CIRCULAR

Amending and supplementing certain articles of Circulars on Toll Stations andservice fees for road usage

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to the Law on Prices dated June 20, 2012;

Pursuant to the Public-Private Partnership Investment Law dated June 18, 2020;

Pursuant to Decree No. 177/2013/ND-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices;

Pursuant to Decree No. 149/2016/ND-CP dated November 11, 2016 of the Government amending and supplementing certain articles of Decree No. 177/2013/ND-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices;

BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;

Pursuant to Decision No. 19/2020/QD-TTg dated June 17, 2020 of the Prime Minister on the collection of service fees for road usage through electronic automatic non-stop systems;

At the proposal of the Director of the Department of Finance and the Director of the Vietnam Highway Administration;

The Minister of Transport issues this Circular amending and supplementing certain articles of Circulars on toll stations and service fees for road usage.

1. Replace the phrase "Vietnam Highway Administration" with the phrase "Vietnam Highway Corporation" at Clause 3, Article 8 and Clause 6, Article 9 of Circular No. 35/2016/TT-GTVT which has been amended and supplemented by Clause 12, Article 1 of Circular No. 28/2021/TT-GTVT.

2. Replace the phrase "Vietnam Highway Administration" with the phrase "Vietnam Highway Corporation" at Article 10 of Circular No. 35/2016/TT-GTVT which has been amended and supplemented by Clause 14, Article 1 of Circular No. 28/2021/TT-GTVT.

3. Replace the phrase "Director of Vietnam Highway Administration" with the phrase "Director of Vietnam Highway Corporation" at:

a) Clause 2, Article 12 of Circular No. 35/2016/TT-GTVT;

b) Article 5 of Circular No. 28/2021/TT-GTVT.

Article 2. Amending and supplementing certain articles of Circular No. 45/2021/TT-GTVT dated December 31, 2021 of the Minister of Transport stipulating the operation of toll stations on highways.

1. Replace the phrase "Vietnam Highway Administration" with the phrase "Vietnam Highway Corporation" at Clause 1, Article 12, Clause 1, Article 24, Point a, Clause 1, Article 29, Clause 1, Article 32, Point b, Item 5, Appendix 1.

2. Replace the phrase "Director of Vietnam Highway Administration" with the phrase "Director of Vietnam Highway Corporation" at Clause 1, Article 32.

Article 3. Effectiveness

This Circular takes effect from August 1, 2023.

Article 4. Organization of Implementation

The Head of the Office of the Ministry, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Highway Corporation, the Heads of agencies, organizations, and individuals related to this Circular shall be responsible for its implementation./.
