Decision No. 08/2003/QĐ-BKHCN on the issuance of regulations on the working methods of the Advisory Science and Technology Council for determining State-level Science and Technology topics and experimental production projects.

DECISION OF THE MINISTER OF SCIENCE AND TECHNOLOGY

Regarding the issuance of the Provision on the Working Method of

the Scientific Advisory Council

for Determining Science and Technology Topics and National Pilot Production Projects

Pursuant to Decree No. 81/2002/CP dated October 17, 2002 of the Government detailing the implementation of certain provisions of the Law on Science and Technology;

Pursuant to Decree No. 22/CP dated May 22, 1993 of the Government stipulating the tasks, powers, and organizational structure of the Ministry of Science, Technology, and Environment (now the Ministry of Science and Technology);

 

THE MINISTER OF SCIENCE AND TECHNOLOGY

 

Pursuant to Decision No. 07/2003/QĐ-BKHCN dated April 3, 2003 of the Minister of Science and Technology regarding the determination of science and technology topics and national pilot production projects;

Considering the proposals of the Heads of the Departments of Industrial Science and Technology Management, Agricultural Science and Technology Management, Social Science and Natural Science Management, and Planning;

Issuing the "Provision on the Working Method of the Scientific Advisory Council for Determining Science and Technology Topics and National Pilot Production Projects";

This Decision shall take effect fifteen days from the date of publication in the Official Gazette and shall replace Decision No. 34/2002/QĐ-BKHCNMT dated May 31, 2002 of the Minister of Science, Technology, and Environment on the issuance of the "Temporary Provision on the Working Method of the Scientific Advisory Council for Determining National-Level Research Topics for the Period 2001-2005".

 

DECISION:

 

Article 1. The Heads of the Departments of Planning, Industrial Science and Technology Management, Agricultural Science and Technology Management, Social Science and Natural Science Management, International Relations, the Director of the Ministry's Office, the Heads of units under the Ministry, and the Heads of related agencies and organizations are responsible for implementing this Decision./.

Principles of the Working Method of the Scientific Advisory Council (hereinafter referred to as the Council)

1. Council meetings must have at least two-thirds of the members present (written opinions of absent members only have reference value). The Chairman of the Council chairs the Council meetings.

2. Council working documents (detailed in Appendix 1 and Appendix 2 attached hereto) must be sent to Council members at least three days before the Council meeting.

Article 1. 3. The advisory process for determining national-level science and technology topics (hereinafter referred to as topics) and national pilot production projects (hereinafter referred to as pilot production projects) is carried out by the Council in two steps as follows:

Step 1: Determine the proposed list of topics and pilot production projects;

Step 2: Determine the brief outlines of each topic and pilot production project.

4. Step 1 consists of two stages.

The Council uses the voting principle to implement Step 1 as follows:

a) Stage 1: Select topics and pilot production projects for implementation by evaluating and classifying them into two categories: "Proposed for Implementation" and "Not Proposed for Implementation".

Topics and pilot production projects proposed for implementation must be agreed upon by at least two-thirds of the Council members present.

b) Stage 2: Classify the topics and pilot production projects that the Council has agreed to propose for implementation into two levels: A and B (A being the higher level, requiring priority implementation).

5. Step 2: The Council uses the majority voting principle to conclude on the brief outlines for each topic and pilot production project.

Working procedure of the Council in Step 1

The Council works according to the following procedure:

1. Introduce the content and working method of the Council

Article 2. a) The Council Secretary reads the decision establishing the Council, introduces the composition of the Council and the attending representatives.

b) A representative of the Ministry of Science and Technology states the requirements and main contents of the relevant documents and regulations concerning the determination of topics and pilot production projects, including:

- The Prime Minister's Decision approving the direction for the development of science and technology during the planning period;

- The Minister of Science and Technology's Decision approving the objectives and main contents of the Program;

- A preliminary list of topics and pilot production projects expected to be included in the science and technology program corresponding to the relevant scientific field (for Councils determining topics and pilot production projects within the Program);

- A preliminary list of independent topics and pilot production projects corresponding to the relevant scientific field (for Councils determining independent topics and pilot production projects);

and introduces the main contents of other necessary professional and operational documents.

2. Select topics proposed for implementation (Stage 1)

2.1. Council discussion

The Council examines and analyzes the preliminary list of topics and pilot production projects expected to be included in the science and technology program or the preliminary list of independent topics and pilot production projects provided by the Ministry of Science and Technology based on the criteria specified in Article 5 of the "Provision on the Determination of Science and Technology Topics and National Pilot Production Projects" issued together with Decision No. 07/2003/QĐ-BKHCN dated April 3, 2003 of the Minister of Science and Technology.

The Council discusses topics and pilot production projects that meet the criteria for national-level research and should be implemented, and those that do not meet the criteria and should not be implemented.

2.2. The Council elects the Ballot Counting Committee. The Ballot Counting Committee consists of three Council members, including one Chairperson.

The Council votes to evaluate and classify topics into two types:

- Proposed for Implementation.

- Not Proposed for Implementation.

The Council votes to evaluate and classify national-level topics and pilot production projects within the science and technology program according to Form 1-ĐTDACT-A.

The Council votes to evaluate and classify independent national-level topics and pilot production projects according to Form 1-ĐTDAĐL-A.

Valid ballots are those marking one of the two columns ("proposed for implementation" or "not proposed for implementation") as indicated on the ballot.

2.3. Summarize the number of votes for implementation

The Council votes to evaluate the proposals for independent state-level Research and Technology Development Projects according to Model Ballot 1-ĐTDAĐL-A.

Valid ballots are those marking one of the two columns ("recommend implementation" or "recommend not to implement") as indicated on the ballot.

2.3. Summarize the number of recommendation votes.

The ballot counting committee compiles the voting results of the Council according to Ballot Form KP 1-ĐTDACT-A and KP 1-ĐTDAĐL-A corresponding to each Council.

Working procedure of the Council in Step 1

3. Classify the Research Topics and Science and Technology Projects that have been agreed upon by the Council for implementation into two levels A or B (A being the higher level, requiring priority implementation) - Step 2.

3.1. The Council discusses the modification, supplementation, or clarification of the name, research subject, briefly outlines the objectives and expected products for each Research Topic and Science and Technology Project.

3.2. The Council votes to classify Research Topics and Science and Technology Projects into two levels A or B (according to Ballot Form 2-ĐTDACT-A and Ballot Form 2-ĐTDAĐL-A corresponding to each Council).

The ballot counting committee consists of members elected to count ballots in Step 1.

Valid ballots are those marked in one of the two columns (A or B) as indicated on the ballot.

3.3. Compile the classification vote counts

The ballot counting committee compiles the voting results of the Council according to Ballot Form KP2-ĐTCT-A and KP2-ĐTĐL-A corresponding to each Council.

4. The Council approves the Minutes of the Council's work results, recommending the proposed list of Research Topics and Science and Technology Projects under the Science and Technology Program or the proposed list of independent Research Topics and Science and Technology Projects according to the relevant scientific field to be sent to the Ministry of Science and Technology.

The Minutes of the Council's work are established according to the prescribed model: Model BBHĐ1-CT-A for the Council determining Research Topics and Science and Technology Projects under the Program and Model BBHĐ1-ĐL-A for the Council determining independent Research Topics and Science and Technology Projects.

Article 3. The Council's working procedure in Step 2

After the Minister of Science and Technology reviews and approves the proposed list of Research Topics and Science and Technology Projects under each Science and Technology Program and the proposed list of independent Research Topics and Science and Technology Projects, the Councils prepare a summary outline for each Research Topic and Science and Technology Project according to the following procedure:

1. The Council discusses and assigns experts to prepare the summary outline

The Council discusses to reach consensus on the requirements for preparing the summary outline for each Research Topic and Science and Technology Project: The summary outline must reflect the urgency of the Research Topic with clear research objectives and subjects, consistent with the specified research time frame and highly feasible.

The summary outline of the Research Topic and Science and Technology Project includes the following basic elements:

- Name of the Research Topic and Science and Technology Project;

- Required achievements;

- Expected results and products, key economic and technical indicators of the product.

The Council assigns two or three members who are deeply knowledgeable in the relevant field to prepare the summary outline for each Research Topic and Science and Technology Project.

In case of necessity, at the Council's request, the Ministry of Science and Technology will invite additional experts not belonging to the Council but deeply knowledgeable in the research field of the Research Topic and Science and Technology Project to prepare the summary outline.

2. The Council agrees on the summary outline

After receiving the summary outlines for each Research Topic and Science and Technology Project prepared by Council members or experts, the Council convenes to exchange, discuss, supplement, or modify details related to each basic element of the prepared summary outlines.

The Council votes to approve the summary outline with a majority agreement.

The Council sends the Ministry of Science and Technology the Minutes of the Council's work with the basic elements of the summary outlines of each Research Topic and Science and Technology Project attached, along with the list of Research Topics and Science and Technology Projects under the science and technology program or the list of independent Research Topics and Science and Technology Projects according to the relevant scientific field (according to form BBHĐ2-CT-A and BBHĐ2-ĐL-A corresponding to each Council) which have been unanimously approved by the Council.

Article 4. This regulation takes effect fifteen days from the date of publication in the Official Gazette.

Article 5. Management levels of Research Topics (Ministry level, provincial/city level, etc.) apply this Regulation in determining Research Topics and Science and Technology Projects under their management./.
