Circular No. 07/2024/TT-BTP abolishes joint circulars issued by the Minister of Justice regarding the enforcement of obligations and registration of security measures.

CIRCULAR

Repeals the joint circulars issued by the Minister of Justice on ensuring the performance of obligations and registering security measures

Pursuant to the Law on Legislative Regulatory Documents dated June 22, 2015; and the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents dated June 18, 2020;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents; Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing certain provisions of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents; and Decree No. 59/2024/NĐ-CP dated May 25, 2024 of the Government amending and supplementing certain provisions of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents which has been amended and supplemented certain provisions pursuant to Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government;

Pursuant to Decree No. 21/2021/NĐ-CP dated March 19, 2021 of the Government detailing the implementation of the Civil Code on ensuring the performance of obligations;

Pursuant to Decree No. 99/2022/NĐ-CP dated November 30, 2022 of the Government on registering security measures;

Pursuant to Decree No. 98/2022/NĐ-CP dated November 29, 2022, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

After reaching consensus with the Minister of Transport, the Minister of Natural Resources and Environment, the Minister of Public Security, and the Governor of the State Bank of Vietnam;

At the proposal of the Director of the National Registration Agency for Security Interests;

The Minister of Justice issues this Circular to repeal the joint circulars issued by the Minister of Justice on ensuring the performance of obligations and registering security measures.

Article 1. Abolish all joint circulars

Abolish the following joint circulars entirely:

1. Joint Circular No. 15/2013/TTLT-BTP-BGTVT-BTNMT-BCA dated November 5, 2013 of the Minister of Justice, the Minister of Transport, the Minister of Natural Resources and Environment, and the Minister of Public Security guiding the exchange and provision of information on secured assets between the registration authority for secured transactions and notary public organizations, civil enforcement agencies, and asset ownership and usage right registration authorities.

2. Joint Circular No. 16/2014/TTLT-BTP-BTNMT-NHNN dated June 6, 2014 of the Minister of Justice, the Minister of Natural Resources and Environment, and the Governor of the State Bank of Vietnam guiding certain matters regarding the disposal of secured assets.

Article 2. Implementation clause

1. This Circular takes effect from August 2, 2024.

2. The Director of the National Registration Center for Secured Transactions, Heads of units under the Ministry of Justice, and relevant agencies, organizations, and individuals shall be responsible for implementing this Circular./.
