Circular No. 08/2022/TT-BNV amends and supplements certain Articles of Circular No. 14/2019/TT-BNV dated November 15, 2019, issued by the Minister of Home Affairs on awarding Commemorative Medals in fields under the management authority of the Ministry of Home Affairs.

Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

BASED ON Clause 1, Article 37 of Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing certain provisions of the Law on Encouragement of Competition and Restriction of Monopoly;

At the proposal of the Director of the Office of the Ministry of Home Affairs;

THE MINISTER OF INTERIOR ISSUES THE CIRCULAR AMENDING AND COMPLEMENTING CERTAIN PROVISIONS OF Circular No. 14/2019/TT-BNV dated November 15, 2019 of the Minister of Interior REGULATING THE AWARDING OF MEMORIAL CHARMES IN SEVERAL FIELDS UNDER THE MANAGEMENT AUTHORITY OF THE MINISTRY OF INTERIOR.

Article 1. AMEND AND COMPLEMENT CERTAIN PROVISIONS OF Circular No. 14/2019/TT-BNV dated November 15, 2019 of the Minister of Interior REGULATING THE AWARDING OF MEMORIAL CHARMES IN SEVERAL FIELDS UNDER THE MANAGEMENT AUTHORITY OF THE MINISTRY OF INTERIOR.

1. Amending and supplementing POINT a, POINT c, POINT d, Clause 1, Article 6 AS FOLLOWS:

“a) Memorial Charm "For the Cause of Civil Service Organization":

Officials, civil servants, public employees working in agencies, units, organizations under the Ministry of Interior, including: Departments, Office of the Ministry, Inspectorate of the Ministry, Office of the Party Committee of the Ministry, Specialized Agency of the Party Committee of the Ministry, Office of the Trade Union of the Ministry, Office of the Youth League of the Ministry, Institute of Civil Service Organization Science, Civil Service Organization Magazine, Information Center.

Civil servants and public employees engaged in personnel work at units directly under the Ministry of Interior, including: State Archives and Records Management Department, Central Propaganda and Reward Board, Government Religious Affairs Board, National Administration Academy.

Officials, civil servants, public employees specializing or concurrently engaging in personnel work at ministries, departments, agencies, central-level Party organizations, state bodies, Vietnam Fatherland Front, political-social organizations; state-owned corporations, economic groups established by the Prime Minister's decision.

Civil servants and public employees specializing or concurrently engaging in personnel work at provincial-level departments, Vietnam Fatherland Front, political-social organizations; administrative offices at provincial-level People's Committees.

Civil servants and public employees working in the field of Civil Service Organization at Provincial Civil Service Departments.

Civil servants working in the field of Civil Service Organization at Civil Service Departments of districts, towns, cities under provinces, provincial-level cities.

Officials, civil servants, public employees specializing or concurrently engaging in personnel work at People's Councils, People's Committees at district and provincial levels.”

“c) Memorial Charm "For the Cause of State Management of Beliefs and Religions":

Civil servants, officials, and workers employed in units under and directly under the Government Religious Board.

Civil servants and public employees working in religious affairs departments under Provincial Civil Service Departments or directly under provincial-level People's Committees.

Civil servants specializing or concurrently engaging in state management of beliefs and religions at Civil Service Departments or departments under district-level People's Committees.

Officials and civil servants concurrently performing belief and religion work at Commune People's Committees.

Officials, civil servants, and public employees specializing or concurrently engaging in belief and religion work at central, provincial, district, and commune-level Party organizations, state bodies, Vietnam Fatherland Front, political-social organizations.

Individuals participating in belief and religion working groups at various levels shall be counted towards concurrent engagement in belief and religion work.”

“d) Memorial Charm "For the Cause of Document Management and Archiving":

Civil servants, officials, and workers employed in units under and directly under the National Archives Administration.

Civil servants, public employees working in Document Management and Archiving Branches or Planning Rooms assisting Provincial Civil Service Departments in managing state affairs related to document management and archiving, and at Historical Archives Centers of provinces, centrally-administered municipalities.

Civil servants engaged in planning to implement state management functions over archival affairs at district level.

Officials, civil servants, public employees specializing or concurrently engaging in document management and archiving work at Party organizations, state bodies, Vietnam Fatherland Front, political-social organizations, public service units; social organizations, social-professional organizations; state-owned corporations, economic groups established by the Prime Minister's decision.”

2. Amendment and supplementation Clause 2, Article 6 AS FOLLOWS:

“2. Leaders of the Party, State; leaders of ministries, departments, Vietnam Fatherland Front, political-social organizations at the central level; leaders of centrally-administered provinces and municipalities; leaders of state-owned corporations, economic groups established by the Prime Minister's decision; leaders of bureaus, general bureaus under ministries and departments; leaders of provincial-level departments and agencies under provincial People's Committees; leaders of provincial-level political-social organizations; leaders of districts, towns, cities under provinces, provincial-level cities who have made contributions to the development of the Ministry of Interior or in one of the following fields: Civil Service Organization; Encouragement of Competition and Restriction of Monopoly; State Management of Beliefs and Religions; Document Management and Archiving.”

3. ADD Clause 4, Clause 5, Article 6 AS FOLLOWS:

“4. Citizens who have made contributions to the development of the Ministry of Interior or in one of the following fields: Civil Service Organization; Encouragement of Competition and Restriction of Monopoly; State Management of Beliefs and Religions; Document Management and Archiving.

5. Other cases as decided by the Minister of Interior.”

4. Amending and supplementing Article 7 as follows:

Article 7. CRITERIA AND CONDITIONS FOR AWARDS OF MEMORIAL CHARMES

1. For individuals specified in Clause 1, Article 6:

a) Engaging in specialized work for at least 15 years or concurrent work for at least 20 years, completing annual tasks satisfactorily. In cases where individuals are sent for study or military service, the time spent studying or serving can be counted towards their work period for the award of Memorial Charms. If an individual does not work continuously, the time for awarding Memorial Charms will be accumulated based on the actual work time in the Civil Service sector.

b) For individuals engaging in specialized or concurrent work that is not continuous, the conversion rate when submitting application files is as follows: One year of concurrent work is equivalent to nine months of specialized work.

c) For individuals with work experience in fields under the management authority of the Ministry of Interior, if the work period in each field is insufficient to qualify for a Memorial Charm in that specific field, the total work period across all fields will be considered for the award of a Memorial Charm, and the individual may be recommended for a Memorial Charm in the current field of work (or before retirement).

2. For individuals specified in Clause 2, Article 6:

a) Party and State leaders who have contributed to the construction and development of the Ministry of Home Affairs.

b) Leaders of ministries, central agencies, the Vietnam Fatherland Front Central Committee, political and social organizations at the central level; Secretaries and Deputy Secretaries of provincial party committees directly under the central government; Chairpersons and Vice Chairpersons of provincial People's Councils and People's Committees directly under the central government; leaders of state-owned corporations and economic groups established by the Prime Minister; leaders of provincial Departments of Home Affairs directly under the central government: Have held their positions for at least five years.

c) Leaders of the Vietnam Fatherland Front Committees at the provincial level and leaders of political and social organizations at the provincial level directly under the central government; Directors and Deputy Directors of departments, bureaus, and equivalent agencies; Secretaries and Deputy Secretaries of county party committees, district party committees, town party committees, and city party committees; Chairpersons and Vice Chairpersons of county-level People's Councils: Have held their positions for at least ten years in charge of one of four areas within the jurisdiction of the Ministry of Home Affairs.

d) Members of the Central Commendation and Reward Council: Serve concurrently for at least five years; members of the Commendation and Reward Councils at the ministry and provincial levels: Serve concurrently for at least ten years.

đ) The time spent in office for the purpose of awarding commemorative medals can be accumulated if the individual does not continuously hold positions in sectors or fields under the jurisdiction of the Ministry of Home Affairs.

3. For individuals falling within the scope defined in Clause 3, Article 6:

They have outstanding achievements in consolidating international cooperation relations, making positive contributions to the construction and development of the sector or field under the jurisdiction of the Ministry of Home Affairs.

4. For individuals falling within the scope defined in Clause 4, Article 6:

Individuals with innovative ideas, solutions, scientific works recognized by competent state authorities, having practical value, making substantial and effective contributions to the development of the Home Affairs sector; individuals donating materials to National Archives Centers; individuals providing financial or material support for the development of the Ministry of Home Affairs or one of the following fields: State Organization; Commendation and Reward; Belief and Religion; Records Management and Archiving.

5. Amend Clause 1, Clause 3, Clause 4 of Article 11 are amended as follows:

"1. Commemorative Medal 'For the Cause of State Organization':

Personnel management agencies at central ministries, agencies, political organizations, and political-social organizations; Provincial Departments of Home Affairs directly under the central government shall receive and review applications for the Commemorative Medal from individuals within their jurisdiction, submitted by the units where the individuals work directly, establish files for those meeting the conditions and standards stipulated, report to the management authority for consideration, and send them to the Ministry of Home Affairs before June 30 each year."

"3. Commemorative Medal 'For the Cause of State Management on Belief and Religion':

a) Agencies responsible for commendation and reward work at central ministries, agencies, political organizations, and political-social organizations; Government Office of Religion; Provincial Departments of Home Affairs or state management agencies on belief and religion at provincial levels directly under the central government shall receive and review applications for the Commemorative Medal from individuals within their jurisdiction, submitted by the units where the individuals work directly, establish files for those meeting the conditions and standards stipulated, report to the management authority for consideration, and send them to the Government Office of Religion before April 30 each year;

b) The Government Office of Religion shall compile and review applications for the Commemorative Medal, and send them to the Ministry of Home Affairs before May 30 each year."

"4. Commemorative Medal 'For the Cause of Records Management and Archiving':

Offices of central ministries, agencies equivalent to ministries, government agencies; Supreme People's Procuracy, Supreme People's Court, State Audit Agency; Central Archive Bureau of the Central Party Office, offices of political-social organizations; Provincial Departments of Home Affairs; state-owned corporations and economic groups shall receive applications for the Commemorative Medal from individuals within their jurisdiction and vertical agencies, check and compare with the prescribed standards, establish files for those meeting the standards, report to the management authority for consideration, and send them to the National Records and Archives Administration before August 30 each year.

b) The National Records and Archives Administration shall compile and review applications for the Commemorative Medal, and send them to the Ministry of Home Affairs before October 30 each year."

6. Transfer Clause 2 of Article 13 to Clause 5 of Article 11 as follows:

"5. The Ministry of Home Affairs' Office shall receive and review applications from units, report to the Standing Committee of the Ministry of Home Affairs' Commendation and Reward Council for consideration, and submit to the Minister of Home Affairs for decision within thirty days from the date of receipt of complete and compliant application documents from the units."

7. Amend and supplement Article 12 as follows:

"Article 12. Application Documents for Awarding Commemorative Medals

1. Application documents for awarding Commemorative Medals include:

a) A proposal for awarding the Commemorative Medal from the unit (in accordance with Form I in the Appendix);

b) A list of proposed recipients of the Commemorative Medal (in accordance with Forms II, III, and IV in the Appendix);

c) A record of achievements and work history for the individual in the sector (in accordance with Form V in the Appendix);

d) Cases eligible for priority consideration for awarding the Commemorative Medal as specified in Clause 1, Article 10 of this Circular, accompanied by copies of Reward Decisions or Certificates of Recognition.

2. Number of application documents sent to the Ministry of Home Affairs:

a) For applications for the Commemorative Medal 'For the Cause of State Organization': One set.

b) For applications for the Commemorative Medals 'For the Cause of Commendation and Reward', 'For the Cause of State Management on Belief and Religion', 'For the Cause of Records Management and Archiving': Two sets.

3. Application documents for commendation awards sent to the Ministry of Home Affairs must also include electronic versions (in ".doc" or ".docx" format for proposals and lists; in ".pdf" format for achievement reports and other related documents, except for documents containing classified information)."

Article 2. Supplement, replace, and abolish certain phrases in some Articles and Appendices issued together with Circular No. 14/2019/TT-BNV dated November 15, 2019, of the Minister of Home Affairs regarding the awarding of Commemorative Medals in fields under the management authority of the Ministry of Home Affairs.

1. Add the phrase “(Department)” before the phrase “Competition and Reward Department of the Provincial Home Affairs Departments” at Point b, Clause 1, Article 6.

2. Add the phrase “(Department or Competition and Reward Department)” before the phrase “provincial-level cities directly under the central government” at Point a, Clause 2, Article 11.

3. Abolish Clause 2 of Article 10 of Circular No. 14/2019/TT-BNV dated November 15, 2019, of the Minister of Home Affairs regarding the awarding of Commemorative Medals in fields under the management authority of the Ministry of Home Affairs.

4. Replace Appendix III, IV, and V issued together with Circular No. 14/2019/TT-BNV dated November 15, 2019, of the Minister of Home Affairs regarding the awarding of Commemorative Medals in fields under the management authority of the Ministry of Home Affairs with Appendix III, IV, and V issued together with this Circular.

Article 3. Effectiveness

This Circular shall take effect from December 1, 2022.

Article 4. Implementation provisions

1. The Director of the Office of the Ministry of Home Affairs, Heads of agencies and units under and directly under the Ministry of Home Affairs; ministries, sectors, central agencies; provincial-level cities directly under the central government; relevant agencies, organizations, and individuals are responsible for organizing the implementation of this Circular.

2. During the process of implementation, if there are any difficulties, it is requested that agencies, units, and individuals promptly reflect them to the Ministry of Home Affairs for study and appropriate amendments and supplements./.
