CIRCULAR
Amending and supplementing some articles of Circular No. 18/2015/TT-BNNPTNT
dated April 24, 2015, issued by the Minister of Agriculture and Rural Development on the management of scientific and technological tasks
Pursuant to the Law on Science and Technology dated June 18, 2013;
of the Ministry of Agriculture and Rural Development

Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decree No. 08/2014/NĐ-CP dated January 27, 2014, promulgated by the Government detailing and guiding the implementation of certain provisions of the Law on Science and Technology;
The Minister of Agriculture and Rural Development issues this Circular amending and supplementing some articles of Circular No. 18/2015/TT-BNNPTNT dated April 24, 2015, issued by the Minister of Agriculture and Rural Development on the management of scientific and technological tasks of the Ministry of Agriculture and Rural Development (amended and supplemented by Circular No. 23/2021/TT-BNNPTNT).
At the proposal of the Director of the Department of Science, Technology and Environment,
Article 1. Amending and supplementing some articles of Circular No. 18/2015/TT-BNNPTNT dated April 24, 2015, issued by the Minister of Agriculture and Rural Development on the management of scientific and technological tasks of the Ministry of Agriculture and Rural Development (amended and supplemented by Circular No. 23/2021/TT-BNNPTNT).
This Circular stipulates the management and organization of implementation of scientific and technological tasks at the ministerial level (hereinafter referred to as KHCN tasks) funded by the state budget under the responsibility of the Ministry of Agriculture and Rural Development (hereinafter referred to as the Ministry), including:
1. Amend and supplement Article 1 as follows:
"Article 1. Scope of Regulation
1. Scientific and technological programs at the ministerial level;
2. Scientific and technological projects at the ministerial level;
3. Scientific and technological proposals at the ministerial level (hereinafter referred to as proposals);
4. Scientific and technological topics at the ministerial level (hereinafter referred to as topics);
5. Pilot production projects at the ministerial level (hereinafter referred to as pilot projects);
6. Potential scientific and technological topics at the ministerial level (hereinafter referred to as potential topics).
2. Amending and supplementing Clause 2, 4, 5, 6, and 7 of Article 2 as follows:
“2. A scientific and technological project at the ministerial level is a KHCN task comprising several topics, pilot projects, and investment projects in science and technology with connected objectives and contents, conducted within a specific period, aimed at solving scientific and technological issues serving the production of one or a group of key products; enhancing technological levels and significantly impacting the development of sectors and fields managed by the Ministry.”
4. Potential topics are scientific and technological topics with exploratory nature, creating initial materials, intermediate products, capable of opening new research directions or generating new technological products aligned with the priority orientation of sectors and fields managed by the Ministry.
5. Selecting organizations and individuals to implement KHCN tasks at the ministerial level is the process by which the Ministry of Agriculture and Rural Development identifies organizations and individuals to carry out KHCN tasks at the ministerial level according to Article 29 of the Law on Science and Technology.
6. Directly assigning organizations and individuals to implement KHCN tasks at the ministerial level is the process by which the Ministry of Agriculture and Rural Development identifies organizations and individuals to carry out KHCN tasks at the ministerial level according to Article 30 of the Law on Science and Technology and Article 31 of Decree No. 08/2014/NĐ-CP dated January 27, 2014, promulgated by the Government detailing and guiding the implementation of certain provisions of the Law on Science and Technology.
7. The code for KHCN tasks at the ministerial level is a symbol for coding, tracking, and managing the database of science and technology of the Ministry according to Model B1. MSNV-BNN attached to this Circular.
3. Amending and supplementing Clause 8 and adding Clause 9 after Clause 8 of Article 2 as follows:
“8. Online meeting methods of advisory boards for selection, direct assignment, and acceptance are methods of meetings through technological solutions that allow members of the board and representatives attending from different locations to perform their duties.
9. User account is the login name and password used to access the System for Managing the Database of Science and Technology of the Ministry.”
4. Amending and supplementing Article 2a as follows:
“Article 2a. Management and organization of implementation of scientific and technological programs and projects at the ministerial level
1. The Minister decides to establish the Steering Committee for scientific and technological programs and projects at the ministerial level. The Steering Committee for scientific and technological programs and projects at the ministerial level includes leaders of the Ministry responsible for science and technology, representatives of relevant agencies and units under the Ministry, directly directing the activities of the program and project.
2. The Department of Science, Technology, and Environment is the agency assisting the Minister in organizing the management of scientific and technological programs and projects at the ministerial level.
3. Topics and pilot projects under scientific and technological programs and projects at the ministerial level are managed as KHCN tasks at the ministerial level.”
5. Amending and supplementing Article 3 as follows:
“Article 3. Requirements for KHCN tasks at the ministerial level
a) They must be urgent, meet practical production needs, focus on addressing key issues of the sector, contribute to increasing added value and sustainable development of agriculture and rural areas;
1. General Requirements
b) They must not overlap with existing or ongoing KHCN tasks. For inherited tasks, clearly state the achievements of previous stages and unresolved issues that need further resolution;
c) They must not violate intellectual property regulations, inventions, and patents recognized by intellectual property protection authorities both domestically and internationally.
2. Specific requirements for scientific and technological programs
a) They must have goals to produce scientific and technological results serving the priority development directions under the management of the Ministry of Agriculture and Rural Development regarding: Developing scientific and technological capacity in key areas; developing priority technologies; developing key and main products of the industry or serving national target programs; the results of KHCN tasks must demonstrate novelty, advancement, high applicability, and meet the program's objectives;
b) Contents must include related KHCN tasks in terms of expertise and be consistent with domestic scientific and technological resources.
3. Specific requirements for scientific and technological projects
a) They must address scientific and technological issues directly serving key agricultural production projects approved by the Minister of Agriculture and Rural Development;
b) Results must ensure application and enhance economic efficiency of the production investment project; they must be significant for the development of KHCN in sectors and fields managed by the Ministry.
b) The results created ensure that they can be applied and enhance the economic efficiency of the investment production project; they are significant for the development of science and technology in the industry or sector under the management of the Ministry.
c) Possess the ability to mobilize non-state budget resources to implement.
4. Specific requirements for the Proposal
a) The Proposal must be based on tasks approved by the Government, the Prime Minister, or the Minister of Agriculture and Rural Development; programs coordinated between the Ministry of Agriculture and Rural Development and other Ministries, agencies at the ministerial level, government agencies, provincial People's Committees, and centrally governed cities;
b) The research results of the Proposal must include recommendations or draft mechanisms, policies, procedures, and regulatory documents that fully satisfy scientific and practical evidence.
5. Specific requirements for the topic
a) Clear objectives and products;
b) Scientific and technological product or technology expected: Ensure novelty and advancement compared to existing scientific and technological products; have potential to bring about changes in productivity, quality, and efficiency; completed in prototype form for pilot production phase; capable of being granted exclusive invention patents, technical progress certificates, useful solutions, or protection certificates; have a recipient address for results;
c) Research topics in the field of policy mechanism: Must be novel; research results must ensure the creation of scientific evidence and timely solutions for addressing practical issues in the formulation and implementation of Party guidelines and policies, socio-economic development policies, and state laws;
d) Have a feasible plan to develop technology or scientific and technological products during the pilot production phase.
6. Specific requirements for potential topics
a) Have exploratory nature, create initial materials, intermediate products; when successfully researched, have the potential to open up new research directions or create new technological products in priority areas within agriculture and rural development;
b) For research creating new technological products, there must be an application address for the main results created upon completion of the topic (if applicable);
c) Prioritize the principal investigator being young researchers with high professional qualifications (master's degree, doctorate), trained abroad.
7. Specific requirements for S&T projects
a) Scientific and technological product or technology of the project: Originating from research results evaluated and accepted by national, ministry, or provincial science and technology councils, and recommended for implementation of S&T projects or results from exploiting inventions, useful solutions;
b) Possess the ability to mobilize non-state budget financial resources to implement the project.”
6. Amend and supplement Article 4 as follows:
Article 4. Proposing Science and Technology Tasks at the Ministry Level
1. Basis for proposing science and technology tasks:
a) Strategies and programs for developing the agricultural sector and rural areas;
b) Strategies for developing fields within the agricultural sector and rural development;
c) National and sectoral strategies for developing science, technology, and innovation;
d) Priority proposals for implementing the Strategy;
đ) Practical requirements of production and socio-economic development in the sector;
e) As required by Party and State leadership, and leadership of the Ministry of Agriculture and Rural Development.
2. Annually or on an ad hoc basis, the Department of Science, Technology, and Environment, acting on behalf of the Minister, shall notify in writing to relevant agencies, organizations, individuals, and post on the Ministry’s electronic portal regarding the proposal of science and technology tasks according to the bases stipulated in Clause 1 of this Article.
3. Agencies, organizations, and individuals shall propose science and technology tasks based on the Ministry's notification and Clause 1 of this Article, and submit them to the Ministry (through the Department of Science, Technology, and Environment).
4. Application forms for topics and potential topics follow Model B1a. PĐXĐT-BNN; for S&T production projects, follow Model B1b. PĐXDASXTN-BNN; for proposals, follow Model B1c. PĐXĐA-BNN; the consolidated list of proposed items follows Model B1d. THĐX-BNN issued together with this Circular.
7. Amend and supplement Article 5 as follows:
Article 5. Building and Approving the Order of Commissioned Science and Technology Tasks
1. The Department of Science, Technology, and Environment shall compile proposals for science and technology tasks from agencies and organizations (hereinafter referred to as organizations) and individuals.
2. The Department of Science, Technology, and Environment shall submit to the Ministry for decision to establish an advisory council for building the order of commissioned science and technology tasks (hereinafter referred to as the Advisory Council) in accordance with Clause 3 of this Article.
3. Composition of the Advisory Council
a) The Advisory Council consists of seven members including the Chairperson, Vice-Chairperson, scientific secretary, and members. The Advisory Council has an administrative secretary responsible for preparing and sending documents to all members of the Council;
b) Members of the Advisory Council include: Representatives of specialized management agencies; members of the Ministry's Science and Technology Council; experts with appropriate expertise and capabilities;
c) For complex or special requirement science and technology tasks, the Minister decides the number of members and composition of the Advisory Council different from the provisions in Point a and Point b of this Clause.
4. Working methods, procedures, and principles of the Advisory Council
a) Meetings of the Advisory Council are organized through one of the following methods: In person; online; a combination of in-person and online;
b) The administrative secretary announces the decision to establish the Advisory Council, introduces the composition of the Advisory Council and attending representatives;
c) A representative from the Department of Science, Technology, and Environment outlines the requirements for the Advisory Council;
d) The Advisory Council only operates when at least two-thirds of the Council members participate as stipulated in the Decision to Establish, including the Chairperson or authorized Deputy Chairperson (in the absence of the Chairperson) according to Model B2. GUQ-BNN issued together with this Circular and the scientific secretary member;
đ) The Advisory Council works according to democratic principles, adhering to professional ethics, independence, honesty, objectivity, scientific rigor, and ensuring scientific integrity. Members of the Advisory Council present review sheets for each science and technology task according to Model B3. PNXĐX-BNN issued together with this Circular. Written opinions of absent members are only for reference. The Advisory Council discusses and reaches consensus on differing opinions of members (if any). The Advisory Council's conclusion is adopted when more than three-quarters of participating members agree;
e) The Council discusses and reaches consensus on the name, objectives, requirements for results, time frame, implementation methods, and priority order of tasks;
g) The scientific secretary records the opinions and comments of the members and the conclusions of the Council in the minutes of the meeting according to Model B4. BBXDDM-BNN issued together with this Circular. The Council approves the minutes.
5. Within ten days from the date of the results of the Advisory Council's work, the Department of Science, Technology and Environment shall compile and submit to the Ministry for approval the list of tasks ordered at the level of the Ministry.
6. Urgent scientific and technological tasks ordered by the Party leadership, State, Government, and the Ministry of Agriculture and Rural Development shall be prioritized for implementation regardless of the annual scientific and technological plan. The establishment and approval of urgent scientific and technological tasks shall be carried out in accordance with the provisions of this Article.
8. Amend and supplement Article 6 as follows:
“Article 6. Announcement of Selection and Direct Assignment of Scientific and Technological Tasks
The Department of Science, Technology and Environment shall publicly announce on the Ministry’s electronic portal for thirty days to allow organizations and individuals to prepare registration files for selection and direct assignment.”
9. Amend and supplement Article 7 as follows:
“Article 7. Conditions for Participation in Selection and Direct Assignment to Implement Scientific and Technological Tasks
1. Organizations registering to participate in selection and direct assignment to lead the task must simultaneously meet the following conditions:
a) Having legal personality and engaging in scientific and technological activities appropriate to the requirements of the task;
b) Not falling under the cases stipulated in Clause 2 of this Article.
2. Organizations falling under any of the following circumstances are not eligible to register for participation in selection and direct assignment to lead the task:
a) At the deadline for submitting registration files for selection and direct assignment, they have not completed the registration, submission, and retention of the results of other scientific and technological tasks as prescribed;
b) At the deadline for submitting registration files for selection and direct assignment, they have not reported on the application of the results of other provincial-level or higher scientific and technological tasks as prescribed;
c) At the deadline for submitting registration files for selection and direct assignment, they have not submitted the proposal for evaluation and acceptance of national, provincial, or municipal-level scientific and technological tasks led by them within thirty days from the end of the implementation period according to the Contract, including any extended period (if applicable);
d) At the deadline for submitting registration files for selection and direct assignment, they have not fully refunded the recovered funds according to the contracts for previously undertaken tasks;
đ) If there has been misconduct leading to suspension of another task, they are not eligible to register for selection and direct assignment for one year from the date of the suspension decision by the competent authority.
3. Individuals registering to participate in selection and direct assignment to lead the task must simultaneously meet the following conditions:
a) Having a bachelor’s degree or higher;
b) Having relevant expertise and actively working in the related field for at least five years up to the date of submission of the file;
c) Having the ability to directly implement or organize the implementation and ensuring sufficient time to lead the scientific and technological task according to schedule and quality;
d) Not falling under the cases stipulated in Clause 4 of this Article.
4. Individuals falling under any of the following circumstances are not eligible to register for participation in selection and direct assignment to lead the task:
a) At the deadline for submitting registration files for selection and direct assignment, they are leading one or more provincial-level or higher scientific and technological tasks;
b) At the deadline for submitting registration files for selection and direct assignment, they have not submitted the proposal for evaluation and acceptance of national, provincial, or municipal-level scientific and technological tasks led by them within thirty days from the end of the implementation period according to the Contract, including any extended period (if applicable);
c) If there has been misconduct leading to suspension of a task led by them, they are not eligible for three years from the date of the suspension decision by the competent authority.”
10. Amend and supplement Article 8 as follows:
“Article 8. Registration Files for Participation in Selection and Direct Assignment to Implement Scientific and Technological Tasks
1. The registration files include:
a) Application form for participation in selection and direct assignment to implement scientific and technological tasks according to Model B5. ĐON-BNN issued together with this Circular;
b) Description: For research topics and potential research topics according to Model B6a. TMĐTCN-BNN; for agricultural science and technology projects according to Model B6b. TMDASXTN-BNN; for scientific and technological projects according to Model B6đ. TMTQ-DAKHCN-BNN; for programs according to Model B6c. TMĐA-BNN; for research topics, programs, and potential research topics in the field of economic policy according to Model B6d. TMKTCS-BNN issued together with this Circular;
c) Summary of the organization's scientific and technological activities for implementing the scientific and technological task according to Model B7. LLTC-BNN issued together with this Circular;
d) Academic resume of the individual applying to lead the task according to Model B8. LLCN-BNN issued together with this Circular;
đ) Academic resume of the main members and scientific secretary according to Model B8. LLCN-BNN issued together with this Circular;
e) Academic resume of domestic and foreign experts (in case of hiring experts to participate in implementation);
g) Summary of scientific and technological activities and confirmation documents about the agreement of participating organizations for cooperation in implementing the scientific and technological task (in case of having cooperating organizations) according to Model B9. LLTCPH-BNN and Model B10. PHTH-BNN issued together with this Circular. Documents and regulations stipulated in this point only apply to tasks requiring counterpart funding outside the state budget.
2. The documents stipulated in Clause 1 of this Article must be original or certified copies according to current regulations. In cases where the files are available on the Ministry's scientific and technological database management system, organizations and individuals participating in selection and direct assignment of tasks are responsible for updating information on the system and providing file numbers to the Department of Science, Technology and Environment.
3. Submission of Files
a) For direct submission or through postal service: The dossier consists of 01 set, using Times New Roman font in Vietnamese, with Unicode character encoding according to Vietnam Standard TCVN 6909:2001, black color, and 01 electronic version of the dossier (in PDF format, without password protection) recorded on a USB drive. The entire dossier must be packed, sealed, and clearly marked on the outside with: The name and code number (if available) of the registered scientific and technological task for selection and assignment, the name and address of the organization registering as the main task organizer, the name, address, and phone number of the task leader; full names of key participants; list of documents included in the dossier;
b) For online submissions: 01 set of electronic dossiers comprising the electronic versions of the documents specified in Clause 1 of this Article and certified electronically in accordance with current regulations;
c) The deadline and address for submitting the dossier shall be announced by the Ministry and published on the Ministry of Agriculture and Rural Development's website or other mass media (in the case of selection) and in writing (in the case of direct assignment).
4. Date of receipt and location for submission of the dossier
a) For direct submission or through postal service: The date of receipt of the dossier is the date stamped by the postal service at the sending location (in the case of submission through postal service) or the arrival stamp of the Department of Science, Technology and Environment (in the case of direct submission);
b) For online submissions: The date of receipt of the dossier is determined based on the actual time recorded on the Scientific and Technological Database Management System;
c) Within the stipulated deadline for submission, organizations and individuals registering to participate in the selection and direct assignment have the right to withdraw their submitted dossier to replace it with a new one or supplement the submitted dossier. The replacement or supplementation of the dossier must be completed before the stipulated deadline for submission.”
11. Amend and supplement Article 9 as follows:
“Article 9. Opening, inspecting, and confirming the validity of dossiers for participation in selection and direct assignment of scientific and technological tasks
1. Within 07 working days from the end of the deadline for submission of registration dossiers for participation in selection and direct assignment, the Department of Science, Technology and Environment shall open, inspect the status, and confirm the validity of the dossiers in the presence of representatives of organizations and individuals registering to participate in the selection and direct assignment. In cases where representatives of organizations and individuals registering to participate in the selection and direct assignment do not attend the opening of the dossiers, the Department of Science, Technology and Environment shall proceed with the opening of the dossiers and record minutes in accordance with Clause 2 of this Article.
2. The results of the opening of the dossiers shall be recorded in the form of a protocol according to Model B11. BBMHS-BNN issued together with this Circular.
3. Valid dossiers will be considered and evaluated as dossiers that meet the provisions of Article 8 of this Circular. For invalid dossiers, the Department of Science, Technology and Environment shall notify the organizations registering as the main task organizers in writing and specify the reasons.”
12. Amend and supplement Article 10 as follows:
“Article 10. Advisory Council for Selection and Direct Assignment of Scientific and Technological Tasks
1. The Department of Science, Technology and Environment shall submit to the Ministry for the establishment of an Advisory Council for Selection and Direct Assignment of Scientific and Technological Tasks at the Ministry level.
a) The composition of the Council is as prescribed in Clause 3 of Article 5 of this Circular, including 02 reviewing members;
b) The Council has an administrative secretary responsible for preparing and sending materials to all members of the Council;
c) Individuals falling under any of the following circumstances shall not be allowed to participate in the Advisory Council:
Individuals who have registered to undertake scientific and technological tasks;
Individuals belonging to organizations registering as the main task organizers and organizations registering as cooperating task organizers;
There is clear evidence indicating a lack of impartiality when participating in the advisory council for the selection and direct assignment of tasks;
Spouses, parents, children, siblings, or half-siblings of the task leader, scientific secretary, and key participants in the implementation of the scientific and technological task; persons with evidence of conflicting interests with the task leader or the main organizing organization;
Individuals who have not yet completed administrative penalty decisions regarding scientific and technological activities or are currently being investigated for criminal responsibility or have been convicted but not yet pardoned;
d) For complex scientific and technological tasks or those with special requirements, the Minister may decide on the number of members and composition of the Council different from the provisions in point a of this clause.
2. Working methods and principles of the Council
a) The working methods and principles of the Council shall be implemented in accordance with Clause 4 of Article 5 of this Circular;
b) Members who have participated in the Advisory Council to determine priority tasks shall be given priority invitations to join the Advisory Council for the selection and direct assignment of corresponding tasks.
3. Responsibilities of Council members
a) To evaluate honestly, objectively, and fairly; to be personally responsible for the results of their evaluation and collectively responsible for the Council's final conclusion. Members of the Advisory Council, participating representatives, and administrative secretaries have the responsibility to keep confidential all information related to the evaluation process of the selection and direct assignment dossiers;
b) To study and analyze each content and information declared in the dossier; to comment and evaluate each dossier according to the specified requirements; to write comments, evaluations, and explanations for the evaluation.”
13. Amend and supplement Article 11 as follows:
“Article 11. Preparing for Meetings of the Advisory Council
1. The administrative secretary is responsible for preparing and sending materials to all members of the Advisory Council at least 05 working days before the meeting to evaluate registration dossiers for selection and direct assignment; providing user accounts for Advisory Council members in cases of online meetings or hybrid online and offline meetings.
2. Materials for the meeting to evaluate registration dossiers for selection and direct assignment include:
a) Decision on the establishment of the Advisory Council;
b) Extracts from the approved task list;
c) Original copy or electronic version of the registration dossier for participation in selection and direct assignment;
d) Task review forms according to models issued together with this Circular (research topics, research projects, potential research topics according to Model B12a. PNXĐTCN-BNN; research topics, potential research topics in the field of economic policy according to Model B12b. PNXĐTKTCS-BNN; agricultural science and technology projects according to Model B12c. NXDASXTN-BNN).”
14. Amend and supplement Article 12 as follows:
Article 12. Procedures and contents of work of the Advisory Council for Selection and Direct Assignment
1. Procedures and contents of work of the Advisory Council for Selection and Direct Assignment
a) The administrative secretary announces the decision to establish the Advisory Council, introduces the members of the Advisory Council and the representatives present, and records the opening of the file;
b) A representative from the Department of Science, Technology, and Environment states the requirements and main contents regarding the selection and direct assignment of tasks;
c) The Advisory Council exchanges and unifies working principles.
2. The Advisory Council proceeds to review and evaluate the registration files for selection and direct assignment
a) Members of the council present their reviews on each file concerning the suitability between the total budget and the products of the task; propose modifications and supplements in the project description; compare the registration files within the same task. The project review form, potential project proposal form, and potential project form according to the model prescribed at point d, Clause 2, Article 11 of this Circular. The scientific secretary reads the review form of absent members (if any);
b) Members of the Advisory Council score each file through voting. Evaluation forms with scores differing more than 20% from the average score of all members are invalid. Evaluation and scoring forms for projects, proposals, and potential projects according to model B13a. PĐGĐTCN-BNN; proposals, projects, and potential projects in economic and policy fields according to model B13b. PĐGĐTKTCS/ĐA-BNN; research and development projects according to model B13c. PĐGDA-BNN issued together with this Circular.
3. The Advisory Council elects a ballot counting committee consisting of three members, including the Chairperson of the ballot counting committee and two other members.
4. The ballot counting committee compiles the voting results of the Advisory Council members according to models B14a. BBKPĐGHS-BNN and B14b. BTHKP issued together with this Circular.
5. The ballot counting committee announces the scoring results after reviewing and excluding invalid ballots. In cases where the organization leading the task has a file with an average score of 70/100 points or higher, the total score of the file will be increased by 10% (ten percent) of its average score.
6. The Advisory Council recommends organizations and individuals to undertake the task when they meet the following conditions simultaneously:
a) Having a file evaluated with the highest average score and must reach 70/100 points or higher, with no criterion having more than 1/4 of the Advisory Council members present giving it a zero score;
b) For files with equal average scores, priority is given in the following order:
Prioritize files proposing less state budget funding;
Prioritize the principal of the task or the leading organization that has been rated as excellent in a ministry-level task within five years from the time of registering to undertake the task;
For files with equal priority scores above, prioritize the file with a higher average score on the content and implementation plan of the leading organization and the principal of the task.
7. The Advisory Council concludes on the files of the organization recommended for winning the selection or direct assignment:
a) Contents requiring modification and supplementation in the task description to meet the ordering requirements;
b) The number of domestic and foreign experts needed to participate;
c) The method of cost allocation up to the final product or partial cost allocation.
8. The scientific secretary prepares and completes the Minutes of the Advisory Council meeting according to model B15. BBĐGHS-BNN issued together with this Circular. The Council unanimously approves the minutes.
15. Amend and supplement Article 13 as follows:
"Article 13. Notification of Results of Selection and Direct Assignment of Scientific and Technological Tasks
1. Within five working days from the end date of the Advisory Council's meeting for Selection and Direct Assignment, the Department of Science, Technology, and Environment shall notify in writing the results of the selection and direct assignment to the registering organization that has won the selection.
2. Within seven working days from receiving the notification of winning, the leading organization and the principal of the task shall be responsible for completing and submitting the revised scientific and technological task description according to the Advisory Council's conclusion (if applicable), and the explanation of the leading organization regarding the modified contents according to the Advisory Council's conclusion according to model B16. BCGTHĐTC-BNN issued together with this Circular to the Department of Science and Technology and Environment for content and budget assessment."
16. Amend and supplement Article 14 as follows:
"Article 14. Content and Budget Assessment
1. The Department of Science, Technology, and Environment submits to the Ministry a Decision to establish the Content and Budget Assessment Team for Ministry-level Scientific and Technological Tasks (hereinafter referred to as the Assessment Team). The Assessment Team consists of five members, including: the Head of the Assessment Team is a representative of the leadership of the Department of Science, Technology, and Environment, the Deputy Head of the Assessment Team is a representative of the leadership of the Financial Department, the members are officers from the Department of Science, Technology, and Environment, officers from the Financial Department, and representatives of the Advisory Council for Selection and Direct Assignment (chairman, vice-chairman, specialized management bureau, reviewer member).
2. Preparing for the Assessment Team meetings
a) The administrative secretary is responsible for preparing and sending materials to all members of the Assessment Team at least three working days before the content and budget assessment meeting; providing user accounts for the Assessment Team members or experts (if any) at least three working days before the content and budget assessment meeting in case of online or hybrid meetings;
b) Materials for the content and budget assessment meeting include:
The decision to establish the Assessment Team;
The revised task description according to the Advisory Council's conclusion;
The explanation report according to model B16. BCGTHĐTC-BNN issued together with this Circular of the leading organization regarding the modified contents according to the Advisory Council's conclusion;
The Minutes of the Advisory Council meeting;
Equipment and raw material price quotations, and service rental prices required to implement the task still valid (the quotation period does not exceed 90 days from the submission deadline);
Other related documents.
3. Principles of operation of the Assessment Team
a) At the latest ten days after receiving the file as stipulated in Clause 2, Article 13 of this Circular, the Department of Science, Technology, and Environment organizes the Assessment Team meeting;
b) The Appraisal Team must have at least 4/5 members present, including the Team Leader, Deputy Team Leader of the Appraisal Team, and representatives of the Advisory Council for Selection, directly assigned according to the provisions of Clause 1 of this Article;
c) There must be a collective conclusion on the content of the appraisal.
4. Tasks of the Appraisal Team
a) Review the content of amendments and supplements based on the Advisory Council's opinions and other amendment contents (if any);
b) Evaluate the appropriateness of the budget estimate compared with:
Research contents according to the Advisory Council's conclusions and other amendment contents (if any);
Necessary time to implement;
Economic and technical norms, expense norms according to current regulations.
c) Assess the ability to match non-state budget capital and the mobilization plan of the leading organization to carry out the task (if any); additional documents and files that need to be supplemented before signing the contract to implement the task (if necessary);
d) Recommend the total amount of funds to implement the task including state budget support funds and other sources (if any), implementation time, and cost allocation methods up to the final product or partial cost allocation.
5. Responsibilities of the Appraisal Team
a) Members of the Appraisal Team are individually and collectively responsible for the team's overall conclusion. Members of the Appraisal Team, representatives (if any), and administrative secretaries have the responsibility to keep confidential information related to the process of appraising the budget;
b) The Appraisal Team reports to the Ministry's leadership in writing and proposes solutions for issues exceeding their authority that arise during the appraisal of scientific and technological task documents (if any) for consideration and decision.
6. Procedure for the Appraisal Team's work
a) The administrative secretary announces the decision to establish the Appraisal Team, introduces the composition of the Appraisal Team and participating representatives, reads the Advisory Council's conclusion at the meeting to evaluate the documents;
b) Chair the appraisal meeting to outline principles, tasks, and responsibilities of the Appraisal Team, requirements and contents of the appraisal for the task;
c) The task leader presents the contents that have been supplemented and amended according to the Advisory Council's conclusions and other amendment and supplement contents (if any); answer questions from Appraisal Team members (if any);
d) Appraisal Team members provide comments on the contents and budget estimates of the task. The task leader does not continue to attend the Appraisal Team's meeting;
đ) Appraisal Team members express their appraisal opinions according to the provisions of Clause 4 of this Article; discuss the proposed conclusion of the Appraisal Team;
e) Before the Appraisal Team makes its concluding opinion, representatives of the leading organization and the task leader are invited to continue attending the Appraisal Team's meeting to hear the proposed conclusion of the Appraisal Team. Representatives of the leading organization and the task leader have the right to explain and clarify before the Appraisal Team concludes officially;
g) The secretary assists the Appraisal Team to complete the Appraisal Minutes according to the templates B17a. BBTĐĐT/ĐA-BNN for topics, plans, potential topics; template B17b. BBTĐDASXTN-BNN for experimental production projects issued together with this Circular.”
17. Amend and supplement Article 15 as follows:
“Article 15. Approval of Selection Results, Direct Assignment, Signing of Explanations and Contracts for Implementing Ministry-Level Scientific and Technological Tasks
1. Within 07 working days from the completion of the appraisal, the leading organization and the task leader are responsible for completing the task documents according to the Appraisal Team's conclusions, providing detailed explanations of the Appraisal Team's conclusions according to the template B18. BCGTTĐ-BNN issued together with this Circular, and sending them back to the Ministry (through the Department of Science, Technology, and Environment).
2. Approval of Selection Results, Direct Assignment
a) The Department of Science, Technology, and Environment submits to the Minister for review and issuance of the Decision approving the leading organization, task leader, budget estimate, cost allocation method, and implementation time of the task. The Decision is issued before June 30 each year. The documents submitted to the Minister are as stipulated in point b of this clause;
b) Documents for approval include:
Draft Decision approving the leading organization, task leader, funds, cost allocation method, and implementation time of the task according to the template B19. QĐPDKP-BNN issued together with this Circular;
Minutes of the Advisory Council meeting, Minutes of the Appraisal Team meeting;
Detailed explanation report according to the template B16. BCGTHĐTC-BNN issued together with this Circular by the leading organization on the contents that have been revised according to the Advisory Council's conclusions and detailed explanation of the Appraisal Team's conclusions according to the template B18. BCGTTĐ-BNN issued together with this Circular;
Task documents revised according to the Appraisal Team's conclusions; Decision establishing the Advisory Council, Appraisal Team, Expert Group (if any).
3. Signing of Explanations and Contracts for Scientific and Technological Tasks
a) The Department of Science, Technology, and Environment and the Finance Department, acting on behalf of the Minister, sign the explanation of the scientific and technological task.
b) Signing of the Contract to Implement the Scientific and Technological Task
For cases where the leading organizations are units under the Ministry: The Department of Science, Technology, and Environment, acting on behalf of the Minister, signs the contract to implement with the leading organization of the task;
For cases where the leading organizations are not budgetary units under the Ministry: The Ministry Office and the Department of Science, Technology, and Environment, acting on behalf of the Minister, sign the contract with the leading organization of the task;
The contract to implement the scientific and technological task follows the model prescribed in Circular No. 05/2014/TT-BKHCN dated April 10, 2014, issued by the Minister of Science and Technology, "Model of Scientific Research and Technological Development Contracts." The contract to implement the scientific and technological project follows the model B3-HĐDA-DAKHCN; The contract to implement the task within the scientific and technological project follows the model B4-HĐNV-DAKHCN or model B5-HĐNV-DAKHCN prescribed in Circular No. 18/2016/TT-BKHCN dated September 1, 2016, issued by the Minister of Science and Technology guiding the management of National-level Scientific and Technological Projects.
c) The time to sign the explanation for implementing the scientific and technological task is before October 31 each year. The time to sign the contract to implement the scientific and technological task is when the funds are allocated.
18. Supplement Article 15a as follows:
“Article 15a. Preservation, Management of Original Documents and Public Disclosure of Information
1. After the selection process and direct assignment have concluded, the Department of Science, Technology, and Environment shall be responsible for compiling all documents (including unsuccessful applications) for retention and management in accordance with current regulations.
2. The Department of Science, Technology, and Environment shall be responsible for publicly disclosing information on the results of the selection and direct assignment of tasks (excluding tasks containing state secrets as defined by authorized agencies) in accordance with the following specific provisions:
a) Content to be disclosed: Decision approving the list of commissioned tasks; Decision approving scientific and technological tasks (including: task name; leading organization and principal individual; objectives; requirements for results; implementation period; total budget estimate and annual budget estimate);
c) Method of disclosure: Within fifteen working days from the date of the approval decision, the Department of Science, Technology, and Environment shall be responsible for publicly announcing the results of the selection and direct assignment and posting them online on the Ministry's website and the Department's website for a minimum of sixty days.
19. Supplement Article 15b as follows:
“Article 15b. Revocation of Selection Results and Direct Assignment of Organizations and Individuals to Perform Tasks
1. During the selection process, the Department of Science, Technology, and Environment shall report to the Ministry for consideration and revocation of the selection results and direct assignment of organizations and individuals to perform tasks in the following cases:
a) The leading organization and principal individual of the task engage in fraudulent, deceptive, or dishonest declarations or commitments in the application documents for participation in the selection and direct assignment of organizations and individuals to perform tasks;
b) Violation of conditions stipulated in Article 7 of this Circular;
c) Overlapping funding for the task from other sources of the state budget;
d) The leading organization and principal individual of the task fail to comply with Clause 2 of Article 13 or Clause 1 of Article 15 of this Circular;
2. From the effective date of the Decision approving the leading organization, principal individual, funding, cost-sharing method, and implementation period of the task until the signing of the contract to implement the task, the Department of Science, Technology, and Environment shall submit to the Ministry for consideration and decision to revoke the approval results in the following cases:
a) Cases specified in point a, point b, and point c of Clause 1 of this Article;
b) The leading organization requests not to undertake the task.
3. Within seven working days from the date of the document revoking the selection results of organizations and individuals to perform tasks, the Department of Science, Technology, and Environment shall notify the leading organization.
4. The leading organization and principal individual whose selection results and direct assignment have been revoked must bear the consequences according to current laws.
5. In other necessary cases, the Minister of Agriculture and Rural Development shall consider and decide.”
20. Amend and supplement Article 16 as follows:
Article 16. Reporting System
Every six months (in May and November each year), the leading organization of the scientific and technological task shall be responsible for submitting progress reports according to Model B20a. BCĐK-BNN issued together with this Circular to the Department of Science, Technology, and Environment. If the leading organization fails to submit progress reports as required for two consecutive times or more, funding for implementing the task will be suspended and handled according to regulations.
21. Amend and supplement Article 17 as follows:
“Article 17. Inspection and Evaluation during the Implementation of Scientific and Technological Tasks
1. Time and form of inspection and evaluation:
a) For research topics, programs, and projects: once every year from the date the contract becomes effective;
b) For potential research topics: once when the topic has been implemented halfway through its time frame;
c) Inspection and evaluation during the implementation of scientific and technological tasks shall be conducted through direct or online methods.
2. Responsibilities for inspection and evaluation:
a) Annually, the Department of Science, Technology, and Environment shall take the lead in building plans and conducting regular inspections and evaluations; selecting appropriate inspection and evaluation times based on the actual implementation of scientific and technological tasks;
b) The Minister shall decide to establish ad hoc inspection teams in cases of complaints, accusations, or management findings indicating violations or non-compliance with approved descriptions;
c) For cases where the leading organizations are subordinate units of the Ministry, the inspection and evaluation team shall consist of: the Department of Science, Technology, and Environment taking the lead, coordinating with the Finance Department, the Specialized Management Bureau, or experts; other members as required by the Minister;
d) For cases where the leading organizations are not budgetary units directly subordinate to the Ministry, the inspection and evaluation team shall consist of: the Department of Science, Technology, and Environment taking the lead, coordinating with the Finance Department, the Ministry Office, the Specialized Management Bureau, or experts; other members as required by the Minister.
3. Contents and principles of inspection and evaluation:
a) Contents of inspection and evaluation:
Scientific content: Completed content; ongoing content; completed products; products applied in practice.
Financial budget usage situation: Usage of financial budget from the state budget; usage of financial budget outside the state budget.
Other contents (if any).
b) Principles of inspection and evaluation:
Inspection and evaluation shall be based on the description and signed scientific research and technology development contracts; ensuring democracy, objectivity, fairness, honesty, and accuracy;
Respecting and minimizing impact on the normal operations of the inspected organization;
Inspections shall only be carried out when there is a plan or request from authorized agencies or persons as prescribed by law;
Inspections must be conducted strictly in accordance with the content, authority, and procedures.
Ensuring close cooperation among relevant agencies and units involved in inspection work to avoid overlap and duplication.
c) Conditions for inspection and evaluation: The leading organization is responsible for sending reports to the Department of Science, Technology, and Environment as the basis for inspection and evaluation:
Progress reports according to Models B20b. BCTĐ-BNN, B20d. BCSPHT-BNN, B20đ. BCSPUD-BNN issued together with this Circular and related documents;
Reports on the use of the financial budget for the task according to Model B20c. BCSDKP-BNN issued together with this Circular and related documents.”
22. AMEND AND SUPPLEMENT Article 17a AS FOLLOWS:
"Article 17a. PROCEDURE FOR INSPECTION AND EVALUATION
1. THE REPRESENTATIVE OF THE INSPECTION AND EVALUATION TEAM SHALL STATE THE REASONS, INTRODUCE THE MEMBERS OF THE INSPECTION AND EVALUATION TEAM.
2. THE REPRESENTATIVE OF THE ORGANIZATION IN CHARGE OF THE TASK SHALL INTRODUCE THE PARTICIPANTS IN THE UNIT'S INSPECTION.
3. THE HEAD OF THE INSPECTION AND EVALUATION TEAM SHALL CHAIR THE MEETING.
4. THE TASK LEADER SHALL REPORT A SUMMARY OF THE IMPLEMENTATION SITUATION OF THE TASK.
5. INDIVIDUALS PARTICIPATING IN THE TASK SHALL COMPLEMENT THEIR OPINIONS.
6. MEMBERS OF THE INSPECTION TEAM SHALL DISCUSS AND EXCHANGE OPINIONS WITH THE ORGANIZATION IN CHARGE, THE TASK LEADER, AND INDIVIDUALS PARTICIPATING IN THE TASK REGARDING THE CONTENTS OF INSPECTION AND EVALUATION.
7. THE ORGANIZATION IN CHARGE AND THE TASK LEADER SHALL PROVIDE CLARIFICATIONS AND ACCEPT THE OPINIONS OF THE INSPECTION AND EVALUATION TEAM.
8. THE HEAD OF THE INSPECTION AND EVALUATION TEAM SHALL CONCLUDE ON THE SCIENTIFIC CONTENT, IMPLEMENTATION PROGRESS, FINANCIAL USE SITUATION, AND RECOMMENDATIONS TO THE ORGANIZATION IN CHARGE OF THE TASK, AND RECORD ANY PROPOSALS FROM THE ORGANIZATION IN CHARGE (IF ANY).
9. THE INSPECTION AND EVALUATION MINUTES MUST BE SIGNED AND CONFIRMED BY THE PARTICIPANTS OF THE INSPECTION TEAM AND THE LEADERS OF THE ORGANIZATION IN CHARGE. THE INSPECTION MINUTES FOLLOW MODEL B20e. BBKTĐG-BNN ISSUED ALONG WITH THIS CIRCULAR.
10. THE INSPECTION OF DOCUMENTS AND REPORTS MAY BE CONDUCTED AT THE ORGANIZATION IN CHARGE OR AT THE MINISTRY (DEPARTMENT OF SCIENCE, TECHNOLOGY AND ENVIRONMENT).
11. FIELD INSPECTION AND EVALUATION: FOR SCIENTIFIC AND TECHNOLOGICAL TASKS WITH PRODUCTS SUCH AS MODELS, SPECIFIC EQUIPMENT, MEASURABLE PRODUCTS, THE INSPECTION AND EVALUATION TEAM SHALL HAVE THE RESPONSIBILITY TO VISIT THE SITE TO INSPECT AND EVALUATE THE QUANTITY OF TASK PRODUCTS. IF NECESSARY, THE INSPECTION TEAM MAY REQUEST QUALITY TESTING OF THE PRODUCTS AT THE APPROPRIATE FUNCTIONAL AGENCY.
12. THE INSPECTION AND EVALUATION FEES FOR REGULAR AND URGENT TASKS ARE ARRANGED FROM THE OPERATIONAL FUNDS FOR SCIENCE AND TECHNOLOGY THROUGH THE MINISTRY’S OFFICE.
23. AMEND AND SUPPLEMENT Article 18 AS FOLLOWS:
"Article 18. ADJUSTMENT OF SCIENCE AND TECHNOLOGY TASKS
1. ADJUSTMENT OF IMPLEMENTATION TIME
a) EXTENDING THE IMPLEMENTATION TIME OF A SCIENCE AND TECHNOLOGY TASK CAN ONLY BE DONE ONCE PER TASK. THE EXTENSION TIME SHALL NOT EXCEED 12 MONTHS FOR TASKS WITH AN IMPLEMENTATION TIME OF 24 MONTHS OR MORE, AND NOT MORE THAN 6 MONTHS FOR TASKS WITH AN IMPLEMENTATION TIME UNDER 24 MONTHS. EXTENDING THE IMPLEMENTATION TIME OF A SCIENCE AND TECHNOLOGY TASK OUTSIDE THESE REGULATIONS SHALL BE DECIDED BY THE MINISTER;
b) EXTENDING THE IMPLEMENTATION TIME OF A SCIENCE AND TECHNOLOGY TASK SHALL BE CONSIDERED AT LEAST 30 DAYS BEFORE THE END OF THE CONTRACT;
c) SHORTENING THE IMPLEMENTATION TIME SHALL BE CONSIDERED WHEN AT LEAST TWO-THIRDS OF THE TASK CONTENT HAS BEEN COMPLETED;
2. ADJUSTMENT OF NAME, OBJECTIVE, AND PRODUCT OF THE SCIENCE AND TECHNOLOGY TASK
a) FOR SCIENCE AND TECHNOLOGY TASKS IMPLEMENTED UP TO THE FINAL PRODUCT: NO ADJUSTMENTS ARE ALLOWED;
b) FOR SCIENCE AND TECHNOLOGY TASKS IMPLEMENTED PARTIALLY: THE DEPARTMENT OF SCIENCE, TECHNOLOGY AND ENVIRONMENT SHALL SUBMIT TO THE MINISTRY FOR ESTABLISHING THE ADVISORY BOARD. THE COMPOSITION, METHODS, AND PRINCIPLES OF THE BOARD SHALL BE IN ACCORDANCE WITH Clause 3, Clause 4 of Article 5 OF THIS CIRCULAR. BASED ON THE ADVISORY BOARD MEETING RESULTS, THE DEPARTMENT OF SCIENCE, TECHNOLOGY AND ENVIRONMENT SHALL SUBMIT TO THE MINISTRY FOR CONSIDERATION AND DECISION.
3. ADJUSTMENT OF THE CONTENT OF THE SCIENCE AND TECHNOLOGY TASK
a) FOR SCIENCE AND TECHNOLOGY TASKS IMPLEMENTED UP TO THE FINAL PRODUCT: THE HEAD OF THE ORGANIZATION IN CHARGE OF THE TASK SHALL INITIATE THE ADJUSTMENT OF THE TASK CONTENT AND BE RESPONSIBLE FOR THE ADJUSTMENT DECISION;
b) FOR SCIENCE AND TECHNOLOGY TASKS IMPLEMENTED PARTIALLY: THE ORGANIZATION IN CHARGE OF THE TASK SHALL SUBMIT A WRITTEN REPORT TO THE MINISTRY (THROUGH THE DEPARTMENT OF SCIENCE, TECHNOLOGY AND ENVIRONMENT). THE DEPARTMENT OF SCIENCE, TECHNOLOGY AND ENVIRONMENT SHALL TAKE THE LEAD AND COOPERATE WITH THE DEPARTMENT OF FINANCE TO REVIEW THE ADJUSTMENT OF THE TASK CONTENT IN EACH SPECIFIC CASE WITHOUT CHANGING THE OBJECTIVE, PRODUCT, AND TOTAL FUNDS FOR TASK IMPLEMENTATION.
4. ADJUSTMENT OF THE TASK IMPLEMENTATION FUND
a) THE ORGANIZATION IN CHARGE OF THE SCIENCE AND TECHNOLOGY TASK SHALL REQUEST AN ADJUSTMENT OF THE TASK IMPLEMENTATION FUND IN CASES WHERE IT IS NECESSARY;
b) THE ADJUSTMENT OF THE SCIENCE AND TECHNOLOGY TASK IMPLEMENTATION FUND SHALL BE CONDUCTED IN ACCORDANCE WITH CURRENT REGULATIONS.
5. ADJUSTMENT OF PURCHASE OF RAW MATERIALS, ENERGY, EQUIPMENT, MACHINES, SERVICES:
a) FOR THE ASSIGNED FUNDS PORTION, THE HEAD OF THE ORGANIZATION IN CHARGE OF THE TASK SHALL INITIATE THE ADJUSTMENT OF THE PROCUREMENT PLAN AND BUDGET FOR THE QUANTITY, VOLUME, AND TYPE OF RAW MATERIALS, ENERGY, EQUIPMENT, MACHINES, AND SERVICES PURCHASED WITH GOVERNMENT FUNDS WITHOUT INCREASING THE TOTAL BUDGET FOR RAW MATERIALS, ENERGY, EQUIPMENT, MACHINES, AND SERVICES ALREADY ASSIGNED;
b) FOR THE UNASSIGNED FUNDS PORTION, THE ORGANIZATION IN CHARGE OF THE TASK SHALL SUBMIT A WRITTEN REPORT, THE DEPARTMENT OF SCIENCE, TECHNOLOGY AND ENVIRONMENT SHALL TAKE THE LEAD AND COOPERATE WITH THE DEPARTMENT OF FINANCE TO REVIEW THE ADJUSTMENT IN EACH SPECIFIC CASE.
6. CHANGE OF TASK LEADER: THE NEW TASK LEADER MUST SATISFY THE REQUIREMENTS AS PROVIDED IN Clause 3 of Article 7 OF THIS CIRCULAR. THE CHANGE OF TASK LEADER SHALL ONLY BE PERMITTED IN THE FOLLOWING CASES:
a) THE TASK LEADER ATTENDS LONG-TERM STUDY OR WORK ABROAD FOR MORE THAN 6 MONTHS CONTINUOUSLY;
b) THE TASK LEADER IS ILL OR SICK AND UNABLE TO MANAGE THE RESEARCH ACTIVITY OF THE TASK (WITH A WRITTEN REQUEST FROM THE TASK LEADER OR CONFIRMATION FROM THE HEALTH AUTHORITY);
c) THE TASK LEADER DIES; IS MISSING FOR MORE THAN 6 MONTHS;
d) THE TASK LEADER SUBMITS A WRITTEN REQUEST TO CHANGE THE TASK LEADER FOR PERSONAL REASONS THAT PREVENT THEM FROM CONTINUING THE TASK;

7. ADJUSTMENT AND SUPPLEMENTATION OF RESEARCH PARTICIPANTS:
THE HEAD OF THE ORGANIZATION IN CHARGE OF THE TASK SHALL INITIATE THE CHANGE OF RESEARCH PARTICIPANTS TO ENSURE THE EFFECTIVE IMPLEMENTATION OF THE APPROVED TASK OBJECTIVES AND PRODUCTS. 8. ADJUSTMENT OF THE OUTBOUND TEAM:
a) THE HEAD OF THE ORGANIZATION IN CHARGE OF THE TASK SHALL INITIATE THE ADJUSTMENT OF THE CONTENT, DATE, AND TIME OF THE OUTBOUND TEAM TO SUIT THE REALITY, ENSURING THE EFFECTIVE IMPLEMENTATION OF THE TASK OBJECTIVES AND PRODUCTS.
b) In the case of adjusting the incoming water, the number of people participating in the outgoing group must have a written opinion from the Ministry.
c) In all cases of adjusting the outgoing group, the total budget for the outgoing mission that has been approved may not be increased.
9. Adjustment of the budget estimate outside the state budget:

11. Procedure and formalities for adjusting scientific and technological tasks within the authority of the Minister as provided in Point a Clause 10 of this Article

2. Submission of the assessment and acceptance dossier
a) Organizations or individuals responsible for the task shall submit the dossier requesting assessment and acceptance within thirty days from the end of the contract or the extended contract period (if applicable);
b) The dossier may be submitted directly or through postal services or online to the Ministry (through the Department of Science, Technology, and Environment);

3. Date of receipt of the dossier
a) For cases where the dossier is submitted directly or through postal services: the date recorded in the postmark (for postal submissions) or the stamp received by the ministry, department, or locality (for direct submissions).
b) In the case of online submission of documents: the date of submission shall be determined based on the actual recorded time on the National Science and Technology Task Management System.
4. In the event that the Ministry of Agriculture and Rural Development does not receive a complete application for evaluation and acceptance within the time limit specified in Clause 1 of this Article, it shall carry out procedures to terminate the Contract in accordance with the Circular stipulating the inspection, evaluation, adjustment, and termination of contracts during the implementation of national-level science and technology tasks funded by the state budget.
26. Amend and supplement Article 19 as follows:
“Article 19. Advisory Board for Evaluation and Acceptance of Science and Technology Tasks
1. The Department of Science, Technology and Environment shall submit to the Ministry for decision on establishing the Board within ten working days from the date of receipt of a valid application.
2. The composition of the Board shall be as prescribed in Point a of Clause 1 of Article 10; the method and principles of operation of the Board shall be as prescribed in Clause 4 of Article 5 of this Circular.
3. The documents for evaluation and acceptance shall be defined in Clause 1 of Article 18b of this Circular. The Department of Science, Technology and Environment shall send the acceptance documents to the members of the Board at least five working days before the meeting.
4. The meeting of the Board shall be organized within thirty days from the date of the decision to establish the Board, and the Board shall only convene when the following requirements are met:
a) The Department of Science, Technology and Environment has received full written comments from all members of the Board at least one working day before the meeting.
b) The meeting must have at least two-thirds of the Board members present, including: the Chairman or Vice-Chairman authorized, two opposing members, and the scientific secretary member.
5. Participants in the meetings of the Board
Members of the Board, head of the task, representative of the main organization, representative of the Department of Science, Technology and Environment, representatives of related units, and other members invited by the Ministry if necessary.
6. Procedure for the Advisory Board's work

“Article 19a. Requirements for comprehensive reports and products; content and methods of evaluating science and technology tasks
1. Requirements for comprehensive reports
a) A general overview of research results related to the task;
b) Data and materials that are representative, reliable, authentic, and up-to-date;
c) The content of the report should comprehensively present all research results in a systematic and logical structure with scientific arguments grounded in theoretical and practical bases that address the research questions, truthfully reflecting the results of the science and technology task;
d) The structure and style of the report should be appropriate.
2. Requirements for products
In addition to the requirements stated in the contract and task description, products must meet the following requirements:
a) For products such as samples, materials, equipment, machinery, production lines, crop seeds, livestock and aquaculture breeds, and other measurable products, they must be tested or evaluated by specialized agencies in accordance with the regulations of the sectoral management authority;
b) For products such as application principles, methods, standards, norms, computer software, design drawings, technological processes, diagrams, maps, data, databases, analytical reports, forecasting documents (methods, processes, models), plans, master plans, economic-technical justifications, feasibility studies, and similar products, they must be reviewed by a specialized scientific board or a team of experts established by the main organization responsible for the task;
c) For products such as postgraduate training outcomes, useful solutions, inventions, publications, and similar products, they must be confirmed by the competent authority.
3. Content of evaluation
a) Comprehensive Report: Evaluate the completeness, clarity, authenticity, and logic of the comprehensive report (research methods, techniques used...) and necessary accompanying documents (design documents, technical documents, intermediate products, original data, cited documents).

“Article 20. Handling of evaluation and acceptance results at the Ministry level
1. For scientific and technological tasks evaluated and classified at the "Pass" level or higher
a) Within 15 days from the date of the Ministry-level evaluation result, the organization in charge of implementation and the head of the scientific and technological task shall complete the dossier according to the opinions and conclusions of the evaluation and acceptance council and send it to the Department of Science, Technology and Environment;
b) The Department of Science, Technology and Environment shall be responsible for supervising the completion of the evaluation dossier of the scientific and technological task after receiving confirmation from the Chairman of the Council on the completion of the dossier by the organization in charge of the task;
c) The task will be settled and the contract terminated after the products formed from the scientific and technological task and assets purchased using state budget funds have been inventoried and handed over in accordance with current regulations.
2. For scientific and technological tasks classified at the "Fail" level: The Department of Science, Technology and Environment shall take the lead and coordinate with relevant units to determine the amount of funds that must be refunded to the state budget in accordance with current regulations.

Within 30 days from the date of formal acceptance of the task, the organization in charge of the task shall carry out registration and retention of the dossier including: comprehensive report and summary report of the implementation results, scientific products of the topic, project, experimental production project, potential topic (paper version and electronic version) and related documents at:
a) National Science and Technology Information Center - Ministry of Science and Technology;
b) Digital Transformation and Agricultural Statistics Center - Ministry of Agriculture and Rural Development;
2. Recognition of results
a) Within five working days from the completion of the registration and retention of the results of the scientific and technological task implementation as stipulated in Clause 1 of this Article, the organization in charge of the task shall submit the recognition result application dossier to the Ministry (Department of Science, Technology and Environment);
b) The recognition result application dossier includes: final report of the topic, minutes of the evaluation and acceptance council meeting; copy of the certificate of registration of the results of the implementation of the scientific and technological task funded by the state budget issued by the National Science and Technology Information Center - Ministry of Science and Technology; copy of the receipt of the results of the implementation of the scientific and technological task funded by the state budget issued by the Digital Transformation and Agricultural Statistics Center - Ministry of Agriculture and Rural Development; report on the completion of the evaluation and acceptance dossier according to Model B32. BCHTHSNT-BNN promulgated together with this Circular;
c) Within ten days from the date of receipt of all documents specified in point b of this clause, the Department of Science, Technology and Environment shall submit to the Ministry for decision on recognition of results according to Model B33. CNKQ-BNN promulgated together with this Circular.”
30. Supplement Articles 21a, 21b, 21c, 21d, 21đ as follows:
“Article 21a. Collection of information on the application of results of scientific and technological tasks funded by the state budget
1. The following types of scientific and technological tasks must implement the collection of information on the application of the results of scientific and technological tasks:
a) Scientific and technological research topics;
b) Scientific and technological development projects;
c) Experimental production projects;
d) Scientific and technological projects.
2. Starting from the date of formal acceptance of the scientific and technological task funded by the state budget, every twelve months and during a continuous five-year period, the organization granted ownership and usage rights of the results of the scientific and technological task shall be responsible for reporting on the application of the results of the scientific and technological task in accordance with Clause 3 of this Article.
3. Content of information on the application of the results of the scientific and technological task according to Model B34. BCUDKQ-BNN promulgated together with this Circular.
4. The organization granted ownership and usage rights of the results of the scientific and technological task shall be responsible for the accuracy of the contents of the information on the application of the results of the scientific and technological task.

d) Objectives and main content of the task;

e) Expected results;

Before December 31 each year, the Department of Science, Technology, and Environment shall be responsible for submitting the consolidated report on ongoing scientific and technological tasks during the year according to Model 13 issued together with Circular No. 14/2014/TT-BKHCN to the Ministry of Science and Technology.
Article 21d. Public Disclosure of Information on the Results of Scientific and Technological Tasks Using State Budget
1. Before November 30 each year, the leading organizations shall be responsible for submitting the consolidated report on scientific and technological tasks that have been accepted and registered the results of implementation during the year according to Model B36. Before December 31 each year, the Department of Science, Technology, and Environment shall be responsible for submitting the consolidated report on scientific and technological tasks that have been accepted and registered the results of implementation during the year according to Model 14 issued together with Circular No. 14/2014/TT-BKHCN to the Ministry of Science and Technology.

“Article 22a. Management and Use of Assets Formed Through the Implementation of Scientific and Technological Tasks Using State Funds

“Article 23. Rights and Responsibilities of Ministries' Agencies and Units
1. The Department of Science, Technology, and Environment:

b) Coordinate with the Science, Technology, and Environment Department to build lists of orders, select, and directly assign scientific and technological tasks;
c) Coordinate to inspect, evaluate, and accept the results of implementing scientific and technological tasks;
d) Introduce, implement applications, and transfer research results according to their assigned functions and tasks.";
35. Amend and supplement Article 24 as follows:
"Article 24. Rights and responsibilities of the main organization
1. Be responsible for implementing and managing scientific and technological tasks effectively. In case the task is evaluated as "unsatisfactory," it must determine and unify the amount of funds to be recovered from all parties involved to fulfill the obligation to refund the state budget.
2. Directly implement scientific and technological activities to achieve the set goals and products within the specified time frame.
3. Organize inspections, self-evaluations, and be accountable before the Minister and the law for the results of implementing scientific and technological tasks.
4. Be accountable before the law and the Minister for the ordered products of the Ministry; the legality and appropriateness of the results and the use of funds for assigned scientific and technological activities.
5. Enjoy rights regarding copyright for scientific works managed by itself in accordance with the law and use funds for managing scientific and technological tasks as prescribed.
6. Report periodically or at any time (when required) on the results of implementing scientific and technological tasks as prescribed.
7. Report financial statements according to current regulations and be responsible for providing complete documentation for inspection, audit when requested.
8. Report on the use of assets formed through the implementation of scientific and technological tasks using state capital after being granted ownership or usage rights.
9. Cooperate with the task leader and related parties to transfer the results of the task after it has been evaluated and accepted according to current regulations.
10. Register and retain the results of the task in accordance with Article 24 of this Circular.
11. Report on the application of the results of the task if granted ownership or usage rights over research and development results.
12. Annually, the main organization of scientific and technological tasks shall organize meetings to disseminate or publish on mass media the research and transfer results of the year.
13. Transfer research results in accordance with Decree No. 70/2018/ND-CP and the Law on Technology Transfer; fully disclose information and report on the application of results as prescribed in Circular No. 14/2014/TT-BKHCN;
14. Consider the participation in evaluation and selection of organizations and individuals who have not submitted or registered retention of results and reported application as prescribed in Clause 1, Article 27 of Circular No. 14/2014/TT-BKHCN and report to the Ministry of Agriculture and Rural Development for handling according to regulations.";
36. Amend and supplement Article 25 as follows:
"Article 25. Rights and responsibilities of the individual task leader
1. Implement the contents of scientific and technological tasks according to the approved Task Description and signed contract, use funds in accordance with the law.
2. Report fully, accurately, and on time about the content, progress, products created, and the situation of fund use for scientific and technological tasks.
3. Report financial statements according to current regulations and be responsible for providing complete documentation for inspection, audit when requested.
4. Enjoy rights regarding copyright for scientific works created by themselves and stipulated allowances according to the law."
Article 2. Repeal and replace certain provisions and annexes of Circular No. 18/2015/TT-BNNPTNT dated April 24, 2015, issued by the Minister of Agriculture and Rural Development on the management of scientific and technological tasks of the Ministry of Agriculture and Rural Development (amended and supplemented by Circular No. 23/2021/TT-BNNPTNT).
1. Repeal Articles 2b, 2c, 2d, 2đ, 2e, 2g, 2h, 2i, 2k, 4a, 14a, 19b, 22c, 22d, 22đ, and Article 23a.
2. Repeal the phrase "MANAGEMENT AND ORGANIZATION OF IMPLEMENTATION OF TASKS UNDER THE PROGRAM ON CONSERVATION AND SUSTAINABLE USE OF GENETIC RESOURCES" in the name of Section 4 Chapter II.
3. Replace the Annex LIST OF FORMS with the Annex LIST OF FORMS promulgated together with this Circular.
Article 3. Implementation Provisions
1. This Circular takes effect from August 15, 2024.
2. Transitional Provisions
a) The submission of application files for approval at the ministry level for scientific and technological tasks approved before the date this Circular takes effect: Continue to be implemented according to the provision at point a clause 2 Article 18b of Circular No. 18/2015/TT-BNNPTNT (amended and supplemented at clause 23 Article 1 of Circular No. 23/2021/TT-BNNPTNT);
b) The criterion for ranking as "Not Achieved" in cases where the application file is submitted late more than six months from the end date of the contract or the extended date (if applicable) for scientific and technological tasks ending within one year from the date this Circular takes effect: Continue to be applied according to the provision at point c clause 1 Article 19b of Circular No. 18/2015/TT-BNNPTNT (amended and supplemented at clause 23 Article 1 of Circular No. 23/2021/TT-BNNPTNT);
c) Reporting, inspection, adjustment, evaluation, and acceptance of results for scientific and technological tasks approved before the date this Circular takes effect (except for the cases stipulated at points a and b of this clause): To be implemented according to the provisions of this Circular from the date it takes effect.
3. During implementation, if there are any difficulties, please reflect them to the Ministry of Agriculture and Rural Development (through the Department of Science, Technology, and Environment) for study, amendment, and supplementation to ensure appropriateness.
