CIRCULAR

REGULATIONS ON THE OPERATIONS OF MOVING FILM SCREENING TEAMS BELONGING TO THE DISTRIBUTION AND SCREENING CENTER OR THE PROVINCE/CITY DIRECTLY UNDER THE CENTRAL GOVERNMENT'S FILM CENTER

Pursuant to the Cinema Law No. 62/2006/QH11 dated June 29, 2006, and the Law Amending and Supplementing Certain Provisions of the Cinema Law No. 31/2009/QH12 dated June 18, 2009;

Pursuant to the Government Decree No. 54/2010/NĐ-CP dated May 21, 2010 detailing the implementation of certain provisions of the Cinema Law No. 62/2006/QH11 and the Law Amending and Supplementing Certain Provisions of the Cinema Law No. 31/2009/QH12;

Pursuant to Decree No. 76/2013/NĐ-CP dated June 17, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Cinema Department,

The Minister of Culture, Sports and Tourism promulgates this Circular on the operations of moving film screening teams belonging to the Distribution and Screening Center or the Province/City Directly Under the Central Government's Film Center.

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates the operations of moving film screening teams established at the Distribution and Screening Center or the Province/City Directly Under the Central Government's Film Center.

Article 2. This Circular applies to moving film screening teams and organizations and individuals related to the operations of moving film screenings.

Article 2. Position, Functions, and Tasks

1. Position

The moving film screening team is a specialized unit under the Distribution and Screening Center or the Province/City Directly Under the Central Government's Film Center.

2. Functions

The moving film screening team has the function of organizing film screenings to serve the people in mountainous areas, islands, remote areas, border regions, ethnic minority areas, particularly difficult areas, and other rural areas.

Point 3. Tasks

a) Develop monthly, quarterly, and annual film screening plans for the moving film screening team, report to the Director of the Distribution and Screening Center or the Film Center for review and approval by the Department of Culture, Sports and Tourism or the Provincial Department of Culture, Sports and Tourism; implement after approval;

b) Combine film screenings with propaganda activities promoting the Party's guidelines, State policies and laws in all fields of politics, economy, culture, and society at both national and local levels;

c) Send members of the moving film screening team to attend training courses, professional development sessions, and experience-sharing seminars organized by the Cinema Department of the Ministry of Culture, Sports and Tourism, the Department of Culture, Sports and Tourism, or the Provincial Department of Culture, Sports, the Distribution and Screening Center, or the Film Center of provinces/cities directly under the Central Government;

d) Carry out other tasks assigned by the Director of the Distribution and Screening Center or the Film Center of provinces/cities directly under the Central Government.

Article 3. Operation Standards

Based on the actual situation in each locality, the Distribution and Screening Center or the Film Center shall develop operation standards for moving film screening teams according to the following regulations:

Clause 1. Moving film screening teams operating in rural and plain areas must conduct at least 12 film screenings per month.

Clause 2. Moving film screening teams operating in mountainous areas, islands, border regions, ethnic minority areas, remote areas, particularly difficult areas must conduct at least 14 film screenings per month.

Article 4. Allocation of Tasks for the Mobile Film Projection Team

1. The tasks of the members of the Mobile Film Projection Team shall be defined as follows:

a) The Team Leader shall provide general direction, organize, and be responsible for the activities of the Mobile Film Projection Team to fulfill assigned tasks;

b) The Deputy Team Leader shall assist the Team Leader in performing tasks within the scope of the Team Leader's duties, carry out other tasks assigned by the Team Leader, organize and be responsible for the activities of the Mobile Film Projection Team when the Team Leader is absent;

c) Film narrators, projection technicians, generator operators, and drivers shall perform film projection work, projection service work, and other tasks when assigned by the Team Leader or Deputy Team Leader;

d) Collaborators shall perform the tasks of the Mobile Film Projection Team when invited to participate as collaborators.

2. Based on actual circumstances, the level of staff competence, and the operational area of each locality, the Film Distribution and Screening Center or the Provincial/City Film Center under the central government shall report to the competent authorities for their consideration and decision regarding the number of Mobile Film Projection Teams and the appropriate number of workers for each Mobile Film Projection Team in the locality.

Article 5. Film Sources for the Mobile Film Projection Team

1. The Mobile Film Projection Team is permitted to screen films that have been granted permission for public distribution according to the provisions of the Cinema Law and related implementing regulations.

2. The film sources provided to the Mobile Film Projection Team include:

a) Films supplied by the Cinema Department of the Ministry of Culture, Sports and Tourism or acting as the intermediary for supply;

b) Films supplied by the Department of Culture, Sports and Tourism or the Department of Culture and Sports of provinces/cities directly under the central government;

c) Films produced and exploited proactively by the Film Distribution and Screening Center or the Provincial/City Film Centers.

Article 6. Technical Equipment for Supporting Activities of the Mobile Film Projection Team

The technical equipment and necessary means for supporting the operations of the Mobile Film Projection Team include:

1. Film projection equipment, including: digital film projectors (full HD) meeting appropriate standards; machines for storing and decoding film signals (images, sound); suitable sound systems; laptops;

2. Mechanical transportation means (specialized cars, motorcycles);

3. Generator;

4. Other necessary equipment and means synchronized and suitable for the conditions at each operational location.

Article 7. Operating expenses

Article 1. Sources of State Budget

a) For the film projection activities of the Mobile Film Projection Teams:

Local state budgets ensure funding for the activities of the Mobile Film Projection Teams in accordance with current laws and annual activity plans approved by the competent authorities.

b) Investment in technical equipment for the Mobile Film Projection Team (as specified in Article 6 of this Circular) shall be carried out as follows:

- For localities with budgetary resources transferred to the central government: Localities shall independently allocate local state budget funds to invest in digital film projection equipment and suitable transportation means for the Mobile Film Projection Teams.

- For localities receiving budgetary subsidies from the central government: The state will support part of the investment in digital film projection equipment and suitable transportation means for the Mobile Film Projection Teams from the central government budget.

2. Other sources

Legal assistance and sponsorship from domestic and foreign organizations and individuals for mobile film projection activities.

3. The Mobile Film Projection Team shall implement financial mechanisms in accordance with the guidance of specialized financial agencies and current laws.

Article 8. Implementation organization

1. The Ministry of Culture, Sports and Tourism shall assign the Cinema Department to manage the national mobile film projection activities.

2. Departments of Culture, Sports and Tourism, Departments of Culture and Sports of provinces/cities directly under the central government shall direct and inspect Film Distribution and Screening Centers or Film Centers during the implementation of this Circular.

Article 9. Effective Date

1. This Circular takes effect from January 1, 2016.

2. During the implementation of this Circular, if there are difficulties or obstacles, organizations and individuals are requested to report to the Ministry of Culture, Sports and Tourism for review, amendment, and supplementation as appropriate.
