For other subjects (traffic participants): focus should be placed on specific provisions of laws concerning traffic safety, appropriate to the educational level of each subject and locality; it is necessary to summarize and statistically analyze common violations of traffic laws to then concentrate on targeted and effective propaganda.

4. Forms and methods of PBGDPL

4. Forms and methods of popularizing laws

a) Reform and improve the quality of legal education and publicity forms: integrate legal education and publicity content into cultural and artistic activities, political life activities; provide legal education materials and build legal bookshelves; organize specialized reports on traffic laws; organize contests to understand traffic laws; introduce the entire content of legal documents through publications and electronic information pages, which can be compiled in question-and-answer format for propaganda, guidance, and explanation of legal documents; enhance the introduction of legal provisions through oral propaganda methods, organizing direct exchanges and dialogues, answering requests from the audience to promote initiative in absorbing legal knowledge; utilize the enforcement activities of agencies such as inspection, supervision, licensing... to disseminate and guide the implementation of legal provisions.

b) Proactively coordinate with communication agencies, strengthen legal education and publicity on mass media; set examples of good people and deeds in complying with traffic safety regulations.

c) Proactively coordinate with agencies, social organizations, political and social organizations, domestic and foreign enterprises to directly disseminate and educate the law to each household, each citizen, each civil servant, employee, and worker; incorporate compliance with traffic safety laws into criteria for commendation, rewards, and annual performance evaluations of civil servants, employees, and workers.

d) Accelerate the socialization of legal education and publicity work to mobilize all available resources in society.

5. Focus on investing in conditions to ensure legal education and publicity work.

a) Regarding personnel for legal education and publicity work:

All General Bureaus, Bureaus, Departments of Transport, Departments of Transport and Public Works must assign competent staff to perform legal affairs, one of the main tasks being to assist the heads of agencies and units in organizing legal education and publicity work. Develop plans to train legal knowledge for the cadre of legal affairs staff who have not been trained in law.

b) Regarding institutional framework:

Develop the Legal Education and Propaganda Program on Transport Law for the period 2008-2012 and the Annual Legal Education and Propaganda Plan to organize legal education and publicity work throughout the industry.

c) Regarding materials and equipment:

Develop a list of basic equipment and materials to serve legal education and publicity work, guiding the compilation and issuance over the next few years. Strengthen the compilation and issuance of new effective legal education materials. Establish mechanisms to reduce prices or provide free certain essential legal documents for state management agencies, individuals in remote areas, and those in particularly difficult economic conditions.

d) Regarding funding:

The Finance Department and relevant units under the Ministry, Departments of Transport, Departments of Transport and Public Works must establish a mechanism to allocate budget specifically for legal education and publicity work according to regulations. The Finance Department shall take the lead and coordinate with the Legal Affairs Department in allocating funds for legal education and publicity work to units under the Ministry in accordance with Circular No. 63/2005/TT-BTC dated August 5, 2005 of the Ministry of Finance guiding the management and use of funds to ensure legal education and publicity work and current financial regulations.

Enhance the mobilization of funds from projects, programs, and other sources to serve legal education and publicity work. Projects and programs of the Ministry need to supplement necessary funds for institutional development and legal education and publicity.

6. Departments, General Bureaus, Bureaus, Institutes, Inspectors, Offices, and subordinate units of the Ministry shall be responsible for:

a) Developing the Legal Education and Propaganda Program for the period 2008-2012 and the Annual Implementation Plan of their own units, submitting them to the Ministry of Transport (through the Legal Affairs Department) for review and inclusion in the Legal Education and Propaganda Program for the period 2008-2012 and the Annual Legal Education and Propaganda Plan of the Ministry.

- Main contents of the Program and Plan include:

+ Specific targets requiring legal education and publicity;

+ Legal content to be disseminated to each target group;

+ Suitable forms of legal education and publicity for each area and target group;

+ Time frame and progress schedule;

+ Implementation measures.

- Deadline for submitting the Program and Plan to the Ministry:

+ Submit the Legal Education and Propaganda Program for the period 2008-2012 of their own units to the Ministry before August 31, 2008;

+ Annually, submit the Legal Education and Propaganda Plan for the following year to the Ministry before October 1 (accompanied by the budget estimate for implementing the Legal Education and Propaganda Plan of their own units).

b) Organize and strictly implement the Legal Education and Propaganda Program from 2008 to 2012 issued together with Decision No. 37/2008/QĐ-TTg dated March 12, 2008 of the Prime Minister; the Legal Education and Propaganda Program for the period 2008-2012 after the Ministry of Transport issues it and the Annual Legal Education and Propaganda Plan of the Ministry of Transport.

Specifically, educational institutions under the Ministry must strengthen legal education and publicity on transport law (specifically the Road Traffic Law and related specialized transport laws) for students.

7. Departments of Transport, Departments of Transport and Public Works shall be responsible for:

a) Developing the Legal Education and Propaganda Program for the period 2008-2012 and the Annual Legal Education and Propaganda Plan to submit to the provincial People's Committee for review and approval according to the regulations of the provincial People's Committee, including content on disseminating and educating the Road Traffic Law to students at educational and training facilities in the locality.

b) Organize and strictly implement the Law Popularization and Education Program from 2008 to 2012 issued together with Decision No. 37/2008/QĐ-TTg dated March 12, 2008 of the Prime Minister; the Law Popularization and Education Program for the 2008-2012 period after its issuance by the Ministry of Transport; and the annual Law Popularization and Education Plan of the Ministry of Transport.

8. The Information Technology Center of the Ministry shall be responsible for coordinating with the Legal Department, relevant Bureaus, and mass media agencies within the transport sector to open a section on Law Popularization and Education and increase the volume of direct Law Popularization and Education information on the Ministry of Transport's website.

9. Mass media agencies within the transport sector: Transport News, industry magazines... need to strengthen the publication of contents and diversify forms of Law Popularization and Education on newspapers and magazines.

10. The Legal Department shall be responsible for:

a) Taking the lead in organizing the establishment of the Law Popularization and Education Program for the 2008-2012 period and the annual Law Popularization and Education Plan of the Ministry of Transport based on programs and plans developed by agencies and units under the Ministry of Transport; serving as the focal point to organize the implementation of Law Popularization and Education work throughout the sector; coordinating with agencies and units in drafting, leading the advisory process to submit to the Minister for the promulgation of legal normative documents on transport; coordinating with agencies, units, and affiliated schools to organize training for the legal affairs staff, legal lecturers, and legal propagandists in the transport sector; coordinating with the Information Technology Center and related units to complete the legal database on transport on the Ministry's website.

b) Taking the lead in monitoring and periodically inspecting the implementation of this Directive; annually organizing mid-term reviews and final summaries of Law Popularization and Education work throughout the sector; proposing commendations for collectives and individuals with outstanding achievements in Law Popularization and Education work according to regulations.

This Directive shall take effect fifteen days after its publication in the Official Gazette. All agencies and units within the transport sector are required to strictly implement this Directive./.
