Amending and supplementing some articles of Circular No. 31/2015/TT-BCT dated September 24, 2015, issued by the Minister of Industry and Trade on implementing the Rules of Origin in the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area

Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 31/2018/NĐ-CP dated March 8, 2018, of the Government detailing the Law on Foreign Trade Management regarding the origin of goods;
Implementing the First Protocol Amending the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area signed on August 26, 2014 within the framework of the 46th Meeting of Ministers for Economic Cooperation in Myanmar; - Australia - New Zealand The Minister of Industry and Trade issues this Circular to amend and supplement some articles of Circular No. 31/2015/TT-BCT dated September 24, 2015 of the Ministry of Industry and Trade on implementing the Rules of Origin in the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area (hereinafter referred to as Circular No. 31/2015/TT-BCT).
Article 1. Amending and supplementing some articles of Circular No. 31/2015/TT-BCT - Australia - New Zealand "Article 3: Implementation organization and enforcement provisions ASEAN 1. This Circular takes effect from October 1, 2015.
At the proposal of the Director of the Department of Import-Export;
2. This Circular replaces Circular No. 33/2009/TT-BCT dated November 11, 2009 of the Ministry of Industry and Trade on implementing the Rules of Origin in the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area. - Australia - New Zealand 3. Contents guiding and unifying understanding related to the implementation of the Chapter on Rules of Origin of Goods, which have been agreed upon by the Member States through successive rounds or reported in the implementation reports of the Sub-Committee on Rules of Origin of Goods (SC-ROO), the Committee on Goods (CTG) and the Joint Committee (JFC) within the framework of the implementation of the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area (AANZFTA), serve as the basis for issuing authorities, organizations issuing Certificates of Origin (C/O) and customs authorities to implement.
4. The contents stipulated in Clause 3 of this Article shall be notified to issuing authorities, organizations issuing C/O and customs authorities through the lead agency implementing AANZFTA pursuant to Article 3 of Resolution No. 28/NQ-CP dated April 22, 2015 of the Government approving the First Protocol Amending the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area."
1. Clause 3 shall be amended and supplemented as follows:
2. Clause 1, Article 10 of Appendix III promulgated together with Circular No. 31/2015/TT-BCT is amended and supplemented as follows:
"Article 10
1. C/O must be issued as soon as possible, but not later than three working days from the date of export."
3. Clause 11 of Appendix VI promulgated together with Circular No. 31/2015/TT-BCT is amended and supplemented as follows:
"11. Box number 10: number and date of the commercial invoice issued by the exporter or manufacturer or third-party trader for the imported consignment."
This Circular takes effect from October 1, 2015.
