Pursuant to the Education Law on June 14, 2005; the Law Amending and Supplementing Certain Articles of the Education Law on November 25, 2009;

Pursuant to the Civil Servant Law dated November 15, 2010;

Pursuant to DecreeNo. 29/2012/ND-CP dated April 12, 2012 of the Government on the recruitment of equipment and laboratory staff in secondary schoolsdevelopment1. This Circular stipulates recruitment for vocational education teachers in public vocational education institutions; utilization, standardization training, and advanced training for vocational education teachers in vocational education institutions, vocational education activity institutions, and vocational education and general education centers. reason civil servants; Decree No. 161/2018/ND-CP dated November 29, 2018 of the Government amending and supplementing certain provisions on the recruitment of civil servants, public officials, promotion of civil servants' ranks, upgrading of public officials' grades, and implementing the employment contract system for certain types of work in administrative state agencies and public service units;

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates the code, criteria for professional titles, appointment, and grading of salaries for equipment and laboratory staff in secondary schools and publicly funded specialized secondary schools, including: Secondary general schools; middle school boarding schools for ethnic minorities; county-level ethnic minority residential middle schools; general high schools; specialized high schools; provincial-level ethnic minority residential high schools; multi-grade high schools; preparatory universities; and schools for persons with disabilities.

Article 2. This Circular applies to equipment and laboratory staff in secondary schools and publicly funded specialized secondary schools.

Chapter II

CRITERIA FOR PROFESSIONAL TITLES, APPOINTMENT, AND GRADING OF SALARIES BY PROFESSIONAL TITLES

Article 3. Criteria for professional titles equipment and laboratory staff equipment and laboratory staff

1. Tasks

a) Organize management, preservation, and use of equipment; keep and use equipment files; repair simple equipment;

b) Develop plans for the use, procurement, and repair of school equipment; dispose of and destroy damaged or expired equipment and chemicals;

c) Prepare necessary equipment, chemicals, and materials according to the requirements of each subject and lesson that uses equipment; guide teachers and students in using equipment during practical lessons and experiments; cooperate with teachers to guide students in practical lessons and experiments; ensure safety and prevent fires during practical lessons and experiments;

d) Participate in organizing and evaluating science and technology competitions for students related to experiments at school level and above;

đ) Utilize application software for equipment management;

e) Lead specialized topic activities on equipment and experiments at the school;

g) Organize the production of teaching aids and simple equipment with locally available materials;

h) Prepare regular reports on equipment and experiment activities;

i) Completing training programs; self-study and self-improvement to enhance professional skills;

k) Performing other tasks assigned by the school principal.

2. Professional ethics standards

a) Adhere to the policies, guidelines, and laws of the Party and State, and industry regulations;

b) Being honest, objective, and conscientious about moral improvement; upholding the dignity, reputation, and credibility of civil servants; fostering unity and mutual assistance among colleagues and students;

c) Perform duties in accordance with professional rules, procedures, and other legal regulations.

3. Educational and Training Standards

a) Hold a college degree in School Equipment Technology (or another relevant field suitable for the position of equipment and laboratory staff in secondary schools);

b) Have a minimum level 1 proficiency in foreign languages as specified in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training on the Vietnamese Foreign Language Proficiency Framework, or have a certificate in ethnic language training for areas requiring ethnic language use;

c) Have basic computer skills as defined in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on Computer Skills Standards;

d) Hold a certificate in professional development according to the criteria for the professional title of equipment and laboratory staff;

Article 4. Professional Competence Standards

a) Be well-versed in the policies, guidelines, laws, regulations, and requirements of the Party, State, industry, and locality regarding education at the current level of study;

b) Effectively implementing the school's educational plan;

c) Possess management, usage, and preservation skills for equipment; fire prevention and firefighting skills in case of fire during practical lessons and experiments;

d) Possessing the ability to repair, make, and cooperate with teachers, students, and parents to create teaching aids and simple equipment;

đ) Be able to flexibly apply and guide teachers in effectively using equipment and experiments in practical teaching;

e) Have communication skills with teachers in guiding students in practical lessons and experiments;

g) Have communication skills with teachers and students while performing duties.

Article 4. Principles for appointment and grading of salaries based on professional titles for equipment and laboratory staff

1. The appointment to the professional title of equipment and laboratory staff as stipulated in this Circular must be based on the job position, responsibilities, tasks, capabilities, and professional qualifications of the staff member.

2. When appointing from civil servant ranks or current professional titles to the professional title of equipment and laboratory staff, there shall be no concurrent increase in salary grade for public officials.

Article 5. Appointment to the position of equipment and laboratory staff

The appointment to the position of equipment and laboratory staff (code V.07.07.20) for officials recruited or currently engaged in equipment and laboratory work at public secondary schools and special education institutions shall be made in accordance with the criteria set forth in Article 3 of this Circular.

Article 6. Method of Salary Classification

1. Officials appointed to the position of equipment and laboratory staff (code V.07.07.20) as stipulated in this Circular shall apply the salary scale for type A0 officials as set out in Table 3 (Salary Scale for Professional and Vocational Staff in State-run Public Institutions) issued together with Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the wage system for cadres, civil servants, officials, and armed forces personnel (hereinafter referred to as Decree No. 204/2004/ND-CP).

2. The assignment of salaries shall be carried out as follows:

a) In cases where the individual has a college degree or higher that meets the requirements of the equipment and laboratory staff position, they may be appointed to the position of equipment and laboratory staff. If they are currently assigned to the salary scale for type A0 officials as issued under Decree No. 204/2004/ND-CP, they will continue to be assigned to the same salary scale.

b) In cases where the individual is currently assigned to the salary scale for type A1 officials or higher or for type B officials, their salary will be reassigned according to the guidelines set forth in Clause 1, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs guiding the assignment of salaries when upgrading ranks, transferring ranks, or changing types of civil servants and officials.

 

Chapter III

IMPLEMENTING PROVISIONS

Article 7. Implementation

1. This Circular serves as the basis for implementing recruitment, utilization, and management of equipment and laboratory staff in secondary schools and public special education institutions.

2. Non-public educational establishments may apply the provisions of this Circular to implement recruitment, utilization, and management of equipment and laboratory staff within their premises.

3. The heads of public educational establishments directly managing and utilizing officials have the responsibility to:

a) Review the positions within their unit, develop plans for appointing the position of equipment and laboratory staff within their authority, submit these plans for review and decision by the competent authority or make decisions based on delegated authority;

b) Appoint the position of equipment and laboratory staff within public educational establishments according to their authority or based on delegated authority after the appointment plan has been approved by the competent authority.

4. The Ministry of Education and Training, People's Committees of provinces and centrally-administered cities have the responsibility to:

a) Direct units under their management to implement appointments to the position and assignment of salaries for equipment and laboratory staff;

b) Approve plans for appointing the position and assigning salaries for officials transitioning from current ranks or positions to the position of equipment and laboratory staff as stipulated in this Circular; resolve issues within their authority during the process of appointing the position and assigning salaries;

c) Make decisions on appointing the position and assigning salaries for officials under their management to the position of equipment and laboratory staff within their authority;

d) Report the results of appointing the position and assigning salaries for equipment and laboratory staff under their management to the Ministry of Education and Training.

Article 8. Effectiveness and Responsibility for Implementation

1. This Circular takes effect from June 17, 2019.

2. The Director of the Office, the Director of the Department of Teachers and Educational Management; the Director of the Department of Organization and Cadre Management; the heads of relevant units under the Ministry of Education and Training; the Chairmen of the People's Committees of provinces and centrally-administered cities; the Directors of provincial Departments of Education and Training; related agencies, organizations, and individuals have the responsibility to implement this Circular./.
