Regulations on the Standards for Heads of Ministries' Inspection Agencies and Agencies Equivalent to Ministries

Based on the Inspection Law dated November 15, 2010;
Pursuant to Decree No. 65/2008/NĐ-CP dated May 20, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;
Pursuant to Decision No. 83/2004/QĐ-BNV dated November 17, 2004 of the Minister of Home Affairs on issuing standards for Department Heads under Ministries, agencies equivalent to Ministries, and government agencies;
The Government Inspectorate hereby stipulates the standards for Heads of Ministries' Inspection Agencies and Agencies Equivalent to Ministries as follows:
Article 1. Position and Responsibilities
The Head of the Ministry's Inspection Agency (referred to collectively as the Head of the Ministry's Inspection Agency) is the head of the Ministry's Inspection Agency, responsible for leading, directing, managing, and overseeing the activities of the Ministry's Inspection Agency; advising the Minister, the head of an agency equivalent to a Ministry (collectively referred to as the Minister) on state management of inspection work, handling complaints and grievances, and anti-corruption within the scope of the Ministry's management according to the law.
Article 2. Tasks
Clause 1. The Head of the Ministry's Inspection Agency is accountable to the Minister, concurrently accountable to the Chief Inspector General of the Government and to the law in the performance of state management functions regarding inspection work, handling complaints and grievances, and anti-corruption within the scope of the Ministry's state management, specifically:
Point a) Developing the Inspection Program and Plan to submit to the Minister for decision and organizing the implementation of such Program and Plan;
Point b) Drafting and submitting to the Minister for consideration to issue or to submit to the competent authority for issuance regulations; proposing amendments to regulations, policies within the scope of inspection work, handling complaints and grievances, and anti-corruption managed by the Ministry;
Point c) Organizing guidance on specialized inspection business procedures for agencies assigned to perform specialized inspection functions under the Ministry, Provincial Inspectorates; guiding, urging, and inspecting subordinate units of the Ministry to comply with legal provisions on inspection work, handling complaints and grievances, and anti-corruption;
Point d) Organizing the collection, statistics, and reporting of information on the operation of the inspection sector within the scope of the Ministry's state management;
Point đ) Organizing the direction of mid-term and final reviews, drawing lessons from inspection activities, complaint and grievance resolution, and anti-corruption within the scope of the Ministry's state management; on this basis, proposing supplements, amendments, and improvements to regulations already issued by the competent authority; taking the lead or participating in scientific research projects and applications in state management of inspection work, complaint and grievance resolution, and anti-corruption.
Clause 2. Leading and directing inspections of the implementation of policies, laws, and duties and powers of agencies, organizations, and individuals directly under the Ministry's management; inspecting state-owned enterprises established by the Minister's decision; inspecting compliance with specialized laws, technical regulations, industry management rules, and fields of agencies, organizations, and individuals, and other inspections assigned by the Minister within the scope of the Ministry's jurisdiction.
Clause 3. Advising the Minister on organizing and directing the implementation of tasks related to complaint and grievance resolution and anti-corruption as prescribed by law.
Clause 4. Performing tasks as stipulated in Article 19 of the Inspection Law and implementing guidelines.
Clause 5. Managing civil servants and inspectors under the Ministry's Inspection Agency; effectively managing and utilizing assets and finances allocated according to regulations.
Clause 6. Performing other tasks assigned by the Minister or delegated by the Chief Inspector General of the Government in accordance with the law.
Article 3. Qualities
1. Patriotic, with firm political resolve, loyal to the Party's political line and viewpoint, the State's laws, resolute in the renewal policy, national independence, and socialism; dedicated to serving the people.
2. Work with a sense of responsibility, high efficiency; frugal, incorruptible, impartial, and selfless; not opportunistic, not corrupt, firmly combating corruption and negative phenomena; practicing thrift against waste.
3. Have organizational discipline awareness; honest, objective, decisive, and willing to take responsibility; have a spirit of self-criticism and criticism.
4. United and democratic with colleagues, exemplary in morality and lifestyle; closely connected with the people, trusted by the collective of civil servants, inspectors at the workplace, and the people in their place of residence.
Article 4. Competence
1. Possess advisory, organizational, and implementation capabilities for the Party's policies and the State's laws on inspection work, complaint resolution, and anti-corruption.
2. Possess research and drafting capabilities for regulatory legal documents, macro-management strategy formulation, and proposing effective solutions for inspection work, complaint resolution, and anti-corruption within the scope of the Ministry's responsibility.
3. Possess the capability to lead large-scale, wide-ranging inspection teams with complex circumstances.
4. Possess management skills; capable of uniting and leading civil servants and inspectors to harness collective strength and coordinate well with related agencies and organizations in executing assigned tasks.
Article 5. Knowledge
1. Proficient in the Party's guidelines, policies, the State's laws, and the direction and tasks of the Inspection sector.
2. Proficient in legal knowledge and inspection work practices, complaint resolution, and anti-corruption; have experience in organization, management, and leadership.
3. Understand various fields under the State's management functions of the Ministry and other relevant specialized fields, economic, political, cultural-social conditions of the country, region, and world.
Article 6. Qualifications
1. Meeting the professional standards for the rank of Chief Inspector or equivalent and above.
2. Hold a bachelor's degree or higher, suitable for inspection work.
3. Hold a high-level Political Theory diploma or equivalent.
4. Hold a senior specialist-level Public Administration Management diploma.
5. Be able to use a common foreign language at level C or higher.
6. Be proficient in using computers and office equipment for work purposes.
Article 7. Other Conditions
1. Have practical experience in leadership and management at the Deputy Inspector-General of the Ministry level or equivalent; have five years or more working in the inspection sector or in state administration within the Ministry's jurisdiction.
2. Cadres and civil servants appointed for the first time to the position of Inspector-General of the Ministry shall not exceed 55 years old for males and 50 years old for females;
3. Not currently undergoing disciplinary action from a reprimand or higher.
4. Cadres and civil servants appointed to the position of Inspector-General of the Ministry must be planned for appointment to that position or an equivalent position.
5. Have complete and clear personal files and history without violating Regulation No. 57-QD/TW dated May 3, 2007 of the Politburo on internal political protection of the Party, confirmed by the competent authority.
Article 8. Implementation clause
1\. This Circular takes effect forty-five days from the date of issuance.
2. The Minister, Head of a ministry-equivalent agency is responsible for implementing this Circular./.
