Regulations on the organization and operation of the Film Review Board of television stations and radio-television stations

Pursuant to the Cinema Law No. 62/2006/QH11 dated June 29, 2006, and the Law Amending and Supplementing Certain Provisions of the Cinema Law No. 31/2009/QH12 dated June 18, 2009;
Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
The Ministry of Culture, Sports and Tourism stipulates the organization and operation of the Film Review Board of television stations and radio-television stations as follows:
I. ORGANIZATION OF THE FILM REVIEW BOARD
Article 1. Organization of the Film Review Board
1. The Film Review Board of television stations and radio-television stations (hereinafter referred to as the Board) shall be established by the head of the television station or radio-television station with a term of two years.
2. The Board shall consist of at least five members including: Chairman, Vice-Chairman, and members representing the authority that establishes the Board, persons with expertise in film management and activities, and those with credibility.
Article 2. Functions and Duties of the Board
The Board performs the function of reviewing films to advise the head of the television station or radio-television station as prescribed in Clause 2, Article 39 of the Cinema Law.
II. OPERATIONS OF THE FILM REVIEW BOARD
Article 3. Principles of Operation of the Board
1. The Board operates based on the principle of collective discussion to review and evaluate films.
2. A film review session of the Board must have more than half of the total number of members present or more than half of the members providing opinions in cases prescribed in Clause 3, Article 5 of this Circular.
3. In addition to film review sessions, the Board meets to draw lessons from its operations at least once every six months.
4. The conclusion of the Board is announced and the responsibility for it lies with the Chairman of the Board or the Vice-Chairman authorized by the Chairman.
5. Members of the Board are not allowed to disclose the content of discussions and conclusions of the Board.
6. Members of the Board who are absent without a valid reason for more than three consecutive film review sessions, upon proposal by the Chairman of the Board, the head of the television station or radio-television station shall relieve them of their duties and appoint replacements.
7. The venue, means of work, and assistants for the Board shall be arranged and organized by the head of the television station or radio-television station.
Article 4. Rights and Responsibilities of the Chairman, Vice-Chairman, and Members of the Board
1. The Chairman presides over film review sessions or meetings to draw lessons from the Board's operations.
2. Proposes changes to Board members in cases prescribed in Clause 6, Article 3 of this Circular.
3. Proposes that the head of the television station or radio-television station invite additional experts to participate in film reviews for consultation when necessary.
4. The Vice-Chairman of the Board exercises the rights and responsibilities of the Chairman when authorized by the Chairman.
5. Members have the right and responsibility to fully participate in all film review sessions, except in cases prescribed in Clause 3, Article 5 of this Circular, and provide written comments and evaluations on the reviewed film; in case of absence, they must report to the Chairman (or Vice-Chairman) of the Board.
Article 5. Procedure and formalities for film review
1. Upon receiving a request for film review from the head of television stations, radio-television stations, the Chairman of the Council (or the Vice-Chairman authorized by the Chairman) shall invite members to view the film and discuss its content and artistry.
2. The opinions discussed and the review forms of the members must be recorded and compiled in the review minutes as the basis for submission to the head of television stations, radio-television stations.
3. For multi-part video tapes or discs, the Council may not convene a concentrated review session, but Council members have the responsibility to view and provide written comments.
Article 6. Opinions of Council members and Council conclusions on each film
1. Council members are responsible for reviewing and evaluating each reviewed film according to the following methods:
a) Widespread broadcasting to all audience groups for films with content that does not violate prohibitions stipulated in Article 11 of the Cinema Law, ensuring technical standards;
b) Must cut one or more scenes; must revise dialogue if it violates the provisions of Article 11 of the Cinema Law before broadcasting;
c) Prohibition of broadcasting for films with content that violates prohibitions stipulated in Article 11 of the Cinema Law that cannot be corrected or do not meet technical standards.
2. The Council's conclusion signed by the Chairman or the Vice-Chairman authorized by the Chairman must be approved by at least two-thirds of the members present or at least two-thirds of the members who have submitted review forms in cases where the Council does not convene.
3. The Council's conclusion on film review must be kept together with the decision allowing the broadcast of the film.
III. IMPLEMENTATION PROVISIONS
Article 7. Effective Date
1. This Circular takes effect from October 1, 2010.
2. During implementation, if there are difficulties, organizations and individuals need to promptly reflect them to the Ministry of Culture, Sports and Tourism for consideration, revision, and supplementation.
Article 8. Responsibilities for Implementation
The Director of the Office, the Director of the Cinema Department, the heads of television stations, radio-television stations, and organizations and individuals related to the review of broadcast films on television are responsible for implementing this Circular./.
