Circular No. 14/2019/TT-BNV stipulates the awarding of Commendation Plaques in fields under the management authority of the Ministry of Home Affairs.

Pursuant to Decree No. 34/2017/NĐ-CP dated April 3, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

BASED ON Clause 1, Article 37, Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing the implementation of certain provisions of the Law on Competition and Rewards; PURSUANT TO the proposal of the Director of the Ministry of Home Affairs' Office;

THE MINISTER OF HOME AFFAIRS ISSUES this Circular to stipulate the awarding of Commemorative Plaques in fields under the management authority of the Ministry of Home Affairs.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the principles, recipients, criteria, procedures, and documentation for examining and presenting Commemorative Plaques to individuals who have made significant contributions to fields under the management authority of the Ministry of Home Affairs.

Article 2. Types of Commemorative Plaques in fields under the management authority of the Ministry of Home Affairs

1. Commemorative Plaques in fields under the management authority of the Ministry of Home Affairs are forms of awards granted by the Minister of Home Affairs to recognize achievements, dedication, and contributions of individuals to the construction and development of the Ministry of Home Affairs.

2. Types of Commemorative Plaques in fields under the management authority of the Ministry of Home Affairs

a) Commemorative Plaque "For the Cause of State Organization".

b) Commemorative Plaque "For the Cause of Competition and Reward".

c) Commemorative Plaque "For the Cause of State Management of Belief and Religion".

d) Commemorative Plaque "For the Cause of Archival and Record Management".

Article 3. Principles for awarding the Commemorative Medal

1. A Commemorative Plaque is only awarded once to an individual and there is no posthumous award. An individual may be awarded multiple types of Commemorative Plaques during their career.

2. The examination and awarding of Commemorative Plaques shall be carried out strictly according to the specified recipients, criteria, procedures for examination and presentation of Commemorative Plaques as stipulated in this Circular, ensuring fairness, democracy, transparency, and timeliness.

3. The Ministry of Home Affairs will present Commemorative Plaques on the anniversaries of traditional days of various sectors and may grant them exceptionally in special cases.

Article 4. Funding for the Presentation of Commemorative Plaques

1. Funding for the presentation of Commemorative Plaques includes expenses for printing certificates of Commemorative Plaques, creating logos and symbols of the sector, boxes, frames, and other expenses (if any).

2. Expenses for printing certificates of Commemorative Plaques and creating symbols (logos) and other expenses are allocated from funds provided to: the Ministry's Office for the Commemorative Plaque "For the Cause of State Organization"; the Government Committee for Religious Affairs for the Commemorative Plaque "For the Cause of State Management of Belief and Religion"; the Central Steering Committee for Competition and Reward for the Commemorative Plaque "For the Cause of Competition and Reward"; the National Archives Administration for the Commemorative Plaque "For the Cause of Archival and Record Management".

Article 5. Rights and Responsibilities of Organizations and Individuals in the Presentation of Commemorative Plaques

1. Individuals receiving Commemorative Plaques shall receive Certificates of Commemorative Plaques and symbols (logos) of the sector or field.

2. Individuals receiving Commemorative Plaques shall have the responsibility to continue preserving and promoting the traditions of the Ministry of Home Affairs, setting a good example in implementing the policies and laws of the Party and the State.

3. Organizations proposing the examination and awarding of Commemorative Plaques shall fully and promptly comply with the regulations on procedures, documentation, deadlines for submission, and ensure the accuracy of the documentation as stipulated in this Circular and other relevant regulations on competition and reward.

4. Individuals confirming achievements or reporting inaccurately about the criteria and conditions for being examined and awarded Commemorative Plaques shall be dealt with according to the law on competition and reward.

5. Organizations and individuals have the right to appeal or report complaints regarding the proposal and examination for the awarding of Commemorative Plaques according to the law on appeals and complaints.

Chapter II

RECIPIENTS, CRITERIA, AND CONDITIONS FOR THE AWARDING OF COMMENDATION PLAQUES

Article 6. Recipients of Commendation Medal

1. Individuals who have been and are working in the following sectors: State Organization; Encouragement and Reward; State Management of Belief and Religion; Archival Affairs:

a) Commendation Medal "For the Cause of State Organization Sector":

Officials, civil servants, public officials, and employees working in agencies, units, and organizations under the Ministry of Home Affairs including functional departments, the Ministry's Office, the Inspectorate, and subordinate organizations.

Officials, civil servants, public officials, and employees engaged in personnel work at central ministries, agencies, and mass organizations; political organizations and socio-political organizations at the central level; state-owned corporations and economic groups established by the Prime Minister's Decision.

Civil servants engaged in personnel work at provincial departments, agencies, and organizations.

Civil servants, public officials, and employees working at Provincial Departments of Home Affairs, Organization and Home Affairs Committees of provinces and centrally-administered cities.

Civil servants working in the field of state organization within District People's Committees' Internal Affairs Offices in centrally-administered cities and provinces.

Officials and civil servants engaged in personnel work at People's Councils and People's Committees at districts, towns, and centrally-administered cities; provinces and centrally-administered cities.

b) Commendation Medal "For the Cause of Encouragement and Reward":

Leaders and members of the Central Encouragement and Reward Council; Encouragement and Reward Councils of central ministries, agencies, and mass organizations; Encouragement and Reward Councils of provinces and centrally-administered cities.

Civil servants, public officials, staff, and employees working in agencies, units, and organizations under the Central Encouragement and Reward Board.

Officials and civil servants working at the Encouragement and Reward Boards under Provincial Departments of Home Affairs; dedicated or part-time civil servants engaged in encouragement and reward work at District People's Committees' Internal Affairs Offices in centrally-administered cities and provinces.

Officials, civil servants, public officials, and employees dedicated or part-time engaged in encouragement and reward work at central ministries, agencies, and mass organizations; political organizations and socio-political organizations at the central level; state-owned corporations and economic groups established by the Prime Minister's Decision.

Officials, civil servants, and public officials dedicated or part-time engaged in encouragement and reward work at local departments, agencies, and organizations.

Officials and civil servants dedicated or part-time engaged in encouragement and reward work at People's Councils and People's Committees at communes, wards, towns; districts, towns, and centrally-administered cities; provinces and centrally-administered cities.

c) Commendation Medal "For the Cause of State Management of Belief and Religion":

Civil servants, public officials, and employees working at the Government Belief and Religion Board; Belief and Religion Boards (Departments) under Provincial Departments of Home Affairs in centrally-administered cities; civil servants responsible for state management of belief and religion at Ethnic Minority and Religion Boards in centrally-administered cities; civil servants engaged in belief and religion management at District People's Committees' Internal Affairs Offices in centrally-administered cities and provinces.

Civil servants, public officials, and employees directly involved in belief and religion work or related to the belief and religion sector at agencies such as Mass Mobilization, Fatherland Front, Public Security, Military, Foreign Affairs, Women's Union, Youth Union, Farmers' Association, Veterans' Association from the central to local levels.

Village-level cadres and civil servants concurrently engaged in belief and religion management.

Cadres, civil servants, public officials, and employees participating in belief and religion working teams at various levels shall be counted towards concurrent religious work time.

d) Commendation Medal "For the Cause of Archival Affairs":

Civil servants, public officials, and employees working in units under the National Archives and Records Administration, Branches of Archives and Records.

Dedicated or part-time civil servants, public officials, and employees engaged in archival affairs at Provincial Departments of Home Affairs in centrally-administered cities, District People's Committees' Internal Affairs Offices in centrally-administered cities and provinces.

Officials and civil servants engaged in advisory management of archival affairs at the provincial and district levels; public officials managing historical archive materials of centrally-administered cities and provinces.

Dedicated or part-time civil servants, public officials, and employees engaged in archival affairs in state agencies, political organizations, socio-political organizations, social organizations, occupational associations, economic organizations, and people's armed forces units.

2. Party and State leaders; leaders of central ministries, agencies, and mass organizations; leaders of provinces and centrally-administered cities; leaders of state-owned corporations and economic groups established by the Prime Minister's Decision; leaders of departments, agencies under provincial People's Committees; leaders of districts, towns, and centrally-administered cities with significant contributions to the development of the Ministry of Home Affairs or in one of the following fields: State Organization; Encouragement and Reward; State Management of Belief and Religion; Archival Affairs.

3. Individuals who are foreigners, foreign residents in Vietnam, overseas Vietnamese who have contributed to building and consolidating comprehensive friendly cooperative relations with the Ministry of Home Affairs or in one of the following fields: State Organization; Encouragement and Reward; State Management of Belief and Religion; Archival Affairs.

Article 7. Criteria and Conditions for Awarding Commendation Medals

1. For individuals falling under the subject specified in Clause 1, Article 6:

a) Engaging in full-time work for at least 15 years and part-time work for at least 20 years, and completing annual tasks satisfactorily. In cases where individuals are sent to study or perform military service, the time spent studying or serving in the military counts towards their working period for the award of Commendation Medals. If an individual does not work continuously, the time for awarding Commendation Medals is accumulated based on the actual working time in the Ministry of Home Affairs.

b) The conversion factor between full-time and part-time work is calculated as follows: 1 year of full-time work equals 1.5 years of part-time work; 1 year of part-time work equals 0.67 years of full-time work.

c) For individuals working in the Ministry of Home Affairs whose time in each sector or field is insufficient for the award of Commendation Medals, the total working time in the Ministry of Home Affairs of such individuals will be considered for the award of Commendation Medals. The type of Commendation Medal awarded to the individual at the time of application.

2. For individuals falling under the subject specified in Clause 2, Article 6:

a) Party and State leaders who have made significant contributions during the process of building and developing the Ministry of Home Affairs.

b) Leaders of central ministries, agencies, mass organizations; leaders of provinces and centrally-administered cities (Secretary, Deputy Secretary in charge of one of the four fields/sectors of the Ministry of Home Affairs; Chairman, Vice-Chairman of the People's Council, People's Committee responsible for one of the four fields/sectors of the Ministry of Home Affairs); leaders of state-owned corporations and economic groups established by the Prime Minister; leaders of provincial-level Departments of Home Affairs: Holding office for at least one term.

c) Leaders and members of the Central Awards and Commendations Council: Serving for at least one term; leaders and members of the Awards and Commendations Councils at the ministry and provincial levels: Serving for at least two terms.

d) Leaders of local departments and agencies (heads and deputy heads responsible for one of the four fields of the Ministry of Home Affairs); leaders of districts, counties, and towns within provinces (Secretary, Deputy Secretary in charge of one of the four fields/sectors of the Ministry of Home Affairs; Chairman, Vice-Chairman of the People's Council, People's Committee responsible for one of the four fields/sectors of the Ministry of Home Affairs): Holding office for at least two terms.

3. For individuals falling under the subject specified in Clause 3, Article 6:

They have outstanding achievements in consolidating international cooperation relations, making positive contributions to the construction and development of the sector or field under the jurisdiction of the Ministry of Home Affairs.

Article 8. Subjects Not Eligible for Consideration for Commendation Medals

1. Individuals who are under disciplinary review or are involved in criminal cases without a conclusion from competent state agencies.

2. Individuals undergoing one of the forms of disciplinary action. The period during which the individual is subject to disciplinary action shall not be counted towards their service time for consideration for the Commendation Medal.

3. Individuals who are under investigation, audit, inspection due to suspected violations, or whose complaints or reports are being verified.

Article 9. Subjects Not Eligible for Awarding Commendation Medals

Individuals who are disciplined with dismissal from employment, prosecuted criminally, and sentenced to imprisonment.

Article 10. Cases Eligible for Priority Consideration for Commendation Medals

Individuals falling under the subject specified in Clause 1, Article 6, shall be given priority consideration for Commendation Medals as follows:

1. Individuals who have been commended:

a) Individuals awarded the title "Heroic Forces", "Heroic Laborer", Gold Star Order, Ho Chi Minh Order, Independence Order, shall be recommended for Commendation Medals immediately upon receipt of commendation decisions.

b) Individuals awarded the Ho Chi Minh Prize, State Prize, National Model Worker title, Orders (excluding those mentioned above) shall be recommended for Commendation Medals five years earlier than the time stipulated in Clause 1, Article 7.

c) Individuals awarded a Certificate of Merit by the Prime Minister or awarded the title of Model Worker at the ministry, agency, central mass organization, provincial, or centrally-administered city level shall be recommended for Commendation Medals three years earlier than the time stipulated in Clause 1, Article 7.

d) Honors and commendations for calculating priority time for Commendation Medals must be awarded and recognized during the individual's working period in the industry; if an individual receives multiple honors and commendations, the highest honor or commendation will be counted for priority time.

2. Individuals working in remote, mountainous, extremely difficult areas, border regions, and islands: Actual working time in these areas will be multiplied by a factor of 1.5 when calculating the time for awarding Commendation Medals.

3. Female individuals shall be eligible for Commendation Medals three years earlier than the stipulated time.

4. At the time of retirement, if an individual is still short of one to less than twelve months of the required time, they shall be given priority consideration for Commendation Medals before retirement.

Chapter III

PROCEDURES, DOCUMENTS FOR CONSIDERATION AND ORGANIZATION OF AWARDING COMMENDATION MEDALS

Article 11. Procedures for awarding Commendation Badges

1. Commendation Badge "For the Cause of the Civil Service Organization Sector"

a) The Cadre and Civil Servant Organization Department of the Ministry of Home Affairs shall prepare files for individuals meeting the criteria of units under and directly under the Ministry and submit them to the Standing Committee of the Ministry of Home Affairs' Competition and Reward Council before June 30 each year.

b) The Cadre and Civil Servant Organization Departments of ministries, agencies at the ministerial level, and government agencies; Provincial Departments of Home Affairs (Competition and Reward Boards) of centrally governed cities and provinces shall be responsible for receiving application files for the Commendation Badge from individuals under their management; civil servants working in the field of state organization at provincial Departments of Home Affairs; Internal Affairs Rooms of districts, counties, and centrally governed cities within provinces; and other cases stipulated in Clauses 2 and 3, Article 6 of this Circular, check against the specified criteria, prepare files for individuals meeting the criteria, report to the same-level leadership for review, and submit to the Ministry of Home Affairs before June 30 each year.

2. Commendation Badge "For the Cause of Competition and Reward"

a) For individuals specified in Point b, Clause 1, Clauses 2 and 3, Article 6: Competition and Reward Agencies of central ministries, sectors, and mass organizations; State-owned corporations and economic groups established by Decision of the Prime Minister; Provincial Departments of Home Affairs (Competition and Reward Boards) of centrally governed cities and provinces shall receive files from units, compare with the criteria, prepare files for individuals meeting the criteria, report to the same-level leadership for review, and submit to the Central Competition and Reward Board before April 10 each year.

b) The Central Competition and Reward Board shall compile and review application files for the Commendation Badge and submit them to the Ministry of Home Affairs before May 10 each year.

3. Commendation Badge "For the Cause of State Management of Beliefs and Religions"

a) For individuals specified in Point c, Clause 1, Clauses 2 and 3, Article 6: Competition and Reward Agencies of central ministries, sectors, and mass organizations; the Cadre and Civil Servant Organization Department and the Government's Religious Affairs Board; Provincial Departments of Home Affairs (Religious Affairs Boards) of centrally governed cities and provinces shall receive files from individuals and units, compare with the criteria, prepare files for individuals meeting the criteria, report to the same-level leadership for review, and submit the files to the Government's Religious Affairs Board before May 30 each year.

b) The Government's Religious Affairs Board shall compile and review application files for the Commendation Badge and submit them to the Ministry of Home Affairs before June 30 each year.

4. Commendation Badge "For the Cause of Official Documents and Archives"

a) For individuals specified in Point d, Clause 1, Clauses 2 and 3, Article 6: Offices of central ministries, sectors, and central agencies of organizations and mass associations; Provincial Departments of Home Affairs (Archives and Records Management Bureaus) of centrally governed cities and provinces shall receive application files for the Commendation Badge from individuals under their jurisdiction, check against the specified criteria, prepare files for individuals meeting the criteria, report to the same-level leadership for review, and submit to the National Office for Official Documents and Archives before November 5 each year.

b) The National Office for Official Documents and Archives shall compile and review application files for the Commendation Badge and submit them to the Ministry of Home Affairs before August 1 each year.

5. The Competition and Reward and Communication Division of the Ministry of Home Affairs' Office shall receive and review application files submitted by the Cadre and Civil Servant Organization Department of the Ministry of Home Affairs; the Central Competition and Reward Board; the Government's Religious Affairs Board; the National Office for Official Documents and Archives; Cadre and Civil Servant Organization Departments of ministries, agencies at the ministerial level, and government agencies; and Provincial Departments of Home Affairs of centrally governed cities and provinces, report to the Standing Committee of the Ministry of Home Affairs' Competition and Reward Council for review, and present to the Minister of Home Affairs for decision.

Article 12. Documents for Proposing to Award Commemorative Medals

Clause 1. The documents for proposing to award Commemorative Medals shall include two sets as follows:

a) A proposal for awarding the Commemorative Medal from the unit (in accordance with Form I in the Appendix);

b) A list of proposed recipients of the Commemorative Medal (in accordance with Forms II, III, and IV in the Appendix);

c) A record of achievements and work history for the individual in the sector (in accordance with Form V in the Appendix);

d) Cases eligible for priority consideration for awarding as specified in Article 10 of this Circular, accompanied by copies of the Decision on Reward and the Certificate of Recognition.

Clause 2. Document storage: One set to be kept at the proposing unit; one set to be sent to the Standing Board of the Competition and Reward Council under the Ministry of Home Affairs.

Article 13. Organization of Commemorative Medal Presentation

Clause 1. The presentation of Commemorative Medals shall take place on the following anniversaries: State Administration Day (August 28); Patriotic Competition Day (June 11); State Management of Beliefs and Religions Day (August 2); and Archival Services Day (January 3).

Clause 2. The Standing Board of the Competition and Reward Council under the Ministry of Home Affairs shall be responsible for reviewing and submitting to the Minister for approval of rewards no later than thirty days from the date of receipt of complete and compliant reward proposal documents from units.

Clause 3. The head of the agency, unit, or organization proposing to award Commemorative Medals shall be responsible for organizing the presentation ceremony for individuals according to current regulations, ensuring solemnity, practicality, avoiding ostentation, formality, and waste.

Chapter IV

IMPLEMENTING PROVISIONS

Article 14. Effective Date

This Circular takes effect from January 1, 2020, and replaces Circular No. 01/2014/TT-BNV dated January 10, 2014, issued by the Ministry of Home Affairs guiding the awarding of Commemorative Medals in fields under the management authority of the Ministry of Home Affairs.

Article 15. Implementation Organization

Clause 1. The Office of the Ministry of Home Affairs, heads of agencies and units under and affiliated with the Ministry of Home Affairs; ministries, sectors, central agencies; provinces, centrally governed cities; relevant agencies, organizations, and individuals are responsible for implementing this Circular.

Clause 2. A uniform model of commemorative medal certificates for various fields shall be used as prescribed in Appendix VI.

Clause 3. During the implementation process, if there are any difficulties, agencies, units, and individuals are requested to promptly report them to the Ministry of Home Affairs for study and appropriate amendments and supplements./.
