THE MINISTER OF TRADE

On the basis of Decree No. 29/2004/NĐ-CP dated January 16, 2004 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Trade;

Pursuant to Decree No. 02/2003/ND-CP dated January 14, 2003 of the Government on the development and management of markets;

Pursuant to Decision No. 252/2003/QD-TTg dated November 24, 2003 of the Prime Minister on the management of goods trade across borders with neighboring countries;

At the proposal of the Director of the Mountainous Trade Department and Border Trade Department,

DECISION:

Article 1. The Rules for Border Markets, Customs Port Markets, and Markets within Border Economic Zones on Land between Vietnam and Neighboring Countries are hereby promulgated along with this Decision.

Article 2. This Decision replaces Decisions No. 0774/1998/QD-BTM dated July 4, 1998 of the Minister of Commerce on the issuance of the Interim Rules on the organization and management of markets in the border area between Vietnam and China; No. 0807/1998/QD-BTM dated July 15, 1998 of the Minister of Commerce on the issuance of the Rules on the organization and management of Vietnam-Laos border markets; and No. 0724/1999/QD-BTM dated June 8, 1999 of the Minister of Commerce on the issuance of the Rules on the organization and management of Vietnam-Cambodia border markets.

THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER ITS PUBLICATION IN THE OFFICIAL GAZETTE.

Article 3. The Chairmen of Provincial People's Committees, Directors of Commerce Departments (or Departments of Commerce and Tourism) of provinces bordering neighboring countries on land, the Head of the Office of the Ministry, the Director of the Mountainous Trade Department and Border Trade Department, and heads of relevant Departments and Bureaus under the Ministry of Commerce shall be responsible for implementing this decision.
