JOINT CIRCULAR
关于组织和编制的指导意见
国家法律援助中心

Pursuant to Decree No. 07/2007/NĐ-CP dated January 12, 2007, issued by the Government, detailing and guiding the implementation of certain provisions of the Legal Aid Law;
Pursuant to Decree No. 93/2008/NĐ-CP dated August 22, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;
根据2008年4月17日政府第48/2008/NĐ-CP号决定关于公安部职能、任务、权力和组织结构的规定；
根据2008年6月23日总理第792/QĐ-TTg号决定关于批准“2008-2010年国家法律援助中心网络规划及至2015年展望”的项目；
司法部和公安部联合发布关于省级司法厅（以下简称中心）下属国家法律援助中心的组织和编制的指导意见如下：
第一部分 中心的组织结构
1. 中心领导 中心领导由主任和副主任组成。
2. 中心部门
a) 中心的行政综合部应设立以执行行政、综合、统计、报告、竞赛、文书、档案管理、资产管理、财务管理及其他共同活动，为中心的运作服务。
b) 中心的专业部门应根据法律领域设立并组织如下：
- 刑事与行政法：提供刑事法、刑事诉讼法、刑事执行、行政法、申诉、控告、行政程序及相关领域的法律援助；
- 民事与土地法：提供民事法、民事诉讼法、民事执行、家庭法、儿童保护法、土地法、住房、环境、消费者保护及相关领域的法律援助；
- 劳动与社会法：提供劳动法、就业、保险、革命功臣优待政策、社会优待政策及其他与全国减贫计划或直接涉及公民基本权利和义务相关的领域的法律援助。
在本联合通知第二条第二款第一部分中规定的专业部门的数量和名称，由省人民委员会主席（以下简称省级）根据工作量、性质、具体活动特点以及在第07/2007/NĐ-CP号政府决议中详细规定并指导实施的法律援助领域的规定决定，但不得超过四个部门。
3. 中心分支机构 中心可以在一个或多个县级行政区设立分支机构，以执行分配范围内的法律援助职能。优先在偏远、边境、海岛、少数民族、山区和其他没有注册参与法律援助的法律执业组织的地方设立分支机构。分支机构的数量和地点由省人民委员会主席决定。
4. 领导职位任命权限 中心主任和副主任的任命、解职和免职按照第07/2007/NĐ-CP号政府决议第九条和第十条的规定进行。中心各部门和分支机构正副职的任命、解职和免职按照省人民委员会的分级授权进行。中心及其各部门和分支机构的领导职位应在法律援助人员中选择任命。
第二部分 中心的编制
1. General principles
a) 中心的编制应根据各职位的工作职责确定，但必须符合本联合通知所指引的功能、任务和组织结构。
b) 对中心的编制确定必须符合2008年6月23日总理第792/QĐ-TTg号决定规定的实施路线图。
c) 中心的编制定额不包括政府2000年11月17日第68/2000/NĐ-CP号决定规定的合同制职位。
2. 编制定额
a) 中心领导由主任和不超过两名副主任组成。
b) 行政综合部由部长、一名副部长、一名会计员和一名兼任文书和出纳的法律专员组成。
c) 各专业部门由部长、不超过两名副部长、至少两名法律援助人员和一名法律专员组成。每个专业部门的法律援助人员数量应根据实际工作职责和工作量确定。
d) 中心分支机构由负责人、至少一名法律援助人员和一名法律专员组成。
III. IMPLEMENTATION
1. 根据本联合通知和2003年12月24日公安部第89/2003/TT-BNV号通知关于分级管理行政事业编制的规定，省人民委员会应履行以下任务：
a) 指导司法厅厅长主持，与公安厅厅长合作：
- 制定完善中心组织机构方案，提交省人民委员会审批；
- 制定中心年度编制计划，提交省人民委员会报省人民代表大会决定。
b) 指导司法厅和相关机构指导、检查中心在编制管理机制、招聘、使用和管理干部职员方面执行法律规定的情况，确保法律援助人员具备专业知识和经验积累，减少不必要的调动；明确具体分级授权，使中心能够自主负责其事业单位功能、任务、编制和财务的执行。
This Circular shall take effect fifteen days from the date of publication in the Official Gazette; all previous provisions contrary to this Joint Circular are hereby abolished.
During implementation, if any issues arise or difficulties occur, it is requested that the People's Committees of provinces, relevant agencies, and units report to the Ministry of Justice and the Ministry of Home Affairs for consideration and resolution within their respective jurisdictions./.
