Strengthening cadres for communes in poor districts
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
1. To strengthen one Deputy Chairman of the People's Committee for each commune in poor districts that have not been allocated two Deputy Chairmen to implement Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government on the Program to rapidly reduce poverty sustainably in 61 poor districts.
Pursuant to Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government on the Program to rapidly and sustainably reduce poverty in 61 poor districts;
2. The People's Committee of the commune strengthened with one Deputy Chairman shall consist of five members including one Chairman, two Deputy Chairmen, and two members.
3. The Deputy Chairman of the People's Committee of the commune strengthened shall be part of the state civil service but not included in the number of commune-level cadres and civil servants prescribed in Decree No. 92/2009/NĐ-CP dated October 22, 2009 of the Government on the titles, number, and some policies for commune-level cadres and civil servants and non-professional staff at the commune level.
Considering the proposal of the Minister of Home Affairs,
DECISION:
Article 2. Source of strengthened cadres
The person appointed to the position of Deputy Chairman of the People's Committee of the commune shall be selected from cadres and civil servants of the province and district, and from young intellectuals volunteering as part of the Pilot Project to select 600 outstanding young intellectuals with university degrees to strengthen their roles as Deputy Chairmen of People's Committees in 62 poor districts approved by the Prime Minister. The number and source of cadres shall be implemented according to the annex attached to this Decision.
Article 3. Policies and benefits
1. The election, appointment, and removal of Deputy Chairmen and members of the People's Committee of the commune strengthened shall be carried out in accordance with Clause 1, Article 34 of the Law on the Organization of People's Councils and People's Committees.
The Deputy Chairman of the People's Committee of the commune strengthened shall enjoy policies and benefits as stipulated in Clause 4 and Clause 5, Article 2 of Decision No. 70/2009/QĐ-TTg dated April 27, 2009 of the Prime Minister on policies for cadre rotation and reinforcement for communes in 61 poor districts and preferential policies and incentives to attract young intellectuals and technical professionals to participate in working groups in communes in 61 poor districts under Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government.
The Ministry of Home Affairs shall take the lead and coordinate with relevant agencies and People's Committees of provinces with poor districts to implement the Pilot Project to select 600 outstanding young intellectuals with university degrees to strengthen their roles as Deputy Chairmen of People's Committees in 62 poor districts to ensure a pool of personnel for reinforcement in communes in poor districts. 1. This Decision shall take effect from March 15, 2011.
2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally-administered cities, and related agencies, organizations, and individuals shall be responsible for implementing this Decision./.
1. The election, removal from office, and dismissal of Vice Chairpersons and members of the People's Committee of communes shall be strengthened and implemented in accordance with Clause 1 of Article 34 of the Law on the Organization of People's Councils and People's Committees.
2. Vice Chairpersons of the People's Committee of communes shall enjoy benefits and policies as stipulated in Clauses 4 and 5 of Article 2 of Decision No. 70/2009/QD-TTg dated April 27, 2009 of the Government Chairman regarding policies for cadre rotation and reinforcement for communes in 61 poor districts and preferential policies to encourage young intellectuals and technical professionals to participate in working groups in communes within 61 poor districts pursuant to Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government.
Article 4. Organization of Implementation
The Ministry of Home Affairs shall take the lead and coordinate with relevant agencies and organizations and the People's Committees of provinces with poor districts to implement the pilot project of selecting 600 outstanding intellectuals with university degrees to reinforce their positions as Vice Chairpersons of the People's Committee of communes in 62 poor districts to ensure a reinforced human resource pool for communes in poor districts.
Article 5. Effectiveness and Responsibility for Implementation
1. This Decision shall take effect from March 15, 2011.
2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of centrally governed cities, and related agencies, organizations, and individuals shall be responsible for implementing this Decision./.
