Article 1. Position and Functions
The Ministry of Home Affairs is a government agency responsible for state management in the following sectors: administrative organization, public service organizations; local administration, administrative boundaries; civil servants, public officials; specialized administrative training and state management; associations, non-governmental organizations; commendation and reward; religion; state archival affairs; youth and state management of public services under the jurisdiction of the ministry as prescribed by law.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Ministry of Home Affairs performs tasks and powers as stipulated in Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government on the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and the specific tasks and powers listed below:
1. Submit to the Government draft laws, draft resolutions of the National Assembly, draft ordinances, draft joint resolutions between the Government and the Central Committee of the Vietnam Fatherland Front, draft decrees of the Government, and other projects, programs, and resolutions assigned by the Government and the Prime Minister according to the annual legislative program of the ministry; submit to the Government and the Prime Minister strategies, plans, long-term, medium-term, and annual development plans, and important national projects and works within the ministry's jurisdiction.
2. Submit to the Prime Minister draft decisions, directives, and other documents within the ministry’s jurisdiction or as assigned.
3. Issue circulars, decisions, directives, and other documents within the scope of the ministry's state management; guide and inspect the implementation of these documents.
4. Direct, guide, inspect, and be responsible for organizing the implementation of legal normative documents, strategies, plans, long-term, five-year, and annual development plans, and important national projects and works already issued or approved within the scope of the ministry's state management; disseminate information, promote, popularize, and educate the law within the scope of the ministry's state management.
5. On administrative organization and public institutions:
a) Submit to the Government proposals for the organizational structure of the Government during the term of the National Assembly; proposals and draft decrees of the Government on establishing new, merging, consolidating, dividing, separating, dissolving ministries, ministerial-level agencies, and agencies under the Government; draft decrees on the organization of specialized agencies under People's Committees; draft decrees on the division of administrative management of the administrative and public service organizations.
b) Review draft decrees of the Government on the functions, tasks, powers, and organizational structures of ministries, ministerial-level agencies, and agencies under the Government; review proposals and draft decisions of the Government on establishing, merging, dissolving, and reorganizing general bureaus and equivalent units, departments, and equivalent units proposed by ministries, ministerial-level agencies; review draft decisions of the Prime Minister on the functions, tasks, powers, and organizational structures of general bureaus and equivalent units under ministries and ministerial-level agencies; review proposals and draft decisions of the Prime Minister on establishing, merging, dissolving, and reorganizing administrative and public service organizations and advisory and inter-sectoral coordination organizations proposed by ministries, ministerial-level agencies, and provincial People's Committees.
c) Take the lead and coordinate with the Government Office and ministries, ministerial-level agencies, and agencies under the Government to conduct a final review of draft decrees of the Government on the functions, tasks, powers, and organizational structures of ministries, ministerial-level agencies, and agencies under the Government before submitting them to the Prime Minister for signature and issuance.
d) Guide common criteria for classifying and ranking administrative and public service organizations as prescribed by law.
đ) Guide and inspect the review of functions, tasks, and powers of civil servants, ministerial-level agencies, and agencies under the Government; compile and report to the Government for decision-making on adjusting the functions, tasks, powers, and organizational structures of ministries, ministerial-level agencies, and agencies under the Government.
6. On local administration:
a) Submit to the Government for submission to the Standing Committee of the National Assembly to issue regulations on the standards of administrative units and classification of administrative units; on establishing, dissolving, merging, dividing, adjusting administrative boundaries, naming, renaming administrative units, and resolving disputes over administrative boundaries.
b) Review and submit to the Prime Minister for approval the files of election results, appointment, dismissal, and removal of Chairpersons and Deputy Chairpersons of provincial People's Committees; propose the transfer and removal from office of Chairpersons and Deputy Chairpersons of provincial People's Committees and delegate the authority of Chairpersons of provincial People's Committees.
c) Assist the Government and the Prime Minister in guiding and inspecting the activities of provincial People's Councils as prescribed by law; attend regular meetings of provincial People's Councils, and when necessary, attend meetings of provincial People's Committees discussing local administration construction and administrative boundary management or the full-term and annual work programs of provincial People's Committees.
d) Advise the Government and the Prime Minister on directing ministries, ministerial-level agencies, and agencies under the Government, and all levels of People's Committees to carry out elections for National Assembly deputies and representatives of all levels of People's Councils; inspect and urge People's Committees at all levels to implement laws and guidelines on elections issued by the National Election Council and central agencies, regularly reporting to the Government and the Prime Minister on the progress of election work.
đ) Advise the Government and the Prime Minister on monitoring, guiding, and inspecting the methods of organization and operation, and the implementation of tasks and powers of People's Committees at all levels as prescribed by the Law on Local Administration Organization and related legal normative documents.
e) Submit to the Government, the Prime Minister for issuance or issue within their authority regulations on the quantity, system, policies for cadres and civil servants at commune level, non-professional workers at commune level, village, residential ward levels; guide the organization and operation of villages, residential wards;
g) Submit to the Prime Minister for issuance of regulations on criteria, conditions, procedures for recognizing island communes, safe area communes, safe area zones; review and submit to the Prime Minister for recognition of island communes, safe area communes, safe area zones;
h) Statistically compile the quantity and quality of representatives of People's Councils at all levels; members of People's Committees at all levels and the cadre, civil servant team at commune level, non-professional workers at commune level, village, residential ward levels; the quantity and classification results of administrative units at all levels;
7. On territorial boundaries and classification of administrative units:
a) Review and submit to the Government for the Government to submit to the National Assembly, the Standing Committee of the National Assembly proposals on establishment, dissolution, merger, division, adjustment of territorial boundaries of administrative units, naming, renaming and resolution of territorial boundary disputes at all levels;

đ) Guide and inspect the Provincial People's Committees and Provincial Departments of Home Affairs in implementing legal provisions on establishment, dissolution, merger, division, adjustment of territorial boundaries of administrative units; naming, renaming and resolution of territorial boundary disputes; classification of administrative units;
e) Submit to the Government, the Prime Minister for issuance or issue within their authority regulations on files, procedures and database management for territorial boundary administrative units at all levels;
8. On personnel establishment management and reduction of personnel establishments:
a) Submit to the Prime Minister for approval of total personnel establishments for civil servants, reserve personnel establishments for civil servants, personnel establishments for civil servants working abroad of ministries, ministerial-level agencies, government agencies, organizations established by the Government, the Prime Minister that are not public service units and centrally-administered cities and provinces;
b) Review and submit to the Prime Minister for consideration and decision on adjustment and supplementation of civil servant personnel establishments of ministries, ministerial-level agencies, government agencies, organizations established by the Government, the Prime Minister that are not public service units and provincial People's Committees within the scope of reserve personnel establishments approved annually by the Prime Minister;
c) Decide on allocation of civil servant personnel establishments for each ministry, ministerial-level agency, government agency, organizations established by the Government, the Prime Minister that are not public service units and centrally-administered cities and provinces after approval by the Prime Minister;
d) Decide on allocation of civil servant personnel establishments for working abroad for ministries, ministerial-level agencies, government agencies after approval by the Prime Minister;
đ) Decide on allocation of personnel establishments for special-purpose associations operating nationwide after approval by the Prime Minister;
e) Decide on adjustment and supplementation of civil servant personnel establishments for each ministry, ministerial-level agency, government agency, organizations established by the Government, the Prime Minister that are not public service units and provincial People's Committees after decision by the Prime Minister;
g) Decide on the total number of staff in public service units self-financing part of recurrent expenditure and public service units fully financed by the state budget of ministries, ministerial-level agencies, government agencies, organizations established by the Government, the Prime Minister that are not public service units;
h) Review the total number of staff in public service units self-financing part of recurrent expenditure and public service units fully financed by the state budget of provincial People's Committees;
i) Audit the target group for reduction of personnel establishments of ministries, ministerial-level agencies, government agencies, organizations established by the Government, the Prime Minister that are not public service units and provincial People's Committees;
k) Guide and inspect the implementation of personnel establishment management and usage, number of staff in public service units, reduction of personnel establishments of ministries, ministerial-level agencies, government agencies, organizations established by the Government, the Prime Minister that are not public service units and provincial People's Committees;
l) Aggregate and statistically compile personnel establishments for civil servants, number of staff in public service units, reduction of personnel establishments of state agencies and public service units nationwide, report to the Government, the Prime Minister and competent authorities;
9. On state cadres, civil servants, public officials:
a) Guide and inspect the implementation of cadre planning for leadership and management positions of ministries, ministerial-level agencies, government agencies; aggregate and report to the Prime Minister on cadre planning for civil servants, public officials and other leadership and management positions under the Prime Minister's authority; guide and inspect the implementation of cadre planning, plans, programs for building a cadre, civil servant, public official team;
b) Guide, inspect the implementation of the Government's and Prime Minister's regulations on: recruitment, utilization, appointment to rank, transfer of rank, promotion of rank, change of occupational title, evaluation, appointment, reappointment, transfer, rotation, special assignment, resignation from position, resignation, removal from office, disciplinary action, termination of employment, retirement, ethics, communication culture of civil servants and public officials, and other management contents for civil servants and public officials as prescribed by law; ensure gender equality principles as prescribed by law;
c) Guide, inspect the implementation of the Government's regulations on titles, standards of cadres, civil servants, and public officials in leadership and management positions from deputy department head level and equivalent to vice-minister level and equivalent in ministries, ministerial-level agencies, and government agencies; from deputy department head level and equivalent in district People's Committees to director level and equivalent in provincial Departments under provincial People's Committees;
d) Specify the code numbers for civil servant ranks, code numbers for occupational titles of public officials; specify the structure of civil servant ranks, the structure of public officials according to occupational titles; specify the professional and vocational standards for civil servant ranks, occupational title standards for specialized public officials within the assigned management field; specify the management work of cadre files, civil servant files, file numbers, cards, card wearing systems for civil servants and public officials, and uniforms for cadres and civil servants;
đ) Provide opinions for consensus for ministries, ministerial-level agencies to issue regulations on professional and vocational standards for civil servant ranks, occupational title standards for specialized public officials within the assigned management field;
e) Take the lead in organizing examinations for promotion of civil servant ranks from specialist level and equivalent to senior specialist level and equivalent, from senior specialist level and equivalent to senior specialist high level and equivalent in state agencies, state-owned units; coordinate with the Party Central Organization Department to organize examinations for promotion of civil servant ranks from specialist level and equivalent to senior specialist level and equivalent, from senior specialist level and equivalent to senior specialist high level and equivalent in Party and political-social organizations; coordinate with ministries, ministerial-level agencies, government agencies to organize examinations or review promotions of public officials' occupational titles; decide on appointments to senior specialist rank, occupational titles equivalent to senior specialist rank within their authority; inspect and supervise the promotion of civil servant ranks and changes in public officials' occupational titles;
g) Review the standards, conditions, procedures, formalities, and personnel files for cadre, civil servant, public official positions and other leadership and management positions within the Prime Minister's decision-making authority as prescribed by law;
h) Implement policies for senior cadres according to assigned tasks and levels;
i) Build and manage national data on the cadre, civil servant, public official workforce, village-level cadres, and cadres within the Prime Minister's decision-making authority; organize the management of cadre, civil servant, public official files according to assigned levels;
k) Guide, inspect, and implement the Government's regulations on planning, generating female cadres, and female ratios for appointments in state agencies; collect and compile national statistics on female cadre work;
10. Regarding training and development of cadres, civil servants, and public officials:
a) Aggregate, guide, and inspect the implementation of training and development programs, plans for cadres, civil servants, and public officials both domestically and abroad, village-level cadres, and representatives of all levels of People's Councils;
b) Guide the Government's regulations on the organizational structure of training and development institutions for cadres and civil servants of ministries, ministerial-level agencies, government agencies, and provincial People's Committees;
c) Uniformly manage the training programs for administrative management knowledge according to civil servant rank standards; pre-appointment training programs for leadership and management positions; training programs for representatives of all levels of People's Councils and village-level cadres and civil servants. Review training programs according to public official occupational title standards;
d) Organize training and development of administrative management knowledge and skills for cadres, civil servants, and public officials in the Civil Service sector; take the lead in organizing training and development of administrative management knowledge and skills for representatives of all levels of People's Councils and village-level cadres and civil servants;
đ) Guide and inspect the implementation of annual training and development of cadres, civil servants, and public officials after approval by competent authorities; aggregate and report to the Prime Minister the results of training and development of cadres, civil servants, and public officials;
e) Develop, issue, guide, inspect, and implement human resource planning for the Civil Service sector; train higher education and postgraduate human resources in fields managed by the Ministry of Civil Affairs;
g) Train civil servants according to senior specialist rank standards and equivalents in Party, State agencies, and public service organizations within the political system and enterprises; train civil servants and public officials before appointing them to leadership and management positions within their authority;
h) Train lecturers, researchers, and other subjects in administrative and state management specialties;
i) Train and develop professional and vocational skills for cadres, civil servants, and public officials in specialties and fields within the scope of state management of the Ministry of Civil Affairs;
11. On salary policy:
a) Guide the implementation of the Government's and Prime Minister's regulations on: policies and salary systems (minimum wage; pay scale; rank and grade levels; allowance systems; salary and income management); other policies and systems for state cadres, civil servants, and public officials from central to village levels; salaries for armed forces and contractual workers in state agencies and state-owned organizations;
b) Guide the classification and salary grade for state enterprise management officials, personnel working in armed forces (military, police, telecommunication security, except non-commissioned officers and conscripts) when they are transferred, accepted, or recruited to work in administrative agencies and public service units of the State.
c) Guide and inspect: The implementation of wage policies, allowances, living expenses, and bonuses for civil servants, public officials, state employees, and contractual workers in administrative agencies and public service units of the State; the increase in salary grades for civil servants, public officials, and employees according to the provisions of the law; the assignment of salary coefficients when appointing civil servant ranks and vocational titles of public officials.
d) Provide comments on matters related to wages, allowances, and other expense items with the nature of wages in draft Resolutions of the Standing Committee of the National Assembly, Decrees of the Government, and Decisions of the Prime Minister regarding special financial mechanisms for agencies and units, for competent authorities to consider and decide.
đ) Serve as the permanent member of the Steering Committee for researching and implementing reforms in the State's wage policy.
12. On associations and non-governmental organizations:
a) Assist the Government in uniformly managing national affairs concerning associations, social funds, charitable funds, domestic non-governmental organizations, and Red Cross activities in accordance with the law.
b) Guide the implementation of the Government's regulations on: Procedures and formalities for establishment; division, separation; merger; consolidation; dissolution; approval of charters, issuance of permits for associations, social funds, charitable funds, and domestic non-governmental organizations.
c) Decide on matters relating to: Permission for establishment; division, separation; merger, consolidation; dissolution; approval of charters, issuance of permits for associations, social funds, charitable funds, and domestic non-governmental organizations with nationwide or inter-provincial operations as prescribed by law.
d) Guide and inspect the implementation of laws and regulations concerning associations, social funds, charitable funds, and domestic non-governmental organizations; the implementation of charters for associations and non-governmental organizations as prescribed by law.
đ) Develop and submit to competent state authorities for promulgation or promulgate within their authority normative legal documents on Red Cross activities. Carry out statistical work and report on Red Cross activities.
e) Participate in state management of foreign non-governmental organizations.

14. Regarding state management of religions:
a) Issue within its authority or take the lead and coordinate with ministries, sectors, central agencies of political-social organizations, and other relevant organizations in advising and submitting to competent authorities for promulgation and implementation of policies and laws on religions and state management of religions.
b) Guide professional matters on state management of religions for relevant sectors, levels, and localities.
c) Uniformly manage the publication of publications, religious books, works, teaching materials, and purely religious cultural products of religious organizations permitted by the State to operate.
d) Guide religious organizations to operate in accordance with the law.
đ) Implement and guide religious organizations, believers, monks, and religious clergy about international cooperation in the field of religion according to the law; serve as the contact point with religious organizations both domestically and internationally.
e) Reward or propose competent authorities to reward and apply preferential policies to religious organizations and individuals participating in religious activities.
15. Regarding state management of official records and archives:
a) Develop projects and plans on official record management, collecting, organizing, protecting, preserving, insuring, using archival materials, and implement them after being approved by competent authorities.
b) Guide and inspect state agencies in implementing regulations on state management of official record work, including drafting, issuing documents; managing documents, electronic documents, and other materials formed during the operation of agencies and organizations; managing and using seals in official record work.
c) Guide and inspect agencies, organizations, and individuals in implementing regulations on state management of archives.
d) Carry out professional activities on collecting, organizing, supplementing, arranging, determining the value of archival materials, protecting, preserving, insuring archival materials, declassifying, publishing, introducing, and organizing the use of archival materials at National Archive Centers.
đ) Uniformly manage statistics on official records and archives nationwide.
e) Store electronic archival documents of state agencies submitted for national archives in accordance with the provisions of the law;
g) Organize inspections and issue Certificates of Inspection Results; manage and issue blank certificates for professional practice in archiving services; guide and inspect the management of archival service activities; compile statistics on the issuance of professional practice certificates nationwide;
16. Regarding administrative reform of state administration:
a) Develop programs, plans, and general projects on administrative reform at each stage to submit to competent authorities for decision; serve as the permanent body for the government's administrative reform work;
b) Advise and propose policies and solutions to promote administrative reform to be decided by the Government and the Prime Minister;
c) Take the lead in implementing organizational restructuring, civil service reform, and civil servant reform;
d) Guide and inspect ministries, ministerial-level agencies, government agencies, and provincial people's committees in developing and implementing administrative reform plans and annual budget estimates;
đ) Review tasks in the annual budget estimate related to administrative reform of ministries, ministerial-level agencies, government agencies, and provincial people's committees regarding objectives and contents, and send them to the Ministry of Planning and Investment and the Ministry of Finance for consolidation and submission to the Prime Minister for approval in the annual state budget estimates;
e) Appraise pilot projects on administrative reform proposed by ministries, ministerial-level agencies, government agencies, and provincial people's committees, and submit them to the Prime Minister;
g) Guide ministries, ministerial-level agencies, government agencies, and provincial people's committees in preparing quarterly, semi-annual, and annual administrative reform reports;
h) Prepare quarterly, semi-annual, and annual administrative reform reports to be presented at government meetings;
i) Take the lead in establishing, issuing, guiding, and implementing monitoring, evaluation, and determination of the Annual Administrative Reform Index for ministries, ministerial-level agencies, and provincial people's committees;
k) Take the lead in establishing, issuing, guiding, and implementing measurement and determination of the Satisfaction Index of citizens and organizations with public administration services;
l) Organize training and seminars for specialized cadres and civil servants responsible for administrative reform in ministries, ministerial-level agencies, government agencies, and provincial people's committees;
m) Take the lead in organizing propaganda on administrative reform;
17. Regarding the implementation of democratic regulations at grassroots levels and mass mobilization work:
a) Guide and inspect the implementation of democratic regulations at grassroots levels in communes, wards, towns, and state administrative agencies and state-owned enterprises in accordance with the law;
b) Guide, inspect, review, and summarize the implementation of mass mobilization work by state administrative agencies and local governments at all levels;
18. Regarding international cooperation:
a) Guide the implementation of government and prime ministerial regulations on organizing international conferences and seminars related to the ministry’s areas of state management; compile and report periodically on international conferences and seminars related to the ministry’s areas of state management;
b) Manage and organize international cooperation within the ministry’s areas of state management in accordance with government regulations;
c) Coordinate with other ministries, sectors, and localities on organizing international conferences and seminars, national-level conferences and seminars chaired by the Prime Minister and Deputy Prime Ministers related to the Ministry of Interior’s areas of state management;
d) Lead and coordinate with relevant agencies in cooperation on civil service matters with ASEAN countries;
19. State management over youth work:
a) Guide and inspect the implementation of legal documents, strategic programs, and development plans for youth and youth work;
b) Guide the integration of mechanisms and policies for youth into planning, programs, and target schemes at various levels and sectors;
c) Summarize, review, and report to the Government and the Prime Minister on the implementation of legal provisions concerning youth;
20. Implement public services in the ministry’s areas of state management in accordance with the law;
21. Inspect and check the implementation of policies and laws within the Ministry of Interior’s scope of state management. Receive citizens, handle complaints, petitions, suggestions, reflections, and implement anti-corruption and crime prevention work according to the law;
22. Lead and coordinate with other ministries and sectors to resolve recommendations from state agencies and political-social organizations as assigned by the Government and the Prime Minister;
23. Guide and inspect the permission for agencies and organizations to use seals and the management and use of seals in accordance with the law;
24. Organize and direct the implementation of scientific research plans and the application of scientific research in the ministry’s areas of state management;
25. Organize and direct the application of technology and information data in the ministry’s areas of management;
26. 28. Perform other tasks and powers delegated by the Government and the Prime Minister and as stipulated by the law.
Article 3. Organizational Structure
1. Department of Organization - Staffing.
2. Department of Local Administration.
3. Department of Civil Servants - Officials.
4. Cadre Training and Development Department;
5. Salary Department;
6. Non-Governmental Organizations Department;
7. Administrative Reform Department;
8. Department of International Cooperation.
9. Legal Affairs Department.
10. Planning and Finance Department.
11. General Department;
12. Youth Work Department;
13. Cadre and Civil Servant Organization Department;
14. Ministry Inspectorate.
15. Ministry Office;
16. National Archives and Public Records Administration;
17. Central Department of Propaganda and Awards;
18. Government Committee on Religion;
19. National Academy of Public Administration;
20. Institute of State Organization Science;
21. State Organization Magazine;
22. Information Center.
In this Article, units specified from Clause 1 to Clause 18 are administrative units assisting the Minister in performing state management functions; units specified from Clause 19 to Clause 22 are public service units serving the state management functions of the ministry.
The Minister of Home Affairs shall submit to the Prime Minister for issuance of decisions on the functions, tasks, powers, and organizational structure of the Central Awards and Commendations Board, the Governmental Religious Board, the National Academy of Public Administration, and the decision on the list of other public service units currently under the ministry.
The Minister of Home Affairs shall specify the functions, tasks, powers, and organizational structure of subordinate units under the ministry, except for those specified in Clauses 17, 18, and 19 of this Article; specify the functions, tasks, powers, and organizational structure of departments, offices, and public service units under the Governmental Religious Board, the Central Awards and Commendations Board; specify the functions, tasks, powers, and organizational structure of public service units under the State Archives and Records Management Department.
The State Archives and Records Management Department shall be organized into five divisions and an office; the Inspectorate of the Ministry shall be organized into three divisions; the Office of the Ministry shall be organized into eight divisions.
Article 4. Transitional Provisions
1. The Central Awards and Commendations Board, the Governmental Religious Board, and the National Academy of Public Administration shall continue to implement existing decisions of the Prime Minister regarding the functions, tasks, powers, and organizational structure until the Prime Minister issues new regulations.
2. The Cadre and Civil Servant Training and Development School shall complete its ongoing tasks until the Minister of Home Affairs completes the reorganization of the school's structure, personnel, finance, and assets.
Article 5. Effective Date
1. This Decree takes effect from the date of issuance.
2. This Decree replaces Decree No. 58/2014/NĐ-CP dated June 16, 2014 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs.
Article 6. Responsibility for Implementation
The Minister of Home Affairs, ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree./.
