THE MINISTER OF TRANSPORTATION
Pursuant to Article 58 of the Vietnam Maritime Code dated June 30, 1990;
Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to the opinion of the People's Committee of Ho Chi Minh City at Circular No. 2811/UB-ĐT dated August 16, 2002,
Considering the proposal of the Director of the Legal Affairs Department and the Director General of the Vietnam Maritime Administration,
DECISION:
Article 1Now hereby promulgates the port waters within the jurisdiction of Ho Chi Minh City including:
1. The waters before the wharves: Saigon, Tan Cang, Tan Thuan Dong, Ben Nghe, Joint Venture Logistics Development Company No. 1, ELF GAS Sai Gon, Bien Dong, Rau Qua, Bong Sen, Vegetable Oil (Navioil), Nha Be Fuel Depot, Sa Mai Cement Factory, Saigon Petro, Petec, Vitaico, Nghi Son Cement Factory, Hiep Phuoc Power Plant, Petechim, Phu Dong, Fuel Depot VK 102, School of Nautical Business II, shipbuilding and repair factories: Ba Son Shipyard, Southern Sai Gon Shipbuilding Company, Sai Gon Shipyard, and An Phu Shipyard.
2. The navigational channels, anchorage areas, and storm shelters for the wharves mentioned in Clause 1 of this Article and the transfer area in Thieng Lieu.
Article 2. The scope of the port waters within the jurisdiction of Ho Chi Minh City is measured according to the highest tide level and defined as follows:
1. Seaward boundary:
a. Western boundary of Van Ganh Rai Bay: limited from the western meridian 106058'12" E (the boundary with the port waters of the province of Ba Ria - Vung Tau), running along the coast of Can Gio district (Ho Chi Minh City) and the coast of Phu Loi island to the two most protruding points of the Ngat Bai River mouth.
b. Boundary of the Soai Rap River mouth: limited by straight lines connecting the following coordinates:
SR 1. 100 22' 09" N; 1060 51' 30" E (Mouth Dong Tran);
SR 2. 100 20' 00" N; 1060 58' 30" E;
SR 3. 100 14' 00" N; 1060 58' 30" E;
SR 4. 100 14' 00" N; 1060 50' 00" E;
SR 5. 100 20' 00" N; 1060 47' 06" E;
2. River boundaries:
a. On the rivers Ngat Bai, Long Tau, Nha Be, Duua, Tac Dinh Cau, Rach Tac Roi, Sai Gon, Dong Nai, the boundaries are defined as follows:
From the two most protruding points of the Ngat Bai River mouth, running along both banks of the Ngat Bai, Long Tau, and Nha Be rivers to Red Light Cape (Hai Ly 6) and then running along both banks of the Duua, Tac Dinh Cau, and Rach Tac Roi rivers to the junction of Rach Tac Roi - Long Tau, excluding the waters before the Phu Dong and Phuc Khanh wharves and the Phuc Khanh fuel depot;
From Red Light Cape (Hai Ly 6) at the junction of the Sai Gon, Nha Be, and Dong Nai rivers, running along both banks of the Sai Gon River to the boundary of the downstream safety channel of the Sai Gon Bridge;
From Red Light Cape (Hai Ly 6) at the junction of the Dong Nai, Nha Be, and Sai Gon rivers, running along both banks of the Dong Nai River to the junction of the Dong Nai and Deep rivers at meridian 106048' 00" E.
b. On the Soai Rap River:
From point SR1 and SR5 at the Soai Rap River mouth, running along both banks of the Soai Rap River to the junction of the Soai Rap and Long Tau rivers (Binh Khanh junction).
3. The boundaries of the branches of the rivers and canals leading to the rivers specified in Clause 2 of this Article are limited by straight lines connecting the two most protruding points at the mouths of these branches and canals. For Rach Ben Nghe, Kien Te Canal, and Rach Dau, the boundaries are the downstream safety channels of the Khanh Hoi Bridge, Tan Thuan Bridge, and Phu Xuan Bridge.
Article 3. The pilot reception and quarantine zones, anchorage areas, transfer zones, and storm shelters for vessels entering the port waters within the jurisdiction of Ho Chi Minh City are defined as follows:
1. Pilot reception and quarantine zone: is the water area limited by a circle with a radius of 01 nautical mile centered at the position with coordinates: 100 19' 00" N; 1070 02'00" E.
2. Anchorage and storm shelter zones:
a. Nha Be area:
i. For vessels with a deadweight tonnage up to 1000 DWT at positions within the water area limited by straight lines connecting the following points:
NB 1. 100 43' 22" N; 1060 44' 57" E.
NB 2. 100 43' 24" N; 1060 44' 44" E.
NB 3. 100 42' 39" N; 1060 44' 41" E.
NB 4. 100 42' 39" N; 1060 44' 49" E.
NB 5. 100 42' 55" N; 1060 44' 49" E.
ii. For vessels with a deadweight tonnage over 1,000 DWT within the water area limited by circles with centers at the following positions:
NB 6. 100 44' 27" N: 1060 46' 03" E, anchorage radius 250 meters;
NB 7. 100 44' 03" N: 1060 45' 46" E, anchorage radius 250 meters;
NB 8. 100 43' 50" N: 1060 45' 33" E, anchorage radius 300 meters;
NB 9. 100 43' 35" N: 1060 45' 22" E, anchorage radius 300 meters;
NB 10. 100 43' 17" N: 1060 45' 14" E, anchorage radius 300 meters;
b. Soai Rap River area: for oil tankers with a deadweight tonnage up to 2,000 DWT at positions within the water area limited by straight lines connecting the following points:
SR 6. 100 40' 01" N; 1060 45' 58" E;
SR 7. 100 40' 08" N; 1060 46' 02" E;
SR 8. 100 40' 26" N; 1060 45' 16" E;
SR 9. 100 40' 32" N; 1060 44' 16" E;
SR 10. 100 40' 19" N; 1060 44' 01" E;
SR 11. 100 40' 10" N; 1060 45' 09" E;
SR 12. 100 40' 17" N; 1060 45' 11" E;
c. Vung Tau - Sai Gon channel area within the port waters under the jurisdiction of the province of Ba Ria - Vung Tau:
i. For vessels with a deadweight tonnage up to 3,000 DWT that have not entered the port waters under the jurisdiction of Ho Chi Minh City shall anchor on the right side of the Vung Tau - Sai Gon channel.
ii. For vessels with a deadweight tonnage over 3,000 DWT that have not entered the port waters under the jurisdiction of Ho Chi Minh City shall anchor on the left side of the Vung Tau - Sai Gon channel.
iii. For vessels carrying dangerous goods that have not entered the port waters under the jurisdiction of Ho Chi Minh City shall anchor in suitable locations within the port waters under the jurisdiction of the province of Ba Ria - Vung Tau.
3. Transfer area in Thieng Lieu: for vessels with a deadweight tonnage up to 75,000 DWT at positions on the Ngat Bai River section from the junction of the Dong Tran River to Mui Nuoc Van.
Article 4.
1. The Port Authority of Ho Chi Minh City has the responsibility to perform its duties and powers as prescribed by the Vietnam Maritime Code and related laws concerning all maritime activities within the port waters under the jurisdiction of Ho Chi Minh City.
2. The Port Authority of Ho Chi Minh City has the responsibility to coordinate with the Vung Tau Port Authority to manage vessels entering and exiting the port waters under the jurisdiction of Ho Chi Minh City in accordance with the provisions of the Vietnam Maritime Code, other relevant laws, and the following specific regulations:
a. Không迟于船舶到达引航员登离船区域前两小时,胡志明市港务局必须通知头顿港务局有关该船舶的名称、国籍、呼号、主要技术参数和其他必要信息。
b. 头顿港务局根据实际情况,包括天气状况、风浪、吃水和船舶载重情况,决定进入胡志明市港口范围内的船舶停泊在本决定第3条第2款第c点和第1款规定的指定位置,以确保海上安全和环境清洁,并应及时通知胡志明市港务局。
c. 当胡志明市港务局调动船舶离开头顿港务局指定的位置进入胡志明市港口水域时,应提前一小时通知头顿港务局。
d. 胡志明市港务局负责办理进入或离开胡志明市港口范围内的船舶的所有法律手续。
3. 根据实际情况,包括天气状况、风浪、吃水和船舶载重情况,胡志明市港务局应将船舶指派到本决定第3条第2款第a点、第b点和第3款规定的指定位置,以确保海上安全和环境清洁。
Article 5. 本决定自发布之日起十五日后生效,并取代交通部于1993年7月2日发布的关于西贡港口水域和西贡港务局责任区域的第1331/QĐ-PCVT号决定。
Article 6. 各位部长办公厅主任、各部属司长、越南航海局局长、越南内河航道局局长、胡志明市交通运输局局长、巴地头顿省交通运输局局长、同奈省交通运输局局长、胡志明市港务局局长、头顿港务局局长、同奈港务局局长以及所有相关机关、组织和个人负责人须对执行本决定承担责任。
