Regulations on the functions, tasks, powers, and organizational structure of the Planning Department

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Article 16 of Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Considering the proposal of the Director of the Department of Personnel Organization,

DECISION:

Article 1. Position and Functions

The Planning Department is the advisory and consolidating body assisting the Minister in performing state management functions over the agricultural and rural development sector in the areas of strategy, planning, investment, and long-term development within the scope of the Ministry's state management.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Take the lead in drafting normative legal documents concerning the assigned management area for submission to the Minister.

2. Regarding the development of strategies, plans, and long-term programs:

a) Guide localities and units under the sector in establishing, reviewing, and approving strategies, plans, and long-term programs;

b) Consolidate and submit to the Minister for approval the design plan of the program. Lead or participate in reviewing the outline, budget, monitoring implementation, and finalizing the program according to the Minister’s assignment;

c) Consolidate, balance, and complete the long-term development strategy, national target program for submission to the Minister. Lead in formulating and consolidating the action program of the agricultural and rural development sector to implement directives and resolutions of the Party and State;

d) Prepare files for submission to the Minister regarding planning projects; manage and utilize planning documents in accordance with regulations;

đ) Guide the public disclosure of industry strategies, plans, and major products after approval according to regulations;

e) Guide and inspect the implementation of approved industry plans and propose solutions to enhance the effectiveness of plan implementation management;

g) Direct research and submit to the Minister for issuance of standards related to the establishment and management of industry plans.

3. Regarding annual plans:

a) Guide localities and units under the Ministry in developing annual plans;

b) Consolidate, balance, and complete the annual development plan for submission to the Minister. Assign the capital for basic construction projects managed by the Ministry. Publicly announce the Ministry's basic construction investment plan on the local level after the State assigns it;

c) Inspect the implementation of the plan based on actual requirements and propose adjustments to the annual plan for submission to the Minister.

4. Regarding investment work:

a) Lead in guiding, identifying, and consolidating lists of investment projects funded from development investment sources; participate in submitting projects funded from operational investment sources to the Ministry;

b) Submit to the Minister for decision-making on the establishment and adjustment of investment projects. Guide and supervise the review process of project outlines and the project establishment process;

c) Coordinate in researching investment mechanisms and policies to attract domestic and foreign investment. Coordinate with relevant Departments and Services to implement regulations on project establishment, review, and monitoring of projects with domestic and foreign investment;

d) Lead in supervising investment activities in accordance with regulations.

5. Implement state management over statistics in the sector in accordance with legal provisions.

6. Guide the implementation and consolidate the main balances of materials, equipment, essential goods in the sector and national reserve funds as assigned by the Minister.

7. Serve as the focal point for implementing defense-related activities in the sector and ensuring national food security.

8. Monitor, consolidate, and lead in preparing reports evaluating the implementation of long-term and annual strategies, plans, and programs of the entire agricultural and rural development sector.

9. Participate with other Ministries and sectors in reviewing overall industry plans, land use plans of localities.

10. Lead in managing the land use of administrative and service units under the Ministry.

11. Manage civil servants, files, assets, and other resources allocated.

12. Organize the implementation of administrative reform in accordance with the Ministry's program and the Minister's assignment.

13. Perform other tasks assigned by the Minister.

Article 3. Organizational Structure

1. Leadership of the Department:

The Department leadership consists of the Director and Deputy Directors appointed and relieved of duty by the Minister of Agriculture and Rural Development in accordance with regulations.

 The Director oversees the Department's operations, is responsible to the Minister of Agriculture and Rural Development and the law for the Department's activities.

 Deputy Directors assist the Director in overseeing certain tasks as assigned by the Director and are responsible to the Director and the law for the assigned tasks.

2. Civil servants of the Department are responsible for executing assigned tasks; they have obligations and rights as prescribed by law.

The Director is responsible for directing the formulation, issuance, and implementation of the Department's working regulations; arranging civil servants in accordance with their positions, standards, job descriptions, and assigned tasks.

Article 4. Effective date

This Decision takes effect fifteen days after its publication in the Official Gazette. Abolish Decision No. 81/2003/QĐ-BNN dated September 4, 2003 of the Minister of Agriculture and Rural Development stipulating the functions, tasks, powers, and organizational structure of the Planning Department and any previous regulations that conflict with this Decision.

Article 5. Responsibilities for Implementation

The Director of the Planning Department, the Head of the Ministry's Office, Department Directors, Bureau Chiefs, the Chief Inspector of the Ministry, and heads of related agencies and units are responsible for implementing this Decision./.
