Decree No. 07/2008/ND-CP on the levels of preferential allowances for persons who have rendered meritorious service to the revolution

provides the levels of allowances and preferential subsidies for persons who have rendered meritorious service to the revolution

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

BASED ON THE Ordinance on Preferential Treatment for Persons Who Have RenderED MerITORIOUS SERVICE TO THE REVOLUTION dated June 29, 2005 AND THE Ordinance AMENDING AND COMPLEMENTING CERTAIN ARTICLES OF THE Ordinance ON PREFERENTIAL TREATMENT FOR PERSONS WHO HAVE RENDERED MERITORIOUS SERVICE TO THE REVOLUTION dated June 21, 2007;

Considering the proposal of the Minister of Labor, Invalids, and Social Affairs,

DECREE:

Article 1. stipulates the standard level for determining the levels of allowances and preferential subsidies for persons who have rendered meritorious service to the revolution and the levels of allowances and subsidies

1. The standard level for determining the levels of allowances and preferential subsidies for persons who have rendered meritorious service to the revolution as prescribed in this Decree is 564,000 VND.

2. This Decree also promulgates the tables of allowance and preferential subsidy levels for each category of persons who have rendered meritorious service to the revolution, including:

a) Table No. 1: Levels of allowances and preferential subsidies for persons who have rendered meritorious service to the revolution;

b) Table No. 2: Levels of disability allowances for war invalids and persons entitled to benefits similar to those of war invalids;

c) Table No. 3: Levels of disability allowances for war invalids type B.

Article 2. 1. The funding for determining the degree of disability and issuing the Disability Confirmation Certificate is allocated in the annual budget estimate of the commune in accordance with the State Budget Law and guiding documents.

THE STATE BUDGET WILL ENSURE FUNDS FOR IMPLEMENTING THE SUBSIDY AND ALLOWANCE SYSTEM AS PROVIDED IN THIS DECREE.

Article 3. Effectiveness

1. This Decree shall take effect fifteen days from the date of publication in the Official Gazette.

2. This Decree replaces Decree No. 32/2007/NĐ-CP dated March 2, 2007 of the Government on the levels of allowances and preferential subsidies for persons who have rendered meritorious service to the revolution.

3. The allowances and preferential subsidies prescribed in this Decree shall be implemented from January 1, 2008.

Article 4. Responsibility for Implementation

1. The Minister of Labor - Invalids and Social Affairs shall be responsible for guiding the implementation of this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government shall be responsible for enforcing this Decree./.
