CIRCULAR

REGULATIONS ON THE APPOINTMENT AND GRADING OF THE PROFESSIONAL TITLES OF COLLEGE PREPARATORY TEACHERS

Pursuant to the Law on Public Officials dated November 15, 2010;

Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, utilization, and management of civil servants;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, public officials, and armed forces;

Pursuant to Decree No. 34/2017/NĐ-CP dated April 3, 2017 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

At the request of the Director of the Civil Servant and Public Official Department;

The Minister of Home Affairs issues this Circular to regulate the appointment and grading of the professional titles of college preparatory teachers.

Article 1. Scope of Regulation and Applicability

1. This Circular regulates the appointment and grading of public officials appointed to the professional titles of college preparatory teachers as specified in Circular No. 06/2017/TT-BNV dated September 27, 2017 of the Minister of Home Affairs on the code numbers of the professional titles of college preparatory teachers (hereinafter referred to as Circular No. 06/2017/TT-BNV) and Circular No. 30/2017/TT-BGDĐT dated December 5, 2017 of the Minister of Education and Training on the standards of the professional titles of college preparatory teachers (hereinafter referred to as Circular No. 30/2017/TT-BGDĐT).

2. This Circular applies to public officials who are college preparatory teachers currently engaged in teaching at state-owned college preparatory schools within the national education system.

Article 2. Principles for Appointment and Grading of Professional Titles of College Preparatory Teachers

1. The appointment to the professional title of college preparatory teacher must be based on the job position, responsibilities, duties, capabilities, and professional qualifications currently held by the public official.

2. When appointing from the current professional title of a public official to a corresponding professional title of college preparatory teacher, it shall not be combined with an increase in salary grade or promotion in the professional title of the public official.

Article 3. Appointment and Grading of Professional Titles of College Preparatory Teachers

1. Public officials appointed to the professional titles of college preparatory teachers as specified in Circular No. 06/2017/TT-BNV and Circular No. 30/2017/TT-BGDĐT shall apply the corresponding salary scale issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, public officials, and armed forces, as follows:

a) The professional title of college preparatory teacher grade I (code number V.07.07.17) shall apply the salary coefficient of public official type A2 (group A2.1), from salary coefficient 4.40 to salary coefficient 6.78;

b) University preparatory teacher vocational title rank II (code number V.07.07.18) shall apply the salary coefficient of category A2 civil servants (group A2.2), ranging from coefficient 4.00 to coefficient 6.38;

c) The professional title of college preparatory teacher grade III (code number V.07.07.19) shall apply the salary coefficient of public official type A1, from salary coefficient 2.34 to salary coefficient 4.98.

2. The grading of salary for public officials currently engaged in teaching at state-owned college preparatory schools within the national education system, who are currently graded under the ranks of civil servants and public officials in the education and training sector as specified in Decision No. 202/TCCP-VC dated June 8, 1994 of the Minister, Head of the Organizational-Cadre Department of the Government (now the Minister of Home Affairs) on the issuance of vocational standards for the ranks of civil servants in the education and training sector, when transitioning to the professional titles of college preparatory teachers as specified in Circular No. 06/2017/TT-BNV and Circular No. 30/2017/TT-BGDĐT, shall be as follows:

a) Grade the salary of college preparatory teacher grade I (code number V.07.07.17) for public officials currently graded as senior lecturers.

b) Grade the salary of college preparatory teacher grade II (code number V.07.07.18) for public officials currently graded as high school advanced teachers.

c) Grade the salary of college preparatory teacher grade III (code number V.07.07.19) for public officials currently graded as lecturers or high school teachers.

Article 4. Organization of Implementation

1. The heads of state-owned college preparatory schools directly managing and using public officials shall be responsible for:

a) Reviewing the job positions of their units, developing plans for the appointment and grading of the professional titles of college preparatory teachers within their authority, submitting them to the competent authority for consideration and decision-making or deciding according to their delegated authority;

b) Deciding on the appointment and grading of the professional titles of college preparatory teachers according to their authority or delegated authority after the plan for the appointment and grading of the professional titles has been approved by the competent authority.

2. Ministries, ministerial-level agencies, government-affiliated agencies, provincial People's Committees, and centrally-administered city People's Committees shall be responsible for:

a) Directing subordinate units under their management to implement the appointment and grading of the professional titles of college preparatory teachers in state-owned college preparatory schools in accordance with regulations;

b) Approving plans for the appointment and grading of the professional titles of college preparatory teachers in state-owned college preparatory schools under their management, transitioning from the current professional titles of public officials to corresponding professional titles of college preparatory teachers as specified in this Circular; resolving issues within their authority during the process of appointment and grading according to professional titles;

c) Deciding on the appointment and grading of the professional titles of college preparatory teachers in state-owned college preparatory schools under their management, transitioning from the current professional titles of public officials to corresponding professional titles of college preparatory teachers as specified in this Circular according to their authority.

Article 5. Effective Date

This Circular takes effect from August 1, 2018.

Article 6. Responsibility for Implementation

1. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees, and centrally-administered city People's Committees shall be responsible for implementing this Circular;

2. In case of difficulties during implementation, please report to the Ministry of Home Affairs for consideration and resolution./.
