CIRCULAR

Guidelines for Importing Used Automobile Engines

Pursuant to Decision No. 11/1998/QĐ-TTg dated January 23, 1998 of the Government Prime Minister on the management mechanism for import and export in 1998;

Pursuant to the opinions of the Ministry of Transport (Letter No. 1140/GTVT-PCVT dated April 22, 1998), the Ministry of Science, Technology and Environment (Letter No. 1010/BKHCNMT-CN dated April 28, 1998), the Ministry of Finance (Letter No. 1185/TC-TCT dated April 14, 1998), the General Department of Customs (Letter No. 1060/TCHQ-GSQL dated April 3, 1998) and after consultation with relevant ministries and agencies;

Following Circular No. 01/1998/TM-XNK dated February 14, 1998 of the Ministry of Trade guiding the implementation of Decision No. 11/1998/QĐ-TTg dated January 23, 1998 of the Government Prime Minister;

The Ministry of Trade hereby provides guidelines for importing used automobile engines as follows:

I. REGULATIONS ON IMPORT AND USE:

Enterprises holding business licenses for import and export of relevant goods may handle the import procedures at customs authorities for various types of used automobile engines (understood as gasoline engines, diesel engines, and semi-diesel engines used for automobiles and tractor units belonging to tariff headings 8701, 8702, 8703, 8704, and 8705 of the Import Tariff).

The importation of used automobile engines must comply with Decision No. 2019/1997/QĐ-BKHCNMT dated December 1, 1997 of the Ministry of Science, Technology and Environment.

Imported automobile engines can only be used to replace engines of legally circulating automobiles and tractor units or to serve as agricultural and fisheries machinery according to relevant regulations of ministries and agencies. Enterprises and relevant authorities should pay special attention to the use of imported goods as mentioned above and must not import them for other purposes.

The import tax on used automobile engines shall be implemented according to current state regulations based on reasonable protection of domestic production.

II. IMPLEMENTATION PROVISIONS

The Ministry of Trade requests that ministries, ministerial-level agencies, government agencies, central bodies of social organizations, People's Committees of provinces and centrally-administered cities inform enterprises under their jurisdiction about the contents of this circular and coordinate with the Ministry of Trade and related ministries and sectors to guide enterprises to effectively implement importation and usage, avoiding negative phenomena and commercial fraud. At the same time, during the implementation process, if there are any issues arising, they are requested to promptly report to the Ministry of Trade for consolidation and appropriate adjustment.

This circular takes effect from the date of issuance until March 31, 1999./.
