THE MINISTER OF POST AND TELECOMMUNICATIONS
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;
Pursuant to Decision No. 1120/QĐ-TTg dated October 20, 2004 of the Prime Minister regarding the establishment of the Information Technology Application Department under the Ministry of Posts and Telecommunications;
At the proposal of the Director of the Organization and Cadres Department and the Director of the Information Technology Application Department,
DECISION:
Article 1. The Information Technology Application Department is an agency directly under the Ministry of Posts and Telecommunications to assist the Minister of Posts and Telecommunications in performing state management functions related to information technology application and organizing activities to promote information technology application throughout the country.
Article 2. The Information Technology Application Department has the following tasks and powers:
1. Drafting and submitting to the Minister of Posts and Telecommunications national programs, long-term plans, five-year plans, and annual plans for information technology application;
2. Studying, proposing, and participating in the development, amendment, and supplementation of legal normative documents on management and promotion of information technology application;
3. Organizing guidance and inspection of the implementation of legal normative documents, programs, plans, projects, and proposals on information technology application by organizations and individuals throughout the country;
4. Taking the lead and coordinating with relevant agencies and units within the Ministry of Posts and Telecommunications to develop and submit to the Minister for issuance guiding documents on:
- Developing programs, plans, projects, and proposals on information technology application;
- Professional matters in the field of information technology application;
5. Reviewing or participating in the review of programs, plans, projects, and investment proposals on information technology application according to the assignment of the Minister;
6. Taking the lead in organizing the implementation of programs, projects, and proposals on promoting information technology application according to the assignment of the Minister;
7. Organizing activities to promote information technology application through providing information, materials, training, capacity building, consulting, technology transfer, and other supporting activities;
8. Taking the lead in reviewing and issuing licenses for electronic certification organizations' operations; participating in inspections and examinations of electronic certification organizations' activities;
9. Cooperating with relevant agencies and units in inspecting the implementation of laws and regulations on information technology application according to the provisions of the law on inspection and the delegation of the Minister;
10. Participating in guiding the activities of associations and non-governmental organizations in the field of information technology application;
11. Proposing and participating in scientific research and international cooperation activities on information technology application;
12. Performing the tasks of the Permanent Office assisting the National Steering Committee on Information Technology;
13. Managing the organization, civil servants, officials, assets, files, and documents of the Department in accordance with the law and the delegation of the Minister;
14. Being proactive in developing activities related to information technology application; creating additional sources of income to expand the scope and scale of activities consistent with the functions of the Department according to the provisions of the State and the Ministry of Posts and Telecommunications; preserving and developing assigned resources;
15. Performing other tasks assigned by the Minister;
Article 3. The Information Technology Application Department is headed by the Director, assisted by Deputy Directors, support staff, and subordinate units.
The Director of the Information Technology Application Department is responsible before the Minister of Posts and Telecommunications and the law for the results of the Department's activities as stipulated in this Decision.
Deputy Directors assist the Director and are responsible to the Director for the tasks delegated to them.
Article 4. The organizational structure of the Information Technology Application Department includes:
1. Departments:
- Department of Promotion of Information Technology Application;
- Department of Information Resource Development;
- Administrative and General Affairs Department;
- Planning and Finance Department;
2. Subordinate Units:
- Representative Office in Ho Chi Minh City;
- Representative Office in Da Nang City;
- Public Service Units;
The staffing of the Information Technology Application Department is established by the Director and submitted to the Minister of Posts and Telecommunications for decision.
The Director of the Information Technology Application Department proposes and submits to the Minister for decision the establishment and definition of functions and tasks of public service units subordinate to the Department in accordance with the law.
The functions, tasks, and powers of the Departments and Representative Offices subordinate to the Information Technology Application Department are defined by the Director.
The working relationships between units under the Information Technology Application Department are defined by the Director.
Article 5. The Information Technology Application Department has legal personality, has its seal, receives funding from the state budget, can open accounts at the State Treasury and Bank in accordance with the law, and has its main office located in Hanoi and representative offices in Ho Chi Minh City and Da Nang City.
Article 6. This Decision takes effect fifteen (15) days after its publication in the Official Gazette. Previous regulations contrary to this Decision are abolished.
Article 7. The Head of the Office, the Director of the Organization and Cadres Department, the Director of the Information Technology Application Department, and the Heads of agencies and units under the Ministry of Posts and Telecommunications are responsible for implementing this Decision./.
