Regarding the Program for Drafting Laws and Ordinances in 2012 and
Adjusting the Program for Drafting Laws and Ordinances in 2011

SOCIALIST REPUBLIC OF VIET NAM
Pursuant to the Constitution of the Socialist Republic of Vietnam in 1992 as amended and supplemented by Resolution number 51/2001/QH10;
Based on the Law on the Organization of People's Councils and People's Committees No. 11/2003/QH11;
Pursuant to the Law on Legislative Activities number 17/2008/QH12;
After considering Report No. 08/TTr-UBTVQH13 dated July 29, 2011 of the Standing Committee of the National Assembly on the draft Program for drafting laws and ordinances in 2012 and adjusting the Program for drafting laws and ordinances in 2011, and the opinions of the National Assembly deputies;
RESOLUTION:
Article 1
Adjust the Program for drafting laws and ordinances in 2011 as follows:
1. Add the draft Resolution on amending and supplementing the Constitution of 1992 and establishing the Committee for Amending the Constitution of 1992 to the Program for adoption at the first session;
2. Transfer the Water Resources Law (Amendment) project and the Higher Education Law project from the Program for comments at the first session to the Program for comments at the second session;
3. Add the State Cryptography Law project and the Vietnam Sea Law project to the Program for adoption at the second session;
4. Transfer the Cooperative Law (Amendment) project from the Program for adoption at the second session to the Program for drafting laws and ordinances in 2012;
5. Add the Tax Management Law (Amendment) project and the Anti-Money Laundering Law project to the Program for comments at the second session;
6. Add the draft Resolution of the Standing Committee of the National Assembly on the environmental protection tax rate to the Program for drafting laws and ordinances in 2011.

Article 3
1. The Standing Committee of the National Assembly and the Government shall focus on directing the implementation of the Program for Drafting Laws and Ordinances immediately after its approval; the organization and implementation of the Program need to be innovated with more concentrated and effective methods; ensure the stability of the Program, only adjust when truly necessary.
2. The Government shall promptly assign agencies to draft new projects included in the Program, consolidate existing drafting committees; ensure funding and other necessary conditions for implementing the Program; timely issue guiding documents for the enforcement of laws and ordinances.
3. Agencies submitting projects, main drafting agencies, and participating drafting agencies shall strictly comply with legal provisions during the preparation process; ensure that projects are thoroughly prepared in terms of content and technical documentation, minimize general provisions as much as possible; ensure the preparation schedule, submission deadlines for projects and related documents to the reviewing agencies, the Standing Committee of the National Assembly, and the National Assembly; participate in revising and perfecting draft laws and ordinances.
4. The Ethnic Council and Committees of the National Assembly shall actively coordinate with drafting agencies and submitting agencies throughout the drafting, reviewing, and researching processes, and incorporate suggestions and revisions into drafts submitted for consideration and adoption by the National Assembly and the Standing Committee of the National Assembly.
5. The Delegations of National Assembly members and National Assembly deputies shall organize research, seek opinions from experts and relevant sectors; allocate time for discussion and provide comments to contribute to improving the draft laws and ordinances. This Resolution was adopted on August 6, 2011, at the first session of the XIIIth National Assembly of the Socialist Republic of Vietnam.
