DECISION OF THE MINISTER OF EDUCATION AND TRAINING
Regarding the amendment and supplementation of certain provisions of the Regulation on recognizing secondary schools meeting national standardsfrom 2001 to 2010 issued together with Decision No. 27/2001/QĐ-BGD&ĐT dated July 5, 2001 of the Minister of Education and Training.

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
WHEREAS, Decree No. 85/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 166/2004/NĐ-CP dated September 16, 2004 of the Government stipulating responsibilities for state management of education;
At the proposal of the Director of the Secondary Education Department,
DECISION:
Article 1. Amending and supplementing certain provisions of the Regulation on recognizing secondary schools meeting national standards from 2001 to 2010 issued together with Decision No. 27/2001/QĐ-BGD&ĐT dated July 5, 2001 of the Minister of Education and Training:
1. Replace all phrases "Department of General Secondary Education" in the Regulation on recognizing secondary schools meeting national standards issued together with Decision No. 27/2001/QĐ-BGD&ĐT dated July 5, 2001 with the phrase "Department of Secondary Education".
2. Clause 2 of Article 2 shall be amended as follows:
The Chairman of the People's Committee of the province, centrally governed city (hereinafter referred to collectively as provincial level) decides to recognize secondary schools and general secondary schools meeting national standards.
3. Clause 3 of Article 10 shall be amended as follows:
3. Inspection report, inspection record of the provincial-level inspection team.
4. Article 11 shall be amended and supplemented as follows:
Article 11. Examination Council and inspection team.
1. Each province, centrally governed city shall establish an Examination Council for proposing recognition of secondary schools meeting national standards (hereinafter referred to as the Examination Council).
a) Composition.
- Chairperson: Deputy Chairman of the Provincial People's Committee - Two Deputy Chairpersons:
+ Director of the Department of Education and Training (acting as permanent member).
+ Chairman of the Provincial Teachers' Union.
- Members of the Council: Representatives of relevant functional agencies.
b) Authority to establish: The Chairman of the Provincial People's Committee decides to establish the Examination Council.
c) Tasks:
- Directing inspection work serving the examination for recognition of secondary schools and general secondary schools meeting national standards.
- Selecting secondary schools and general secondary schools meeting national standards.
- Preparing files for proposing recognition of schools meeting national standards to be submitted to the Chairman of the Provincial People's Committee for decision.
2. Inspection Team. Before examining and recognizing secondary schools and general secondary schools meeting national standards, the Provincial People's Committee establishes an inspection team based on the list submitted by the Department of Education and Training for the Chairman of the Provincial People's Committee to decide.
a) Composition: Seven members, including representatives from the Department of Education and Training, Provincial Teachers' Union, Department of Planning and Investment, Department of Finance, Department of Health, Department of Sports and Physical Training, Department of Home Affairs; with a team leader and one secretary.
b) Tasks:
- Inspecting and evaluating the implementation of building national standard schools based on the criteria stipulated in the Regulation on recognizing secondary schools meeting national standards.
- Inspecting all files and management records of the school according to regulations.
- Preparing minutes and files to submit to the Examination Council.
5. Article 12 shall be amended and supplemented as follows:
Article 12. Permanent Office.
To direct the construction of secondary schools meeting national standards, each level of educational administration has a permanent office.
1. People's Committee at the district level:
a) Permanent Office: District Education Office.
b) Tasks:
- Directing and guiding secondary schools to develop plans and specific targets to strive for national standards;
- Advising local party committees and authorities on measures to build secondary schools meeting national standards;
- Guiding the preparation of files, receiving and transferring files for proposing recognition of secondary schools meeting national standards to the Department of Education and Training after reporting and obtaining approval from the District People's Committee (in writing).
2. Provincial People's Committees:
a) Permanent Office: Department of Education and Training
b) Tasks:
- Developing planning and plans for building secondary schools and general secondary schools meeting national standards in the locality to be submitted to the Provincial People's Committee for approval.
- Directing and guiding general secondary schools and district education offices to develop specific plans for building schools meeting national standards.
- Coordinating with provincial-level departments to resolve difficulties faced by schools and districts during the process of building schools meeting national standards.
- Receiving and transferring files for proposing recognition of general secondary schools meeting national standards and district education offices to the Examination Council.
- Organizing annual reviews and summaries of the work of building national standard schools in the locality. Reporting the results of building secondary schools and general secondary schools meeting national standards each year to the Ministry of Education and Training (Secondary Education Department).
3. Ministry of Education and Training:
a) Permanent Office: Secondary Education Department.
b) Tasks:
- Assisting the Minister in developing legal documents and guidance documents on the work of building national standard schools. Issuing templates for certificates of recognition of secondary schools meeting national standards.
- Assisting the Minister in directing the construction of national standard schools at the secondary level nationwide.
- Conducting inspections and evaluations of secondary schools and general secondary schools that have met national standards.
Article 2. This Decision takes effect 15 days after its publication in the Official Gazette. Any previous regulations that conflict with this Decision are hereby abolished.
Article 3. The Heads of the Office of the Ministry of Education and Training, the Director of the Secondary Education Department, the Heads of units related to the Ministry of Education and Training, the Chairmen of the People's Committees of provinces and centrally governed cities, and the Directors of Departments of Education and Training are responsible for implementing this Decision./.
