CIRCULAR

Guidelines for Establishing the Elderly Affairs Board at the Provincial and Central City Level

Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decision No. 301/2005/QĐ-TTg dated November 21, 2005 of the Prime Minister approving the National Program of Action on Elderly People in Vietnam for the period 2005-2010.

The Ministry of Home Affairs issues guidelines for establishing the Elderly Affairs Board at the provincial and central city level as follows:

Article 1. Establishment of the Elderly Affairs Board at the Provincial and Central City Level

1. The Elderly Affairs Board at the provincial and central city level (hereinafter referred to as the Provincial Elderly Affairs Board) is an inter-departmental coordinating organization with the function of assisting the Chairman of the Provincial People's Committee in directing and coordinating activities serving elderly care and promoting their roles.

2. The Provincial Elderly Affairs Board shall be established by a decision of the Chairman of the Provincial People's Committee.

3. The Provincial Elderly Affairs Board does not have legal personality, nor does it have its own bank account or seal; the operating funds of the Provincial Elderly Affairs Board are guaranteed by the state budget and allocated within the regular operating budget of the board's permanent office (Department of Labor, Invalids, and Social Affairs).

4. The Head of the Provincial Elderly Affairs Board may use the seal of the Provincial People's Committee, while the Deputy Head of the Provincial Elderly Affairs Board may use the seal of the board's permanent office (Department of Labor, Invalids, and Social Affairs).

5. The Head of the Provincial Elderly Affairs Board shall submit to the Chairman of the Provincial People's Committee for approval and issuance of the Operational Regulations of the Provincial Elderly Affairs Board.

Article 2. Tasks of the Provincial Elderly Affairs Board

1. Assist the Chairman of the Provincial People's Committee in formulating policies, programs, and plans for elderly care and role promotion.

2. Assist the Chairman of the Provincial People's Committee in directing, urging, inspecting, and evaluating the implementation of laws and policies by departments, localities, and other entities concerning elderly care and role promotion.

3. Assist the Chairman of the Provincial People's Committee in organizing coordination among departments, localities, mass organizations, and other entities in publicizing, disseminating, and mobilizing the people to implement Party policies and state laws regarding elderly people.

4. Regularly compile and report to the Chairman of the Provincial People's Committee on the implementation of elderly care and role promotion activities.

Article 3. Members of the Provincial Elderly Affairs Board

Members of the Provincial Elderly Affairs Board include:

1. Head: One Deputy Chairman of the Provincial People's Committee;

2. Acting Deputy Head: Director of the Department of Labor, Invalids, and Social Affairs;

3. Deputy Head: Chairperson of the Provincial Elderly Association;

4. Members:

- One Leader from the Department of Home Affairs;

- One Leader from the Provincial People's Committee Office;

- One Leader from the Department of Finance;

- One Leader from the Department of Health;

- One Leader from the Department of Planning and Investment;

- One Leader from the Department of Culture, Sports, and Tourism;

- One Leader from the Department of Information and Communications;

- One Leader from the Department of Agriculture and Rural Development;

- One Leader from the Ethnic Minority Affairs Board of the Province.

Representatives from mass organizations participating include:

- One Leader from the Provincial Vietnam Fatherland Front Committee;

- One Leader from the Provincial Vietnam Farmers' Union;

- One Leader from the Provincial Vietnam Women's Union;

- One Leader from the Provincial Vietnam Veterans' Association.

5. Heads of relevant agencies and organizations shall notify the list of personnel appointed as members to the Head of the Provincial Elderly Affairs Board. The Head of the Provincial Elderly Affairs Board shall assign specific tasks to the members of the board.

6. Members of the Provincial Elderly Affairs Board shall serve in兼任职务。

Article 4. Standing Office and Working Group of the Provincial Elderly Work Board

Clause 1. The Department of Labor, Invalids and Social Affairs shall be the standing office of the Provincial Elderly Work Board.

Clause 2. The Working Group of the Provincial Elderly Work Board (referred to as the Working Group) shall be located at the Department of Labor, Invalids and Social Affairs. The Working Group shall have three officers working on a part-time basis, including: one officer from the Department of Labor, Invalids and Social Affairs serving as the Head of the Working Group; one officer from the People's Committee Office; and one officer from the Provincial Association of the Elderly.

Clause 3. The Head of the Provincial Elderly Work Board shall issue the Rules of Operation for the Working Group of the Provincial Elderly Work Board.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

Clause 1. Departments, sectors, agencies, and mass organizations of the province shall, based on their functions and responsibilities, be responsible for disseminating information, mobilizing support, coordinating, organizing, and implementing activities related to elderly persons.

Clause 2. This Circular shall take effect forty-five days from the date of signature.

Clause 3. Any difficulties encountered during implementation should be reported to the Ministry of Home Affairs for study, timely amendment, and supplementation./.
