Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No.27/2022/NĐ-CPPursuant to Decision No. 263/QD-TTg dated February 22, 2022 of the Prime Minister approving the Target Program on Building New Rural Areas Phase 2021-2025 (hereinafter referred to as Decision No. 263/QD-TTg);;

On the basis of Decree No. 38/2023/NĐ-CP dated June 24, 2023 of the Government amending and supplementing some articles of Decree No. 27/2022/NĐ-CP (hereinafter referred to as Decree No. 38/2023/NĐ-CP);

Pursuant to the proposal of the Director of the Office of the Central Steering Committee for New Rural Areas Construction and the Director of the Department of Legal Affairs;

The Minister of Agriculture and Rural Development issues this Circular amending and supplementing some articles of Circular No. 05/2022/TT-BNNPTNT dated July 25, 2022 of the Ministry of Agriculture and Rural Development guiding certain contents of implementation of the Target Program on Building New Rural Areas Phase 2021-2025 within the scope of state management of the Ministry of Agriculture and Rural Development.

Article 1. Amending and supplementing some articles of Circular No. 05/2022/TT-BNNPTNT dated July 25, 2022 of the Ministry of Agriculture and Rural Development guiding certain contents of implementation of the Target Program on Building New Rural Areas Phase 2021-2025 within the scope of state management of the Ministry of Agriculture and Rural Development, as follows:

1. Amending Clause 1 of Article 2 as follows:

"1. Implementation principles as prescribed in Article 4, Chapter I, Decree No. 27/2022/NĐ-CP."

2. Amending and supplementing Article 3 as follows:

"Article 3. Plan for Implementing the New Rural Area Construction Program

The establishment, approval, and assignment of plans for implementing the New Rural Area Construction Program shall be carried out in accordance with the provisions of Chapter II, Decree No. 27/2022/NĐ-CP (amended and supplemented at Clauses 2, 3, and 4 of Article 1 of Decree No. 38/2023/NĐ-CP) and related guiding documents.

3. Supplement Point i and Point k to Clause 1 of Article 4 as follows:

3. Supplementing Point i and Point k to Clause 1 of Article 4 as follows:

"i) Establishing national technical standards and economic-technical norms for investment, management, and operation of irrigation works;

k) Developing and disseminating technical guidance materials to improve and enhance the quality of the irrigation system, and meet the irrigation criteria."

"2. County-level safe agricultural product procurement-supply centers, modern agricultural product supply systems shall be implemented in accordance with the guidance of the Ministry of Agriculture and Rural Development and current laws."

4. Amending and supplementing Clause 2 of Article 5 as follows:

"2. County-level safe agricultural product procurement centers and modern agricultural product supply systems shall operate in accordance with the guidelines of the Ministry of Agriculture and Rural Development and current laws."

6. Supplement Clause 6 to Article 7 as follows:

5. Amending and supplementing Point a of Clause 1 of Article 6 as follows:

“a) Establishing and developing effectively concentrated raw material zones according to the orientations set forth in Decree No. 98/2018/NĐ-CP dated July 5, 2018 of the Government on policies encouraging the development of cooperation and linkage in agricultural production and consumption; Decision No. 100/QĐ-TTg dated January 19, 2019 of the Prime Minister approving the project to implement, apply, and manage traceability systems; Decision No. 1804/QĐ-TTg dated November 13, 2020 of the Prime Minister approving the Program to support the development of collective economic organizations and cooperatives from 2021 to 2025; Decision No. 255/QĐ-TTg dated February 25, 2021 of the Prime Minister approving the Plan to restructure the agricultural sector from 2021 to 2025; Decision No. 885/QĐ-TTg dated June 23, 2020 of the Prime Minister approving the Project to develop organic agriculture from 2020 to 2030, and according to the planning of concentrated raw material zones of localities.”

“Article 8. Developing household and village-level models for treating domestic wastewater

6. Supplementing Clause 6 to Article 7 as follows:

“6. Organizing supervision and evaluation of rural clean water quality; applying the Rural Clean Water Monitoring-Evaluation Index System issued by the Ministry of Agriculture and Rural Development in the assessment and recognition of new rural areas at all levels; promoting and mobilizing people to participate in managing, protecting, and using clean water from centralized water supply facilities.”

3. Pilot construction of models for treating domestic wastewater using ecological technology, low cost, simple design; Construction and replication of household and village-level models for collecting and treating rural domestic wastewater in accordance with the guidance of the Ministry of Agriculture and Rural Development, ensuring ease of construction, use, operation, and suitability for each locality's characteristics.

7. Amending and supplementing Article 8 as follows:

8. Amending and supplementing Article 10 as follows:

“Article 8. Developing household and village-scale wastewater treatment models

1. Reviewing and formulating plans for organizing drainage and domestic wastewater treatment, integrated into the general plan for rural construction and implementing drainage and domestic wastewater treatment projects according to the formulated plans.

2. Applying and transferring advanced technologies for household and village-scale domestic wastewater treatment suitable to regional conditions.

3. Piloting models of domestic wastewater treatment using ecological technology, low cost, simple design; Building and replicating models of household and village-scale domestic wastewater collection and treatment in rural areas following the guidelines of the Ministry of Agriculture and Rural Development, ensuring ease of construction, use, operation, and suitability to the characteristics of each locality.

4. Promoting and mobilizing people to renovate drainage systems and apply appropriate domestic wastewater treatment models based on actual conditions, minimizing untreated wastewater discharges into the environment.”

"c) Support the main contents of policies on cooperation, linkage, and development of chain consumption contracts for agricultural products as prescribed in Decree No. 98/2018/NĐ-CP dated July 5, 2018 of the Government on policies encouraging the development of cooperation and linkage in production and consumption of agricultural products, and as prescribed in Article 21 of Decree No. 27/2022/NĐ-CP (amended and supplemented in Clause 12, Article 1 of Decree No. 38/2023/NĐ-CP);"

"d) Support public services in raw material areas such as: Issuing planting area codes, tracing product origins; confirming and certifying quality standards, conformity marks of special products (OCOP, ecological, organic...); providing weather information and market information."

"d) Supplement Clause 3 as follows:"

"3. Support mechanization and high-tech application in modern agriculture"

"a) Purchase machines, equipment, and technology for agricultural mechanization;"

"b) Training and training operation of machines, equipment, and technology;"

"c) Support production premises in accordance with Article 11 of the Law on Supporting Small and Medium Enterprises or Article 21 of the Law on Cooperatives;"

"d) Organize conferences, seminars, inspections, and evaluations of the degree of mechanization application in agricultural production."

"9. Amend and supplement Article 12 as follows:"

"a) Amend and supplement the opening clause of Clause 4 as follows:"

"Implementing the contents prescribed in Decision No. 919/QĐ-TTg dated August 1, 2022 of the Prime Minister approving the Program of One Commune One Product for the period of 2021-2025, current laws, and related guiding documents. Establish the National Exhibition Space and Development of OCOP Products to promote innovation, connect supply and demand, promote, introduce, and trade OCOP products domestically and internationally. Among which, focus on implementing the following contents:"

"b) Amend and supplement Point d and Point đ of Clause 4 as follows:"

"d) On promotion and trade facilitation, connecting supply and demand:"

"Strengthen trade promotion activities, connecting supply and demand for OCOP products through trade fairs, exhibitions, events honoring, promoting, and introducing distinctive annual OCOP products linked with national, regional, local, and international cultures; promote the consumption of OCOP products linked with key tourism markets."

"Build and manage the OCOP Vietnam brand synchronously and effectively; enhance intellectual property protection, improve the image, recognizability, and value of OCOP products in the market."

"Pilot and replicate models of OCOP product introduction and sales points according to the guidelines of the Ministry of Industry and Trade on building OCOP product introduction and sales points (as assigned in Decision No. 919/QĐ-TTg dated August 1, 2022 of the Prime Minister approving the Program of One Commune One Product for the period of 2021-2025). Prioritize building OCOP product introduction and sales points linked with major cities, tourist centers, agricultural and rural tourism in localities."

"Pilot and replicate models of OCOP streets; OCOP product exhibition spaces linked with tourism; establish a distribution system for OCOP products on transportation means (railway, air...); e-commerce village models for OCOP products, virtual trade fairs and exhibitions for OCOP; modern and synchronized OCOP introduction centers applying information technology, linked with the exploitation of advantages in rural tourism."

"Establish a suitable distribution system, gradually set up a specific and distinctive OCOP product introduction and sales system linked with gift and souvenir products, local specialty products."

"Establish a trade promotion and product promotion system to the international market; enhance the capacity of logistics systems in OCOP product trade; build and implement programs for trade promotion, product promotion, and brand recognition for national OCOP products."

"Establish the National Exhibition Space and Development of OCOP Products to promote, introduce, develop products, connect supply and demand, and the OCOP product market."

"Strengthen international cooperation activities in promotion, introduction, and trade facilitation to develop OCOP products in foreign markets."

"đ) Build and perfect the management and supervision system for OCOP products:"

"Organize annual evaluation and ranking of OCOP products according to Decision No. 148/QĐ-TTg dated February 24, 2023 of the Prime Minister on issuing criteria and procedures for evaluating and ranking products under the One Commune One Product program; strengthen the application of digital technology in organizing the evaluation and ranking of OCOP products."

"Establish a reporting system and manage data on OCOP products at all levels (central, provincial, district). Strictly manage and supervise OCOP products to improve quality, value, and promote connection between supply and demand of OCOP products."

"Establish regulations and promote inspection and supervision activities on the implementation of policies and regulations regarding product evaluation and ranking in localities, maintaining production conditions of subjects and product quality after evaluation and recognition."

"Study and build technical standards for monitoring and evaluation procedures of OCOP products."

"Pilot and build appropriate timelines for applying socialized mechanisms in monitoring, evaluation, and ranking activities of OCOP products."

"c) Supplement Point h in Clause 4 as follows:"

"h) Implement some pilot models under the OCOP Program on: Developing value chains for OCOP products linked with local raw materials, developing small and medium-scale processing; green OCOP products linked with community management of resources, biodiversity conservation, and OCOP service products linked with enhancing the role of the community according to the guidelines of the Ministry of Agriculture and Rural Development and current laws."

"10. Amend and supplement the opening clause of Article 15 as follows:"

"Implementing the contents prescribed in Decision No. 923/QĐ-TTg dated August 2, 2022, of the Prime Minister approving the Science and Technology Program to serve the construction of new rural areas for the period 2021-2025, current laws, and related guiding documents. Among which, focus on implementing the following contents:"

11. Amend and supplement Article 16 as follows:

a) Amend and supplement the introductory paragraph as follows:

"Implementing the contents prescribed in Decision No. 922/QĐ-TTg dated August 2, 2022, of the Prime Minister approving the Rural Tourism Development Program during the construction of new rural areas for the period 2021-2025, current laws, and related guiding documents. Among which, focus on implementing the following contents:"

b) Amend and supplement Clause 5 as follows:

"5. Building and implementing pilot models for rural tourism development towards green, responsible, and sustainable tourism."

Build pilot models for rural tourism development according to various types: community tourism, agricultural tourism, eco-tourism, tourism linked with nature conservation, craft village tourism, smart village tourism, zero-emission tourism. Prioritize models with distinctive tourism products for each region and economic efficiency; aiming to enhance awareness and responsibility of all stakeholders in the tourism value chain (managers, travel agencies, communities, and tourists, etc.) in preserving and promoting cultural values and protecting the environment; using local materials and labor; applying digital transformation solutions; mobilizing the participation of women, the poor, ethnic minorities, and vulnerable groups to improve the livelihoods and income of the people.

Implement some pilot models under the Program for rural tourism development towards green, responsible, and sustainable tourism in accordance with the guidance of the Ministry of Agriculture and Rural Development and current laws."

12. Amend and supplement Article 17 as follows:

"Article 17. Improving environmental quality"

"1. Implement regulations on collecting, recycling, and reusing waste; collecting and treating pesticide and veterinary drug packaging after use; managing plastic waste in agricultural, forestry, and fisheries activities from issued documents, including Decree No. 08/2022/NĐ-CP dated January 10, 2022 detailing certain provisions of the Law on Environmental Protection; Decision No. 491/QĐ-TTg dated May 7, 2018 of the Prime Minister approving the adjustment of the National Strategy on Integrated Solid Waste Management until 2025, vision to 2050; Decision No. 1746/QĐ-TTg dated December 4, 2019 of the Prime Minister on issuing the National Action Plan on Marine Plastic Debris Management until 2030; Decision No. 1121/QĐ-TTg dated September 25, 2023 of the Prime Minister approving the National Strategy on Antimicrobial Resistance Prevention and Control in Vietnam for the period 2023-2030, vision to 2045; Circular No. 12/2021/TT-BNNPTNT dated October 26, 2021 on guiding the collection and treatment of livestock waste and agricultural by-products for reuse; Circular No. 19/2019/TT-BNNPTNT dated November 15, 2019 on regulating the collection, treatment, and use of crop by-products; Circular No. 02/2022/TT-BTNMT dated January 10, 2022 of the Minister of Natural Resources and Environment detailing the implementation of certain provisions of the Law on Environmental Protection and related guiding documents."

"2. Develop technical guidelines for processing, recycling, and reusing organic waste, agricultural waste, and plastic waste based on the circular economy principle; reduce plastic waste emissions."

"3. Develop models for recycling, reusing, and processing agricultural waste, agricultural by-products, and plastic waste in rural areas."

13. Supplement Clause 3 to Article 19 as follows:

"3. Environmental protection activities for animal husbandry and aquaculture facilities include:"

"a) Developing and disseminating technical guidance materials, training manuals, and handbooks on environmental protection for animal husbandry and aquaculture facilities suitable to regional conditions."

"b) Supporting communication and training costs for recycling, reusing, and processing waste at animal husbandry and aquaculture facilities."

"c) Supporting the construction of models ensuring environmental hygiene, recycling waste at animal husbandry and aquaculture facilities; models for managing, reusing, recycling, processing, and reducing plastic waste."

14. Amend and supplement Article 20 as follows:

a) Amend and supplement the introductory paragraph as follows:

"Implementing the contents prescribed in Decision No. 925/QĐ-TTg dated August 2, 2022, of the Prime Minister approving the Program to Strengthen Environmental Protection, Food Safety, and Clean Water Supply in Rural Areas during the Construction of New Rural Areas for the Period 2021-2025; Decision No. 1384/QĐ-BNN-QLCL dated April 15, 2022 of the Ministry of Agriculture and Rural Development approving the Project on Ensuring Food Safety and Improving the Quality of Agricultural, Forestry, and Aquatic Products for the Period 2021-2030, and related guiding documents. Among which, focus on implementing the following contents:"

b) Supplement Point c to Clause 8 as follows:

"c) Support the construction of safe food markets at district, inter-district, provincial, and inter-provincial levels that meet requirements for hygiene and food safety."

c) Supplement Clause 10, Clause 11 as follows:

"10. Implement measures effectively to achieve the contents of the Program to Strengthen Environmental Protection, Food Safety, and Clean Water Supply in Rural Areas during the Construction of New Rural Areas for the Period 2021-2025, focusing on the following solutions:"

a) Communication and capacity building: Develop special programs and regular columns on environmental protection, food safety, and rural clean water supply to be broadcast periodically on television, radio, print newspapers, and online news sites. Launch specialized competition movements to commend, honor, and reward outstanding collectives and individuals with effective solutions and innovations aimed at reducing pollution, improving the environment, ensuring food safety, and providing clean water in rural areas; organize contests for bright, green, clean, and beautiful rural areas. Train and enhance the capacity of community spokespersons and communicators on agricultural and rural environmental protection work, operation of water supply facilities, and waste treatment works. Develop model communication products and designs for environmental protection, food safety, and rural clean water supply.

b) Establish national technical standards, economic-technical norms, and technical guidelines on environmental protection, food safety, and rural clean water supply in the construction of new rural areas during the period from 2021 to 2025.

c) Review, update, transfer, and apply technologies related to water supply and environmental protection that are suitable to local conditions towards reducing investment and operational costs, simple operating techniques, and environmentally friendly methods; prioritize domestic production technologies, modern, circular, and environmentally friendly technologies.

d) Develop guidance, implement, summarize, evaluate, and replicate models for mobilizing the participation of businesses, political-social organizations, cooperatives, teams, groups, and rural communities in protecting the rural environment.

đ) Continue maintaining, enhancing quality, and developing the network of grassroots-level environmental protection communicators.

11. Implement some central pilot models on environmental protection, food safety, and rural clean water supply according to the guidelines of the Ministry of Agriculture and Rural Development and current laws.

15. Amend and supplement Article 21 as follows:

a) Amend and supplement the introductory paragraph as follows:

"Implement the contents stipulated in Decision No. 924/QĐ-TTg dated August 2, 2022, of the Prime Minister approving the Program on Digital Transformation in New Rural Area Construction towards Smart Rural Areas during the period 2021-2025, current laws, and relevant guiding documents. Focus on implementing the following contents:"

b) Supplement Clause 6 as follows:

"6. Implement some central pilot models on smart rural communes and e-commerce villages according to the guidelines of the Ministry of Agriculture and Rural Development and current laws."

16. Amend and supplement Clause 4 of Article 22 as follows:

"4. Purchase office equipment serving the activities of the Steering Committee, Working Group, and assisting agencies at all levels according to the approval decision of the competent authority, laws on bidding, and management and use of public assets."

17. Supplement Clause 4 into Article 23 as follows:

"4. A set of monitoring and evaluation indicators for the implementation of the National Target Program on New Rural Area Construction during the period 2021-2025, including indicators reflecting outcomes, responsibility for tracking, summarizing, and reporting (details in Appendices I and II issued together with this Circular)."

18. Amend and supplement Clause 1 of Article 26 as follows:

"1. Pilot and replicate models of modern security surveillance and community surveillance linked to the implementation of the Program on Digital Transformation in New Rural Area Construction towards Smart Rural Areas during the period 2021-2025 according to Decision No. 924/QĐ-TTg dated August 2, 2022, of the Prime Minister and the Program on Enhancing Quality and Effectiveness of Security and Order Criteria in New Rural Area Construction during the period 2021-2025 according to Decision No. 926/QĐ-TTg dated August 2, 2022, of the Prime Minister and relevant guiding documents."

19. Supplement Clause 5 into Article 27 as follows:

"5. Develop and disseminate training materials for cadres working on New Rural Area Construction at all levels."

a) Develop, compile, edit, revise, and widely distribute training materials (manuals, handbooks, etc.) to enhance the capabilities, shift perceptions, and thinking of cadres working on New Rural Area Construction at all levels, especially at the grassroots level (general knowledge of the National Target Program on New Rural Area Construction and specialized fields of the Program).

b) Develop, compile, edit, revise, and widely distribute training materials to raise awareness and shift thinking of farmers and communities about agricultural economic development and New Rural Area Construction.

20. Supplement Sub-item 4 after Sub-item 3, Item 5, Chapter II as follows:

"Sub-item 4

MAINTENANCE, REPAIR, AND OPERATION OF COMPLETED PROJECTS AFTER COMMISSIONING"

INVESTMENT AFTER COMMISSIONING AND PUTTING INTO USE”

21. Supplement Article 29a after Article 29 in Sub-item 4 as follows:

"Article 29a. Maintenance, repair, and operation of completed projects

1. Projects subject to maintenance and repair are those funded by the National Target Program on New Rural Area Construction after completion and commissioning.

2. Management, operation, and maintenance of completed projects shall be carried out in accordance with Clause 1 and Clause 2 of Article 19 of Decree No. 27/2022/NĐ-CP (amended and supplemented by Clause 10 of Article 1 of Decree No. 38/2023/NĐ-CP) and other relevant guiding documents."

Article 2. Effective Date

1. This Circular takes effect from May 31, 2024.

2. For tasks approved by the competent authority to be implemented before the date this Circular takes effect, continue to implement according to the approval decision of the competent authority and relevant laws.

3. Specific documents cited in this Circular will be applied according to newly issued documents when new regulating documents take effect.

4. During implementation, if there are emerging issues or difficulties, relevant agencies, units, organizations, and individuals should report to the Ministry of Agriculture and Rural Development for research, amendment, and supplementation to ensure compliance./.
