Pursuant to the proposal of the General Director of the Vietnam Social Security,
The Prime Minister issues this Decision on pilot electronic transactions in the implementation of procedures for joining social insurance, health insurance, unemployment insurance and requesting issuance of social insurance books, health insurance cards.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decision stipulates electronic transactions in the implementation of procedures for joining social insurance, health insurance, unemployment insurance and requesting issuance of social insurance books, health insurance cards (hereinafter referred to collectively as electronic transactions in the field of social insurance).
Article 2. Applicability
1. Enterprises, state agencies, public institutions and organizations participating in social insurance, health insurance, unemployment insurance as prescribed by law (hereinafter referred to collectively as employers) shall choose methods of electronic transactions in the field of social insurance.
2. Organizations providing value-added services in the field of social insurance (hereinafter referred to as Organization I-VAN).
3. Social Insurance Agency.
Article 3. Explanation of Terms
In this Decision, the following terms shall be understood as follows:
1. Electronic transactions in the field of social insurance refer to the implementation of procedures for joining social insurance, health insurance, unemployment insurance and requesting issuance of social insurance books, health insurance cards through electronic means.
2. Data messages in electronic transactions in the field of social insurance are information created, sent, received, and stored through electronic means.
3. Electronic social insurance files are data messages in electronic transactions concerning joining social insurance, health insurance, unemployment insurance and requesting issuance of social insurance books, health insurance cards.
4. Electronic social insurance transaction account is an account issued by the Vietnam Social Security for employers to log into the Vietnam Social Security’s electronic portal or the electronic transaction portal of the Organization I-VAN to conduct electronic transactions in the field of social insurance.
5. Organization I-VAN is an organization operating in the field of information technology that has signed a contract with the Vietnam Social Security to provide value-added services in electronic transactions in the field of social insurance.
6. Value-added services in electronic transactions in the field of social insurance (English: Insurance - Value Added Network), hereinafter referred to as I-VAN service, is a service for receiving, transmitting, storing, and recovering data messages in electronic transactions in the field of social insurance between employers and the Social Insurance Agency through the Organization I-VAN after the employer pays a fee to use the electronic transaction service.
7. The Vietnam Social Security’s electronic portal is the sole point of access on the internet to link and integrate various channels of information, applications, and services of the Vietnam Social Security, through which users can exploit and utilize.
8. The Vietnam Social Security’s electronic transaction portal is the sole point of access on the internet of the Vietnam Social Security’s information technology system to receive, transmit, store, and recover data messages in electronic transactions in the field of social insurance with the Organization I-VAN.
Article 4. Principles of electronic transactions in the field of social insurance
1. Comply with the provisions of laws on electronic transactions, social insurance, health insurance, unemployment insurance, and related laws.
2. Ensure continuity, timeliness, clarity, accuracy, fairness, honesty, security, effectiveness, and compliance with legal regulations on information confidentiality and integrity.
3. Have a valid digital certificate issued by an organization providing digital signature certification services in accordance with the law when participating in electronic transactions in the field of social insurance.
Article 5. Conditions and selection for conducting electronic transactions in the social insurance sector by employers
1. Employers conducting electronic transactions in the social insurance sector must meet the following conditions:
a) Possessing a digital certificate as stipulated in Clause 3, Article 4 of this Decision;
b) Having the ability to access and use the Internet; having a stable email address and registering with the Vietnam Social Security.
2. Employers may choose to conduct electronic transactions in the social insurance sector directly through the Vietnam Social Security Electronic Portal as prescribed in Article 18 of this Decision or through the I-VAN Electronic Transaction Gateway as prescribed in Article 22 of this Decision.
Article 6. Criteria for selecting organizations operating in the information technology sector to sign contracts for providing I-VAN services
1. Regarding the subject:
a) Being a business established in accordance with the Law on Enterprises and the Law on Investment, operating in the information technology sector in Vietnam;
b) Having at least three years of experience in the information technology sector, having successfully implemented an electronic data exchange system with at least ten agencies and organizations.
2. Regarding financial capacity and place of business:
a) Having sufficient financial capability to establish an electronic data exchange system, technical equipment, organization, and maintain operations consistent with the scale of I-VAN service provision;
b) Having a guarantee letter from a credit institution legally operating in Vietnam to address risks and compensate for potential losses during the service provision process;
c) Having a place of business and location for equipment that ensures safety and suitability for the type of service provided.
3. Regarding personnel:
a) Having at least five university-level staff specializing in information technology, with practical experience in network management, security of electronic data exchange systems, database management, understanding laws related to social insurance, health insurance, unemployment insurance;
b) Having a technical team available 24 hours a day to maintain the electronic data exchange system and support users of I-VAN services.
4. Regarding technical requirements:
a) The system and technical equipment must meet the following requirements:
- Providing services to employers and connecting with the Vietnam Social Security Electronic Transaction Gateway 24 hours a day and seven days a week, including holidays, except for maintenance periods. The downtime for maintaining the electronic data exchange system should not exceed 3% of the total service hours in a year;
- Having the ability to detect, warn, and prevent unauthorized access and cyber attacks to ensure the confidentiality and integrity of data exchanged between parties;
- Having procedures for data backup, online data backup, and data recovery; being able to restore data within eight hours from the time the electronic data exchange system encounters an issue.
b) Transactions and storage of social insurance records must meet the following requirements:
- Storing transaction results and electronic social insurance records until the transaction is completed;
- The original electronic transaction data message must be retained on the electronic data exchange system and accessible online;
- Having contingency plans and backup systems to handle abnormal situations and fix issues to ensure safe and continuous operation of the electronic data exchange system.
c) Requirements for electronic transaction logs:
- Electronic transaction logs must be stored for a minimum of ten years from the date of successful transaction completion;
- Ensuring monitoring and retrieval of information from the electronic transaction log system during the retention period.
d) Ensuring data connection standards specified by Vietnam Social Security.
Chapter II
RIGHTS AND OBLIGATIONS OF EMPLOYERS, ORGANIZATION I-VAN, AND SOCIAL INSURANCE AUTHORITIES
Article 7. Rights of the Employer
1. To conduct electronic transactions in the field of social insurance in accordance with the Law on Electronic Transactions, this Decision, and relevant legal provisions.
2. To choose one of the two electronic transaction portals in the field of social insurance as prescribed in Clause 2, Article 5 of this Decision.
3. To be guided, supported, and have issues resolved promptly by the Vietnam Social Security or the I-VAN Organization when encountering problems during the implementation of electronic transactions.
4. To have the Vietnam Social Security and the I-VAN Organization ensure the confidentiality and integrity of data related to electronic transaction information in accordance with the law.
Article 8. Obligations of the Employer
1. To establish, send, and receive electronic social insurance files directly at the Vietnam Social Security Electronic Portal or through the I-VAN Organization's Electronic Transaction Portal.
2. Not to perform transactions using paper files for procedures that have been registered in the form of electronic transactions during the period of conducting electronic transactions, except in cases provided for in Clause 6 of this Article.
3. To manage digital signatures and ensure the accuracy of digital signatures on electronic social insurance files; to manage usernames and passwords of electronic social insurance transaction accounts to ensure the security and confidentiality of information data on the I-VAN Organization's electronic data exchange system and the Vietnam Social Security's information technology system.
4. To store and ensure the integrity of all electronic social insurance files in accordance with legal regulations on archiving, electronic transactions, social insurance, health insurance, unemployment insurance, and related laws.
5. To implement regulations ensuring the safety and security of the I-VAN Organization's electronic data exchange system and the information technology system of the social security agency.
6. To prepare and submit paper social insurance files to the directly managing social security agency no later than five working days from the date of expiration of the electronic social insurance file submission deadline in cases where the electronic data exchange system and technical infrastructure have not resolved any issues by the time of the electronic social insurance file submission deadline.
7. To fulfill the terms agreed upon in the contract with the I-VAN Organization and pay for the use of I-VAN services based on the signed contract.
8. To comply with inspections and audits by state agencies authorized to oversee the implementation of social insurance, health insurance, and unemployment insurance according to the law.
9. To bear legal responsibility for declaring their own electronic social insurance files in accordance with legal regulations on electronic transactions, social insurance, health insurance, unemployment insurance, and related laws.
10. To fulfill other obligations as prescribed by law.
Article 9. Rights of the I-VAN Organization
1. To connect to the Vietnam Social Security Electronic Transaction Portal to provide electronic transaction services in the field of social insurance.
2. To receive business support from Vietnam Social Security regarding social insurance, health insurance, and unemployment insurance to carry out electronic data reception and transmission transactions between employers and Vietnam Social Security in the field of social insurance; to be provided with standard templates and formats to implement I-VAN service provision activities.
3. To receive support from the Vietnam Social Security to resolve issues related to social insurance, health insurance, and unemployment insurance business arising during the provision of I-VAN services.
4. To terminate the I-VAN service provision contract with the Vietnam Social Security according to the agreement in the contract in compliance with the provisions of the law.
5. To sign and terminate contracts with employers regarding the provision and use of I-VAN services in accordance with the law; to collect service fees from employers in accordance with the signed contract in compliance with the law.
6. To refuse to provide I-VAN services to organizations that do not meet the conditions for participation in transactions or violate signed contracts in compliance with the law.
Article 10. Obligations of the I-VAN Organization
1. Establish a connection channel with the Vietnam Social Security Electronic Transaction Gateway in accordance with the connection standards prescribed by the Vietnam Social Security.
2. To publicly announce the operating methods and service quality on the website introducing I-VAN services of the organization.
3. Provide the I-VAN service to employers who have signed contracts with the organization.
4. Ensure continuous, secure, and complete information about files and necessary conditions for electronic transactions in the social insurance field.
5. Implement the receipt, transmission, storage, and recovery of electronic transaction data messages in the social insurance field accurately and completely within the specified deadlines; transfer electronic social insurance files to the Vietnam Social Security Electronic Transaction Gateway within two hours from receiving the electronic social insurance file from the employer; notify the confirmation of submission of the electronic social insurance file to the employer using the I-VAN service in accordance with regulations.
6. To comply with laws and technical, business, and information security regulations issued by competent authorities regarding information technology and telecommunications.
7. Retain the results of each receipt and transmission of electronic data in the social insurance field; retain electronic social insurance files during the period when the transaction has not been completed.
8. Store electronic transaction logs on the electronic data exchange system in accordance with Point c Clause 4 Article 6 of this Decision.
9. Notify via email to the employer and Vietnam Social Security ten days before stopping the electronic data exchange system for maintenance and take measures to ensure the rights of related parties.
10. To provide full information and data and to implement regular and ad hoc reporting systems on I-VAN service provision activities as required by the Vietnam Social Security.
11. To regularly update new regulations of the Vietnam Social Security concerning standard templates related to electronic transactions in the social insurance field.
12. Cooperate with Vietnam Social Security to support employers in using services and conducting electronic transactions in the social insurance field.
Article 11. Rights of the Social Insurance Agency
1. Require the I-VAN Organization to establish a connection channel in accordance with the prescribed connection standard of the Vietnam Social Security to ensure continuity, security, and safety, and provide the I-VAN service to employers from the date the I-VAN service provision contract signed with the Vietnam Social Security becomes effective.
2. Require the I-VAN Organization to transfer electronic social insurance files to the Vietnam Social Security Electronic Transaction Gateway within two hours from receiving the electronic social insurance file from the employer.
3. Require the I-VAN Organization to provide services in accordance with the signed contract.
4. Sign and terminate contracts on electronic transactions with the I-VAN Organization in accordance with the provisions of the law.
Article 12. Responsibilities of the Social Insurance Agency
1. Establish, maintain, and ensure connection and connection standards between the Vietnam Social Security Electronic Transaction Gateway and the I-VAN Organization to implement the provision of electronic transaction services in the social insurance field. Operate the system for receiving and processing electronic social insurance data continuously, completely, securely, safely, and confidentially.
2. Receive files and resolve requests from employers regarding electronic transactions in the social insurance field.
3. Support employers in receiving, transmitting, storing, and recovering electronic transaction data message when requested.
4. Provide professional support to the I-VAN Organization to perform transactions involving the receipt, transmission, storage, and recovery of electronic transaction data messages between employers and the Vietnam Social Security.
5. Timely inform the I-VAN Organization and employers of new regulations of the Vietnam Social Security concerning standardized formats of electronic transaction services in the social insurance field on the Vietnam Social Security Electronic Transaction Gateway.
6. Cooperate with the I-VAN Organization to provide professional support to employers to conduct electronic transactions in the social insurance field when requested.
7. Support the I-VAN Organization and employers in resolving issues arising related to social insurance, health insurance, unemployment insurance business during the implementation of electronic transactions in the social insurance field when requested.
8. Notify and issue results of resolution in accordance with laws on electronic transactions, social insurance, health insurance, unemployment insurance, and relevant laws.
9. Publicize a list of organizations providing I-VAN services on the Vietnam Social Security Electronic Information Portal for employers to choose from.
10. Cease electronic social insurance file transactions when employers violate the information technology system safety and security regulations of the Vietnam Social Security.
11. Inspect the implementation of social insurance, health insurance, and unemployment insurance for employers in accordance with the law.
Chapter III
ELECTRONIC SOCIAL INSURANCE FILE
Article 13. Electronic Social Insurance File
1. The electronic social insurance file includes: Application forms and other documents as prescribed by laws on social insurance, health insurance, and unemployment insurance in electronic form.
2. Paper documents accompanying the file must be converted to electronic form and meet the following conditions:
a) Fully reflect the content of the paper document;
b) Have a specific mark confirming that the document has been transferred from paper to electronic transaction message;
c) Contain digital signatures and full names of individuals who have converted the paper document to electronic transaction message.
3. When the paper document loses its legal validity, the related contents in the electronic transaction message also lose their legal validity.
Article 14. Requirements and Legal Validity of the Electronic Social Insurance File
1. Requirements for the electronic social insurance file:
a) The electronic social insurance file must comply with management requirements and conform to the provisions of laws on electronic transactions, social insurance, health insurance, and unemployment insurance. In cases where the law requires a signature, the electronic transaction message will be considered valid if it is signed with a digital signature;
b) The electronic social insurance file must contain all required digital signatures of responsible persons signing the electronic transaction message as prescribed. In cases where the law requires a seal from authorized agencies or organizations, the electronic transaction message will be considered valid if it is signed with a digital signature of the authorized person according to the regulations on the management and use of seals and digital signatures.
2. Legal Validity of the Electronic Social Insurance File The electronic social insurance file has the same legal validity as a paper file when it meets the conditions stipulated in Clause 1, Clause 2 of Article 13 and Clause 1 of Article 14 of this Decision.
Article 15. Time for Submitting the Electronic Social Insurance File
1. Individuals submitting the electronic social insurance file can conduct electronic transactions through the Vietnam Social Security Electronic Portal or the I-VAN 24/7 Electronic Transaction Gateway at any time of day, seven days a week, including holidays and public holidays.
2. Vietnam Social Security or I-VAN sends an email confirmation of receipt of the electronic social insurance file to the submitter's email address within fifteen minutes of receiving the submitted electronic social insurance file.
Article 16. Storage of the Electronic Social Insurance File
The retention period for the electronic social insurance file shall be carried out in accordance with the legal provisions on recordkeeping. In cases where the electronic social insurance file has exceeded the retention period but is related to the integrity of information in the system and ongoing electronic social insurance files, it shall continue to be retained until the destruction of the electronic social insurance file does not affect other electronic transactions.
Article 17. Cancellation and Destruction of the Electronic Social Insurance File
1. The electronic social insurance file may only be canceled with the consent and confirmation of the parties involved in the transaction, in compliance with the law or based on the conclusion of the competent state agency. Cancelled electronic social insurance files must be stored for the reference of the competent state agency.
2. Electronic social insurance files that have exceeded the retention period as prescribed may be destroyed, except where otherwise provided by the competent state agency. The destruction of electronic social insurance files must not affect the integrity of non-destroyed electronic social insurance files and must ensure the normal operation of the information system.
Chapter IV
CONDUCTING ELECTRONIC TRANSACTIONS IN THE SOCIAL INSURANCE FIELD THROUGH THE VIETNAM SOCIAL SECURITY ELECTRONIC PORTAL
Article 18. Registration for Using Electronic Transaction Methods
1. The employer shall prepare the Application Form for Registration to Use Electronic Transaction Methods in the Social Insurance Field according to Model No. 01/ĐK-GD attached hereto and send it to the Vietnam Social Security's Online Portal.
2. Within three working days from the date of receipt of the Application Form for Registration to Use Electronic Transaction Methods in the Social Insurance Field from the employer, if approved, the Vietnam Social Security will notify the issuance of an account for electronic transactions via the employer’s email address; if not approved, the Vietnam Social Security will notify the employer of the reasons.
Article 19. Modification and Supplement of Information on the Registration Application Form for Using Electronic Transaction Methods
1. In case of modification or supplementation of information regarding digital certificates, email addresses, phone numbers, and contact persons on the Application Form for Registration to Use Electronic Transaction Methods, within five working days from the date of occurrence of such modifications or supplements, the employer shall access their social insurance electronic transaction account to prepare the Application Form for Modification and Supplement of Registration Information to Use Electronic Transaction Methods in the Social Insurance Field according to Model No. 02/SĐ-GD attached hereto.
2. Within three working days from the date of receipt of the Application Form for Modification and Supplement of Registration Information to Use Electronic Transaction Methods, the Vietnam Social Security will send a confirmation notification of the modification and supplement of information to the employer’s email address.
Article 20. Registration to Cease Electronic Transactions in the Social Insurance Field
1. If the employer wishes to cease electronic transactions in the social insurance field, they must prepare the Application Form for Registration to Cease Use of Electronic Transaction Methods in the Social Insurance Field according to Model No. 03/NG-GD attached hereto and send it to the Vietnam Social Security's Online Portal.
2. Within three working days from the date of receipt of the Application Form for Registration to Cease Use of Electronic Transaction Methods in the Social Insurance Field from the employer, the Vietnam Social Security will send a confirmation notification of ceasing electronic transactions in the social insurance field to the employer’s email address.
3. From the date of the Vietnam Social Security’s notification confirming the cessation of electronic transactions in the social insurance field, the employer shall conduct social insurance transactions using paper documents as prescribed. Should the employer wish to resume the use of electronic transaction methods in the social insurance field, they must follow the registration procedures stipulated in Article 18 of this Decision.
Article 21. Submission of Social Insurance Electronic Documents through the Vietnam Social Security's Online Portal
1. The employer shall submit social insurance electronic documents in one of the following ways:
a) The employer accesses their social insurance electronic transaction account, prepares the social insurance electronic document online at the Vietnam Social Security's Online Portal, and sends the social insurance electronic document to the Vietnam Social Security;
b) The employer prepares the social insurance electronic document using software or tools supporting social insurance electronic transactions that meet the data format standards of the Vietnam Social Security; then accesses their social insurance electronic transaction account to send the social insurance electronic document to the Vietnam Social Security.
2. Within two hours from the time of receipt of the social insurance electronic document from the employer, the Vietnam Social Security will send a confirmation notification of submission of the social insurance electronic document to the employer’s email address.
Chapter V
ELECTRONIC TRANSACTIONS IN THE SOCIAL INSURANCE FIELD THROUGH THE I-VAN ORGANIZATION
Article 22. Registration for using the I-VAN service
1. The employer shall fill out the Application for Registration to Use the I-VAN Service according to Form No. 04/ĐK-IVAN attached hereto and send it to the electronic transaction portal of the I-VAN Organization. Within two hours from the time of receiving the application, the I-VAN Organization shall send it to the electronic transaction portal of the Vietnam Social Security.
2. Within three working days from the date of receipt of the Application for Registration to Use the I-VAN Service from the employer, the Vietnam Social Security shall notify the confirmation to the I-VAN Organization; in case of non-approval, the Vietnam Social Security shall inform the reasons to the I-VAN Organization.
3. Within two hours from the time of receiving the notification from the Vietnam Social Security, the I-VAN Organization shall notify the employer.
Article 23. Amendment and Supplement of Information on the Application for Registration to Use the I-VAN Service
1. In case of amendment or supplement of information on the Application for Registration to Use the I-VAN Service, the employer shall access their electronic social security transaction account to fill out the Application for Amendment and Supplement of Registration Information to Use the I-VAN Service according to Form No. 05/SĐ-IVAN attached hereto and send it to the electronic transaction portal of the I-VAN Organization; the I-VAN Organization shall transfer it to the electronic transaction portal of the Vietnam Social Security within two hours from the time of receiving the application.
2. In case of changing the I-VAN Organization, the employer must follow the procedure to stop using the I-VAN Service as stipulated in Article 24 of this Decision and then follow the procedure to register for using the I-VAN Service as stipulated in Article 22 of this Decision.
Article 24. Registration to Stop Using the I-VAN Service
1. If the employer wishes to stop using the I-VAN Service, they must fill out the Application for Registration to Stop Using the I-VAN Service according to Form No. 06/NG-IVAN attached hereto and send it to the electronic transaction portal of the I-VAN Organization; the I-VAN Organization shall transfer it to the electronic transaction portal of the Vietnam Social Security no later than two hours from the time of receiving the application.
2. Within three working days from the date of receipt of the Application for Registration to Stop Using the I-VAN Service, the Vietnam Social Security shall notify the confirmation of stopping the use of the I-VAN Service to the employer through the I-VAN Organization currently providing services to the employer.
3. Within two hours from the time of receiving the confirmation notification of stopping the use of the I-VAN Service from the Vietnam Social Security, the I-VAN Organization shall notify the employer.
4. From the moment of receiving the confirmation notification of stopping the use of the I-VAN Service, the employer shall proceed with the procedures to register for social insurance transactions using paper documents.
Article 25. Submission of Electronic Social Insurance Documents Through the I-VAN Organization
1. The employer shall perform the declaration and submission of electronic social insurance documents in one of the following ways:
a) The employer accesses their electronic social insurance transaction account, fills out the electronic social insurance document online at the electronic transaction portal of the I-VAN Organization, and sends the electronic social insurance document to the I-VAN Organization;
b) The employer prepares the electronic social insurance document using software or tools supporting electronic social insurance transactions that meet the data format standards of the Vietnam Social Security; thereafter, they access their electronic social insurance transaction account to send the electronic social insurance document to the I-VAN Organization.
2. After receiving the electronic social insurance document from the employer, the I-VAN Organization shall send the document to the electronic transaction portal of the Vietnam Social Security and notify the confirmation of submission of the electronic social insurance document via email to the employer within two hours.
Chapter VI
IMPLEMENTATION
Article 26. Effective date
This Decision takes effect from May 1, 2015 until the Government Decree regulating the procedures and formalities for participating in and resolving social insurance benefits through electronic transactions in the field of social insurance becomes effective.
Article 27. Implementation Organization
1. The Vietnam Social Security is responsible for guiding the documents, procedures, and processes of electronic transactions in the field of social insurance in accordance with the laws on electronic transactions, social insurance, health insurance, unemployment insurance, and other relevant laws to implement this Decision.
2. The Vietnam Social Security is responsible for summarizing and evaluating the results of piloting electronic transactions in the field of social insurance and submitting recommendations to report to the Prime Minister before January 1, 2016, while sending to the Ministry of Labor - Invalids and Social Affairs, the Ministry of Health, and the Ministry of Finance./.
