Based on the Law on Competition and Rewards dated November 26, 2003, and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards dated June 14, 2005;
Pursuant to the Education Law on June 14, 2005; the Law Amending and Supplementing Certain Articles of the Education Law on November 25, 2009;
Based on Decree No. 32/2008/NĐ-CP dated March 19, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Based on Decree No. 42/2010/NĐ-CP dated April 15, 2010, of the Government detailing the implementation of certain provisions of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards;
Based on Circular No. 02/2011/TT-BNV dated January 24, 2011, of the Ministry of Home Affairs guiding the implementation of Decree No. 42/2010/NĐ-CP dated April 15, 2010, of the Government detailing the implementation of certain provisions of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards;
After receiving agreement document No. 1899/BTĐKT-VI of the Central Steering Committee for Competition and Rewards - Ministry of Home Affairs dated November 9, 2011 regarding the issuance of the Circular on awarding the titles of People's Teacher and Outstanding Teacher;
The Minister of Education and Training hereby issues guidelines for standards, procedures, formalities, and documentation for awarding the titles of People's Teacher and Outstanding Teacher as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Circular guides the standards, procedures, formalities, and documentation for awarding the titles of People's Teacher and Outstanding Teacher, including: Standards for awarding; Councils, scope of examination and presentation; Awarding procedures; Documentation and time for submitting nominations.
2. This Circular applies to teachers in schools and educational institutions within the national education system and educational management officials including:
a) Teachers and lecturers in preschool education institutions, general education institutions, vocational education institutions, continuing education institutions, higher education institutions; the schools, education centers of state agencies, political organizations, political-social organizations, people's armed forces.
b) Principals, Deputy Principals, Directors, Deputy Directors of educational institutions; officials and civil servants working in departments and offices of universities, academies, colleges, and secondary vocational schools; officials and civil servants working in education and training departments, provincial education and training departments, and the Ministry of Education and Training; officials specializing in vocational education management at labor, invalids, and social affairs departments; officials specializing in educational management at central ministries and sectors; educational researchers; officials specializing in education trade unions (collectively referred to as educational management officials).
c) Teachers of public schools who have retired but continue to participate in teaching and management work (officials, teachers, lecturers) at private educational institutions.
3. The titles of People's Teacher and Outstanding Teacher shall not be awarded to individuals during the period they are being disciplined, under disciplinary review, or under criminal investigation.
Article 2. Time for awarding and announcing the titles of People's Teacher and Outstanding Teacher
2. The period during which individuals who were officials, civil servants, or employees directly researching, developing, or reviewing and approving programs, projects, and proposals as specified in Clause 7 of Article 3 of this Circular may not establish, hold titles, positions of management, or operate enterprises or cooperatives is the duration of completion of those programs, projects, and proposals. of The titles of People's Teacher and Outstanding Teacher are awarded and announced every two years on the occasion of Teachers' Day on November 20.
Article 3. Organization of Presentation
Ministries and central sectors organize award ceremonies for People's Teachers and Outstanding Teachers directly under their respective ministries and sectors according to current regulations;
Provincial People's Committees (hereinafter collectively referred to as provincial level) organize award ceremonies for People's Teachers and Outstanding Teachers directly under their respective provinces according to current regulations;
The Ministry of Education and Training organizes award ceremonies for People's Teachers and Outstanding Teachers directly under the Ministry of Education and Training and some special cases decided by the National Council Chairperson;
The ceremony for presenting awards is conducted in accordance with the Government's regulations on State protocol in organizing rallies, commemorations, presentations, and receptions of national honors, Orders, Medals, Flags of Excellence from the Government, and Certificates of Merit from the Prime Minister.
Article 4. Rights and responsibilities of teachers awarded the title of People's Teacher and Outstanding Teacher 1. Teachers awarded the title of People's Teacher and Outstanding Teacher shall enjoy rights as prescribed in Clause 3, Article 73 and Article 77 of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing implementation of certain provisions of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards.
2. Teachers awarded the title of People's Teacher and Outstanding Teacher have the responsibility to continue to promote their moral qualities and pedagogical talents to truly serve as role models for colleagues to emulate and preserve awarded items.
Article 5. Revocation and restoration of the title of People's Teacher and Outstanding Teacher
The revocation and restoration of the title of People's Teacher and Outstanding Teacher shall be carried out in accordance with the provisions of Article 84 of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing implementation of certain provisions of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards.
Article 6. Budget for awarding and prize money
1. The level that decides to establish the Council for awarding the title of People's Teacher and Outstanding Teacher in accordance with Article 10 and Article 11 of this Circular shall be responsible for allocating budget for the awarding activities in accordance with the State Budget Law.
2. Prize money for People's Teachers and Outstanding Teachers shall be implemented in accordance with the provisions of Article 69 and Clause 3, Article 73 of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government.
CRITERIA FOR AWARDS OF THE TITLE OF PEOPLE'S TEACHER AND OUTSTANDING TEACHER
Chapter II
Criteria for awarding the title of People's Teacher
, Clause 1, Clause 2 Article 7a of this Regulation.. 1. Loyalty to the Socialist Republic of Vietnam; good compliance with the Party’s guidelines and policies and state laws.
2. Having good moral qualities, passionate, dedicated to the profession; being exemplary, truly serving as a bright model for students and colleagues to follow; excellently completing assigned tasks, making significant contributions to building units into outstanding labor collectives and decisive victory units; having been awarded the title of Outstanding Teacher by the state for at least six years up to the year of nomination; continuing to achieve high results after being awarded the title of Outstanding Teacher in one of the following forms of reward or titles: National Model Worker; Labor Medal, National Defense Medal or higher; Ho Chi Minh Award, State Award;
Having outstanding pedagogical talent, high reputation and influence in the field and society, being a leading teacher recognized by colleagues, a model teacher respected by students and the people, having many achievements in training and assisting colleagues in professional and vocational work and scientific research:
a) Teaching with high quality and effectiveness, having many excellent students and contributing to discovering and nurturing talented students, contributing to cultivating talents for the country.
b) Having innovative ideas, solutions, research topics widely applied in teaching, education or educational management recognized and classified by the provincial, ministry-level, or state-level Scientific Councils from after the year of being awarded the title of
Outstanding Teacher . Specifically:- For
kindergarten and primary and secondary school teachers, vocational college teachers, vocational training center teachers, and regular education centers:Having at least three innovations or three solutions or leading two research topics to improve educational quality recognized and classified as excellent (Class A) by the provincial Education and Training Department's Scientific Council (for units under the provincial Education and Training Department), the provincial Scientific Council, or the superior authority's Scientific Council (for units under the ministries, sectors, or provincial People's Committees). - For college, university, academy, and state agency, political organization, social-political organization, and people's armed forces teachers: leading the compilation of two textbooks (or leading the compilation of one textbook and participating in the compilation of two textbooks) which have been published; having three domestic or international scientific articles; leading two provincial, ministry-level, or state-level research topics effectively applied in teaching, recognized and classified as excellent (Class A) by the provincial, ministry-level, or state-level Scientific Council. For university teachers, guiding at least three doctoral candidates, of whom at least two have successfully defended their dissertations, or guiding at least five master's students who have successfully defended their theses;
- For educational managers: leading two research topics recognized and classified as excellent (Class A) by the provincial, ministry-level, or state-level Scientific Council, effectively applied in work (for managers of kindergartens, primary and secondary schools, vocational colleges, vocational training centers, and regular education centers, having at least three innovations or three solutions or two research topics to improve educational quality recognized and classified as excellent (Class A) by the provincial Education and Training Department's Scientific Council); having led or advised in drafting legal regulations, organizational structures, operations, effectively implementing educational reforms and development, contributing to the unit's successful performance of its functions and achieving outstanding results. For managers at the head or deputy level, the collective or unit they manage must have achieved the title of Outstanding Labor Collective for at least two consecutive years prior to the year of nomination.
3. Having directly nurtured and taught for at least twenty years. For educational managers, they must have worked in the sector for at least twenty-five years, including at least fifteen years directly nurturing and teaching.
Criteria for awarding the title of Outstanding Teacher
Article 8. 1. Loyalty to the Socialist Republic of Vietnam;
good compliance with the Party’s guidelines and policies and state laws 2. Having good moral qualities, dedicated to the profession, loving and caring for students;.
2. Possess good moral qualities, be dedicated to the profession, love, care for, and educate students; serving as a model, truly being a bright example for students and colleagues to emulate, respected by students, colleagues, and the people. Excellently completing assigned tasks, making significant contributions to building the unit or school into an Outstanding Labor Collective; having at least 7 years as a Model Worker at the grassroots level, including 3 consecutive years immediately preceding the year of nomination for the title of Teacher, and having been recognized with at least one Model Worker title at the provincial or ministerial level, or receiving a Certificate of Merit from the Prime Minister, or three Certificates of Merit from the province or ministry for teachers and lecturers. For teachers and educational management staff in areas with extremely difficult socio-economic conditions, they must have achieved the Model Worker title at the grassroots level for at least 5 years, including 2 consecutive years immediately preceding the year of nomination for the title of Teacher, and received at least one Certificate of Merit from the province or ministry.
Possessing pedagogical talent, making significant contributions to the education cause, teaching with high quality and effectiveness, producing many excellent students and graduates; having innovations, experiences, technical solutions, or research topics applied effectively in teaching, education, or educational management recognized and classified by scientific councils at various levels as follows:
a) For teachers in early childhood education institutions:
- Being an outstanding teacher according to the occupational standards, ensuring the quality and effectiveness of childcare and education, implementing activities to care for and educate children with high quality, reducing malnutrition rates among children, contributing to attracting children to school, achieving notable results in universal primary education.
- Excellently fulfilling the goals and requirements of early childhood education, contributing to building the unit into an Outstanding Labor Collective; guiding and mobilizing many parents to raise their children scientifically, achieving good results; being trusted and recognized by colleagues as an exemplary early childhood educator in the locality, and being trusted by parents.
- Having at least one innovation or improvement; applying new scientific and technological progress in childcare and education, evaluated and classified as good (Class B) or higher by the provincial educational science council.
- Mentoring and nurturing at least two teachers to become excellent teachers in the school and being recognized as an excellent teacher at the district level or higher at least once.
b) For teachers in elementary schools:
- Being an outstanding teacher according to occupational standards, excellently fulfilling the duties of an elementary school teacher, achieving many accomplishments in universal primary education; teaching with high quality and effectiveness; having many students classified as excellent.
- Contributing to building the unit into an Outstanding Labor Collective; being recognized by colleagues as an excellent teacher; being a role model teacher, a bright example in the local education sector; being respected by students, trusted by parents and the community.
- Having at least two improvements or two innovative experiences applied in teaching and educating students, evaluated and classified as good (Class B) or higher by the provincial educational science council.
- Achieving many accomplishments in mentoring colleagues to become excellent teachers, having nurtured at least three teachers to become excellent teachers in the school and locality, and being recognized as an excellent teacher at the provincial level or higher at least once.
c) For teachers in secondary schools; high schools; comprehensive vocational training centers; continuing education centers; community learning centers; foreign language and computer centers; vocational training centers:
- Being an outstanding teacher according to occupational standards, teaching and educating students with high quality and effectiveness, promoting students' initiative and creativity, having students achieve excellence at various levels;
- Contributing to building the unit into an Outstanding Labor Collective, contributing to stabilizing and developing the education cause in the locality; being recognized by colleagues as an outstanding teacher in the grade level; being a role model teacher, a bright example in the local education sector; being respected by students, trusted by parents and the community.
- Having at least two improvements or two innovative experiences applied in teaching and management, evaluated by the provincial educational science council evaluate, and classified as good (Class B) or higher by the provincial educational science council.
- Achieving accomplishments in nurturing and building a team of excellent teachers in the school and locality, having nurtured at least two teachers to become excellent teachers at the district level or higher, and being recognized as an excellent teacher at the provincial level or higher at least once.
d) For teachers in vocational colleges and technical colleges:
- Teaching with high quality and effectiveness, contributing to reforming training objectives, content, and programs. Contributing to training skilled technicians and workers for the industry and locality. Having students excel in theory and practical skills.
- Contributing to building the school into an Outstanding Labor Collective for many years, being trusted by students.
- Having at least two solutions or two innovative experiences, improvements applied effectively, evaluated and classified as good (Class B) or higher by the provincial educational science council (for units under the provincial education and training department), the council at the provincial level, or the superior management agency (for units under the central ministries, departments, or provincial people's committees).
- Being trusted and recognized by colleagues as an outstanding teacher in the locality and the industry, having been recognized as an excellent teacher at the provincial or ministerial level or higher at least once. Nurturing many excellent teachers with solid professional skills and expertise.
e) For lecturers in colleges, provincial political schools, and civil servant training centers of ministries and sectors:
- Teaching with high quality and effectiveness, contributing to reforming training objectives, content, and programs, improving educational quality and training outcomes;
- Participating in writing at least two textbooks used in teaching, including one published textbook; participating in at least one research topic serving education that has been applied in the institution, recognized by the provincial or ministerial scientific council. evaluate, classified as good (type B) or primarily responsible for two scientific research topics at the basic level classified as excellent, and have been applied in the school for at least two years;
- Contributed to building and nurturing a team of excellent lecturers at the department and the university; recognized at least once as an excellent lecturer at the provincial or ministerial level;
- Contributed to guiding students to improve learning methods and scientific research, achieving results, with outstanding students;
g) For lecturers at universities, colleges, academies:
- Teaching and guiding students in scientific research, internships with high quality and effectiveness; contributing to reforming goals, contents, programs, methods, and improving educational quality;
- Chief editor of one textbook or participating in compiling at least two textbooks that have been put into teaching and published, or author of two monographs; having at least five scientific articles published in domestic and international journals; primarily responsible for one scientific research topic at the ministerial or provincial level or a branch of a national-level scientific research topic evaluated by the provincial, ministerial, or national-level Scientific Council; classified as good (type B); guiding at least two doctoral candidates, including one who successfully defended their doctoral dissertation, or guiding at least five master's students who successfully defended their dissertations;
- Contributing to building and nurturing a team of excellent lecturers in the specialty and the university;
- Contributing to guiding students and master's students to improve learning methods; actively researching and achieving high achievements, with outstanding students;
h)||| For lecturers in special trades, research topics are considered specifically based on the scope of influence; training doctoral and master's degrees are applied according to the trade involved in training and approved by the National Award Granting Council during the award year upon request from relevant ministries and sectors;
i) For educational management staff:
- Primarily responsible for at least two solutions, innovations, or scientific research topics during the time as management staff (or one during direct teaching and one during management) with effects on reforming teaching methods and management, enhancing management efficiency, evaluated by the provincial or ministerial-level Scientific Council, classified as good (type B) or higher, and have advised and primarily drafted normative legal documents, regulations, and organizational structures to effectively implement educational reforms and development, contributing to building units achieving outstanding labor collectives. Truly serving as exemplary models for colleagues to emulate and learn from;
- For management staff at preschool, primary, secondary, and continuing education institutions, vocational training centers, must have at least two solutions, innovations, or scientific research topics evaluated and classified as excellent (type A) by the provincial Educational Scientific Council or the main industry's Scientific Council;
- For management staff at preschool, primary, secondary, continuing education institutions, vocational training centers, the time spent managing while also teaching according to regulations counts as direct teaching time but not more than five additional years added to the direct teaching time;
- For management and leadership staff at the head or deputy level, the collective unit managed and directed by them must achieve the title of Advanced Labor Collective for at least three consecutive years prior to the nomination year (including one year achieving the title of Outstanding Labor Collective);
k) For teachers and management staff working in areas with extremely difficult economic and social conditions as defined by the Government, they will enjoy preferential standards as follows:
- The time working and directly teaching in such areas with extremely difficult economic and social conditions is multiplied by a factor of 1.33;
- For teachers who demonstrate a spirit of overcoming difficulties to build schools, mobilize many students to attend school, guide and assist students in their studies, with many students growing up and contributing to local development; improve and apply innovative experiences in teaching and management recognized by the county-level Educational Science Council for kindergarten, elementary, and middle school teachers, and by the provincial Educational Department for high school teachers;
- For management staff, the collective unit managed and directed by them must achieve the title of Advanced Labor Collective for at least two consecutive years prior to the nomination year for consideration;
3. Having at least fifteen years of direct nurturing and teaching experience for teachers and lecturers. For educational management staff, there must be at least twenty years of work experience in the field, including at least ten years of direct nurturing and teaching experience;
Chapter III
THE COUNCIL, SCOPE OF CONSIDERATION FOR THE TITLE OF PEOPLE'S TEACHER, OUTSTANDING TEACHER
Article 9. Levels of Councils, Composition, and Scope of Consideration
1. Institutional Council
The Basic Level Council is organized at educational institutions, Vietnam General Confederation of Labor Education Units, and central sector units;
Composition of the Basic Level Council: The Unit Head serves as the Chairman, a Deputy Head and the Union Chairman serve as Vice Chairmen, Heads of related functional departments within the unit; representatives of leaders and specialists from the department responsible for competition and commendation; representatives of outstanding teachers; or People's Teachers, Outstanding Teachers (if any);
The Basic Level Council is established by the Rector or Unit Head's decision;
The Basic Level Council nominates the title of People's Teacher, Outstanding Teacher for teachers trusted and recommended by the staff, civil servants, and employees in the unit;
2. The County Level Council
The County, District, City, and Provincial Town Councils collectively referred to as the County Level Council;
Composition of the County Level Council: The Chairman (or Deputy Chairman) of the County People's Committee serves as the Chairman, the Director of the Education and Training Department serves as the Permanent Vice Chairman, the Chairman of the County Education Union serves as the Vice Chairman, personnel engaged in competition and commendation at the county level, the Deputy Director of the Education and Training Department, personnel responsible for professional affairs, organization and human resources, and representatives of outstanding teachers or People's Teachers, Outstanding Teachers serve as members;
The County Level Council The Chairman of the People's Committee at the district level shall issue a decision to establish;
The County Level Council to present awards of National Teacher and Outstanding Teacher titles to teachers proposed by the grassroots Council under the district-level management;
3. The expanded provincial education and training council
The expanded provincial education and training council consists of: the provincial education and training department, the provincial labor, invalids and social affairs department, the provincial education union, heads of departments responsible for various levels of education and training, personnel organization, inspection, the provincial education and training department office, representatives from some departments, agencies, and permanent members of the provincial education sector's commendation and reward council;
Members of the expanded provincial education and training council: the Director of the provincial education and training department serves as the Chair, one Deputy Director serves as the Vice-Chairman in charge of daily operations, the Chairman of the provincial education union serves as the Vice-Chairman, one leader of the provincial labor, invalids and social affairs department serves as the Vice-Chairman, Deputy Directors, heads of departments responsible for various levels of education and training, personnel organization, inspection, the provincial education and training department office, representatives from some departments and agencies with teachers proposed for award consideration, permanent members of the provincial education sector's commendation and reward council, representatives of outstanding teachers; or National Teachers, Outstanding Teachers serve as members;
The Council expanded provincial education and training shall be established by the Director of the provincial education and training department issuing a decision;
The expanded provincial education and training council shall present awards of National Teacher and Outstanding Teacher titles to teachers proposed by the grassroots councils at educational institutions directly under provincial departments and sectors;
4. Provincial Council
Members of the provincial council include: the Chairman (or Vice-Chairman) of the provincial People's Committee serves as the Chair, the Director of the provincial education and training department serves as the Vice-Chairman in charge of daily operations, the Chairman of the provincial education union serves as the Vice-Chairman, the Head of the provincial commendation and reward board serves as the Vice-Chairman, Deputy Directors, heads of departments responsible for various levels of education and training, personnel organization, inspection, the provincial education and training department office, representatives from leaders of some departments and sectors with teachers proposed for award consideration, permanent members of the provincial education sector's commendation and reward council, representatives of provincial model workers, National Teachers or Outstanding Teachers serve as members;
The provincial council shall be established by the Chairman of the provincial People's Committee issuing a decision;
The provincial council shall present awards of National Teacher and Outstanding Teacher titles to teachers proposed by the district-level council, the expanded provincial education and training council, and the grassroots councils of universities and colleges directly under the province;
5. Council Thai Nguyen University, Hue University, Da Nang University, Vietnam National University in Hanoi, Vietnam National University in Ho Chi Minh City (hereinafter referred to as the University Council)
Members of the University Council include: the Director or Deputy Director serves as the Chair, the Chairman of the Union serves as the Vice-Chairman, one Deputy Director of the University serves as the Vice-Chairman, principals of affiliated schools, heads of departments: training, personnel organization, inspection, general affairs; representatives of National Teachers, Outstanding Teachers and model workers who are excellent lecturers, staff involved in commendation and reward work of the University serve as members;
The University Council shall be established by the University Director issuing a decision;
The University Council shall present awards of National Teacher and Outstanding Teacher titles to teachers proposed by the grassroots councils at affiliated units;
6. Council of ministries, central agencies
The ministry-level, central agency council (hereinafter referred to as the ministry-level council);
Members of the ministry-level council: the Minister or Deputy Minister in charge serves as the Chair, the Chairman of the industry union or Deputy Minister in charge of commendation and reward work serves as the Vice-Chairman, Deputy Ministers, heads of relevant functional agencies, representatives from the permanent members of the industry's commendation and reward council, representatives of model workers at the ministry level, National Teachers, Outstanding Teachers serve as members;
The ministry-level council shall be established by the head of the ministry, central agency issuing a decision;
The ministry-level council shall present awards of National Teacher and Outstanding Teacher titles to teachers proposed by the grassroots councils at subordinate units of the ministry, central agency. For grassroots councils under the management of bureaus, general bureaus, state-owned corporations, their main managing units must submit a written request to the ministry-level council for consideration;
The Ministry of Education and Training Council shall present awards of National Teacher and Outstanding Teacher titles to teachers proposed by the grassroots councils at subordinate units of the Ministry, the University Council, and the provincial council;
7. National Council
Members of the National Council shall be decided by the Prime Minister based on the proposal of the Minister of Education and Training;
The National Council shall present awards of 1. Teachers awarded the title of People's Teacher and Outstanding Teacher shall enjoy rights as prescribed in Clause 3, Article 73 and Article 77 of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing implementation of certain provisions of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards. to teachers proposed by the ministry-level council.
Article 10. Provisions on the operation of the Council for Bestowing Titles of People's Teacher and Outstanding Teacher at all levels
1. The Council must have at least one-third of its total number of members being representatives of outstanding teachers or People's Teachers and Outstanding Teachers.
2. The minimum number of members of the Council at each level is nine members.
3. Meetings of the Council shall be considered valid when at least two-thirds of the members named in the decision attend; in cases where members are absent, they must request permission from the Chairman of the Council and return their opinions through ballots.
4. The lower-level Council completes the nomination dossier to submit to the higher-level Council for bestowing titles of People's Teacher and Outstanding Teacher for teachers who have received approval votes from at least ninety percent of the members named in the decision.
5. The Councils at all levels will not consider cases where the application dossiers are not filled out according to regulations, are incomplete, invalid, or submitted outside the designated route and beyond the prescribed time limit.
6. Each level's Council for Bestowing Titles of People's Teacher and Outstanding Teacher has a secretariat or secretarial board to assist, established by the Chairman of the Council.
7. The Council for Bestowing Titles of People's Teacher and Outstanding Teacher at all levels uses the seal of the agency or unit where the Chairman of the Council is the Head (the person in charge). For the provincial-level Council, it may use the seal of the Department of Education and Training with authorization from the Chairman of the Council to have the Vice-Chairman sign the Council's documents and files.
Chapter IV
PROCEDURE FOR BESTOWING TITLES OF PEOPLE'S TEACHER AND OUTSTANDING TEACHER
Article 11. Procedure for Bestowing Titles of People's Teacher and Outstanding Teacher at the Basic Level Council
1. Introduction and Trust Voting:
a) The Head of the basic-level unit organizes a joint meeting between the Party, administration, Trade Union, and Youth League (if applicable) of the unit to disseminate to the staff and officials within the unit the criteria for selecting the titles of People's Teacher and Outstanding Teacher as stipulated in the Law on Competition and Reward and this Circular.
b) Based on a thorough understanding of the target group, criteria, and selection procedures, organize for the staff and teachers to self-introduce and publicly introduce those who meet the criteria.
c) All staff and officials within the unit exchange achievements and contributions of each individual, compare and contrast with the criteria, and cast trust votes. The results of the introduction voting are publicly announced within the unit.
d) Teachers included in the list for selection by the basic-level Council must achieve at least eighty percent of the introduction votes from the staff and officials.
e) For colleges and universities with over two hundred staff members, they can organize introductions and trust votes at the department level with the participation of student representatives in the departments.
2. Preliminary Review by the Basic-Level Council:
Based on the list of individuals achieving at least eighty percent of the introduction votes, the basic-level Council organizes meetings to review the achievements and contributions of each individual, the opinions and evaluations of the staff and officials, compare with the criteria, and conduct preliminary reviews through voting.
3. Announcing Preliminary Review Results and Conducting Public Opinion Polls:
After obtaining the preliminary review vote results, the basic-level Council announces the preliminary review results throughout the unit by posting the list of individuals who have achieved the required preliminary review votes for at least seven working days; send official letters to subordinate units and post on the unit's website (if available) for staff and officials to be informed and provide feedback; organize public opinion polls among staff and officials, the Trade Union Executive Board, the Communist Youth League Executive Board, and student representatives (for preschool education institutions and primary schools, organize public opinion polls among parent representatives instead of students).
4. Approval Voting by the Basic-Level Council:
a) Based on the preliminarily reviewed list and the public opinion poll results, the basic-level Council convenes to review and approve through voting. The approved list includes teachers who have achieved at least eighty percent of the preliminary review votes from the total number of Council members. The approval voting results are announced throughout the unit.
b) Complete the personal dossier and the basic-level Council dossier for those who meet the conditions, and submit them to the higher-level Council as stipulated in Article 9 of this Circular.
Article 12. Procedures for awarding the titles of People's Teacher and Outstanding Teacher at the county council, expanded education department council, provincial council, university council; central ministry, agency, and sector council.
1. Establishing lists and files:
a) Based on the list proposed by the grassroots council, verify and establish a list of individuals meeting the criteria to be submitted to the council. Individuals meeting the criteria to be submitted to the council are those who have received at least 80% of recommendation votes from officials, civil servants, and employees, and whose approval votes reach at least 90% of the total number of council members at each level.
b) Prepare files to be sent to each council member for review in advance.
2. Holding a preliminary review meeting:
On the basis of the list of individuals receiving at least 80% of recommendation votes and 90% of approval votes from the grassroots council, the council organizes a meeting, examines achievements and merits based on the criteria, and conducts a preliminary vote.
3. Announcing the preliminary review results and conducting public opinion surveys according to the following procedures:
a) County council, expanded education department council: Announce the preliminary review results and seek opinions from subordinate grassroots councils and related councils through public notices, notification letters, and on the website of that level (if available) to gather opinions.
b) Provincial council: Announce the preliminary review results and seek opinions from district education and training departments, subordinate units, and related units through notification letters and on the website of the education and training department to gather opinions.
c) University council: Announce the preliminary review results and seek opinions from affiliated schools and related units through public notices, notification letters, and on the university's website to gather opinions.
d) Central ministry, agency, and sector council: Announce the preliminary review results and seek opinions from grassroots councils through notification letters and on the website of the central ministry, agency, or sector.
4. Holding a meeting to approve:
a) Based on the preliminarily reviewed list, the results of public opinion surveys, the council convenes to consider, deliberate, and approve.
b) Complete individual files meeting the conditions and council files to be submitted to the higher-level council. For People's Teachers, the provincial or central council proposes to the Standing Committee of the Provincial Party Committee and the Party Cadre Affairs Committee for consideration before submitting to the higher-level council.
Chapter V
FILES AND TIME LIMITS FOR PROPOSING AWARDS OF THE TITLES OF PEOPLE'S TEACHER AND OUTSTANDING TEACHER
Article 13. Files for proposing awards of the titles of People's Teacher and Outstanding Teacher
1. Individual files:
a) A record of achievements for the proposal to award the title of People's Teacher and Outstanding Teacher filled out according to the individual file template for the proposal to award the title of People's Teacher and Outstanding Teacher (annexed appendix).
b) Copies of certificates for inventions, solutions, textbooks (with the author's name and publisher noted on the cover), acceptance records for scientific research projects, scientific articles (title and table of contents of articles published in journals or proceedings of international conferences), and certificates for commendations and rewards related to the criteria for awarding the title of People's Teacher and Outstanding Teacher.
2. Files of lower-level councils proposing to higher-level councils:
a) A proposal letter for conferring the title of People's Teacher and Outstanding Teacher.
b) A list of proposals for conferring the title of People's Teacher and Outstanding Teacher.
c) Minutes of the council meeting and voting results.
d) Summary of individual achievements for the proposal to confer the title of People's Teacher and Outstanding Teacher.
e) Decision establishing the council.
g) Opinions of the Standing Committee of the Provincial Party Committee and the Party Cadre Affairs Committee regarding People's Teachers (provincial and central councils).
The format of the council's files for proposing awards of the titles of People's Teacher and Outstanding Teacher is attached as an appendix to this Circular.
3. Heads of agencies, units, and organizations proposing awards of the titles of People's Teacher and Outstanding Teacher are responsible for the accuracy of the proposal files, and are also responsible for handling complaints and reports in accordance with the law.
4. Individuals proposing awards of the titles of People's Teacher and Outstanding Teacher are legally responsible for the accuracy of the information they declare in the files.
Article 14. Time for submission of files
1. The Council at the ministry, department, or agency shall submit files to the State-level Council for awarding the titles of People's Teacher and Outstanding Teacher before June 5 of the year of awarding.
2. The provincial Council, University Council, and subordinate units under the Ministry of Education and Training shall submit files to the Council for awarding the titles of People's Teacher and Outstanding Teacher under the Ministry of Education and Training before April 5 of the year of awarding.
3. Files submitted to the Council under the Ministry of Education and Training and the State-level Council shall be sent to the address at 49 Dai Co Viet Street, Hai Ba Trung District, Hanoi (the list and summary of achievements should be sent via email to [email protected]).
4. The number of sets of files submitted from lower-level Councils to higher-level Councils is two sets.
Chapter VI
IMPLEMENTING PROVISIONS
Article 15. Effective Date
This Circular takes effect from April 2, 2012. This Circular replaces Circular No. 22/2008/TT-BGDĐT dated April 23, 2008, issued by the Ministry of Education and Training guiding standards, procedures, formalities, and files for awarding the titles of People's Teacher and Outstanding Teacher.
Article 16. Responsibility for Implementation
1. The specialized unit responsible for Competition and Reward Work under the Ministry of Education and Training shall act as the focal point to assist the Minister of Education and Training in implementing and supervising the implementation of this Circular.
2. The Heads of the Office, Heads of relevant units under the Ministry of Education and Training; Chairpersons of Provincial People's Committees; Heads of educational management agencies under central ministries and sectors, educational institutions, and related agencies and units are responsible for enforcement, organizing publicity, dissemination, and implementation of this Circular.
