Pursuant to DecreeNo. 136/2007/ND-CP dated 1August 7, 2007 and Decree No. 65/2011/ND-CP dated September 6, 2012 amending and supplementing Decree No.and amended and supplemented by certain articles related to conditions for investment and business and administrative procedures in the field of information and communications on November 7, 201836/2007/ND-CP dated 1136/2007/ND-CP of the Government on exit and entry of Vietnamese citizens;

Pursuant to DecreeNo. Decision No. 77/2009/NĐ-CP dated 1September 5, 2009 of the Government stipulating the functionsamendissues this Circular to regulate duties, powers; equipment, use of means, technical devices, weapons, and auxiliary tools; forms, contents of patrol and control, administrative violation handling; assignment of responsibilities and coordination relations in traffic patrol and control work on public roads by traffic police.

The Minister of Public Security and the Minister of Foreign Affairs issue this Joint Circular to amend and supplement some provisions of Joint Circular No. 08/2009/TTLT-BCA-BNG dated June10/2009 of the Ministry of Public Security - Ministry of Foreign Affairs guiding the issuance of ordinary passports and and travel documents for Vietnamese citizens residing abroad according to Decree No. 136/2007/ND-CP dated 1August 7, 2007 and Decree No. 65/2012/ND-CP dated September 6, 2012.

Article 1. Amending and supplementing some provisions of Joint Circular No. 08/2009/TTLT/BCA-BNG

1. Amend and supplement Clause 3 of Article 1 as follows:

"3. Documents used as grounds for issuing, amending, and supplementing passports, and issuing travel documents include the following:

a) Documents proving Vietnamese nationality (with photo) as prescribed by Vietnamese laws on nationality issued at different periods;

b) Certificate of identity of Vietnamese citizens currently residing abroad issued by the Exit and Entry Administration Bureau still valid (model X04 issued together with this Circular);

c) Documents issued by competent state management agencies of Vietnam still valid, containing full personal information and photo. Personal information of a person includes: name, date of birth, place of birth, gender, nationality. If these documents have expired or do not contain photos, they can only be used as references for issuing, amending, and supplementing passports, and issuing travel documents."

Article 3. Information Technology System

"1. In cases where a passport is requested for the first time

a) A set of documents including:

- One application form according to model X02 issued together with this Circular;

- Two new photos, size 4 x 6cm, white background, frontal view, bare head, no tinted glasses;

- A copy of the documents serving as grounds for issuing the passport as specified in Clause 3 of Article 1 of this Circular that has been amended and supplemented. If it is a photocopy, the original must be presented for verification and comparison.

- For children under 14 years old requesting a separate passport, an additional copy of the birth certificate must be submitted. If it is a photocopy, the original must be presented for verification and comparison. The application form must be filled out and signed by the parents; if filled out and signed by foster parents or guardians, proof of their status as foster parents or guardians must be provided.

- In cases where a parent requests to include a child under 9 years old in their Vietnamese passport, the application form should be filled out jointly by the parent, two photos of the child size 3 x 4 cm, and supporting documents as in the case of a child requesting a separate passport; joint inclusion in the guardian's passport is not allowed.

b) Processing by the Vietnamese representative office:

- Within five working days from the date of receiving complete and valid documents, the Vietnamese representative office will decide to issue the passport and deliver the result to the applicant.

- If the documents are insufficient to issue a passport, the Vietnamese representative office will request the applicant to provide detailed personal information and related information to support the determination of: address of permanent or temporary residence in Vietnam before departure, details of travel documents (type, duration, and issuing authority), relatives in Vietnam; submit documents proving the above information (if available) and send the file to the Consular Department of the Ministry of Foreign Affairs to request the Civil Status, Nationality, and Authentication Department of the Ministry of Justice and the Exit and Entry Administration Department of the Ministry of Public Security to verify.

- Within forty days from the date of receipt of the request, the agency requested shall be responsible for replying to the verification results in writing to the Consular Department.

- Within five working days from the date of receipt of the verification results, the Consular Department shall be responsible for notifying the Vietnamese representative office abroad in writing to process.

- Within two working days from the date of receipt of the reply from the Consular Department, the Vietnamese representative office abroad shall consider the issuance of the passport and deliver the result to the applicant. After fifty working days from the date of sending the verification request but not receiving a reply from the Consular Department, the head of the Vietnamese representative office shall consider and decide on the issuance of the passport and deliver the result to the applicant."

3. Amending and supplementing Clause 2 of Article 2 as follows:

"2. Reissuing a passport (due to loss, damage, or remaining validity period requiring reissue), separating a child from the parent's passport to issue a separate passport.

a) A set of documents according to point a of Clause 1 of Article 2 of this Circular that has been amended and supplemented, and the following documents:

- In case of lost passport, a report of lost passport (with confirmation from local authorities);

- In case of damaged passport or remaining validity period, the passport itself; - In case of separating a child from the parent's passport to issue a separate passport, the parent's passport, application form filled out by the parent, signed on behalf of the parent. If the parent also requests a reissued passport, an additional application form (model X02) and two photos size 4 x 6cm of the parent must be submitted.
b) Processing by the Vietnamese representative office:

- Within five working days from the date of receiving complete and valid documents, the Vietnamese representative office will decide to reissue the passport and deliver the result to the applicant.

- In case of separating a child from the parent's passport, after issuing the passport for the child, the Vietnamese representative office will annotate in two languages (Vietnamese and English) on one of pages 6, 7, or 8 of the parent's passport with the content: "Name of child... deleted from page 4 of this passport".

- In case of reissuing a passport due to damage, remaining validity period requiring reissue, or separating a child and reissuing a passport for the parent, after issuing the new passport, the Vietnamese representative office will photograph the personal information page of the old passport for record keeping and perforate (on the right side, below, from page 1 to page 24 of the passport, except for pages with valid visas or residence permits issued by foreign countries) and return it to the applicant.

- In case the file does not contain sufficient grounds for issuing a new passport, the Vietnamese representative office shall request the person to clearly declare personal factors and propose the Exit and Entry Administration or the Vietnamese representative office that issued the passport to verify. The response time of the issuing authority and the time for the Vietnamese representative office to deliver the result to the applicant shall be carried out in accordance with point b, clause 1, Article 2 of this Circular, as amended and supplemented.

4. Amend and supplement Point a, Clause 3, Article 2 as follows:

"a) One set of file in accordance with point a, Clause 1, Article 2 of this Circular, as amended and supplemented, and the following documents:"

- In case of requesting to adjust the surname, date of birth, place of birth, gender, or citizen identification number, submit a copy of the document proving such adjustment. If it is a photocopy, present the original for verification and comparison.

- In case of requesting to include a child under nine years old in the Vietnamese passport of the father or mother, submit the file as prescribed for the case of requesting to issue a joint passport for children of the father or mother under nine years old as stipulated in point a, Clause 3, Article 2 of this Circular, as amended and supplemented. For children born to a Vietnamese citizen and a foreigner, the Vietnamese representative office will only include the child in the Vietnamese passport of the father or mother if the child has Vietnamese nationality.

5. Add Clause 5 to Article 2 as follows:

"5. In case the applicant requests to receive the result through postal service or authorizes another person to collect on their behalf, the procedures shall be as follows: - In case of receiving the result through postal service, clearly indicate in the application form (Form X02) and pay the postage fee according to the regulations of the local post office; - In case of authorizing another person to collect on their behalf, the authorized person must present their identity document, submit the receipt of the file and the authorization letter when collecting the passport."

6. Amend and supplement Article 3 as follows:

"Article 3. Regarding the validity period of passports

1. Passports issued to citizens aged 14 or older have a validity period of up to 10 years from the date of issuance and cannot be extended.

2. Passports issued solely to children under 14 or jointly to children under 9 years old in the passport of the father or mother have a validity period of five years from the date of issuance and cannot be extended.

3. In case a passport of the father or mother still has more than five years of validity remaining and a child under nine years old is added, the validity period will be adjusted to five years from the date of adding the child."

7. Amend and supplement Points a and b, Clause 2, Article 5 as follows:

"a) In cases where a citizen goes abroad for work, study, tourism, or other personal matters and the passport is lost or expired; they are not allowed to reside abroad, are forced to leave the country, or voluntarily return to the country but do not have a valid passport:

- One set of file in accordance with point a, Clause 1, Article 2 of this Circular, as amended and supplemented, and the following documents:

+ A copy of the document used as the basis for issuing a travel permit as stipulated in Clause 3, Article 1 of this Circular, as amended and supplemented. If it is a photocopy, present the original for verification and comparison;

+ An expired passport or a report of lost passport. In case of voluntary return to the country, the report of lost passport must be confirmed by the local authorities;

+ In case of voluntary return to the country, clearly state the intention in the application form.

- Procedures of the Vietnamese representative office:

+ Within five working days from the date of receiving a complete and valid file, the Vietnamese representative office decides to issue a travel permit and delivers the result to the applicant.

+ In case the file does not contain sufficient grounds for issuing a travel permit, the Vietnamese representative office shall request the person to clearly declare personal factors and propose the Exit and Entry Administration of the Ministry of Public Security to verify. The verification request of the Vietnamese representative office, the response time of the Exit and Entry Administration, and the time for the Vietnamese representative office to deliver the result to the applicant shall be carried out in accordance with point b, Clause 1, Article 2 of this Circular, as amended and supplemented.

b) In case there is a written expulsion decision by the competent authority of a foreign country but the person does not have a valid passport

- One set of file including:

+ Two newly taken photographs of the Vietnamese citizen being expelled, size 4x6 cm, white background, looking straight ahead, bareheaded, without tinted glasses. No application form is required;

+ The effective expulsion decision by the competent authority of the host country.

- Procedures of the Vietnamese representative office:

+ The Vietnamese representative office sends a request for verification of personal factors and information about the expulsion decision of the host country to the Exit and Entry Administration of the Ministry of Public Security for verification. Within 45 days from the date of receiving the verification request, the Exit and Entry Administration of the Ministry of Public Security shall respond in writing to the Vietnamese representative office.

+ The Vietnamese representative office will only issue a travel permit upon approval by the Exit and Entry Administration of the Ministry of Public Security."

8. Add Article 5a as follows:

"Article 5a. Issuance of Personal Confirmation Certificate

a) A set of documents including:

- One application form for requesting a personal confirmation certificate according to Form X03 issued together with this Circular;

- Two newly taken photographs of Vietnamese citizens abroad, size 4x6 cm, white background, looking straight ahead, bareheaded, without tinted glasses;

- A copy of the document proving the relationship between the applicant and the relative abroad. If it is a photocopy, present the original for verification and comparison.

b) Applicants and places to submit the file:

- Vietnamese citizens within the country (father, mother, wife, husband, son, daughter, brother, sister, aunt, uncle) requesting to confirm the personal status of their relatives abroad for the purpose of applying for a passport or travel permit.

- The applicant for a personal confirmation certificate may submit the file at the Exit and Entry Administration or the Exit and Entry Management Department of the Provincial Police (referred to as Provincial Police).

c) Procedures of the exit and entry management agency:

- In case the file is submitted to the Exit and Entry Management Department of the Provincial Police where the applicant resides: + Within 25 working days from the date of receiving a complete and valid file, the Exit and Entry Management Department of the Provincial Police is responsible for verifying and sending the file to the Exit and Entry Administration."

Within five working days from the date of receiving the file from the Provincial Public Security Exit and Entry Administration Office, the National Exit and Entry Administration shall examine and issue the personnel confirmation certificate, send the result back to the Provincial Public Security Exit and Entry Administration Office for delivery to the applicant, and at the same time notify the Vietnamese representative office abroad upon the applicant's request.

- In case of filing the application with the National Exit and Entry Administration: Within thirty working days from the date of receiving all valid files, the National Exit and Entry Administration shall direct verification and examination for issuing the personnel confirmation certificate, deliver the result to the applicant, and notify the Vietnamese representative office abroad upon the applicant's request. d) The personnel confirmation certificate has a validity period of twelve months from the date of issuance and is not extendable.

9. Article 6, Clause 1, Point b is abolished.

Article 2. Effective Date

This Circular takes effect from October 5, 2013./.
